<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 4317</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260416" legis-day="20260414">April 16 (legislative day, April 14), 2026</action-date><action-desc><sponsor name-id="S317">Mr. Barrasso</sponsor> (for himself, <cosponsor name-id="S287">Mr. Cornyn</cosponsor>, <cosponsor name-id="S410">Ms. Lummis</cosponsor>, and <cosponsor name-id="S365">Mr. Scott of South Carolina</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 23, United States Code, to withhold Federal highway funding from States that issue driver’s licenses, commercial driver’s licenses, or personal identification cards to individuals without verifying the legal status of those individuals, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Licenses for Illegal Drivers or Truckers Act of 2026</short-title></quote>.</text></section><section id="id0F1945EBE5CF4F74870A469747500CFD" section-type="subsequent-section"><enum>2.</enum><header>Preserving the integrity of State-issued driver’s licenses, commercial driver’s licenses, and personal identification cards</header><subsection commented="no" display-inline="no-display-inline" id="id6dc20127b26a41d0b0c7257ed0d78b20"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">Chapter 1</external-xref> of title 23, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/23/154">section 154</external-xref> the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id56687bed1c0f430999cb5640d0c6114b"><section commented="no" display-inline="no-display-inline" id="idfa7e2988151145dc976d39c008ebc69f"><enum>155.</enum><header>Preserving the integrity of State-issued driver's licenses, commercial driver's licenses, and personal identification cards</header><subsection id="IDe7b4ff8a5ee941edaea24d18e0dbf79d"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id91a3cf6b2942476cb8909079c45e8841"><enum>(1)</enum><header>Commercial driver’s license</header><text>The term <term>commercial driver’s license</term> has the meaning given the term in section 31301 of title 49.</text></paragraph><paragraph id="ID41468c60ec684adc8892f5e7fdafce48"><enum>(2)</enum><header>Driver’s license</header><text>The term <term>driver’s license</term> means a motor vehicle operator’s license (as defined in section 30301 of title 49).</text></paragraph><paragraph id="ID0c503dc0c86e42d7b60e975721141f79"><enum>(3)</enum><header>Evidence of lawful presence</header><text>The term <term>evidence of lawful presence</term> means valid, unexpired documentary evidence issued by the Secretary of Homeland Security that a person is—</text><subparagraph id="IDa2f088dc42e84bd88a0f3e8ec0ce6e4f"><enum>(A)</enum><text>a citizen or national of the United States; or</text></subparagraph><subparagraph id="ID00ee1735f83b4fab91d13def543ce0da"> <enum>(B)</enum> <text>an alien lawfully admitted for permanent residence (as those terms are defined in section 101(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)</external-xref>)).</text>
 </subparagraph></paragraph><paragraph id="ID7b54957054424281b88494f2c5eb3170" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header>Personal identification card</header><text>The term <term>personal identification card</term> means an identification document (as defined in section 1028(d) of title 18) issued by a State.</text></paragraph></subsection><subsection id="ID219878bd3c2541eabf7673ea4148b1bf"><enum>(b)</enum><header>Withholding of funds for noncompliance</header><paragraph id="IDe9c45551702b4642810ab1871b443c3c"><enum>(1)</enum><header>In general</header><text>On October 1, 2026, and each October 1 thereafter, the Secretary shall withhold from a State 10 percent of the amounts required to be apportioned to the State under paragraphs (1) through (8) of section 104(b) for a fiscal year if that State does not have in effect and is enforcing a law that meets the requirements described in subsection (e).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7a3e9f265f9f4b63beb8fdc078ebf4d2"><enum>(2)</enum><header>Duration</header><text>If, before the last day of the fiscal year for which funds are withheld under this section, the Secretary determines that the State is in compliance with this section, the Secretary shall, on the first day on which the Secretary makes that determination, apportion to the State the funds withheld from that State for that fiscal year under this section.</text></paragraph></subsection><subsection id="ID0899d748110449ea820e92094cc8fd13"><enum>(c)</enum><header>Redistribution of withheld funds</header><text>On the first October 1 after a fiscal year for which amounts were withheld from a State under this section, the Secretary shall redistribute those amounts to States that are in compliance with this section so that each State in compliance with this section receives an amount equal to the proportion that—</text> <paragraph commented="no" display-inline="no-display-inline" id="ida95f21b2513340d8b6cf238bea87914e"> <enum>(1)</enum> <text>the amount apportioned to the State under section 104(b); bears to</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd673db2a041449a7ba4849530f347d89"><enum>(2)</enum><text>the total amount apportioned to all States in compliance with this section under section 104(b).</text></paragraph></subsection><subsection id="ID8b2aa08e67874e588beed91e6e636d28" commented="no"><enum>(d)</enum><header>Effect of withholding</header><text>Except as provided in subsection (b), no funds withheld under this section from apportionment to a State shall be available to a State.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idd01a6a4a8e484c6794bdb154e9c3ece2"> <enum>(e)</enum> <header>Law To require and verify lawful presence</header> <paragraph commented="no" display-inline="no-display-inline" id="idff8884ca67484621ab69f00c2c7640cf"> <enum>(1)</enum> <header display-inline="yes-display-inline">In general</header> <text>A State shall be in compliance with this section if the State has in effect and is enforcing a law to require and subsequently verify evidence of lawful presence from each applicant for a driver’s license, commercial driver’s license, or personal identification card issued by the State.</text>
                            </paragraph>
                            <paragraph commented="no" display-inline="no-display-inline"
                                id="id48a1cd67b1d54f3483b6d701b21b7a8b">
                                <enum>(2)</enum>
                                <header>Requirement</header>
 <text display-inline="yes-display-inline">A law referred to in paragraph (1) shall employ a means approved by the Secretary of Homeland Security—</text>
                                <subparagraph id="id5355578d7bf04659aa82f720c941b46a">
                                    <enum>(A)</enum>
 <text>to confirm the identity of an applicant for a driver’s license, commercial driver’s license, or personal identification card through electronic validation of biographic and biometric information, including the name, photograph, and fingerprints of the applicant;</text>
                                </subparagraph>
                                <subparagraph id="id9f71d22a8c86441aa7be73bc624c69b6">
                                    <enum>(B)</enum>
 <text>to confirm the validity of the lawful presence of an applicant described in subparagraph (A), including whether the applicant has lawfully maintained that lawful presence, through the results of background and security checks, including fingerprint checks by the Federal Bureau of Investigation; and</text>
                                </subparagraph>
                                <subparagraph id="id9ade72001caf47b59a9186dd90f07d91">
                                    <enum>(C)</enum>
 <text>to verify the authenticity of the evidence of lawful presence provided by an applicant described in subparagraph (A), which shall include an identity document containing a photograph, by confirming the social security number or individual taxpayer identification number of the applicant with, as applicable—</text>
                                    <clause commented="no" display-inline="no-display-inline"
                                        id="idfb04ee9ec88747c7ba5c9f590f84c016">
                                        <enum>(i)</enum>
 <text display-inline="yes-display-inline">the Internal Revenue Service;</text>
                                    </clause>
                                    <clause commented="no" display-inline="no-display-inline"
                                        id="id884fc5a7f7b6450ba608bf24dc5118ec">
                                        <enum>(ii)</enum>
 <text display-inline="yes-display-inline">the Social Security Administration; or</text>
                                    </clause>
                                    <clause commented="no" display-inline="no-display-inline"
                                        id="id8a8f68eced0b464d860653e196f83aa9">
                                        <enum>(iii)</enum>
 <text display-inline="yes-display-inline">the Systematic Alien Verification for Entitlements program of U.S. Citizenship and Immigration Services.</text>
                                    </clause>
                                </subparagraph>
                            </paragraph>
 </subsection><subsection id="ID62976071ac24496aab11ad07362c5808"><enum>(f)</enum><header>REAL ID Act of 2005</header><text>Nothing in this section affects any State requirement under title II of the REAL ID Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/49/30301">49 U.S.C. 30301</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/109/13">Public Law 109–13</external-xref>).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id786db882337f4d53b79d842d3cf7c81f"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">chapter 1</external-xref> of title 23, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/23/154">section 154</external-xref> the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idd80dd9f3fb5d42e89be4e8e4c3856307"><toc><toc-entry level="section" bold="off">155.
