      byproduct 6PPD-Q on coho salmon and the environment and to promote research and funding
 opportunities for an alternative to 6PPD, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>6PPD Task Force Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idca79b701ca104fc88a40b420203f7233"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="id7FF13906D1004D87B5B4EE58B9163F5D"><enum>(1)</enum><header>6PPD</header><text>The term <term>6PPD</term> means the chemical compound N-(1,3-dimethylbutyl)-N′- 11 phenyl-p-phenylenediamine.</text></paragraph><paragraph id="id56ca1cdaff5d4fbab4e2c6b09589191b" commented="no" display-inline="no-display-inline"> <enum>(2)</enum> <header>6PPD-<enum-in-header>Q</enum-in-header></header> <text>The term <term>6PPD-Q</term> means 6PPD-quinone.</text>
 </paragraph><paragraph id="idf6a1b07edd864cceabfcfb2540165dd5"><enum>(3)</enum><header>Task Force</header><text>The term <term>Task Force</term> means the 6PPD Task Force established pursuant to section 4(a).</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="id64c60797414847149fe31050e7aba805"><enum>3.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="id5afa5ab521fd4b5e9e61debe58e28a77"><enum>(1)</enum><text>6PPD is a chemical commonly used in all motor vehicle tires, military vehicle tires, and aircraft tires, contributing to passenger safety by preventing tires from degrading quickly and ensuring tire durability;</text></paragraph><paragraph id="idc688e8d780364a5aad9f4337438b04f0"> <enum>(2)</enum> <text>as 6PPD in tires reacts with oxygen or ozone in the environment, 6PPD breaks down and transforms into compounds, including 6PPD-Q;</text>
      </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id65e4c226dcf54cc5a99759d62d20029f">
        <enum>(3)</enum>
 <text display-inline="yes-display-inline">stormwater runoff may cause tire and road wear particles containing 6PPD-Q to wash into streams, rivers, and other bodies of water that are habitats for aquatic species, such as Pacific salmon;</text>
      </paragraph><paragraph id="iddf8f15cd26164c7f8f41bbf7f7cdc96a">
        <enum>(4)</enum>
 <text>6PPD-Q from stormwater runoff is acutely toxic to adult and juvenile coho salmon (Oncorhynchus kisutch);</text>
 </paragraph><paragraph id="id98f18552b4724ed8b4f981958b9ca1c3"><enum>(5)</enum><text>private-sector efforts exist in the United States to develop, while also prioritizing motor vehicle passenger safety and environmental impacts, potential alternatives to 6PPD that will not—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida0cf43e19d584a7daa82227015ef1b0d"> <enum>(A)</enum> <text display-inline="yes-display-inline">transform into 6PPD-Q and enter into waterways, where 6PPD-Q may lead to coho salmon mortality; or</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id137b6529c2144e1b8e1a976300d543b3"><enum>(B)</enum><text display-inline="yes-display-inline">harm other wildlife species or people;</text></subparagraph></paragraph><paragraph id="id9e188022399d49f1ae863c398e80e99c"><enum>(6)</enum><text>finding a 6PPD alternative has national security, domestic supply chain, and environmental and human health implications and must be addressed in a timely manner; and</text></paragraph><paragraph id="iddc314029e7154144bfbb50e8be39c82f"><enum>(7)</enum><text>efforts to replace 6PPD must ensure continued compliance with vehicle safety and performance standards critical to passenger and public safety.</text></paragraph></section><section id="idec814f2bef9a4fdf8e7f8879a0f89148"><enum>4.</enum><header>Establishment of 6PPD task force</header><subsection id="id73850c1b076b473f99f2df9c45562fc0"><enum>(a)</enum><header>Establishment</header><text>Not later than 60 days after the date of the enactment of this Act, the Secretary of Transportation, in consultation with the Administrator of the Environmental Protection Agency, shall, to the extent practicable, enter into an agreement with the National Academy of Sciences pursuant to which the National Academy of Sciences shall establish a task force, to be known as the <quote>6PPD Task Force</quote>.</text></subsection><subsection id="ida5a455c6b8d84befabb1e1c7cb21a96a"><enum>(b)</enum><header>Duties</header><text>The Task Force shall—</text><paragraph id="id151fac31083341048ab9acc4e865e54f"><enum>(1)</enum><text>improve data and information sharing for research into an alternative to 6PPD among Federal agencies, research institutions, and State, Tribal, and local governments for the purposes of—</text><subparagraph id="idc392018a7b044b9b8219abeb4b91a013"><enum>(A)</enum><text>identifying the potential impacts of 6PPD on coho salmon, other aquatic species, human health, and the environment; and</text></subparagraph><subparagraph id="id2bdd6a91dd0c43888d4e99f42cd8df45"><enum>(B)</enum><text>mitigating the adverse effects of 6PPD on water quality, human health, and the environment;</text></subparagraph></paragraph><paragraph id="id19f883eba32d467a84ed0194fb07806d"><enum>(2)</enum><text>identify and recommend Federal funding opportunities to researchers, institutions of higher education, State, Tribal, and local governments, tire manufacturers, chemical suppliers, tire additive manufacturers, and other entities—</text><subparagraph id="ida19383f43f9d4fe89251dc1def7b576e"> <enum>(A)</enum> <text>to study the potential impacts of 6PPD, related compounds, and their degradation products, including 6PPD-Q, on Pacific salmon, other economically or ecologically valuable aquatic species, and human health; and</text>
 </subparagraph><subparagraph id="id99082b60c8da461b9e237f70314368ce"><enum>(B)</enum><text>to develop an alternative chemical to 6PPD, including scientific validation and scale-up activities to commercialize 6PPD alternatives;</text></subparagraph></paragraph><paragraph id="id8023eb60da4e4859891e4973956b29fe"><enum>(3)</enum><text>identify and include in the annual report required under subsection (g)—</text><subparagraph id="idc5d567a745af4a79b273aef03dee83a6"><enum>(A)</enum><text>recommendations for expediting the identification, toxicity, and performance testing of safer alternatives to 6PPD; and</text></subparagraph><subparagraph id="id594e638bbf764e339d3fb57feb137f83"><enum>(B)</enum><text>opportunities to encourage the adoption of safer alternatives to 6PPD in tires available on the market;</text></subparagraph></paragraph><paragraph id="idd8079051a0de4afcb0c773d1fe1418d9"><enum>(4)</enum><text>share with Federal agencies, research institutions, and State, Tribal, and local governments best practices, techniques, methodologies, and cost estimates for 6PPD mitigation efforts, including street sweeping and stormwater runoff treatment;</text></paragraph><paragraph id="ida82a0c469622464bbce6999eeee63ba0"><enum>(5)</enum><text>identify and provide research to Federal agencies, research institutions, and State, Tribal, and local governments regarding pathways not related to motor vehicle tires through which 6PPD exposure occurs, including exposure to 6PPD through—</text><subparagraph id="ide9593edd8e874508946c6e7972c7e3aa"><enum>(A)</enum><text>reuse of tires, including for artificial turf;</text></subparagraph><subparagraph id="id1d5ba43808bc4dc18175f38ad4bca1cf"><enum>(B)</enum><text>playground materials;</text></subparagraph><subparagraph id="id43128e4618cb419da39b1681c46f4e38"><enum>(C)</enum><text>artificial reefs;</text></subparagraph><subparagraph id="id9b9459b834c44baa9e2ebe3fdb3f34d9"><enum>(D)</enum><text>underwater tire piles; and</text></subparagraph><subparagraph id="idb75bb010c4df423b90cccd80c7aeb94f"><enum>(E)</enum><text>other rubber materials; and</text></subparagraph></paragraph><paragraph id="id1936118894354ed08d15f0dc227587fe"><enum>(6)</enum><text>share funding information, technical assistance, yearly reports, and resources in an online repository accessible to—</text><subparagraph id="id91ca033e3abb45a1bbcac181661bfbbe"><enum>(A)</enum><text>Indian Tribes;</text></subparagraph><subparagraph id="id9abee6f9db0e44f290c073aebd7ed90e"><enum>(B)</enum><text>State departments of transportation;</text></subparagraph><subparagraph id="id45940fe06603495097552037951ceef5"><enum>(C)</enum><text>metropolitan planning organizations;</text></subparagraph><subparagraph id="idd4c57178fa794dd39d8e6ef01270ea3d"><enum>(D)</enum><text>State and local governments;</text></subparagraph><subparagraph id="id6f8381f2daac42f0b43b5d2cc3334482"><enum>(E)</enum><text>tire manufacturers;</text></subparagraph><subparagraph id="idb017d4c25ff0470288605c4f19298f7b"><enum>(F)</enum><text>chemical suppliers;</text></subparagraph><subparagraph id="idd8794629dbac427c816d9e5477c61609"><enum>(G)</enum><text>tire additive manufacturers;</text></subparagraph><subparagraph id="id2ed782f3c49c4080967aef6cc13c2699"><enum>(H)</enum><text>institutions of higher education; and</text></subparagraph><subparagraph id="idd544de189e7a4b3c9281ed359086ffcf"><enum>(I)</enum><text>the public.</text></subparagraph></paragraph></subsection><subsection id="id32ee3fbecbb14cb58ddf8e11fba2d7da"><enum>(c)</enum><header>Membership</header><text>The Task Force shall be composed of the following members:</text><paragraph id="idc01a82df53424a21a31ba40120e14e74"><enum>(1)</enum><text>A designee of the Secretary of Transportation.</text></paragraph><paragraph id="id85078f117e1f4b988eec0916e54788b3"><enum>(2)</enum><text>A designee of the Administrator of the Environmental Protection Agency.</text></paragraph><paragraph id="idd8aaa419b87840549174379dec64cf6f"><enum>(3)</enum><text>A designee of the Secretary of Agriculture.</text></paragraph><paragraph id="idb6388ea0e81345c68a65b8decbbe2abe"><enum>(4)</enum><text>A designee of the Director of the United States Geological Survey.</text></paragraph><paragraph id="idbe6f12c462994873ad49f40feaa16ecc"><enum>(5)</enum><text>A designee of the Director of the United States Fish and Wildlife Service.</text></paragraph><paragraph id="iddafeb0e0315c423691e8c38fbbc2e4d7"><enum>(6)</enum><text>A designee of the Administrator of the National Oceanic and Atmospheric Administration.</text></paragraph><paragraph id="idc9d9b9b1eb3a4301b2ddcff8873f36ca"><enum>(7)</enum><text>A designee of the Director of the National Institutes of Health.</text></paragraph><paragraph id="idacd77250f5594542b5727b63cc417607"><enum>(8)</enum><text>A designee of the Director of the Centers for Disease Control and Prevention.</text></paragraph><paragraph id="ida12f6d4a1596479585a44d427d43461d"><enum>(9)</enum><text>Not fewer than 4 representatives from Tribal governments located on the western coast of the United States with current knowledge of 6PPD impacts on coho salmon, who shall be appointed by the National Academy of Sciences with consideration given to differences in regional perspectives and experiences.</text></paragraph><paragraph id="idde38c0653195436687e283712575df01"><enum>(10)</enum><text>Not fewer than 4 representatives from the private sector, who shall be appointed by the National Academy of Sciences, including—</text><subparagraph id="id7a52d850041c45c79ac74e37d59e53c8"><enum>(A)</enum><text>2 representatives from the tire manufacturing industry; and</text></subparagraph><subparagraph id="idda175c129c774c779b27473491239090"><enum>(B)</enum><text>2 representatives from the tire chemical additive manufacturing industry.</text></subparagraph></paragraph><paragraph id="idf8afcf2bb95648b9af4fbbb067c18b14"><enum>(11)</enum><text>Not fewer than 1 representative from the environmental community, who shall be appointed by the National Academy of Sciences.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida79dd889b1444c45b30435ed3b336baf"><enum>(12)</enum><text>Not fewer than 2 representatives with expertise in environmental and public health from State government agencies with active 6PPD mitigation programs or that have documented 6PPD runoff impacts on aquatic species, who shall be appointed by the National Academy of Sciences from not fewer than 2 different States.</text></paragraph><paragraph id="iddbe61f332cb84d6e986eb5745c265e43"><enum>(13)</enum><text>Not fewer than 1 representative from a university research institution with experience researching 6PPD and aquatic toxicology, who shall be appointed by the National Academy of Sciences.</text></paragraph></subsection><subsection id="id7f014cde4ac14884ade37e34d82aec6b"> <enum>(d)</enum> <header>Co-Chairs</header> <text>The members described in paragraphs (1) and (2) of subsection (c) shall serve as the Co-Chairs of the Task Force.</text>
 </subsection><subsection id="id3883275afc2449fe9805c6cfdc7d8804"><enum>(e)</enum><header>Meetings</header><text>The Task Force shall meet not less than 3 times annually.</text></subsection><subsection id="id9704d1da97054b89bd921ddd7895a5d7"><enum>(f)</enum><header>Inapplicability of FACA</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/10">Chapter 10</external-xref> of title 5, United States Code (commonly referred to as the <quote>Federal Advisory Committee Act</quote>), shall not apply to the Task Force.</text></subsection><subsection id="id2f4e1204022543ebba8dc00411d9e94a"><enum>(g)</enum><header>Report</header><text>Not later than 180 days after the date of enactment of this Act, and annually thereafter, the Task Force shall submit to the Committee on Environment and Public Works of the Senate and the Committees on Transportation and Infrastructure and Energy and Commerce of the House of Representatives, and make publicly available, a report that includes—</text><paragraph id="id0ca8eb4cf81c481bbd902c9b1e32fb4a"><enum>(1)</enum><text>the findings and recommendations of the Task Force; and</text></paragraph><paragraph id="id5835bcf3d49c4bfeafbd9cf54724b651"><enum>(2)</enum><text>a list of stakeholders and industry experts consulted by the Task Force.</text></paragraph></subsection></section></legis-body></bill>
