which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To improve the access of consumers to professional sports broadcasts, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>For the Fans Act</short-title></quote>.</text></section><section id="idf98c507ddf0d4ac4982e2682c9321ae1"><enum>2.</enum><header>Access to streaming of live games</header><subsection id="id58f76c990454485ab8a783752669ba17"><enum>(a)</enum><header>Definitions</header><text>In this Act:</text><paragraph id="id3dd7499072e2475fb3960d73abb8856f"><enum>(1)</enum><header>League</header><text>The term <term>league</term> means a professional sports team organization in the United States for any of the following sports:</text><subparagraph id="id9459c38dd69349cba5c6ec94f4d96d13"><enum>(A)</enum><text>Baseball.</text></subparagraph><subparagraph id="idfa6ae3d023e240ec9ed9540c1e1b4815"><enum>(B)</enum><text>Basketball.</text></subparagraph><subparagraph id="id6bdd2b4ed5b743c0a6279d2e7b59a723"><enum>(C)</enum><text>Football.</text></subparagraph><subparagraph id="idb03f9891ae884bc69074a1a120ec380d"><enum>(D)</enum><text>Hockey.</text></subparagraph><subparagraph id="id9285660a278e43d3ad3c7b13d4a8ce15"><enum>(E)</enum><text>Soccer.</text></subparagraph><subparagraph id="idf86aa1fab6a5404cb2af64ace173fa2f"><enum>(F)</enum><text>Any other sport determined by the Federal Trade Commission, pursuant to a rule promulgated in accordance with section 553 of title 5, United States Code.</text></subparagraph></paragraph><paragraph id="idee9b18f74771434098345bf465328ec5"><enum>(2)</enum><header>League streamer</header><text>The term <term>league streamer</term> means a streaming subscription service streaming the games of a league that—</text><subparagraph id="idcdae5947326e41b59238a0e9a1a147a7"><enum>(A)</enum><text>has the name of the league in the title of the streaming subscription service;</text></subparagraph><subparagraph id="id94f8868abca747788abc646699ccda5b"><enum>(B)</enum><text>is promoted by the league;</text></subparagraph><subparagraph id="id30803bd7f34d414eb064451de6cf0f14"><enum>(C)</enum><text>has an agreement with the league to receive a portion of proceeds from streaming the majority of the games of the league; or</text></subparagraph><subparagraph id="idfb2900b27b6c4164a694f2c6074da025"><enum>(D)</enum><text>meets any other requirement, as determined by the Federal Trade Commission, pursuant to a rule promulgated in accordance with section 553 of title 5, United States Code.</text></subparagraph></paragraph><paragraph id="id555cccdf4ded49e1a00a4684548e0b89"><enum>(3)</enum><header>Local fan</header><text>The term <term>local fan</term>, with respect to a league team, means an individual located in the same State as the league team team, or in any other locality determined by the Federal Communications Commission.</text></paragraph></subsection><subsection id="id33291ce7c61a4604b51062743577fead"><enum>(b)</enum><header>No blackouts</header><paragraph id="id30c2b0e2f7be4e548c34cff336fd71df"><enum>(1)</enum><header>In general</header><text>A league streamer shall provide to customers of the league streamer access to view live every game of the league without implementing any kind of blackout for consumers, including a geographic blackout.</text></paragraph><paragraph id="id7e001b515b654b6092e162ecb4a114e4"><enum>(2)</enum><header>Enforcement by the Federal Trade Commission</header><subparagraph id="idd533c5a90b074c46bc6ce9c324bcaef4"><enum>(A)</enum><header>Unfair or deceptive acts or practices</header><text>A violation of paragraph (1), or a regulation promulgated thereunder, shall be treated as a violation of a rule defining an unfair or deceptive act or practice under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>) and as a violation of section 5(a) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/45">15 U.S.C. 45(a)</external-xref>) relating to unfair methods of competition.</text></subparagraph><subparagraph id="id914f0b5fd3cc4c2a8e6218f69416e9ba"><enum>(B)</enum><header>Powers of the commission</header><clause id="id1b4f707dee964938ade880c7a0fe6835"><enum>(i)</enum><header>In general</header><text>The Federal Trade Commission shall enforce paragraph (1), and any regulation promulgated thereunder, in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this Act.</text></clause><clause id="id19350389551f47de965d85f0c51dc50c"><enum>(ii)</enum><header>Privileges and immunities</header><text>Any person who violates paragraph (1), or a regulation promulgated thereunder, shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act.</text></clause><clause id="id6be306230962434f8ef7d185bfdf7080"><enum>(iii)</enum><header>Authority preserved</header><text>Nothing in this Act shall be construed to limit the authority of the Commission under any other provision of law.</text></clause><clause id="id0d5b139d2a604a878feff543ba2a6fa7"><enum>(iv)</enum><header>Rulemaking</header><text>The Commission may promulgate in accordance with section 553 of title 5, United States Code, such rules as may be necessary to carry out this subsection, including with respect to how to comply with paragraph (1).</text></clause></subparagraph></paragraph></subsection><subsection id="idff621e0a8abc48f7992c35315cffcac3"><enum>(c)</enum><header>Free access for local fans</header><paragraph id="id76e38a5b880949aaa84d58729a135e9f"><enum>(1)</enum><header>In general</header><text>A league shall provide to each local fan access to view live all games of the league team at no cost to the local fan and at a quality of service not less than that which is the best available, through a singular method of viewing for all games, which may be—</text><subparagraph id="id3b3efbde2c0f46019108997cdaf3c3be"><enum>(A)</enum><text>by local telecast or by streaming on a single streaming service; and</text></subparagraph><subparagraph id="id506bd8121b71475fae4eecc771f52877"><enum>(B)</enum><text>supported by advertisements.</text></subparagraph></paragraph><paragraph id="id50699741aafc4f21a4b40680c82e7e11"><enum>(2)</enum><header>Exception</header><text>Paragraph (1) shall not apply to—</text><subparagraph id="iddf5bd45c3ad2460fbdc7d4ad39ddb1c4"><enum>(A)</enum><text>a minor league team; or</text></subparagraph><subparagraph id="id44e6a13082d84a40969df4058b64a4ff"><enum>(B)</enum><text>a league with fewer than 8 teams.</text></subparagraph></paragraph><paragraph id="id16ae097ef29e4aba89dc51afe0a60283"><enum>(3)</enum><header>Enforcement</header><subparagraph commented="no" display-inline="no-display-inline" id="ida4645cfd8b9d4e658e5d34f99dc78567"><enum>(A)</enum><header display-inline="yes-display-inline">Enforcement by the Federal Communications Commission</header><text>The Federal Communications Commission shall have jurisdiction over complaints alleging a violation of paragraph (1).</text></subparagraph><subparagraph id="id298136e00af54595b3f615d85ea70d24"><enum>(B)</enum><header>Enforcement by State attorneys general</header><clause commented="no" display-inline="no-display-inline" id="idb7829db7cd3d43e08f0ade405d78fd25"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">In any case in which an attorney general of a State has reason to believe that an interest of the residents of that State has been or is threatened or adversely affected by the engagement of any person in an act or practice that violates this Act or a regulation promulgated under this Act, the attorney general of the State may, as parens patriae, bring a civil action on behalf of the residents of the State in an appropriate district court of the United States to—</text><subclause id="id9be3a251197b474589f3f74869ab6f9b"><enum>(I)</enum><text>enjoin that act or practice;</text></subclause><subclause id="id86a4f0fab28044df9bd1ea3468631e7b"><enum>(II)</enum><text>enforce compliance with this Act or the regulation;</text></subclause><subclause id="id50d55e476cf14347b90ad46b0d9e652f"><enum>(III)</enum><text>on behalf of residents of the State, obtain damages, restitution, or other compensation, each of which shall be distributed in accordance with State law; or</text></subclause><subclause id="id32ac54e1dc9149dc846a38bdbdba3ed6" commented="no" display-inline="no-display-inline"><enum>(IV)</enum><text>obtain such other relief as the court may consider to be appropriate.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id4cecf05c80e542cfaea9d9bcb7f2e389"><enum>(ii)</enum><header>Reasonable attorney's fees</header><text>In a civil action brought under clause (i) in which the plaintiff prevails, the court may award reasonable attorney’s fees, including litigation expenses, and costs reasonably incurred.</text></clause></subparagraph></paragraph></subsection></section></legis-body></bill>
