<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 4337</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260416" legis-day="20260414">April 16 (legislative day, April 14), 2026</action-date><action-desc><sponsor name-id="S369">Mr. Markey</sponsor> (for himself, <cosponsor name-id="S422">Mr. Welch</cosponsor>, <cosponsor name-id="S390">Mr. Van Hollen</cosponsor>, <cosponsor name-id="S322">Mr. Merkley</cosponsor>, and <cosponsor name-id="S430">Ms. Blunt Rochester</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit the use of certain emergency authority to keep a fossil fuel-powered electric generating facility or fossil fuel power plant online, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Big Fossil Bailouts on Your Power Bill Act</short-title></quote>.</text></section><section id="id4c493d2221b54bfabb06e84a03a5ea23"><enum>2.</enum><header>Limitations on certain emergency authority under the Federal Power Act</header><text display-inline="no-display-inline">Section 202(c) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824a">16 U.S.C. 824a(c)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id49d19309a59c442abfa1309df08550a1"><enum>(1)</enum><text>in paragraph (1), in the first sentence—</text><subparagraph commented="no" display-inline="no-display-inline" id="id3dd01533266b40c485e3e54c5792814c"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>or other causes,</quote>; and</text></subparagraph><subparagraph id="id97f233cc58714329b0fcc9a03f526248" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>by striking <quote>with or without notice, hearing, or report,</quote>;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idba7ee926bed24a96a90af913c516b2c2"><enum>(2)</enum><text>in paragraph (2), by adding at the end the following: <quote>Before issuing such an order, the Commission, to the maximum extent practicable, shall consider alternatives to meet the emergency, including alternatives that both meet the emergency and minimize adverse environmental impacts.</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4cb6e272416b4859a49b52d853f69fea"><enum>(3)</enum><text>in paragraph (4)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idbf569d92d9374564877ea081b2a3faae"><enum>(A)</enum><text>in subparagraph (A), in the first sentence, by striking <quote>that may result in a conflict with a requirement of any Federal, State, or local environmental law or regulation</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id219ca77872974883b7fb2fe23251b4c3"><enum>(B)</enum><text>in subparagraph (B), in the first sentence—</text><clause commented="no" display-inline="no-display-inline" id="id77e4b804f88c4e6b9c33788b18260757"> <enum>(i)</enum> <text>by inserting <quote>advance of</quote> before <quote>renewing or reissuing</quote>;</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id5b6cc9715c3345e49c487d333d412bb7"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking <quote>shall consult with the</quote> and inserting the following: “shall—</text><quoted-block style="OLC" display-inline="no-display-inline" id="idedc7abe19de6497eb08cc0e5d9802623"><clause commented="no" display-inline="no-display-inline" id="idc78761d4c9a44375b97f75362d3ff1ca" indent="up2"><enum>(i)</enum><text display-inline="yes-display-inline">hold a hearing open to the public on the proposed order;</text></clause><clause indent="up2" commented="no" display-inline="no-display-inline" id="id3fa40ebb532147838343ae123196548b"><enum>(ii)</enum><text>determine—</text><subclause commented="no" display-inline="no-display-inline" id="id3909a74053204a05beba88113d3242fe"><enum>(I)</enum><text display-inline="yes-display-inline">whether and the extent to which the order will raise rates for ratepayers; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id33339c98e23548a5a8ae99e11e0e95ca"><enum>(II)</enum><text display-inline="yes-display-inline">whether the order may result in a conflict with a requirement of any Federal, State, or local environmental law or regulation; and</text></subclause></clause><clause indent="up2" commented="no" display-inline="no-display-inline" id="ida4431d6b853544328b7e4f9d1c3de489"><enum>(iii)</enum><text>to accomplish the duties and comply with the requirements described in paragraph (2) and clause (ii), consult with—</text><subclause commented="no" display-inline="no-display-inline" id="idc07ba0ecd228497c9757bc2d531f690f"><enum>(I)</enum><text display-inline="yes-display-inline">the relevant State and local agencies or regulators, including the relevant State commission (collectively referred to in this paragraph as the <quote>relevant non-Federal agencies</quote>), in—</text><item commented="no" display-inline="no-display-inline" id="idf605a825084c47c1b304482e40ac0d44"><enum>(aa)</enum><text display-inline="yes-display-inline">each State and locality in which the applicable facility is physically located; and</text></item><item commented="no" display-inline="no-display-inline" id="id128ad627f2e34604a82632422b876041"><enum>(bb)</enum><text>each State and locality in which the order may result in a conflict described in clause (ii)(II); and</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="id8c52c5c67abf42c4b6d310f7012540ba"> <enum>(II)</enum> <text display-inline="yes-display-inline">the</text>
 </subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause commented="no" display-inline="no-display-inline" id="id9bc4660793c14edab926a22c2e258e11"><enum>(iii)</enum><text display-inline="yes-display-inline">in clause (iii)(II) (as so designated), in the first sentence, by striking <quote>such law or regulation, and shall</quote> and inserting the following: “each environmental law or regulation with respect to which the order may result in a conflict described in clause (ii)(II).</text><quoted-block style="OLC" display-inline="no-display-inline" id="idbcc3756d2319428d9bddfd54e5e2a575"><subparagraph commented="no" display-inline="no-display-inline" id="idcf5f04bf576742539d01404c32456e4e" indent="up2"><enum>(C)</enum><text display-inline="yes-display-inline">The Commission shall</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id06de96fe8482476eadf7df6b1be15e64"><enum>(C)</enum><text>in subparagraph (C) (as so designated)—</text><clause commented="no" display-inline="no-display-inline" id="id4d30e81a82bc492888c44c0d3b20ad2e"><enum>(i)</enum><text display-inline="yes-display-inline">in the first sentence—</text><subclause commented="no" display-inline="no-display-inline" id="idd3b3fcaddc01479488e0a489e433570b"><enum>(I)</enum><text display-inline="yes-display-inline">by striking <quote>such Federal agency determines</quote> and inserting <quote>1 or more Federal or relevant non-Federal agencies consulted under subparagraph (B)(iii) determine</quote>; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idaaae884e6c034ccc834cb5d08711683b"><enum>(II)</enum><text>by inserting <quote>rate or</quote> after <quote>adverse</quote>; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idd161b5ef5de6408e8a47946ec1e6b434"><enum>(ii)</enum><text>in the second sentence—</text><subclause commented="no" display-inline="no-display-inline" id="id3daccfead42b440e8c63b43528beb924"><enum>(I)</enum><text display-inline="yes-display-inline">by striking <quote>The conditions</quote> and inserting <quote>The cost estimates and conditions</quote>; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id1f63fdb8c22b4e48acc434fda18a4b66"><enum>(II)</enum><text>by striking <quote>such Federal agency</quote> and inserting <quote>any 1 or more Federal or relevant non-Federal agencies</quote>; and</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idda5073d2b35c495f91f0a94b105a73e6"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf1532c287c134b0d87c3748f36c9fd1d"><subparagraph indent="up2" commented="no" display-inline="no-display-inline" id="idb6a14e7841bf4f9194eba6620ebddfb4"><enum>(D)</enum><text>An order issued under this subsection shall be considered to be a renewed or reissued order subject to the requirements of this paragraph and all other requirements relating to a renewed or reissued order if the order relates to the same facility and a substantially similar emergency as a previous order issued under this subsection.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4ce8aca4e9154bd9b31a2597843a953a"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id00f50478aa054f14816cb928fb57f640"><paragraph commented="no" display-inline="no-display-inline" id="id808a9d2892ae4807b56894f1463fb905" indent="up1"><enum>(6)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idc3796dc4c4c64cc2bc4f9969a22093a4"><enum>(A)</enum><text display-inline="yes-display-inline">Except as provided in subparagraph (B), the Commission may not issue an order under this subsection that would—</text><clause commented="no" display-inline="no-display-inline" indent="up1" id="id7659599143ac4e8787f0ce9c3d29a316"><enum>(i)</enum><text display-inline="yes-display-inline">prevent or delay the retirement or other permanent closure of a facility for the generation of electric energy; or</text></clause><clause commented="no" display-inline="no-display-inline" indent="up1" id="id8ef266b1ca4a4046b4be1db4364decff"><enum>(ii)</enum><text display-inline="yes-display-inline">require the generation of electric energy at a facility that has retired or otherwise permanently closed.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="id8ab7fb9b843e4611bce95921351e72c5"><enum>(B)</enum><text display-inline="yes-display-inline">Subparagraph (A) shall not apply to a particular facility if—</text><clause commented="no" display-inline="no-display-inline" id="id022aaf8a4e46424fbe44930472e474bc"><enum>(i)</enum><text display-inline="yes-display-inline">an emergency exists that cannot be met in any manner other than delay of the retirement or other permanent closure of the facility; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id1a4fe26a16f64b11bfda39bb99068d55"><enum>(ii)</enum><text display-inline="yes-display-inline">the applicable Transmission Organization requests in writing to delay the retirement or other permanent closure of the facility.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" indent="up1" id="idc90e01d56c7944f494f23d3bebe4728f"><enum>(7)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idc1500565361d4bf29b15aeb6f13fbd6b"><enum>(A)</enum><text>Before issuing an order under paragraph (1), the Commission shall—</text><clause commented="no" display-inline="no-display-inline" indent="up1" id="id45c15b9762c54e0eb64a8197e0a96ea1"><enum>(i)</enum><text display-inline="yes-display-inline">create a public online docket for matters pertaining to the order; and</text></clause><clause commented="no" display-inline="no-display-inline" indent="up1" id="id9af27860977a49349b9d743ff64b75f2"><enum>(ii)</enum><text display-inline="yes-display-inline">publish on a publicly available website—</text><subclause commented="no" display-inline="no-display-inline" id="id9f54f2c290074bf18a87454834825974"><enum>(I)</enum><text display-inline="yes-display-inline">notice of the proposed order, including a link to the docket created under clause (i); and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idb8b655253bba4ab080af1eb29f0e6286"><enum>(II)</enum><text display-inline="yes-display-inline">any request submitted pursuant to paragraph (6)(B)(ii).</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="id668a1ca2e20e4e5692b8695e8001087e"><enum>(B)</enum><text display-inline="yes-display-inline">An order issued under paragraph (1) (including any renewed or reissued order under paragraph (4)) shall be—</text><clause commented="no" display-inline="no-display-inline" id="ida29f5d80fe354cee878eeaa323e247cb"><enum>(i)</enum><text display-inline="yes-display-inline">published on the publicly available docket created under subparagraph (A)(ii); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id636e0a98b26b4c78a0a7f47dd73370d1"><enum>(ii)</enum><text display-inline="yes-display-inline">accompanied by a report that includes—</text><subclause commented="no" display-inline="no-display-inline" id="id6e523b8a77b04c3c88c9f62225437524"><enum>(I)</enum><text display-inline="yes-display-inline">an analysis of the causes of the emergency;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idc66d7dbfd436469ca45b5b9a75d28036"><enum>(II)</enum><text display-inline="yes-display-inline">an analysis of the alternatives considered to meet the emergency, including alternatives that both meet the emergency and minimize adverse environmental impacts; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id96048ab57736470782d4fc0320fb44c4"><enum>(III)</enum><text display-inline="yes-display-inline">estimates of the additional electrical system costs that are expected to be incurred by any electric utility and any customers of an electric utility as a result of the order, including the costs of additional fuel, maintenance, capital, or labor.</text></subclause></clause></subparagraph><subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="ida5e4778907ad4468ad68ab3b01815b02"><enum>(C)</enum><text>The Commission shall comply with subclauses (II) and (III) of subparagraph (B)(ii) to the maximum extent practicable, in light of the circumstances, in the case of an initial order issued under paragraph (1) to address a particular emergency, but shall fully comply with those subclauses with respect to any renewed or reissued order issued to address that emergency.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="ide6023dc17e5049f3b0a83d6f9ece5e3f"><enum>(D)</enum><text display-inline="yes-display-inline">Not later than 60 days after the date on which an order is issued under paragraph (1), each electric utility that is, or expects to be, impacted by the order (including each electric utility identified by the Commission under subparagraph (B)(ii)(III)) shall provide to customers of the electric utility written notice that includes—</text><clause commented="no" display-inline="no-display-inline" id="idbca4010d1298454395b870f761dc85a1"><enum>(i)</enum><text display-inline="yes-display-inline">an identification of the order, including a link to, or instructions for accessing, the order as published under subparagraph (B)(i);</text></clause><clause commented="no" display-inline="no-display-inline" id="id62986325c8364050b07cdbcd06cad1ca"><enum>(ii)</enum><text display-inline="yes-display-inline">a description of the impacts and expected impacts of the order, including any costs of additional fuel, maintenance, capital, or labor that have occurred or are expected to occur as a result of the order; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id7d8ab02a0e5e45b4bd88787dbe5eba9c"><enum>(iii)</enum><text display-inline="yes-display-inline">any other information relevant to the electric utility or customers of the electric utility.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
