referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To ensure that State and local law enforcement may cooperate with Federal officials to protect our communities from violent criminals and suspected terrorists who are illegally present in the United States.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Sanctuary City Elimination Act</short-title></quote>.</text></section><section id="id8812c7b26b0f4485b0c04b6ef266dce7"><enum>2.</enum><header>Ensuring that local and Federal law enforcement officers may cooperate to safeguard our communities</header><subsection id="idaecd1d90184b4114a7ce1f39eba03924"><enum>(a)</enum><header>Authority To cooperate with Federal officials</header><text>A State, a political subdivision of a State, or an officer, employee, or agent of such State or political subdivision that complies with a detainer issued by the Department of Homeland Security under section 236 or 287 of the Immigration and Nationality Act (8 U.S.C. 1226 and 1357)—</text><paragraph id="id5696fb91f71541779b6b02e63a5ade87"><enum>(1)</enum><text>shall be deemed to be acting as an agent of the Department of Homeland Security; and</text></paragraph><paragraph id="id9469682b0fce48dd831a2a1e0c416b40"><enum>(2)</enum><text>with regard to actions taken to comply with the detainer, shall have all authority available to officers and employees of the Department of Homeland Security.</text></paragraph></subsection><subsection id="idb9d51edbd628417c85453d924b6a8e0a"><enum>(b)</enum><header>Legal proceedings</header><text>In any legal proceeding brought against a State, a political subdivision of a State, or an officer, employee, or agent of such State or political subdivision, which challenges the legality of the seizure or detention of an individual pursuant to a detainer issued by the Department of Homeland Security under section 236 or 287 of the Immigration and Nationality Act (8 U.S.C. 1226 and 1357)—</text><paragraph id="id26917d3980004c6ea7d3513f96eb1fae"><enum>(1)</enum><text>no liability shall lie against the State or political subdivision of a State for actions taken in compliance with the detainer; and</text></paragraph><paragraph id="idaec1e72a2ec14141855c7d731e94d87a"><enum>(2)</enum><text>if the actions of the officer, employee, or agent of the State or political subdivision were taken in compliance with the detainer—</text><subparagraph id="idb4f0a2f647c24ebdb8e0123caf819456"><enum>(A)</enum><text>the officer, employee, or agent shall be deemed—</text><clause id="id27E0CBBAEB0841E691E76E0EDBBC7348"><enum>(i)</enum><text>to be an employee of the Federal Government and an investigative or law enforcement officer; and</text></clause><clause id="id586832FE3D4E4A3DB74D7B640D8DDFE3"><enum>(ii)</enum><text>to have been acting within the scope of his or her employment under section 1346(b) and <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/171">chapter 171</external-xref> of title 28, United States Code;</text></clause></subparagraph><subparagraph id="id4229ae1c9fb5404ea366cb51992ee89c"><enum>(B)</enum><text>section 1346(b) of title 28, United States Code, shall provide the exclusive remedy for the plaintiff; and</text></subparagraph><subparagraph id="id79eaba1a000740de880fa41b106b9af9"><enum>(C)</enum><text>the United States shall be substituted as defendant in the proceeding.</text></subparagraph></paragraph></subsection><subsection id="iddc098e23267f4cda8356ed9b5f028211"><enum>(c)</enum><header>Rule of construction</header><text>Nothing in this section may be construed to provide immunity to any person who knowingly violates the civil or constitutional rights of an individual.</text></subsection></section><section id="id3b82340ba7474b308422f921eea41f29"><enum>3.</enum><header>Sanctuary jurisdiction defined</header><subsection id="id81D76F851C164C5C8EBFD4350DFB1A0F"><enum>(a)</enum><header>In general</header><text>Except as provided under subsection (b), for purposes of this Act, the term <term>sanctuary jurisdiction</term> means any State or political subdivision of a State that has in effect a statute, ordinance, policy, or practice that prohibits or restricts any government entity or official from—</text><paragraph id="id6AC5E52E5CBC407487F439D391E42BF7"><enum>(1)</enum><text>sending, receiving, maintaining, or exchanging with any Federal, State, or local government entity information regarding the citizenship or immigration status (lawful or unlawful) of any individual; or</text></paragraph><paragraph id="id8632CB218CFA412F84E1087EF73D9F72"><enum>(2)</enum><text>complying with a request lawfully made by the Department of Homeland Security under section 236 or 287 of the Immigration and Nationality Act (8 U.S.C. 1226 and 1357) to comply with a detainer for, or notify about the release of, an individual.</text></paragraph></subsection><subsection id="idD8D7C9C7344748A7BC7B22853BE77389"><enum>(b)</enum><header>Exception</header><text>A State or political subdivision of a State shall not be deemed a sanctuary jurisdiction based solely on it having a policy whereby its officials will not share information regarding, or comply with a request made by the Department of Homeland Security under section 236 or 287 of the Immigration and Nationality Act (8 U.S.C. 1226 and 1357) to comply with a detainer regarding, an individual who comes forward as a victim or a witness to a criminal offense.</text></subsection></section><section id="idDFE8B5D9FB1F4EFB99249467325F29B1"><enum>4.</enum><header>Sanctuary jurisdictions ineligible for certain Federal funds</header><subsection id="id68dc4db327334f8a88d481e6cafbf381"><enum>(a)</enum><header>Education grants</header><paragraph id="id4ec6f78d804a450fa7d91592b23eb84e"><enum>(1)</enum><header>National foundation on the arts and humanities grants</header><text>Section 7(f) of the National Foundation on the Arts and the Humanities Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/956">20 U.S.C. 956(f)</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="idfd0bf137f0344891bd2bc9da70f51799"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text><clause commented="no" display-inline="no-display-inline" id="id9afe09e548184e76b6f89fc27efa319d"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>The Chairperson</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4baf5bd805a34174ac3841dff1c0faa4"><paragraph commented="no" display-inline="no-display-inline" id="id52d92d1d333743f6a5f75967c11d8ba4"><enum>(1)</enum><text display-inline="yes-display-inline">Except as provided in subparagraph (B), the Chairperson</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id5f64542e707b44f791611acb7f8f9534"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idff7849f41f15460e97520b8c1768cc02"><subparagraph id="idd2852b6e8faa430084ed11a310a899bb"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="idad036b277ebd47bd94602db71118a705"><enum>(i)</enum><text>No application for a grant under this subsection may be approved unless the plan accompanying the application satisfies the requirements specified in this subsection.</text></clause><clause commented="no" display-inline="no-display-inline" id="id9803ebe8aeff42e5a2ea3b8ca24c639d" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">The Chairperson is not authorized to establish any grants-in-aid or allocate any Federal financial assistance or related Federal funding to a State or political subdivision of a State that is a sanctuary jurisdiction (as defined in section 3 of the <short-title>Sanctuary City Elimination Act</short-title>).</text></clause><clause commented="no" display-inline="no-display-inline" indent="up1" id="id8618e29e0dbb42549421d711a9fd8749"><enum>(iii)</enum><text display-inline="yes-display-inline">If a State or a political subdivision of a State that is a sanctuary jurisdiction releases an alien from State or local custody and such alien subsequently commits any criminal offense (or admits to committing acts constituting the essential elements of any criminal offense) against any individual in any other State, the attorney general of the State in which such crime occurred shall have standing to bring an action against the Chairperson or the State or political subdivision of such State that released such alien, on behalf of the injured party, in an appropriate district court of the United States to obtain injunctive relief requiring the Chairperson to withhold from such State any grant funding authorized under this section.</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="ida9ca8e74f7c54333a15ee64e034ee8d3"><enum>(C)</enum><text>in paragraph (2)(A), by striking the undesignated matter at the end; and</text></subparagraph><subparagraph id="id61d1597032a44c128c4965feda6e64ee" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text>in paragraph (3)—</text><clause commented="no" display-inline="no-display-inline" id="idb89cef189873425393ef9f053ee4e394"><enum>(i)</enum><text display-inline="yes-display-inline">in the matter preceding subparagraph (A), by inserting <quote>No application may be approved by the Chairperson unless the accompanying plan satisfies the requirements specified in this subsection.</quote> after <quote>by the Chairperson.</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id989e0ed2d0384f398cea873420e9f109"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking the undesignated matter at the end.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4252b6ce5141492eac7f1807e614dd88"><enum>(2)</enum><header display-inline="yes-display-inline">National environmental education grants</header><text>Section 6(i) of the National Environmental Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/5505">20 U.S.C. 5505(i)</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="idcb7f10447f2b49778d42ad34ffff4040"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>Grants</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id75877a180c66413888fdad8eff238477"><paragraph commented="no" display-inline="no-display-inline" id="id4ec5b734e1a24bf480d1847754278bb7"><enum>(1)</enum><header>Maximum amount</header><text>Grants</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idaf865beb289d498a841a9da8ec79a88a"><enum>(B)</enum><text>by striking <quote>In addition, 25 percent</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id47e42a1cf8cc444f984fc24620b23cc8"><paragraph commented="no" display-inline="no-display-inline" id="id4e2f58d4dfb1435ba5cada634bc374f7"><enum>(2)</enum><header>Set aside for small grants</header><text>Not less than 25 percent</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id471a98bde80f452aada250994275bb7c"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5451a7c75e6a4434a78d800a82d2cb4d"><paragraph id="id666dde9aa1b749e4b1d68ad63d71462f" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Ineligibility of sanctuary jurisdictions</header><text>The Administrator shall not provide any financial assistance under this section to any sanctuary jurisdiction (as defined in section 3 of the <short-title>Sanctuary City Elimination Act</short-title>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id247bf883c8994e38b5e4f6f964cd32d7"><enum>(4)</enum><header display-inline="yes-display-inline">Enforcement by the attorney general of a State</header><text display-inline="yes-display-inline">If a State or a political subdivision of a State that is a sanctuary jurisdiction releases an alien from State or local custody and such alien subsequently commits any criminal offense (or admits to committing acts constituting the essential elements of any criminal offense) against any individual in any other State, the attorney general of the State in which such crime occurred shall have standing to bring an action against the Administrator or the State or political subdivision of such State that released such alien, on behalf of the injured party, in an appropriate district court of the United States to obtain injunctive relief requiring the Administrator to withhold from such State any financial assistance authorized under this section.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3dd6e419a6474c1c9761876e384643fa"><enum>(3)</enum><header display-inline="yes-display-inline">Elementary and secondary education grants</header><text>Section 1002 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6302">20 U.S.C. 6302</external-xref>) is amended—</text><subparagraph id="idb653d2701255468f8ec755023e1052ba"><enum>(A)</enum><text>by redesignating subsection (f) as subsection (h); and</text></subparagraph><subparagraph id="id0524bf87c44d426da47114efb5235181"><enum>(B)</enum><text>by inserting after subsection (e) the following:</text><quoted-block id="id7bd34038d7a34a07b655348900553d39" display-inline="no-display-inline" style="OLC"><subsection id="id8aa9b2f2a6d84ca2ad3fb9f72f6901b5"><enum>(f)</enum><header>Ineligibility for grants</header><text>No appropriations authorized under this section for State and local educational agencies, education programs, or education services or assistance may be allocated as grants to any State or any political subdivision of a State that is a sanctuary jurisdiction (as defined in section 3 of the <short-title>Sanctuary City Elimination Act</short-title>).</text></subsection><subsection id="id608bdad088f7445998d0c9081a2f74d6" commented="no" display-inline="no-display-inline"><enum>(g)</enum><header>Enforcement by the attorney general of a State</header><text>If a State or a political subdivision of a State that is a sanctuary jurisdiction releases an alien from State or local custody and such alien subsequently commits any criminal offense (or admits to committing acts constituting the essential elements of any criminal offense) against any individual in any other State, the attorney general of the State in which such crime occurred shall have standing to bring an action against the Secretary or the State or political subdivision of such State that released such alien, on behalf of the injured party, in an appropriate district court of the United States to obtain injunctive relief requiring the Secretary to withhold from such State any funding appropriated pursuant to this section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8869bd6d1f8a4afd9a0aee3e4cb1aecc"><enum>(4)</enum><header>Higher education stem training grant program</header><text>Section 553 of the America COMPETES Reauthorization Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/20/9903">20 U.S.C. 9903</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idd709ad15061e4bb9abb00ea04ca97542"><subsection id="id80141cfe8e744d0e8ceaac00d8d09c3b"><enum>(h)</enum><header>Ineligibility for grants</header><text>An institution of higher education located within a State or political subdivision of a State that is a sanctuary jurisdiction (as defined in section 3 of the <short-title>Sanctuary City Elimination Act</short-title>) is not eligible to receive a grant under this section.</text></subsection><subsection id="id0bc7915c56464933804ab6634fa23631"><enum>(i)</enum><header>Enforcement by the attorney general of a State</header><text>If a State or a political subdivision of a State that is a sanctuary jurisdiction releases an alien from State or local custody and such alien subsequently commits any criminal offense (or admits to committing acts constituting the essential elements of any criminal offense) against any individual in any other State, the attorney general of the State in which such crime occurred shall have standing to bring an action against the Director or the State or political subdivision of such State that released such alien, on behalf of the injured party, in an appropriate district court of the United States to obtain injunctive relief requiring the Director to withhold from such State any grant funding authorized under this section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id2066c009b0c34077abb2746a8f9b76c7"><enum>(5)</enum><header>State fiscal stabilization education grants</header><text>Section 14001 of the American Recovery and Reinvestment Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/20/10001">20 U.S.C. 10001</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf7176a47f7154271be1bc5e7cdd8f74d"><subsection id="idd6a15ba0dac54a25afc6538db03c4f38"><enum>(g)</enum><header>Ineligibility for grants</header><text>The Secretary of Education shall not allocate any funds appropriated to carry out this title to any State or political subdivision of a State that is a sanctuary jurisdiction (as defined in section 3 of the <short-title>Sanctuary City Elimination Act</short-title>).</text></subsection><subsection id="id91eedc561a314b3192eae765bcb363ed"><enum>(h)</enum><header>Enforcement by the attorney general of a state</header><text>If a State or a political subdivision of a State that is a sanctuary jurisdiction releases an alien from State or local custody and such alien subsequently commits any criminal offense (or admits to committing acts constituting the essential elements of any criminal offense) against any individual in any other State, the attorney general of the State in which such crime occurred shall have standing to bring an action against the Secretary or the State or political subdivision of such State that released such alien, on behalf of the injured party, in an appropriate district court of the United States to obtain injunctive relief requiring the Secretary to withhold from such State any grant funding allocated under this title.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id98c657de6aff40fdb96e53c03e27f74b"><enum>(b)</enum><header display-inline="yes-display-inline">Grants for pollution research and pollution control programs</header><text>The Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idb4b58fc291a043c88bd37c4b4edfe53d"><enum>(1)</enum><text display-inline="yes-display-inline">in section 104 (<external-xref legal-doc="usc" parsable-cite="usc/33/1254">33 U.S.C. 1254</external-xref>), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb49057750b1149f3aefa0b9b78849aa3"><subsection commented="no" display-inline="no-display-inline" id="id0246b4c300c142528e4b2a593efb62e4"><enum>(x)</enum><header>Ineligibility of sanctuary jurisdictions</header><paragraph commented="no" display-inline="no-display-inline" id="id90515b036c444683a4e2dff0c889d32d"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>The Administrator shall not make any grant under this section to any sanctuary jurisdiction (as defined in section 3 of the <short-title>Sanctuary City Elimination Act</short-title>).</text></paragraph><paragraph id="id0e16fc4ab30b44728f26bb430ecb5a2b" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Enforcement by the attorney general of a State</header><text display-inline="yes-display-inline">If a State or a political subdivision of a State that is a sanctuary jurisdiction releases an alien from State or local custody and such alien subsequently commits any criminal offense (or admits to committing acts constituting the essential elements of any criminal offense) against any individual in any other State, the attorney general of the State in which such crime occurred shall have standing to bring an action against the Administrator or the State or political subdivision of such State that released such alien, on behalf of the injured party, in an appropriate district court of the United States to obtain injunctive relief requiring the Administrator to withhold from such State any grant funding authorized under this section.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5d0c4f0ae67149349ea2696c6ae60b4e"><enum>(2)</enum><text>in section 106 (<external-xref legal-doc="usc" parsable-cite="usc/33/1256">33 U.S.C. 1256</external-xref>), by—</text><subparagraph commented="no" display-inline="no-display-inline" id="id37d80a6b392549cc9fa858bb2dcfafe6"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (d)—</text><clause commented="no" display-inline="no-display-inline" id="id1c56ede784394612a29d6d3a98db3ca2"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>No grant</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id16062c87d0f54d69ae6886845fa607c3"><paragraph commented="no" display-inline="no-display-inline" id="idde2645114d404393b7e6fddc032592f4"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">No grant</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause commented="no" display-inline="no-display-inline" id="id832e054474264b0b96c4d9a66e16bb60"><enum>(ii)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="ide8843e472be4434eafd727be0250234d"> <paragraph commented="no" display-inline="no-display-inline" id="ide9e2c5fa3bb447ff986df745fd1d518f"> <enum>(2)</enum> <header>Ineligibility of sanctuary jurisdictions</header> <text display-inline="yes-display-inline">The Administrator shall not allot any funds appropriated pursuant to this section to any sanctuary jurisdiction (as defined in section 3 of the <short-title>Sanctuary City Elimination Act</short-title>).</text>

id="ida8c92d06979c4fb3bb21d6468be55d05"><enum>(2)</enum><header>Grants for planning and administrative expenses</header><text>Section 203(a) of the Public Works and Economic Development Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3143">42 U.S.C. 3143(a)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idbdf79bc5bbeb41f7865929c93cfb5387"><subsection commented="no" display-inline="no-display-inline" id="idc4d40e8a872e426fac57b17a4d12563b"><enum>(a)</enum><header>In general</header><paragraph commented="no" display-inline="no-display-inline" id="id847de7a6d3404c2ab8e7ce8d40ee77af"><enum>(1)</enum><header>Grants authorized</header><text display-inline="yes-display-inline">On the application of an eligible recipient, the Secretary may make grants to pay the costs of economic development planning and the administrative expenses of organizations that carry out such planning.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8d74bd9b590040de92f9687f3c48da11"><enum>(2)</enum><header>Ineligible recipients</header><text>No State or political subdivision of a State shall be deemed an eligible recipient for purposes of grant funding under this section if it is a sanctuary jurisdiction (as defined in section 3 of the <short-title>Sanctuary City Elimination Act</short-title>).</text></paragraph><paragraph id="idf430e46d4f1144d6bfa66417c794381f" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Enforcement by the attorney general of a State</header><text display-inline="yes-display-inline">If a State or a political subdivision of a State that is a sanctuary jurisdiction releases an alien from State or local custody and such alien subsequently commits any criminal offense (or admits to committing acts constituting the essential elements of any criminal offense) against any individual in any other State, the attorney general of the State in which such crime occurred shall have standing to bring an action against the Secretary or the State or political subdivision of such State that released such alien, on behalf of the injured party, in an appropriate district court of the display-inline="yes-display-inline">Enforcement by the attorney general of a State</header><text display-inline="yes-display-inline">If a State or a political subdivision of a State that is a sanctuary jurisdiction releases an alien from State or local custody and such alien subsequently commits any criminal offense (or admits to committing acts constituting the essential elements of any criminal offense) against any individual in any other State, the attorney general of the State in which such crime occurred shall have standing to bring an action against the Secretary or the State or political subdivision of such State that released such alien, on behalf of the injured party, in an appropriate district court of the United States to obtain injunctive relief requiring the Secretary to withhold from such State the supplementary grant funding authorized under this section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id6a61844d7c2f4b44b49c8c5c3fb44a04"><enum>(4)</enum><header>Grants for training, research, and technical assistance</header><text>Section 207 of the Public Works and Economic Development Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3147">42 U.S.C. 3147</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4d7e707c4c5c40f8b9bd097f16f608bc"><subsection id="id6940f0071100431ca16c14d6be7383db"><enum>(d)</enum><header>Ineligibility of sanctuary jurisdictions</header><text>Grant funds authorized under this section may not be used to provide assistance to any sanctuary jurisdiction (as defined in section 3 of the <short-title>Sanctuary City Elimination Act</short-title>).</text></subsection><subsection id="id6d2c430186dc4c879850f7f90aa17ff4" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header display-inline="yes-display-inline">Enforcement by the attorney general of a State</header><text display-inline="yes-display-inline">If a State or a political subdivision of a State that is a sanctuary jurisdiction releases an alien from State or local custody and such alien subsequently commits any criminal offense (or admits to committing acts constituting the essential elements of any criminal offense) against any individual in any other State, the attorney general of the State in which such crime occurred shall have standing to bring an action against the Secretary or the State or political subdivision of such State that released such alien, on behalf of the injured party, in an appropriate district court of the United States to obtain injunctive relief requiring the Secretary to withhold from such State the grant funding authorized under this section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id1578A9E8BF7B4231A06690F8F677AC64"><enum>(d)</enum><header>Community Development Block Grants</header><text display-inline="yes-display-inline">Title I of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5301">42 U.S.C. 5301 et seq.</external-xref>) is amended—</text><paragraph id="id907bfe5830904ab8bc2f201d70a778ee"><enum>(1)</enum><text>in section 102(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/5302">42 U.S.C. 5302(a)</external-xref>), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb16ac437113d4905930b077d048d3622"><paragraph id="idd1c4b2494d9647958808fa582a285297"><enum>(25)</enum><text>The term <term>sanctuary jurisdiction</term> has the meaning given such term in section 3 of the <short-title>Sanctuary City Elimination Act</short-title>.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id0E0D031F696F401EBB97CAB072FDCD54"><enum>(2)</enum><text>in section 104(b) (<external-xref legal-doc="usc" parsable-cite="usc/42/5304">42 U.S.C. 5304(b)</external-xref>)—</text><subparagraph id="id356cc8aa40b542bb9ad1b98f00650ae9"><enum>(A)</enum><text>in paragraph (5), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="idaac578e5bbd841c8a7afa7bd647c0cb0"><enum>(B)</enum><text>by redesignating paragraph (6) as paragraph (7); and</text></subparagraph><subparagraph id="idfc2047f7fb9b4328b214ab38efded2ee"><enum>(C)</enum><text>by inserting after paragraph (5) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" local government, the grantee is not a sanctuary jurisdiction and will not become a sanctuary jurisdiction during the period for which the grantee receives a grant under this title; and</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idb79d8992d91e44b799dc346ed21fa2be"><enum>(3)</enum><text>in section 106 (<external-xref legal-doc="usc" parsable-cite="usc/42/5306">42 U.S.C. 5306</external-xref>), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7e10cdcc1a6543afa60d567b13c0cef1"><subsection id="id90e6965b931d4c0285a016a4d84ae499"><enum>(g)</enum><header>Protection of individuals against crime</header><paragraph id="id99d2ebcc4eee4e2aaca2b06eb0b873a2"><enum>(1)</enum><header>In general</header><text>No funds authorized to be appropriated to carry out this title may be obligated or expended for any State, political subdivision of a State, or unit of general local government that is a sanctuary jurisdiction.</text></paragraph><paragraph id="id6c11a03d3ee843adaa6a0e9a721bd136"><enum>(2)</enum><header>Returned amounts</header><subparagraph id="id8398dc73ea8f47d5820b6b6eedb395e1"><enum>(A)</enum><header>State</header><text>If a State or a political subdivision of a State is a sanctuary jurisdiction during the period for which it receives funding under this title, the Secretary—</text><clause id="id3f030d9d2a2e45b19ecc75a0814c395b"><enum>(i)</enum><text>shall direct the State or political subdivision to immediately return to the Secretary any such amounts that the State or political subdivision received for that period; and</text></clause><clause id="ide8d6c33f5ef8422c8c98592be650fe6f"><enum>(ii)</enum><text>shall reallocate amounts returned under clause (i) for grants under this title to other States or political subdivisions of such States that are not sanctuary jurisdictions.</text></clause></subparagraph><subparagraph id="id6ee408ba4fe44ca3a3fcb0751cca7032"><enum>(B)</enum><header>Unit of general local government</header><text>If a unit of general local government is a sanctuary jurisdiction during the period for which it receives funding under this title, any such amounts that the unit of general local government received for that period—</text><clause id="id457910b26ad64b7091d19f7f83663c2c"><enum>(i)</enum><text>in the case of a unit of general local government that is not in a nonentitlement area, shall be returned to the Secretary for grants under this title to States and other units of general local government that are not sanctuary jurisdictions; and</text></clause><clause id="ide35df6e1b49b45bfb41d83289de91ea2"><enum>(ii)</enum><text>in the case of a unit of general local government that is in a nonentitlement area, shall be returned to the Governor of the State for grants under this title to other units of general local government in the State that are not sanctuary jurisdictions.</text></clause></subparagraph><subparagraph id="id836C02783CED4F8382824A91CC82EA22"><enum>(C)</enum><header>Reallocation rules</header><text>In reallocating amounts under subparagraphs (A) and (B), the Secretary—</text><clause id="idf99f9651a9184b91a475d58fa13c3eb6"><enum>(i)</enum><text>shall apply the relevant allocation formula under subsection (b), with all sanctuary jurisdictions excluded; and</text></clause><clause id="id8701bff57fc24a4fb42f9fea36cfb186"><enum>(ii)</enum><text>shall not be subject to the rules for reallocation under subsection (c).</text></clause></subparagraph></paragraph></subsection><subsection id="id885aee68b99d4d6b8a83a41a0167bb83" commented="no" display-inline="no-display-inline"><enum>(h)</enum><header display-inline="yes-display-inline">Enforcement by the attorney general of a State</header><text display-inline="yes-display-inline">If a State or a political subdivision of a State that is a sanctuary jurisdiction releases an alien from State or local custody and such alien subsequently commits any criminal offense (or admits to committing acts constituting the essential elements of any criminal offense) against any individual in any other State, the attorney general of the State in which such crime occurred shall have standing to bring an action against the Secretary or the State or political subdivision of such State that released such alien, on behalf of the injured party, in an appropriate district court of the United States to obtain injunctive relief requiring the Secretary to withhold from such State the funding authorized under this title.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ide037a8601f954c5aa77c9245be4520a0"><enum>(e)</enum><header>Brownfields Utilization, Investment, and Local Development Act of 2018 grant funding</header><text>Section 104(k) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C.
