<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 4324</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260416" legis-day="20260414">April 16 (legislative day, April 14), 2026</action-date><action-desc><sponsor name-id="S409">Mr. Luján</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 28, United States Code, to prohibit attorneys for the Government who are sanctioned by a court from temporarily representing the Government.</official-title></form><legis-body><section id="idf9db2c76d7f54a1c877ada20bad3f303" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Prosecutorial Accountability Act</short-title></quote>.</text></section><section id="S1"><enum>2.</enum><header>Temporary prohibition of sanctioned attorneys from representing the Government</header><text display-inline="no-display-inline">Section 530B(b) of title 28, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id8a60c06d36964f7e9d8a1231cfc14fd2"><enum>(1)</enum><text>by striking <quote>The</quote> and inserting <quote>(1) The</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6491ee16970c499191c862d2b03aec53"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="iddc7f3899b5484e75bdc5c9524587b7b2"><paragraph commented="no" display-inline="no-display-inline" id="id20b53f7469844e62b840f0d3dd0ab545" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id34eaed82c1d44ad2858051b9b98d7cc3"><enum>(A)</enum><text>The rules described in paragraph (1) shall provide for barring an attorney for the Government from representing the Government in court and filings for 1 year if a court has imposed sanctions under rule 11 of the Federal Rules of Civil Procedure on the attorney.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="id4fc948e11a91423d88a7d9dce2e1a93c"><enum>(B)</enum><text>The Office of Professional Responsibility of the Department of Justice shall carry out the rules described in subparagraph (A).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
