<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 4343</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260417" legis-day="20260414">April 17 (legislative day, April 14), 2026</action-date><action-desc><sponsor name-id="S399">Mr. Hawley</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 5, United States Code, to provide that a Member of Congress convicted of certain felony offenses relating to sexual abuse shall not be eligible for retirement benefits based on that individual’s Member service, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H5A164A1AE8984AE68DB813F72ABB1E2F"><section section-type="section-one" id="H48D13A93831F442C843057E0BA670182"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Pensions for Congressional Predators Act</short-title></quote>.</text></section><section id="HAAAFD83C862C43B08CC8DAA74A6C1219"><enum>2.</enum><header>Forfeiture of CSRS or FERS annuity based on service as a Member of Congress after conviction of felony sexual abuse</header><subsection id="H2D394F936CA645E2AEF3830CB9E4DC04"><enum>(a)</enum><header>Civil Service Retirement System</header><text display-inline="yes-display-inline">Section 8332(o)(2) of title 5, United States Code, is amended—</text><paragraph id="H430E15E547184079A879A45CFADCA94B"><enum>(1)</enum><text>in subparagraph (A)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id72f3a86cb96344b59eb12a9d3d117f52"><enum>(A)</enum><text display-inline="yes-display-inline">in clause (ii), by striking the period at the end and inserting <quote>, except that such requirement shall not apply with respect to an offense described in clause (xxxii), (xxxiii), (xxxiv), or (xxxv) of subparagraph (B).</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1c1dcb9cdeef4a6782be0251bcd6e718"><enum>(B)</enum><text display-inline="yes-display-inline">in clause (iii)—</text><clause id="HA2A60C222B6A42F1B0E511085823372B"><enum>(i)</enum><text>in subclause (I)(bb), by striking <quote>; or</quote> and inserting a semicolon;</text></clause><clause id="H0E2215936459403D9454AFBAAEB301E9"><enum>(ii)</enum><text>in subclause (II)(bb), by striking the period at the end and inserting <quote>; or</quote>; and</text></clause><clause id="H9DE8CAB07CDA4332B03F8E83DD36DC3A"><enum>(iii)</enum><text>by adding at the end the following:</text> <quoted-block style="USC" display-inline="no-display-inline" id="H4CC8EBEDC9794C5C8D7B96420BB25296"> <clause commented="no" id="HB2745917D5324ED5B3FF6EE4BCFB92D8" indent="up1"> <enum>(III)</enum> <text display-inline="yes-display-inline">is committed after the date of enactment of the <short-title>No Pensions for Congressional Predators Act</short-title> and is described in clause (xxxii), (xxxiii), (xxxiv), or (xxxv) of subparagraph (B).</text>

 </quoted-block></clause></subparagraph></paragraph><paragraph id="H074E8AF0C8334E7AB4684E5378E6CED8"><enum>(2)</enum><text>in subparagraph (B), by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H5D8BD9480B6D46F98ED3A549674FDAEB"><subparagraph id="H06FE9568C5AB487C955A2C96133C2CD9" indent="up1"><enum>(xxxii)</enum><text display-inline="yes-display-inline">If the individual is or was a member of the Senate or the House of Representatives, a Delegate to the House of Representatives, or the Resident Commissioner from Puerto Rico, an offense under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/109A">chapter 109A</external-xref> of title 18 (relating to sexual abuse) or any similar offense under State or Tribal law, including rape.</text></subparagraph><subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="idf9f5d76c921949b086f8b45ff311f952"><enum>(xxxiii)</enum><text display-inline="yes-display-inline">If the individual is or was a member of the Senate or the House of Representatives, a Delegate to the House of Representatives, or the Resident Commissioner from Puerto Rico, an offense under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/110">chapter 110</external-xref> of title 18 (relating to sexual exploitation and other abuse of children) or any similar offense under State or Tribal law.</text></subparagraph><subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="id7cc58dd9b4204daa9588070029db7bbc"><enum>(xxxiv)</enum><text display-inline="yes-display-inline">If the individual is or was a member of the Senate or the House of Representatives, a Delegate to the House of Representatives, or the Resident Commissioner from Puerto Rico, an offense under section 1466A of title 18 (relating to obscene visual representations of the sexual abuse of children) or any similar offense under State or Tribal law.</text></subparagraph><subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="id403568d2a626466fb784b7fc365a19a1"><enum>(xxxv)</enum><text display-inline="yes-display-inline">If the individual is or was a member of the Senate or the House of Representatives, a Delegate to the House of Representatives, or the Resident Commissioner from Puerto Rico, an offense under chapter 117 or section 1590 or 1591 of title 18 (relating to trafficking of children and other persons) or any similar offense under State or Tribal law.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="H43B9FA904D4D49BFB0489668B1318696"><enum>(b)</enum><header>Federal Employees' Retirement System</header><text display-inline="yes-display-inline">Section 8411(l)(2)(C) of title 5, United States Code, is amended by striking the period at the end and inserting the following: <quote>, or, in the case of an offense described in any of clauses (xxxii) through (xxxv) of section 8332(o)(2)(B), after the date of enactment of the <short-title>No Pensions for Congressional Predators Act</short-title>.</quote>.</text></subsection><subsection id="HE4EFE28DF50F4A9C849320488191780F"><enum>(c)</enum><header>Application</header><text display-inline="yes-display-inline">For purposes of applying section 8332(o) or 8411(l) of title 5, United States Code, the amendments made by this section shall apply to any act or omission occurring after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
