<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 4289</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260414">April 14, 2026</action-date><action-desc><sponsor name-id="S427">Mr. Schiff</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 to provide for the consideration of climate change, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H0F362F810B2946C38E386E404712963F"><section section-type="section-one" id="H71EA34B75A7E43949AD3978DCE99563B"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preparing Superfund for Climate Change Act of 2026</short-title></quote>.</text></section><section id="HD1631CF93C0E47E9A5E0AE5A74ADE878"><enum>2.</enum><header>Climate change mitigation</header><text display-inline="no-display-inline">Section 121 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9621">42 U.S.C. 9621</external-xref>) is amended—</text><paragraph id="HA47578C69D33462DB995E6C1291B7825"><enum>(1)</enum><text>in subsection (b)(1), in the fifth sentence—</text><subparagraph id="H113903C86D6C4716A3B16B43CA853DD2"><enum>(A)</enum><text>in the matter preceding subparagraph (A), by striking <quote>account:</quote> and inserting <quote>account—</quote>;</text></subparagraph><subparagraph id="H50B6A828CE9A45C5900BF28B64F4BE02"><enum>(B)</enum><text>in subparagraph (F), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="H5124E467CF4F4398800ECACCE4AA3C24"><enum>(C)</enum><text>in subparagraph (G), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="HF0D8B582FDA94C459E3F3BCFCF489DDB"><enum>(D)</enum><text>by inserting after subparagraph (G) the following:</text><quoted-block style="OLC" act-name="" id="H62E80616C076449290440E2CC361F5B4"><subparagraph id="H90A75A28CEFE4335B50C8230EB6D7239"><enum>(H)</enum><text>the potential threat to human health and the environment associated with local natural disasters and extreme weather hazards, including any projected exacerbation or change in those disasters and hazards due to climate change.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HCF1AA3DBD1EB4800BF210C6CE591926E"><enum>(2)</enum><text>in subsection (c), by inserting after the first sentence the following: <quote>The President shall include in the review an assessment of whether the selected remedial action remains protective after taking into account local natural disasters and extreme weather hazards, including any projected exacerbation or change in those disasters and hazards due to climate change.</quote>.</text></paragraph></section></legis-body></bill>
