which was read twice and referred to the <committee-name committee-id="SSAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To ensure National Guard members performing full-time National Guard duty in support of Federal law enforcement operations receive benefits equivalent to those provided for service during a national emergency.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Guard Equal Benefits for Federal Missions Act</short-title></quote>.</text></section><section id="id55c54ab0f9b545038e8ff68334519bb8"><enum>2.</enum><header>Treatment of certain title 32 service as national emergency service</header><subsection id="id2c9e6512b9a6493ebe9bc1ea2082d513"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/32/5">Chapter 5</external-xref> of title 32, United States Code, is amended by adding at the end the following new section:</text><quoted-block style="USC" display-inline="no-display-inline" id="id390be8ce73914ee79d076571261632bf"><section id="idefd47847297d4f14a7a28bd8202d7075"><enum>511.</enum><header>Treatment of certain full-time National Guard duty for benefit eligibility</header><subsection id="idd76151ecc72a4ab188db16859cbad923"><enum>(a)</enum><header>In general</header><text>For purposes of any provision of law that provides benefits based on service in response to a national emergency, full-time National Guard duty performed under section 502(f) shall be treated as service in response to a national emergency if such duty—</text><paragraph id="id2f6dd503b1aa40a0b5c031262e784655"><enum>(1)</enum><text>is authorized by the President or the Secretary of Defense; and</text></paragraph><paragraph id="id7fcc679bf9604f449f5b7f48c8cccd1a"><enum>(2)</enum><text>is performed in direct support of Federal law enforcement operations, including operations conducted in coordination with—</text><subparagraph id="idb8c61cf3dfc541c7b995926fcadf39c1"><enum>(A)</enum><text>U.S. Immigration and Customs Enforcement;</text></subparagraph><subparagraph id="id261eee3814b640bfa27d704acdaaa3d2"><enum>(B)</enum><text>the Drug Enforcement Administration;</text></subparagraph><subparagraph id="id5963fbd77b6149c9862017752998de3f"><enum>(C)</enum><text>the Bureau of Alcohol, Tobacco, Firearms and Explosives; or</text></subparagraph><subparagraph id="id4f8ae37013ea488ebb02eb6a403b9339"><enum>(D)</enum><text>any other Federal law enforcement agency designated by the Secretary of Defense; and</text></subparagraph></paragraph><paragraph id="ide606e85151b245daaf6670e70f713a2a"><enum>(3)</enum><text>is carried out for the purpose of addressing—</text><subparagraph id="idb025accf94654bd3a4631b74852277b2"><enum>(A)</enum><text>significant criminal activity;</text></subparagraph><subparagraph id="id57bb40bc0adc4dfbb46e44353ff17bc6"><enum>(B)</enum><text>drug trafficking;</text></subparagraph><subparagraph id="ide67f6432010842cba872ba02d719053f"><enum>(C)</enum><text>organized crime; or</text></subparagraph><subparagraph id="idaefb2534d98b4d1c86eb03b5799befee"><enum>(D)</enum><text>other threats to public safety as determined by the Secretary of Defense.</text></subparagraph></paragraph></subsection><subsection id="id4018ac1c1213455a9387101914b2cc1b"><enum>(b)</enum><header>Benefits covered</header><text>Service described in subsection (a) shall be deemed qualifying service for purposes of—</text><paragraph id="ideff4d07da5ec46af9cd0b46816db3860"><enum>(1)</enum><text>section 12731 of title 10 (retirement age reduction);</text></paragraph><paragraph id="id9782f88604f94269a85f4fe7f3761987"><enum>(2)</enum><text>section 1145 of title 10 (Transitional Assistance Management Program);</text></paragraph><paragraph id="id3dd3f5c584a04abe8e311d19a062336e"><enum>(3)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/33">chapter 33</external-xref> of title 38 (Post-9/11 GI Bill); and</text></paragraph><paragraph id="idfb60871d4a2143e1a016bf6005389ad3"><enum>(4)</enum><text>any other Federal benefit requiring service in response to a national emergency.</text></paragraph></subsection><subsection id="id3c215aebc7cf419f89235c356b2c6884"><enum>(c)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to limit the authority of the President to declare a national emergency.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id52e8b25298f248d6a7c9a18c11a43480"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/32/5">chapter 5</external-xref> of title 32, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/32/510">section 510</external-xref> the following new item:</text><quoted-block style="OLC" id="idd8af6c2e-7622-4438-a40b-25f5f63845d2"><toc><toc-entry level="section">511.
