<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 4326</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260416" legis-day="20260414">April 16 (legislative day, April 14), 2026</action-date><action-desc><sponsor name-id="S409">Mr. Luján</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To improve the hiring and training processes at U.S. Immigration and Customs Enforcement and U.S. Customs and Border Protection.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as <quote><short-title>The FBI Hiring Review Act</short-title></quote>.</text></section><section id="iddde7f810427d445c8b370fd327b39d8c"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="id723ec698ae2c45c89b848b8dd76f4af7"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida309debd07f04c3c8df63d7e936e5ff3"><enum>(A)</enum><text>the <committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id69e0c87ffb17452a936255b2f802317f"><enum>(B)</enum><text>the <committee-name committee-id="SSAP00">Committee on Appropriations of the Senate</committee-name>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd0204d269c2141e9be411e32ee5cd4ed"> <enum>(C)</enum> <text>the <committee-name committee-id="HJU00">Committee on the Judiciary of the House of Representatives</committee-name>; and</text>
                </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6a1bc65e9d5a4950bfc0838552b0b5e7">
                    <enum>(D)</enum>
 <text>the <committee-name committee-id="HAP00">Committee on Appropriations of the House of Representatives</committee-name>.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id931782b7315c4cbb9c0ac9d2212c2f96"><enum>(2)</enum><header display-inline="yes-display-inline">FBI</header><text>The term <term>FBI</term> means the Federal Bureau of Investigation.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id309c8c6df9f74f66ac34f1903ba43f06"><enum>(3)</enum><header>Deputy Assistant Attorney General</header><text display-inline="yes-display-inline">The term <term>Deputy Assistant Attorney General</term> means the Deputy Assistant Attorney General for Management and Compliance at the Department of Justice.</text></paragraph></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id5692d788486347cb9a9795b9b278a23e"><enum>3.</enum><header display-inline="yes-display-inline">Hiring audit at the FBI</header><text display-inline="no-display-inline">The Deputy Assistant Attorney General, in coordination with the Office of Personnel Management, shall conduct an audit of the hiring records for any employees hired by the FBI after the date of enactment of <external-xref legal-doc="public-law" parsable-cite="pl/119/21">Public Law 119–21</external-xref> to certify all hiring requirements with respect to such employees, including background checks, were complete and remained consistent with applicable Office of Personnel Management hiring standards.</text></section><section id="id52db86043e614f83ab846a93f3e766c1"><enum>4.</enum><header>Requirement to check State and local systems</header><text display-inline="no-display-inline">The Deputy Assistant Attorney General shall cross-reference all new employees hired for positions at the FBI since January 20, 2025 with State-level misconduct files, including police records and employment records of law enforcement agencies, to determine whether information contained in such files was taken into consideration during the evaluation of such new employees prior to being hired.</text></section><section id="id1ff41974fb0d4a8db761ec67fa04140c"><enum>5.</enum><header>Federal Law Enforcement Training Centers certification of training</header><subsection commented="no" display-inline="no-display-inline" id="ideccdf02803c94e2a8c360f9afb3c8041"><enum>(a)</enum><header display-inline="yes-display-inline">Certifications</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Director of the Federal Law Enforcement Training Centers shall certify that every agent or officer of the FBI has successfully completed the required training for their respective positions within the FBI.</text></subsection><subsection id="ida70fcc48be164eb3a34ee700f156686b"><enum>(b)</enum><header>Length of training</header><text>The certifications required under subsection (a) should indicate the length of training that each officer and agent completed for their respective positions.</text></subsection></section><section id="id268d354376424419a9109df46997137f"><enum>6.</enum><header>Government Accountability Office study and report</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Comptroller General of the United States shall submit to the appropriate congressional committees a report that includes—</text><paragraph commented="no" display-inline="no-display-inline" id="id0b2c58cb2c2f407a9b60681f98f8f6d2"><enum>(1)</enum><text display-inline="yes-display-inline">the findings from the audit conducted pursuant to section 3;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfef62fcd8664422fac9eb7c0a093feb0"><enum>(2)</enum><text display-inline="yes-display-inline">a description of the Deputy Assistant Attorney General's determination of the use of State-level misconduct files during the evaluation of potential new FBI employees; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd53dfab50b044b7e9a9c26e6721f2193"><enum>(3)</enum><text display-inline="yes-display-inline">an audit of pass and fail rates for training at the Federal Law Enforcement Training Centers for FBI agents and officers.</text></paragraph></section></legis-body></bill>
