Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a program to make grants for the establishment of prison libraries.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HC87C9B08E95441B8ABFF592CC51AF99F"><section section-type="section-one" id="H0ED31B8FA0E64A8F833AACC2C80B853B"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prison Libraries Act of 2026</short-title></quote>.</text></section><section id="H5FDEA59A84D144B6852DD12B5212EEE5"><enum>2.</enum><header>Establishment</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Attorney General shall establish a program to make grants to eligible applicants for the purpose of providing library services to incarcerated individuals in order to advance reintegration efforts, reduce recidivism, and increase educational opportunities.</text></section><section id="H5B599B4CF4DB4543827829023DA47F64"><enum>3.</enum><header>Eligibility criteria</header><text display-inline="no-display-inline">An eligible grantee under this Act is any State or territory that submits an application that includes the following:</text><paragraph id="HC96F044E4C2A49318D1A6B0C3EC572BC"><enum>(1)</enum><text>A comprehensive plan for how the grant will be used, including project objectives, program design, and evaluation process.</text></paragraph><paragraph id="H9E580A52EE8E4BC5A54C69CA40FB13FB"><enum>(2)</enum><text display-inline="yes-display-inline">Proof of the existence of a physical library at a correctional facility or the intention of creating one.</text></paragraph><paragraph id="HE2DEF1EF7B5B48EF987803358413E442"><enum>(3)</enum><text display-inline="yes-display-inline">Data on the demographics of the population of the facility sufficient to demonstrate a compelling need for funding, including educational level of prison population, rates of recidivism, socioeconomic breakdown of the prison population or any other relevant data.</text></paragraph></section><section id="H3FC00FF6AF5E42D187024AEB180F3590"><enum>4.</enum><header>Use of funds</header><text display-inline="no-display-inline">Grant amounts shall be used to provide library services to incarcerated individuals as set forth in section 2, and may include usage for any of the following:</text><paragraph id="H47C9F6D0684049228F3155D3674F7DD3"><enum>(1)</enum><text>Education and job training.</text></paragraph><paragraph id="H3767DC5F61C244F4864B03AF70CA3F64"><enum>(2)</enum><text>Acquisition of modern materials and equipment that reflect the interests, identities, abilities, and languages of the prison population.</text></paragraph><paragraph id="H8B93F65CB399455B8043E13F2CCBA369"><enum>(3)</enum><text>Expansion of the infrastructure of prison libraries to be less restrictive, safety permitted, and more welcoming with design and decor.</text></paragraph><paragraph id="HC7D49B138C70427EBEEC40FD3F646BD4"><enum>(4)</enum><text>Hiring of qualified librarians and staff to manage the libraries, their resources, and services and serve as the social coordinator for organized activities and events, and who hold the following qualifications:</text><subparagraph id="H659925DEBD77478C9627AE958DD5EF64"><enum>(A)</enum><text>Have practical library management experience.</text></subparagraph><subparagraph id="H8D3C8D605E8C4C2DA657967008F20B41"><enum>(B)</enum><text>Demonstrated ability to catalogue, archive, and maintain databases and E-resources.</text></subparagraph><subparagraph id="HCEC2D77633EC4E8C93B8D44764977905"><enum>(C)</enum><text display-inline="yes-display-inline">Demonstrated ability to organize weekly, bi-weekly, and monthly events and activities.</text></subparagraph></paragraph><paragraph id="H149AE3C7B9E14E83A01A37C03ECC342E"><enum>(5)</enum><text>Literary training.</text></paragraph><paragraph id="HF063CD29FD1F429DA071E8BA9B277808"><enum>(6)</enum><text>Digital literacy training.</text></paragraph><paragraph id="H3A4FC212A4C34D57B03EBFB5D858D54C"><enum>(7)</enum><text>Career readiness programming.</text></paragraph><paragraph id="H2B60704FF6D646D485D6FC5C5DA2FAFF"><enum>(8)</enum><text display-inline="yes-display-inline">Civic engagement programs.</text></paragraph><paragraph id="H77EC7F2A0ECC4BD9ADB8E52A2FDE51A1"><enum>(9)</enum><text>Restorative justice programs.</text></paragraph><paragraph id="H9EC3BDE0A8D14498AC931F7351C091DD"><enum>(10)</enum><text>Resident-led programs.</text></paragraph><paragraph id="H180E032025A14EC4BFBF20BD3A106578"><enum>(11)</enum><text>Health and wellness activities.</text></paragraph><paragraph id="H09200D5939074122BA9BCBC839371741"><enum>(12)</enum><text>Cultural exchange and appreciation programs, events, and activities.</text></paragraph><paragraph id="H9D5D027E9EAE4210A8D6235775D90525"><enum>(13)</enum><text>Access to computers (including laptops) and the internet.</text></paragraph><paragraph id="HB596CC43AA834EB4A854BFD8ED1877AD"><enum>(14)</enum><text>Book discussion programs.</text></paragraph><paragraph id="H58C9219A95954E2B89D8B935537522BD"><enum>(15)</enum><text>Language services, including free English classes.</text></paragraph><paragraph id="HA6AF82F6362B408A95076E0B8489A471"><enum>(16)</enum><text display-inline="yes-display-inline">Audiobooks and accessible reading materials for the visually impaired and print disabled.</text></paragraph><paragraph id="H5065EC727D2143CA8F2B21C3377A60C1"><enum>(17)</enum><text>eBooks.</text></paragraph><paragraph id="H1E0D4B7E79A84A0B8CDEE15479D9EC3C"><enum>(18)</enum><text>Management of book donation programs.</text></paragraph><paragraph id="HAA5D0B77D3DF4D698EDF1C825C214965"><enum>(19)</enum><text>Audio and visual materials or multimedia.</text></paragraph><paragraph id="H91D1F18ED3EE486FB114F7D248C25CFF"><enum>(20)</enum><text>Artistic programing such as painting, creative writing, poetry slams, drama, or music.</text></paragraph><paragraph id="HE171FE0217744827A0C44CDB1A55129E"><enum>(21)</enum><text>Financial literacy.</text></paragraph><paragraph id="H076B074C16864A32A69EB6EF0B5E04BD"><enum>(22)</enum><text>Family literacy activities facilitated during in-person visits.</text></paragraph><paragraph id="H3212B3B1F09D499EA877E71CEF13385B"><enum>(23)</enum><text>Resource fairs.</text></paragraph><paragraph id="HAE42F7D91D2141AE99C331922FA35292"> <enum>(24)</enum> <text>Making reasonable efforts toward building a working relationship with local public libraries, including—</text>
                <subparagraph id="H6C0E0DDBE8954730BCD825A7891961E8">
                    <enum>(A)</enum>
 <text>adoption of a standardized guideline for library management;</text> </subparagraph> <subparagraph id="H91DD2BE869254E438BBD32C208095D82"> <enum>(B)</enum> <text>sharing of resources and materials through an interlibrary loan arrangement; and</text>
                </subparagraph>
                <subparagraph id="H2197E019CA97424D9B1BC924AC291097">
                    <enum>(C)</enum>
 <text>implementation of coordinated organized events and activities.</text> </subparagraph> </paragraph></section><section id="H52B970D0F6AB4329907EEBA3597257F3"><enum>5.</enum><header>Prohibited uses</header><text display-inline="no-display-inline">Grant amounts may not be used for the following:</text><paragraph id="H6AA9CD969A6D43F29614A7E4BCCCDA88"><enum>(1)</enum><text>Purchasing food, clothes, shoes, or hygiene supplies.</text></paragraph><paragraph id="H5E0A51FEF2E246B098297542369F0B1B"><enum>(2)</enum><text>Payment of employee salary and benefits unassociated with prison libraries.</text></paragraph><paragraph id="H091A7FC2AE2A449C993802D7B44849C1"><enum>(3)</enum><text>Physical and mental care for incarcerated individuals.</text></paragraph><paragraph id="H3AC3A78818A84D54A808C931420AB644"><enum>(4)</enum><text>Incarcerated individual transportation.</text></paragraph><paragraph id="H1EDC5BE34D52486886441187BCEECF0F"><enum>(5)</enum><text>Staff training unrelated to library services.</text></paragraph><paragraph id="H5879576FF0714EECA84CB58388F6ADF4"><enum>(6)</enum><text>General administrative functions or operations of the prison.</text></paragraph><paragraph id="HFF61463F177D4CFC8816E191DA7A71E4"><enum>(7)</enum><text>Facility maintenance unrelated to the libraries.</text></paragraph><paragraph id="H1DAE954ED123460BBB70453A3FE7A43D"><enum>(8)</enum><text>Other obligations imposed on the facility by law, including establishment of maintenance of a law library.</text></paragraph><paragraph id="H92EFEBED214E48E2BC8AD912CCE66F73"><enum>(9)</enum><text>Any other use unrelated to library services, resources, and management.</text></paragraph></section><section id="HCB7FA118724643C891F9469DDFEC15B2"><enum>6.</enum><header>Prioritization</header><text display-inline="no-display-inline">The Attorney General shall, in making grants under this Act, comply with the following:</text><paragraph id="HB854FA4AE4D24997BBA1546DA23BCBF9"><enum>(1)</enum><text>The Attorney General shall prioritize making awards to grantees that are the following:</text><subparagraph id="H323F5D1827A6405A9FEAE7450F0476E9"><enum>(A)</enum><text display-inline="yes-display-inline">Applicants that follow local or national standards and guidelines for library management.</text></subparagraph><subparagraph id="H376257197C26401CA546F0629BD10F38"><enum>(B)</enum><text display-inline="yes-display-inline">Applicants that add or prioritize post-secondary education curriculum to library programming.</text></subparagraph><subparagraph id="H861235352869472494B237019423D67B"><enum>(C)</enum><text display-inline="yes-display-inline">Applicants with plans for tangible, positive, and measurable impact for their prison population, including—</text><clause id="HDFEE747395204DC396AA6E16A67EE289"><enum>(i)</enum><text>plans for increasing literacy rates;</text></clause><clause id="H1EA7D6ACBE93450DAE35AA047183D98A"><enum>(ii)</enum><text>plans for increased secondary and post-secondary enrollment and graduation rates;</text></clause><clause id="HB301C29C2CBE4F53BB665DD8C20FA4FC"><enum>(iii)</enum><text>plans for development of technical and vocational skills;</text></clause><clause id="H084EE6B0A8D6428BB0397529D20FDB51"><enum>(iv)</enum><text>plans for expanded access to employment opportunities post-release; and</text></clause><clause id="H3F264BE245A74AD6ACA5EAE26E761012"><enum>(v)</enum><text>any other factors that the Attorney General determines appropriate.</text></clause></subparagraph><subparagraph id="HFC70BF1B2EB44F498DF67B6483C5B0F4"><enum>(D)</enum><text display-inline="yes-display-inline">Applicants with plans for numerous initiatives to maximize benefits and services for their prison population.</text></subparagraph></paragraph><paragraph id="H6C7572FCFBC04E1AA3A2A52D2495DE6A"><enum>(2)</enum><text>The Attorney General shall ensure geographic diversity as between grantees with regard to the States and territories and between urban and rural areas.</text></paragraph><paragraph id="H26BB89FCACCE4FD59102C2C9D88389BB"><enum>(3)</enum><text>The Attorney General shall establish a reporting system to monitor progress, performance, and expenditures of grantees.</text></paragraph></section><section id="HA394DADF061B46A188CBCB87C1264167"><enum>7.</enum><header>Term</header><text display-inline="no-display-inline">A grant under this Act shall be for a term of 1 year, and may be renewed annually for a period of not more than 6 years in total.</text></section><section id="HA350057046284A29BC4F97B9D23C10A5"><enum>8.</enum><header>Reporting</header><text display-inline="no-display-inline">Grantees shall submit annual performance measures, including library activity statistics and program outcomes, and expenditure reports to systems established by the Attorney General under section 6(3).</text></section><section id="H3778E74E59D247B1A3CAC6D10C3E7597"><enum>9.</enum><header>Conditions</header><subsection id="H8D206A5D9D154D318DF2E819049D718B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A grantee may not charge a fee to any incarcerated individual for the following:</text><paragraph id="H476A0BA8CC8B4055BF0E0C2187023C8D"><enum>(1)</enum><text>Access to physical books.</text></paragraph><paragraph id="H57BD4AB757D64BBBBAC4F27533D2EA04"> <enum>(2)</enum> <text>Access to eBooks and audiobooks.</text>
 </paragraph><paragraph id="HAFB8E99C548B4379A0248993984BE5F9"><enum>(3)</enum><text>Access to computers (including laptops) and the internet within the library.</text></paragraph><paragraph id="H93BBD7F350BE43338A526BBBB9453C0F"><enum>(4)</enum><text>Access to educational and artistic materials needed to facilitate learning, training, or activities, including notebooks, pens, pencils, paints, and similar supplies.</text></paragraph><paragraph id="H9C38DFD0AD2546E1B035CF4D62D26023"><enum>(5)</enum><text>Printing services.</text></paragraph><paragraph id="H460E10B67E1E41D2823528C7BCCB7587"><enum>(6)</enum><text>Any other library services or resources.</text></paragraph></subsection><subsection id="HFF0113DF0D914FDD9F4825D8AF381D1C"><enum>(b)</enum><header>Availability for educational programming</header><text display-inline="yes-display-inline">A grantee shall make the library space available to post-secondary organizations and personnel for educational programming.</text></subsection></section><section id="H6824F4C835624C0ABDA2CC11A9581F77"><enum>10.</enum><header>Consultation</header><text display-inline="no-display-inline">The Attorney General shall consult with the Director of the Institute of Museum and Library Services in implementing this Act.</text></section><section id="H1BE9B647853444A2AD396DF9134C90DA"><enum>11.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated to carry out this Act $10,000,000 for each of fiscal years 2026 through 2031.</text></section></legis-body></bill>
