Report on housing in Alaska.</toc-entry></toc></subsection></section><section commented="no" display-inline="no-display-inline" id="ide01005d2505241e98e720f4a0903be91"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="idc4465bbbf41549eebcaa01cc19493991"><enum>(1)</enum><header>Department of Hawaiian Home Lands</header><text>The term <term>Department of Hawaiian Home Lands</term> has the meaning given the term in section 801 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4221">25 U.S.C. 4221</external-xref>).</text></paragraph><paragraph id="idd97d785f959d4ae28f0e98cbfca3dd0a"><enum>(2)</enum><header>Domestic violence</header><text>The term <term>domestic violence</term> has the meaning given the term in section 40002(a) of the Violence Against Women Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/34/12291">34 U.S.C. 12291(a)</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1547fe64dcf04bbbb54cbcc075bfb7b5"><enum>(3)</enum><header display-inline="yes-display-inline">Federally recognized tribe; Indian area; Indian tribe; tribally designated housing entity</header><text>The terms <term>Federally recognized tribe</term>, <term>Indian area</term>, <term>Indian tribe</term>, and <term>tribally designated housing entity</term> have the meanings given those terms in section 4 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4103">25 U.S.C. 4103</external-xref>).</text></paragraph><paragraph id="id2f88fe45b37e45349d30e49ea346d3bc"><enum>(4)</enum><header>Hawaiian Home Lands</header><text>The term <term>Hawaiian Home Lands</term> means lands that—</text><subparagraph id="id8ea168f6c21b4f31b2d4b07d6c66284e"><enum>(A)</enum><text>have the status as Hawaiian home lands under section 204 of the Hawaiian Homes Commission Act, 1920 (42 Stat. 110); or</text></subparagraph><subparagraph id="ide73a14c885c2481ba108a46c629b64d8" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>are acquired pursuant to that Act.</text></subparagraph></paragraph><paragraph id="ideeefc3ee2b594e878e91fcb40643741d"><enum>(5)</enum><header>Homeless youth</header><text>The term <term>homeless youth</term> has the meaning given the term in section 387 of the Runaway and Homeless Youth Act (<external-xref legal-doc="usc" parsable-cite="usc/34/11279">34 U.S.C. 11279</external-xref>).</text></paragraph><paragraph id="id975c12df7abe4a1bb9e7cf7413c389bb"><enum>(6)</enum><header>Native Hawaiian</header><text>The term <term>Native Hawaiian</term> means any individual who is—</text><subparagraph id="ideb4267f07a274719bdc47e77da779489"><enum>(A)</enum><text>a citizen of the United States; and</text></subparagraph><subparagraph id="id640872cf3e3044d8ad89274c17d86abc"><enum>(B)</enum><text>a descendant of the aboriginal people, who, prior to 1778, occupied and exercised sovereignty in the area that currently constitutes the State of Hawaii, as evidenced by—</text><clause id="id8e503d06b45b48c6a40a5c754a98accd"><enum>(i)</enum><text>genealogical records;</text></clause><clause id="id6f5088bf5b9e476594a7b2c16bb6374f"><enum>(ii)</enum><text>verification by kupuna (elders) or kama'aina (long-term community residents); or</text></clause><clause id="id98de7030e6b54ead8d9bd31783cecaca"><enum>(iii)</enum><text>birth records of the State of Hawaii.</text></clause></subparagraph></paragraph><paragraph id="ide10fa8b4d6be43e6803a2c6a1d86130e"><enum>(7)</enum><header>Native Hawaiian organization; Native Hawaiian community-based organization</header><text>The terms <term>Native Hawaiian organization</term> and <term>Native Hawaiian community-based organization</term> have the meanings given those terms in section 6207 of the Native Hawaiian Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/7517">20 U.S.C. 7517</external-xref>).</text></paragraph><paragraph id="id16c087b99fdc40a9b58bf22c2026cd37"><enum>(8)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Housing and Urban Development.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide9280953719e4406822aed4812fcb46b"><enum>(9)</enum><header display-inline="yes-display-inline">Tribal organization</header><text>The term <term>tribal organization</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id193acef58c8b45b1aa306a0c3f268550"><enum>3.</enum><header>Flexibility for community compass technical assistance</header><text display-inline="no-display-inline">The Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4101">25 U.S.C. 4101 et seq.</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id2c849d901c0345388241463f52c1dd45"><enum>(1)</enum><text display-inline="yes-display-inline">in section 101 (<external-xref legal-doc="usc" parsable-cite="usc/25/4111">25 U.S.C. 4111</external-xref>), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idc695ca0a48fa4d3fa1567986f7acc581"><subsection id="id58aba075d64a4739af04e9f240a5b04a"><enum>(l)</enum><header>Technical assistance flexibility</header><text>Notwithstanding any requirement of the Community Compass Technical Assistance and Capacity Building Program, in approving technical assistance requests, the Secretary shall grant an Indian tribe or a tribally designated housing entity requesting such technical assistance maximum flexibility and deference when determining the allowable uses of such technical assistance funding.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1b3fef752eca4d58aa550fa8e40beea1"><enum>(2)</enum><text>in section 802 (<external-xref legal-doc="usc" parsable-cite="usc/25/4222">25 U.S.C. 4222</external-xref>), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="iddf57670891d141cfb2393c0fcd4fb702"><subsection id="idaadbcef9079a4de8b9003397ef1436f4"><enum>(f)</enum><header>Technical assistance flexibility</header><text>Notwithstanding any requirement of the Community Compass Technical Assistance and Capacity Building Program, in approving technical assistance requests, the Secretary shall grant the Department of Hawaiian Home Lands, or its subrecipients under subsection (e)(2), requesting such technical assistance maximum flexibility and deference when determining the allowable uses of such technical assistance funding.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="idE02FDBFCF1844903B34DE8822ED3A315"><enum>4.</enum><header>Consolidation of environmental review requirements</header><text display-inline="no-display-inline">Section 105 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4115">25 U.S.C. 4115</external-xref>) is amended—</text><paragraph id="id5605a99ff8364d05a402f1b871327db1"><enum>(1)</enum><text>in subsection (c)(2), by inserting <quote>, or a tribally designated housing entity official designated by the tribe,</quote> after <quote>tribe</quote>;</text></paragraph><paragraph id="ida84dc7f46d71406fb4cd3b15eeb99309"><enum>(2)</enum><text>in subsection (d)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb72b9150d11c4319af8eef8d956c4001"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (1) through (4) as subparagraphs (A) through (D), respectively, and adjusting the margins accordingly;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4fc61fb10e6941a3995db07153be6906"><enum>(B)</enum><text>by striking <quote>The Secretary may</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb7eae2a97c1a4081aacb341c44084613"><paragraph id="id006355e8ab7b4a81aa98d870b5b14bf8"><enum>(1)</enum><header>In general</header><text>The Secretary may</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8bd06caa27954087b265efd13b27fac0"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2b7cdf452a054f21bff1c64617fb81cf"><paragraph id="id58a528708bee4896b4a510f6d5f0183b"><enum>(2)</enum><header>Timeline</header><text>The Secretary shall act upon a waiver request submitted under this subsection not later than 60 days after receiving the request.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id67ab93fe389d4439a2db5810229db1f1"><enum>(3)</enum><text>by adding at the end of the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1371dc021d254a2ebe22b26b2c3720b5"><subsection id="idaa792deb6fa141cda0e96e62e11a0e6b"><enum>(e)</enum><header>Consolidation of environmental review requirements</header><paragraph commented="no" display-inline="no-display-inline" id="id5ca2d123df9b46d3be6f7807275b712a"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>With respect to a project carried out using amounts provided under this Act, including under title VIII of this Act or carried out by an Indian tribe, or under a grant made to an Indian tribe under title I of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5301">42 U.S.C. 5301 et seq.</external-xref>), the Indian tribe, recipient, or the Director of the Department of Hawaiian Homelands, as applicable, shall be deemed to be in compliance with the environmental review requirements under this section or section 806 of this Act, under title I of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5301">42 U.S.C. 5301 et seq.</external-xref>), and under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>), and the Indian tribe or the Director of the Department of Hawaiian Homelands, as applicable, shall be discharged from any applicable environmental review requirements that may apply to Federal agencies with respect to the use of additional Federal funding sources for that project, if—</text><subparagraph id="idb7872754bf7c44d485d2383048eccc4c"><enum>(A)</enum><text>a recipient is using 1 or more sources of Federal funds in addition to assistance provided under this Act or under title I of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5301">42 U.S.C. 5301 et seq.</external-xref>);</text></subparagraph><subparagraph id="id1c2be6f394eb4cbe8b1ee4f5ff74547c"><enum>(B)</enum><text>the sum of the other sources of Federal funds described in subparagraph (A) do not exceed 49 percent of the Federal share of the project cost; and</text></subparagraph><subparagraph id="id020c52a08312453eb27c17afdad4c5ab"><enum>(C)</enum><text>the recipient’s Indian tribe or the Director of the Department of Hawaiian Homelands, as applicable, has assumed all of the responsibilities for environmental review, decisionmaking, and action pursuant to this section, section 806 of this Act, or title I of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5301">42 U.S.C. 5301 et seq.</external-xref>), as applicable.</text></subparagraph></paragraph><paragraph id="id9427df11865c475aa1486ca322f32da9"><enum>(2)</enum><header>Effect</header><text>Upon completion of an environmental review for a project described in paragraph (1) in accordance with procedures established by the Secretary, as applicable, no other Federal agency providing additional Federal funds for the project shall be required to conduct a separate or supplemental environmental review for purposes of compliance with the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) or any other provision of Federal law described in paragraph (1), except to the extent that the project is materially changed in a manner that was not analyzed in the consolidated review.</text></paragraph></subsection><subsection id="iddb1be792f5914d6c8e3c425dc6b3de2b"><enum>(f)</enum><header>Environmental streamlining</header><text>With respect to a project carried using amounts provided under this Act, including under title VIII of this Act or grants made to an Indian tribe under title I of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5301">42 U.S.C. 5301 et seq.</external-xref>), each of the following applies:</text><paragraph id="id2ee85c1401764225aaa182196b9466c7"><enum>(1)</enum><header>General exemption</header><text>Notwithstanding any other provision of law, the following activities are exempt from any environmental review requirements:</text><subparagraph id="id5927f115398148ed9fe5965d5364977f"><enum>(A)</enum><text>An activity for which a similar statutory exemption applies to comparable activities carried out by another Federal agency.</text></subparagraph><subparagraph id="id33e18fced2464946a793620662d5a160"><enum>(B)</enum><text>An affordable housing activity with a total development cost of not more than $250,000.</text></subparagraph><subparagraph id="idcb52785cde434a229f8e0409e3c08bea"><enum>(C)</enum><text>An activity consisting solely of the acquisition of real property or long-term equipment using non-Federal funds.</text></subparagraph><subparagraph id="ida74df47d3ccf4c00b64089b752f6a941"><enum>(D)</enum><text>An activity consisting of the rehabilitation of an existing structure, if—</text><clause id="id4ae4d3912af942559426592ef1bc021a"><enum>(i)</enum><text>the cost of such rehabilitation is less than 50 percent of the market value of the structure before rehabilitation; and</text></clause><clause id="idf7388acacba8422fb538069a1c5240ee"><enum>(ii)</enum><text>the rehabilitation does not involve ground disturbance, an expansion or change in the footprint of the structure, or any work affecting a structure that is listed on the National Register of Historic Places.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide62024dc52804344bfead947e8d2bddf"><enum>(2)</enum><header>Determination by tribe</header><text>An Indian tribe that has assumed responsibility for environmental review, decisionmaking, and action pursuant to procedures established by the Secretary pursuant to subsection (e)(1)(C) shall make and document any determination that an activity qualifies for an exemption under this subsection, and such determination shall be deemed sufficient for purposes of compliance by any other Federal agency providing financial assistance for the activity.</text></paragraph><paragraph id="idbb6a3aa3418847eba061185f811468db"><enum>(3)</enum><header>Radon</header><subparagraph commented="no" display-inline="no-display-inline" id="idda57cde7d19c4838b3ed5662f10eaa53"> <enum>(A)</enum> <header display-inline="yes-display-inline">In general</header> <text>Notwithstanding any other provision of law, the Secretary may not require recipients, including the Director of the Department of Hawaiian Home Lands, and Indian tribes to consider or test for radon as part of the environmental review for the project.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide96804865a3d4202b3c1366da2582438"><enum>(B)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in subparagraph (A) shall be construed to limit the authority of a recipient or Indian tribe to consider, test for, or mitigate radon.</text></subparagraph></paragraph><paragraph id="id565b5883c3e54e349a0d164872d548e6"><enum>(4)</enum><header>Lead testing</header><subparagraph commented="no" display-inline="no-display-inline" id="id3ab0a3656d374a1eb2635646a986d6ab"><enum>(A)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this paragraph:</text><clause commented="no" display-inline="no-display-inline" id="id8e93b759b2ed48719c1d5c94a713cee1"> <enum>(i)</enum> <header>Remote area</header> <text>The term <term>remote area</term> means an area with a United States Postal Service ZIP Code that has a level 1 Frontier and Remote Area Code, as most recently posted on the website of the Department of Agriculture.</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="idd8a70202e1fd40eba19f199f29b6afee"><enum>(ii)</enum><header>Target housing</header><text>The term <term>target housing</term> means target housing, as defined in section 1004 of the Residential Lead-Based Paint Hazard Reduction Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/42/4851b">42 U.S.C. 4851b</external-xref>), that is assisted under this Act.</text></clause></subparagraph><subparagraph id="idc4e488c31acf48708241f02cbb0f6b39"><enum>(B)</enum><header>Testing</header><text>Lead paint testing of target housing that is in a remote area, and that is being rehabilitated, renovated, repaired, or painted in a manner that will repair or disturb building components that are painted or coated, shall be conducted through—</text><clause id="ida6ba8d0a0c8447d0aaa94f75ec9d7a3e"><enum>(i)</enum><text>paint chip testing, lead-based paint inspection, visual assessment for deteriorated paint, or a lead risk assessment for lead-based paint hazards, as applicable in accordance with section 302 of the Lead-Based Paint Poisoning Prevention Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4822">42 U.S.C. 4822</external-xref>); or</text></clause><clause id="id725044f17b644f62941f1e32d7abd64f"><enum>(ii)</enum><text>a visual assessment for deteriorated paint and use of lead test kits approved by the Environmental Protection Agency in accordance with section 402 or 404, as applicable, of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2682">15 U.S.C. 2682</external-xref>, 2684) on each building component that is painted or coated and is to be disturbed.</text></clause></subparagraph></paragraph><paragraph id="idd3c6d7256d11489db900078a8b315a8e"><enum>(5)</enum><header>Federal Flood Risk Management Standards</header><text>The project shall not be subject to the Federal Flood Risk Management Standards, and the Secretary shall revise regulations governing floodplain management and the protection of wetlands to exclude the Federal Flood Risk Management Standards from applying to such projects.</text></paragraph><paragraph id="idfbed7c644ce4490a9d0dd9b337930b19" commented="no"><enum>(6)</enum><header>Exemption from flood insurance requirements</header><text>Notwithstanding any provision of law, the Secretary may provide financial assistance for acquisition or construction purposes to Indian tribes and tribally designated housing entities under any program administered by the Secretary for a property that—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9a4be422729448a0a3e1d536ba0903b9"><enum>(A)</enum><text display-inline="yes-display-inline">is owned by the Indian tribe, tribally designated housing entity, tribal organization, or other Tribal entity; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide6fdaf47ec3b4458bcf5e163d97acde3"><enum>(B)</enum><text display-inline="yes-display-inline">is—</text><clause commented="no" display-inline="no-display-inline" id="id7944fa41b87346b69e8cc1594f875e82"><enum>(i)</enum><text display-inline="yes-display-inline">not covered by flood insurance; or</text></clause><clause commented="no" display-inline="no-display-inline" id="ide2f40746d63c488c9e05ed64d336a367"><enum>(ii)</enum><text display-inline="yes-display-inline">not located in a jurisdiction that participates in the national flood insurance program.</text></clause></subparagraph></paragraph><paragraph id="id642430973e034f9eba3c75946ecabd24"><enum>(7)</enum><header>Exemptions from certain separation distance requirements for projects from storage tanks</header><subparagraph commented="no" display-inline="no-display-inline" id="idd332826eeb5440fe8eb88ceebd86817f"><enum>(A)</enum><header display-inline="yes-display-inline">Residential tanks</header><text>A recipient, including the Director of the Department of Hawaiian Home Lands, carrying out activities under this Act or an Indian tribe carrying out activities under title I of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5301">42 U.S.C. 5301 et seq.</external-xref>) shall be exempt from the acceptable separation distance and mitigation requirements of the Secretary for residential tanks when the tank—</text><clause commented="no" display-inline="no-display-inline" id="id34e879ffdeb84948a76e7caa9a6a8f38"><enum>(i)</enum><text display-inline="yes-display-inline">has a capacity of not more than 1,320 gallons;</text></clause><clause id="idd70ef2c13e554b579cc4555b7dec063a"><enum>(ii)</enum><text>is intended to contain common liquid fuels such as gasoline, fuel oil, kerosene, diesel, liquified petroleum gas (propane), or crude oil;</text></clause><clause id="id5255d57ae9b64f34a22ca5c4068c4fce"><enum>(iii)</enum><text>is sited on land or property that contains a 1- to 4-family dwelling;</text></clause><clause id="id8862988ca90f4acdabb867ae76438a03"><enum>(iv)</enum><text>is intended to be used solely by residents of such dwelling; and</text></clause><clause id="idf77560264a6d404eb9647b385b76986c"><enum>(v)</enum><text>is intended to be used by residents of such dwelling exclusively for non-commercial, non-industrial purposes.</text></clause></subparagraph><subparagraph id="idcaa9d9ef822841f89640618b424f2cc2"><enum>(B)</enum><header>Rule of construction</header><text>Nothing in this paragraph shall be construed to limit the authority of a recipient, including the Director of the Department of Hawaiian Home Lands, or an Indian tribe to consider acceptable separation distance or implementation mitigation measures for residential tanks.</text></subparagraph><subparagraph id="idaf6b947aff914bc4a8fea5ec75efbe7e"><enum>(C)</enum><header>Above ground storage tanks</header><text>The acceptable separation distance requirements of the Secretary between a residential structure assisted by a recipient, including the Director of the Department of Hawaiian Home Lands, with funds under this Act (or assisted with funds under a grant to an Indian tribe under title I of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5301">42 U.S.C. 5301 et seq.</external-xref>)) and an above-ground storage tank used to store hazardous substances, as defined in subpart C of part 51 of title 24, Code of Federal Regulations, or any successor regulation, including mitigation measures, shall not apply if the recipient, including the Director of the Department of Hawaiian Home Lands, or Indian tribe determines that—</text><clause id="id1c2016e9ed7e47b0a507c1c775436af6"><enum>(i)</enum><text>the application of the requirements would prevent or materially impede the ability of the recipient or Indian tribe to address its housing needs;</text></clause><clause id="id40a489f0676a4116a6e268087c8b5c5d"><enum>(ii)</enum><text>the use of an alternative standard, or the absence of a standard, will not present an unacceptable risk to the health or safety or residents; and</text></clause><clause id="id3799ef97587b42478f7616882c092532"><enum>(iii)</enum><text>the recipient or Indian tribe has—</text><subclause id="id8632ee0f96c345af9e4e9adb9ce5adbc"><enum>(I)</enum><text>provided notice and an opportunity for comment to residents of the affected area regarding the proposed inapplicability of the requirements; and</text></subclause><subclause id="id9200bcaebd62478eb0de4ecc0593e3d3"><enum>(II)</enum><text>developed and adopted a safety and response plan addressing the potential risks associated with an above ground storage tank.</text></subclause></clause></subparagraph><subparagraph id="id8af021ea02b8436dbc8b2c2accafc0fe"><enum>(D)</enum><header>Rule of construction</header><text>Nothing in this paragraph shall be construed to limit the authority of a recipient, including the Director of the Department of Hawaiian Home Lands, or an Indian tribe to consider, adopt, or enforce acceptable separation distance standards or implement mitigation measures for risks associated with above ground storage tanks.</text></subparagraph></paragraph><paragraph id="idfc8b28b366b0404cb2cbe95f2157995a"><enum>(8)</enum><header>Wetland requirements</header><text>The Secretary may not apply additional requirements involving protection of wetlands in instances where—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf4cc39e4bda543bfaa28585c308c2d14"><enum>(A)</enum><text display-inline="yes-display-inline">an affected wetland requires a U.S. Army Corps of Engineers General, regional, or individual permit; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idac96aeb88d664fda94b0e45f60a98cee"><enum>(B)</enum><text display-inline="yes-display-inline">the recipient, including the Director of the Department of Hawaiian Home Lands, or Indian tribe complies with the conditions of the permit.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id4CCA2D637FF44A539A08CD81976BBF06"><enum>5.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">Section 108 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4117">25 U.S.C. 4117</external-xref>) is amended, in the first sentence, by striking <quote>2009 through 2013</quote> and inserting <quote>2027 through 2033</quote>.</text></section><section id="id03d90995a53947d0a1dbe9ad07f69737"><enum>6.</enum><header>Eligible families</header><text display-inline="no-display-inline">The Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4101">25 U.S.C. 4101 et seq.</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id713e1ece31d84f4ea679bb0b42ca6f5e"><enum>(1)</enum><text display-inline="yes-display-inline">by amending section 201(b)(3) (<external-xref legal-doc="usc" parsable-cite="usc/25/4131">25 U.S.C. 4131(b)(3)</external-xref>) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id96207b1aeaa24fd0964187da422d5503"><paragraph id="id142df4230ba340f7a8377a5c9683a6b6"><enum>(3)</enum><header>Other families</header><subparagraph id="id1a7d2a4d8f1747ba97bec6b8a9b99745"><enum>(A)</enum><header>Essential families</header><text>Notwithstanding paragraph (1), a recipient may provide housing or housing assistance provided through affordable housing activities assisted with grant amounts under this Act for a family on an Indian reservation or other Indian area if the recipient determines that—</text><clause commented="no" display-inline="no-display-inline" id="id3295b45bd3b147fda5bdeb1f2e268e70"><enum>(i)</enum><text display-inline="yes-display-inline">the presence of the family on the Indian reservation or other Indian area is essential to the well-being of Indian families; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id1c5bfd86ce3e44d1b477763e0b5c36fe"><enum>(ii)</enum><text display-inline="yes-display-inline">the need for housing for the family cannot reasonably be met without such assistance.</text></clause></subparagraph><subparagraph id="id2a9d6de3d5814516904be4361a08bc22"><enum>(B)</enum><header>Homeownership assistance</header><text>Notwithstanding paragraph (1), a recipient may provide assistance for homeownership activities under section 202 or title VI of this Act with grant amounts under this Act for Indian families with a household income that does not exceed 120 percent of the median income for the area, as determined by the Secretary, and such housing shall be considered affordable housing for purposes of this Act, provided a recipient shall not use more than 50 percent of its annual grant under this Act to serve such families.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id92f60047a39c4048a17086942d15fb94"><enum>(2)</enum><text>in section 809(a)(2) (<external-xref legal-doc="usc" parsable-cite="usc/25/4228">25 U.S.C. 4228(a)(2)</external-xref>), by amending subparagraph (B) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id06b5787567aa480aa13d5aa4893e48a3"><subparagraph id="id371e0fbee59d4e6b9f28e4bfdc81f7b4"><enum>(B)</enum><header>Exception to low-income requirement</header><clause id="idec63259ba8e34fcf8fcb14e203564549"><enum>(i)</enum><header>In general</header><text>The Director may provide assistance for homeownership activities under—</text><subclause id="ida25bbe45090941c2b5e16017cc139cad"><enum>(I)</enum><text>section 810(b) for Native Hawaiian families with a household income that does not exceed 120 percent of the median income for the area, as determined by the Secretary, and such housing shall be considered affordable housing for purposes of this title; or</text></subclause><subclause id="id6668ddb1df3c4cf1b4eac84552a44ad8"><enum>(II)</enum><text>loan guarantee activities under section 184A of the Housing and Community Development Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/12/1715z-13b">12 U.S.C. 1715z–13b</external-xref>) to Native Hawaiian families who are not low-income families, to the extent that the Secretary approves the activities under that section to address a need for housing for those families that cannot be reasonably met without that assistance.</text></subclause></clause><clause id="id95871e2dbf704197b04934ce71f27c8d"><enum>(ii)</enum><header>Limitation</header><text>The Director shall not use more than 50 percent of a grant provided under this title to serve families described in clause (i)(I).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="idF7ABF8A917D84D2F8E657E069B3FE1A5"><enum>7.</enum><header>Student housing assistance</header><text display-inline="no-display-inline">Section 202(3) of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4132">25 U.S.C. 4132(3)</external-xref>) is amended by inserting <quote>including college housing assistance,</quote> after <quote>self-sufficiency and other services,</quote>.</text></section><section id="idA9841BA26A7C4212B62ACF1D0A7C9044"><enum>8.</enum><header>Clarification of application of rent rule to units owned or operated by Indian tribe or tribally designated housing entity</header><text display-inline="no-display-inline">Section 203(a) of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4133">25 U.S.C. 4133(a)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id44b70b7271e04b25a02981bf8617b946"><enum>(1)</enum><text>in paragraph (2), by inserting <quote>owned or operated by a recipient and</quote> after <quote>residing in a dwelling unit</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfc3e018022eb49bfa341ae7e8b145720"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id67e8204b7b36432da6029bc2361fe03b"><paragraph commented="no" display-inline="no-display-inline" id="idf10aad120d15474d884d045cc1d36e32"><enum>(3)</enum><header>Self-determination</header><text>Notwithstanding paragraph (2), each recipient may establish its own policies governing maximum and minimum rents and homebuyer payments for dwelling units assisted under this Act, including rents and homebuyer payments that exceed 30 percent of the monthly adjusted income, provided that the policies are written and made publicly available.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id4B53ABD7957C48188E0FE725216D4F84"><enum>9.</enum><header>De minimis exemption for procurement of goods and services</header><text display-inline="no-display-inline">Section 203(g) of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4133">25 U.S.C. 4133(g)</external-xref>) is amended by striking <quote>$5,000</quote> and inserting <quote>150 percent of the micro-purchase threshold set forth in section 200.320 of title 2, Code of Federal Regulations, or any successor regulation</quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id95c6930afbf84e7b9207f14b1b5e3ca9"><enum>10.</enum><header>Procurement policies</header><text display-inline="no-display-inline">Section 203 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4133">25 U.S.C. 4133</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id971504f9a4ae438199e30332bffebbc3"><subsection id="id8d984bfe7ca644ff82e62e2ae6c12258"><enum>(h)</enum><header>Tribal procurement policies</header><paragraph commented="no" display-inline="no-display-inline" id="idf8e705aa2ac542779c39fd5bf4d97b71"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Notwithstanding any other provision of law, including subsection (g), a recipient may adopt its own policies and procedures governing the procurement of goods and services using amounts provided under this Act.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida42c1d8114c14d6a8ad973aef931aaf1"><enum>(2)</enum><header>Form</header><text>A recipient with its own policies and procedures described in paragraph (1) shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id3b91cbc5606f4c4fb6f190e33ec8c624"><enum>(A)</enum><text display-inline="yes-display-inline">make the policies and procedures written and publicly available; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc3a4d707b5f74297acd796f9cf90ad0e"><enum>(B)</enum><text>follow those policies and procedures.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0b7c6f5708334963805bc3e50f283cea"><enum>(3)</enum><header>Default</header><text>If a recipient does not adopt its own policies and procedures under paragraph (1), the recipient shall be subject to the procurement standards applicable to Indian tribes in accordance with section 200.317 of title 2, Code of Federal Regulations, or any successor regulation.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="ida6235aaf-ae12-4df9-b89f-5f680682e631"><enum>11.</enum><header>Total development cost maximum cost</header><text display-inline="no-display-inline">Section 203 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4133">25 U.S.C. 4133</external-xref>), as amended by this Act, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD4302262E3704EF08AB8D1D5602963DB"><subsection commented="no" display-inline="no-display-inline" id="idf05f3f2968074428a0e6a79e77263249"><enum>(i)</enum><header>Total development cost maximum cost</header><text display-inline="yes-display-inline">Affordable housing that is developed, acquired, or assisted under the block grant program established under section 101 shall not exceed by more than 20 percent, without prior approval of the Secretary, the total development cost maximum cost for all housing assisted under an affordable housing activity, including development and model activities.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HEB409191693A4CC5B7125246B602FE99"><enum>12.</enum><header>Homeownership or lease-to-own low-income requirement and income targeting</header><text display-inline="no-display-inline">The Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4101">25 U.S.C. 4101 et seq.</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id2d6e715c4a074624805eb1319cc3cdf2"><enum>(1)</enum><text display-inline="yes-display-inline">in section 205 (<external-xref legal-doc="usc" parsable-cite="usc/25/4135">25 U.S.C. 4135</external-xref>)—</text><subparagraph id="H946C5A2E2E9F40BE91B45B71993F56F5"><enum>(A)</enum><text>in subsection (a)(1)—</text><clause id="H83560CE862454C77B7F2828C2C095A73"><enum>(i)</enum><text>in subparagraph (C), by striking <quote>and</quote> at the end; and</text></clause><clause id="HF8DCB63AB40247C78B2451F652F2D7BE"><enum>(ii)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HF59AE0D93F63462C8D66CDE133726B00" style="OLC"><subparagraph id="H1A045497A2D940208F607DFC4C12F3BD"><enum>(E)</enum><text display-inline="yes-display-inline">notwithstanding any other provision of this paragraph, in the case of rental housing that is made available to a current rental family for conversion to a homebuyer or a lease-purchase unit, that the current rental family can purchase through a contract of sale, lease-purchase agreement, or any other sales agreement, is made available for purchase only by the current rental family, if the rental family was a low-income family at the time of their initial occupancy of such unit; and</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8E2F338842FC48D5ADB4CC611577272E"><enum>(B)</enum><text>in subsection (c)—</text><clause commented="no" display-inline="no-display-inline" id="id6AF2F1BA9A3443D492036E29F5CC65EC"><enum>(i)</enum><text>by striking <quote>The provisions</quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="idBBD95AB84D214D019EC0A60E5A15762D" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="idF9BFA9D5855441BFA1B41DF75CCA2620"><enum>(1)</enum><header>In general</header><text>The provisions</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause commented="no" display-inline="no-display-inline" id="idFECD66631ADA4D219A583C4857DCD869"><enum>(ii)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id9A34E8CF48EA4A158201387B39DD44F1" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="idC4729A37CF3048EC9C7D4B2DDE2FC127"><enum>(2)</enum><header>Applicability to improvements</header><text>The provisions of subsection (a)(2) regarding binding commitments for the remaining useful life of property shall not apply to improvements of privately owned homes if the cost of the improvements do not exceed 10 percent of the maximum total development cost for the home.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id45f31e6f965642ae9a3414fc18d464d2"><enum>(2)</enum><text>in section 813(a) (<external-xref legal-doc="usc" parsable-cite="usc/25/4232">25 U.S.C. 4232(a)</external-xref>)—</text><subparagraph id="idcf0f411fdc77485c886fe66d2277de71"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="id43cc603e16894a5499e34948d2bf2102"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>and</quote> at the end; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idde860c93abe243aa8a4868540d59ba8e"><enum>(ii)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1b17ec2883674bcd9d219809b359d0c6"><subparagraph id="idb69933c3282840e29fef04edf9bba34d" commented="no"><enum>(C)</enum><text>notwithstanding any other provision of this paragraph, in the case of rental housing that is made available to a current rental family for conversion to a homebuyer or a lease-purchase unit, the current rental family can purchase through a contract of sale, lease-purchase agreement, or any other sales agreement, is made available for purchase only by the current rental family, if the rental family was a low-income family at the time of their initial occupancy of such unit; and</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id21c6075828554ac0b6496aaba7c5e241" commented="no"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4efc87e275ec477fbba7e1406838cb5f"><paragraph id="id589e4190d52d4bf7b817b995aee6cd63" commented="no"><enum>(3)</enum><header>Applicability to improvements</header><text>The provisions of subsection (a)(2) regarding binding commitments for the remaining useful life of property or other period as determined by the Secretary shall not apply to improvements of privately owned homes if the cost of the improvements do not exceed 10 percent of the maximum total development cost for the home.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="idd1f94e02-2688-4042-9595-e6bc2f90d65c"><enum>13.</enum><header>Lease requirements and tenant selection</header><text display-inline="no-display-inline">Section 207 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4137">25 U.S.C. 4137</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id673e8180-7777-47a2-9e7d-168e1fd55a66" style="OLC"><subsection id="id3d0eb521-2b09-49fe-b5ab-825c856f7ea0"><enum>(c)</enum><header>Notice of termination</header><text display-inline="yes-display-inline">The notice period described in subsection (a)(3) shall apply to projects and programs funded in part by amounts authorized under this Act.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" display-inline="no-display-inline" id="id3886ac78f838490aacc56df8bbd5bf00"><enum>14.</enum><header>Housing counseling certification exemption</header><subsection commented="no" display-inline="no-display-inline" id="id4a6ac5a8752245599b3a44741923deb2"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>Subtitle A of title II of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4131">25 U.S.C. 4131 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id54b7548e5c2547dd9f75ee5eb906a830"><section id="id9dff052d9c99484c95fca9d1311799a5" commented="no"><enum>211.</enum><header>Housing counseling certification exemption</header><subsection commented="no" display-inline="no-display-inline" id="ided1f8d2318c44458b3f4669aa0477436"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding section 106(g)(1) of the Housing and Urban Development Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/12/1701x">12 U.S.C. 1701x(g)(1)</external-xref>), Indian tribes, Tribal organizations, tribally designated housing entities, and the Department of Hawaiian Home Lands carrying out homeownership counseling or rental housing counseling under section 105(a)(20) of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5305">42 U.S.C. 5305(a)(20)</external-xref>) or section 202(3) or 810(b)(2)(A) of this Act may not be required to comply with any housing counseling certification requirements established by the Secretary.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="ida0e61882254049bc9a5d376fe6a0c423"><enum>(b)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to limit the ability of an entity described in subsection (a) to obtain a housing counseling certification from the Secretary.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id02e6b439426a4931a19d94707d3dfcd4"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of contents in section 1(b) of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="public-law" parsable-cite="pl/104/330">Public Law 104–330</external-xref>; 110 Stat. 4016) is amended by inserting after the item relating to section 210 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idd1a0f41cb048460f82b4b9aeabf0fe1b"><toc><toc-entry level="section" bold="off">Sec. 211. and</text></paragraph><paragraph id="id800BC1CA1AD14B7F83E3D6840809FF67"><enum>(2)</enum><text>by striking subparagraph (B) and inserting the following:</text><quoted-block id="id715615E52360443F86DE4C3C5DDDC55E" display-inline="no-display-inline" style="OLC"><subparagraph id="id08EC8ABABCD34459BBC238D55F787073"><enum>(B)</enum><header>Procedural requirements</header><clause id="idA86A59303B1B4712A881DE0D3475EC65"><enum>(i)</enum><header>In general</header><text>If the Secretary takes an action described in subparagraph (A), the Secretary shall provide notice to the recipient at the time that the Secretary takes that action.</text></clause><clause id="id94D90F8AC2AC4BC587B2728D5E946841" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><header>Notice requirements</header><text>The notice under clause (i) shall inform the recipient that the recipient may request a hearing by not later than 30 days after the date on which the Secretary provides the notice.</text></clause><clause commented="no" display-inline="no-display-inline" id="idA8D8BF274C234C888ACEC6087B5548B5"><enum>(iii)</enum><header>Hearing requirements</header><text>A hearing requested under clause (ii) shall be conducted—</text><subclause commented="no" display-inline="no-display-inline" id="idD91DC03B42504959BDE5762981FB783B"><enum>(I)</enum><text>in accordance with subpart A of part 26 of title 24, Code of Federal Regulations (or successor regulations); and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id975878A1484946EF8EF1022F4E0F12C9"><enum>(II)</enum><text>to the maximum extent practicable, on an expedited basis.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id0465802BACD64803A6D05B10CE484141"><enum>(iv)</enum><header>Failure to conduct a hearing</header><text>If a hearing requested under clause (ii) is not completed by the date that is 180 days after the date on which the recipient requests the hearing, the action of the Secretary to limit the availability of payments shall no longer be effective.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section commented="no" display-inline="no-display-inline" id="id3adb0cc0b4b04b20a90920c7be9e5316"><enum>16.</enum><header>Streamlining reporting requirements</header><text display-inline="no-display-inline">Section 404 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4164">25 U.S.C. 4164</external-xref>) is amended—</text><paragraph id="id26ff7772ac564769afec72e2e04a5fe3"><enum>(1)</enum><text>by redesignating subsection (d) as subsection (e); and</text></paragraph><paragraph id="id431deeeb6a6f42b2818ab055e03b1aeb"><enum>(2)</enum><text>by inserting after subsection (c) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id005222bc8be444f8879d1e5878e0dad0"><subsection id="id44cb86590bc645c0a40f82280e422249"><enum>(d)</enum><header>Consolidated reporting</header><text>Notwithstanding any other provision of law, the Secretary shall develop policies and procedures that authorize interested Indian tribes and tribally designated housing entities receiving grant amounts under this Act to submit to the Secretary, at their discretion, 1 consolidated annual performance report covering all grants the Indian tribe or tribally designated housing entity receives under this Act and from other grant programs administered by the Secretary.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id60fa4018-f693-4486-ac49-18bf041983d3"><enum>17.</enum><header>Reports to Congress</header><text display-inline="no-display-inline">The Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4101">25 U.S.C. 4101 et seq.</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="ide1a979ec44c142829e4f4ade1f0809d2"><enum>(1)</enum><text display-inline="yes-display-inline">in section 407 (<external-xref legal-doc="usc" parsable-cite="usc/25/4167">25 U.S.C. 4167</external-xref>)—</text><subparagraph id="id34e81ecf-a1f9-40ad-b998-e35dc23b1536"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (a), in the matter preceding paragraph (1)—</text><clause commented="no" display-inline="no-display-inline" id="idf8aae40681644c83bca9e4cc5cf006b7"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>90</quote> and inserting <quote>180</quote>; and</text></paragraph><paragraph id="idd4a4eeef71d342b2a88e6c01093ae8bf"><enum>(3)</enum><text>in subsection (c)(2), by striking <quote>50 years</quote> and inserting <quote>99 years</quote>.</text></paragraph></section><section id="ida6e7efdccc054caca580155442becde8"><enum>19.</enum><header>Innovative readiness training program coordination</header><subsection commented="no" display-inline="no-display-inline" id="idc311bd3cb1df43c0b38d3f9ef7d4fdd1"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Title VII of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4211">25 U.S.C. 4211 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id44e90c10e23c4853aa430ea08f1dcb19"><section id="idebb8d65b6ff741d0af22fa0ae0cf8fce"><enum>706.</enum><header>Innovative readiness training program coordination</header><subsection id="ida66b240aba0a4a2a9f117e91ad1b95dc"><enum>(a)</enum><header>Coordination requirement</header><text>The Secretary shall coordinate with the Secretary of Defense, and with Indian tribes and tribally designated housing entities that are recipients of funds under this Act, to maximize the benefit of the Department of Defense’s Innovative Readiness Training Program (in this section referred to as the <quote>Program,</quote>), when the Program conducts civil engineering and construction activities in partnership with recipients of formula and competitive block grant funds made available under title I.</text></subsection><subsection id="id1f7fdb5fdd1a44479e9157cda98b3621"><enum>(b)</enum><header>Maximizing benefit</header><text>The coordination under subsection (a) shall include—</text><paragraph id="id2551562f89614414a5076d7e436be174"><enum>(1)</enum><text>the development of a joint Memorandum of Understanding between the Department of Housing and Urban Development and the Department of Defense to streamline the identification of suitable construction projects under this Act;</text></paragraph><paragraph id="idda0b23ceb0fe4c69aa9824545f48d58d"><enum>(2)</enum><text>the synchronization of project planning and execution to ensure that Program construction activities directly support the affordable housing goals and priorities identified in a housing plan submitted under section 102; and</text></paragraph><paragraph id="id19cfd3a02aeb4a6496381661e9fb8927"><enum>(3)</enum><text>the identification and communication of best practices to Indian tribes for leveraging Program resources, including guidance on project eligibility and application processes.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id70715932360041bc9895cf3925117dea"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of contents in section 1(b) of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="public-law" parsable-cite="pl/104/330">Public Law 104–330</external-xref>; Act.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="idF220514F4FAB41F88687B825D7D071A4"><enum>21.</enum><header>Reauthorization of housing assistance for Native Hawaiians</header><text display-inline="no-display-inline">Section 824 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4243">25 U.S.C. 4243</external-xref>) is amended by striking <quote>such sums as may be necessary</quote> and all that follows through the period at the end and inserting <quote>such sums as may be necessary for each of fiscal years 2027 through 2033.</quote>.</text></section><section id="id67A0619CD94D46D4B32328468831C43B"><enum>22.</enum><header>Community-based development organizations and special activities by Indian tribes</header><text display-inline="no-display-inline">Section 105 of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5305">42 U.S.C. 5305</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1444419EEAF14DBD8C8E17A04BAC9C80"><subsection id="idf1645593fe674a7d9bdcb1041c21d6fe"><enum>(i)</enum><header>Special activities by Indian tribes</header><paragraph commented="no" display-inline="no-display-inline" id="idec8918204ac644d5b07612197324ffda"><enum>(1)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this paragraph:</text><subparagraph commented="no" display-inline="no-display-inline" id="id113592d736354b0fa24b6c0ad4b3f1da"><enum>(A)</enum><header>Tribal organization</header><text>The term <term>tribal organization</term> has the meaning the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6f2279c7fa644e6289db76d8781a7164"><enum>(B)</enum><header display-inline="yes-display-inline">Tribally designated housing entity</header><text display-inline="yes-display-inline">The term <term>tribally designated housing entity</term> has the meaning given the term in section 4 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4103">25 U.S.C. 4103</external-xref>).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7612f7da77904e9d8c38592bd65224e5"><enum>(2)</enum><header>Authorization</header><text display-inline="yes-display-inline">An Indian tribe (or a tribal organization or tribally designated housing entity designated by the Indian tribe) receiving a grant under section 106(a)(1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id4c4fe78f178a4b95bf4430f8cc02f4a3"><enum>(A)</enum><text display-inline="yes-display-inline">is authorized to directly carry out activities described in section 106(a)(15), including the new construction of affordable housing; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9febf648653e4766ac878b4f0b7fc241"><enum>(B)</enum><text>may not be subject to any limitation on the percentage of the grant that may be used to carry out the activities described in subparagraph (A).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id526ac0ad268e45fab704ffd06e05d655"><enum>23.</enum><header>Eligibility for housing counseling grants</header><text display-inline="no-display-inline">Section 106(a)(4) of the Housing and Urban Development Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/12/1701x">12 U.S.C. 1701x(a)(4)</external-xref>) is amended—</text><paragraph id="id4eaac46ff0e64410bddfc08fabc747be"><enum>24.</enum><header>Section 184 Indian Home Loan Guarantee program</header><subsection id="id49B5F692DD984CD98FFFE21ECE852043"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 184 of the Housing and Community Development Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/12/1715z-13a">12 U.S.C. 1715z–13a</external-xref>) is amended—</text><paragraph id="id389E2EC8DC0D4E56BE9D8A58448E743D"><enum>(1)</enum><text display-inline="yes-display-inline">by amending subsection (a) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2e19f4e655874e4aac19443004ecd303"><subsection id="id4319a8f987a34a67b2e6bc26fd970382"><enum>(a)</enum><header>Authority</header><text>To provide access to sources of private financing to Indian families, Indian housing authorities, and Indian tribes, who otherwise could not acquire housing financing because of the unique legal status of Indian lands and the unique nature of tribal economies, and to expand homeownership opportunities to Indian families, tribally designated housing entities, Indian housing authorities, and Indian tribes on fee simple lands, the Secretary may guarantee not to exceed 100 percent of the unpaid principal and interest due on any loan eligible under subsection (b) made to an Indian family, tribally designated housing entity, Indian housing authority, or Indian tribe on trust land and fee simple land.</text></subsection><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="id35D317DC2CBA412788F504FEAA067F9F"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="id94DF91BD8AC9435B8022DD1762528F2F"><enum>(A)</enum><text>by amending paragraph (2) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id77a78fcb51614019a6a96d90c92064a0"><paragraph id="idfa2329e4ddfa4fba86e9a71313da9c52"><enum>(2)</enum><header>Eligible housing</header><text>The loan shall be used to construct, acquire, refinance, or rehabilitate 1- to 4-family dwellings that are standard housing.</text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph><subparagraph id="id4C7BF2DD1EE04CC09A971200E90C82A6"><enum>(B)</enum><text>in paragraph (4)—</text><clause id="id15531ea2fb4d4c32a9befcb0fb8d7c15"><enum>(i)</enum><text>by redesignating subparagraphs (A) through (D) as clauses (i) through (iv), respectively, and adjusting the margins accordingly;</text></clause><clause id="idA54697401E5A4C4A942B307D5CEF983C"><enum>(ii)</enum><text>by striking <quote>The loan</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id25B45F63DE19416688CE2E5994E919E2"><subparagraph id="id29575FDCFA4841EDB7F972B008659679"><enum>(A)</enum><header>In general</header><text>The loan</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause id="idedc32f7a399841b4b626fd6253caffb0"><enum>(iii)</enum><text>in subparagraph (A), as so designated, by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8589f99f2d8442ceb2688b71c82613f6"><clause id="id5b8f78abd888454bbbf239ce98320314"><enum>(v)</enum><text>Any other lender that is supervised, approved, regulated, or insured by any agency of the Federal Government, including any entity certified as a community development financial institution by the Community Development Financial Institutions Fund established under section 104(a) of the Riegle Community Development and Regulatory Improvement Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/12/4703">12 U.S.C. 4703(a)</external-xref>).</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="iddcd822b881bb4411b57ad6b094db6fb0"><enum>(iv)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id33a7a68daeed456f839e13ffeadd0514"><subparagraph id="id8fdbf417c044444fbe4b4fceee829fd8"><enum>(B)</enum><header>Direct guarantee endorsement process and indemnification</header><clause id="id4EC2EE5E34AD42EE98EBA3C1BE7AB5D9"><enum>(i)</enum><header>Authorization</header><text>The Secretary may, dependent on the available systems development and staffing resources, delegate to eligible lenders the authority to directly endorse loans under this section.</text></clause><clause id="id6642CD857AAA45CC8E1124D72DA991A3"><enum>(ii)</enum><header>Indemnification</header><subclause id="idB78A9D0558D045469DE23CBCF8093C27"><enum>(I)</enum><header>In general</header><text>If the Secretary determines that a loan guaranteed under this section was not originated in accordance with the requirements established by the Secretary, the Secretary may require the lender approved under this subparagraph to indemnify the Secretary for the loss or potential loss, irrespective of whether the violation caused or will cause the loan default. </text></subclause><subclause id="idE6D47ED358CF4B8AA2D4A1A2ED2D3F75"><enum>(II)</enum><header>Fraud or misrepresentation</header><text>If fraud or misrepresentation is involved in a loan guaranteed under this section, the Secretary may require the originating lender approved under this subparagraph to indemnify the Secretary for the loss regardless of whether there was a payment made by the Secretary under the guarantee.</text></subclause><subclause id="id2fe37b3ed74049698396af4eec2ca4b0"><enum>(III)</enum><header>Implementation</header><text>The Secretary may implement any requirement described in this subparagraph by regulation, notice or Dear Lender Letter. </text></subclause></clause></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida102322d2e714e7a970de3f0d02391b2"><enum>(C)</enum><text display-inline="yes-display-inline">in paragraph (5)(A), by inserting before the semicolon at the end the following: <quote>except, as determined by the Secretary, when there is a loan modification under subsection (h)(1)(B), the term of the loan shall not exceed 40 years</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide26146db2da1480a934756af56f05948"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9845a80c550e48ada66c41443ba88a00"><paragraph id="ida2c89164425342168fa33a416be4d506"><enum>(6)</enum><header>Review of lenders</header><subparagraph id="id0D674EF8A848447CBC0BE1989AC7E4BA"><enum>(A)</enum><header>In general</header><text>The Secretary may periodically review the lenders originating, underwriting, or servicing single family mortgage loans under this section. </text></subparagraph><subparagraph id="id71FEEC74D4134CD9AF1A5955EA5CE1FB"><enum>(B)</enum><header>Requirements</header><text>In conducting a review under subparagraph (A), the Secretary—</text><clause id="id5c24e5bbcb604fc492162e3ef5da8d37"><enum>(i)</enum><text>shall compare the lender with other lenders originating or underwriting loan guarantees for Indian housing based on the rates of defaults and claims for guaranteed loans originated, underwritten, or serviced by that lender; and</text></clause><clause id="id4442d83b290c4344bfa317dc4d68272c"><enum>(ii)</enum><text>may compare the lender with such other lenders based on underwriting quality, geographic area served, or any commonly used factors the Secretary determines necessary for comparing mortgage default risk, provided that the comparison is of factors that the Secretary would expect to affect the default risk of mortgage loans guaranteed by the Secretary.</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id14834981721546baa3edcb58c872ca13"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (c)—</text><subparagraph id="id930bf4d4e9fc4c0c845bf9ed99d187de"><enum>(A)</enum><text>in paragraph (1)—</text><clause commented="no" display-inline="no-display-inline" id="ida7cfeb551a18467ea8b538bb1b9aa85a"><enum>(i)</enum><text>by striking <quote>Before</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7dd32676d9e442c2bbc21dccf6d52285"><enum>(ii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2fe93bc0209e43b49a00010f34ca0dad"><subparagraph id="id59fc569353834a058fc15977df2ab122"><enum>(B)</enum><header>Exception</header><text>Subparagraph (A) shall not apply when the Secretary exercises its discretion to delegate direct guarantee endorsement authority to eligible lenders under subsection (b)(4)(B)(i).</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="idb684bb5d7a6343fda8abf8ed3f5af3e0"><enum>(B)</enum><text>in paragraph (2)—</text><clause commented="no" display-inline="no-display-inline" id="idAAB6E4D0E38147579863FF6E54CD6B09"><enum>(i)</enum><text>by striking <quote>The Secretary</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1B82CC4DB9164591825C49A4922A9E5C"><subparagraph commented="no" display-inline="no-display-inline" id="id7A8E1522A1FE4002AB61963A716EFDF4"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the Secretary</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause commented="no" display-inline="no-display-inline" id="id56084F1CFE194CD2BCF95F96EEF1F988"><enum>(ii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id434581B3FC1446FDAF360FA1BF18321C"><subparagraph id="id7ACFD1B4EFF840DC9906728C2854DE58"><enum>(B)</enum><header>Exceptions</header><text>When the Secretary exercises its discretion to delegate direct guarantee endorsement authority to eligible lenders under subsection (b)(4)(B)(i)—</text><clause commented="no" display-inline="no-display-inline" id="id548518be95114937ac096cb3dce5f311"><enum>(i)</enum><text display-inline="yes-display-inline">subparagraph (A) shall not apply; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id2b931a1ca6cf4f98b762249368ddf08f"><enum>(ii)</enum><text display-inline="yes-display-inline">the direct guarantee endorsement lender may issue a certificate under this paragraph as evidence of the guarantee in accordance with requirements established by the Secretary.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="idaffdf67069e8486d8f5b5b58e74b899d"><enum>(C)</enum><text>in paragraph (3), by inserting <quote>, or where applicable, the direct guarantee endorsement lender,</quote> after <quote>Secretary</quote> in each place that term appears; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8a1da7adcf8c4667b01b9c8c570b63ee"><enum>(4)</enum><text>in subsection (l)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idaa45a4cb84c6445e9390331d991ad04d"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (8) and (9) as paragraphs (9) and (10), respectively; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id76f8eb519fd0441dbfe4a37d575eefaf"><enum>(B)</enum><text>by inserting after paragraph (7) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE8B4B152F3754C0B824375D59FE1AFEF"><paragraph commented="no" display-inline="no-display-inline" id="idda0269058bde4531a497ccf6fd811318"><enum>(8)</enum><text>The term <term>tribally designated housing entity</term> has the meaning given the term in section 4 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4103">25 U.S.C. 4103</external-xref>).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H954D80D03FEB492FBF6B874FF6B10776"><enum>(b)</enum><header>Loan guarantees for Indian housing</header><text display-inline="yes-display-inline">Section 184(i)(5) of the Housing and Community Development Act of 1992 (12 U.S.C. 1715z–13a(i)(5)) is amended—</text><paragraph id="H3AB9FEB819FE41B997DB6BC670E088A5"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (B), by inserting after the first sentence the following: <quote>There are authorized to be appropriated for those costs such sums as may be necessary for each of fiscal years 2027 through 2033.</quote>; and</text></paragraph><paragraph id="HCA085B92DBEB402196722660AF0B2E40" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (C), by striking <quote>2008 through 2012</quote> and inserting <quote>2027 through 2033</quote>.</text></paragraph></subsection></section><section id="id6fd89f118e734058a12cdfec68f2f3f8"><enum>25.</enum><header>Loan guarantees for Native Hawaiian housing</header><text display-inline="no-display-inline">Section 184A of the Housing and Community Development Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/12/1715z-13b">12 U.S.C. 1715z–13b</external-xref>) is amended—</text><paragraph id="id2248fa3ab4c0410cadd70106f0c52dd7"><enum>(1)</enum><text>in subsection (b), by inserting <quote>, and to expand homeownership opportunities to Native Hawaiian families who are eligible to receive a homestead under the Hawaiian Homes Commission Act, 1920 (42 Stat. 108) on fee simple lands in the State of Hawaii</quote> after <quote>markets</quote>;</text></paragraph><paragraph id="idb925368a3540424ca744c6560bbbc907"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph id="id4A9EA1EDD9F44802A35D0BF26F513225"><enum>(A)</enum><text>by amending paragraph (2) to read as subparagraph (A), the Secretary—</text><clause id="id989955caa20445f695c33acfedbe9d24"><enum>(i)</enum><text>shall compare the lender with other lenders originating or underwriting loan guarantees for Indian housing and Native Hawaiian housing based on the rates of defaults and claims for guaranteed loans originated, underwritten, or serviced by that lender; </text></clause><clause id="ida2e5abeec422442f946c2839860dd491"><enum>(ii)</enum><text>may compare the lender with such other lenders based on underwriting quality, geographic area served, or any commonly used factors the Secretary determines necessary for comparing mortgage default risk, provided that the comparison is of factors that the Secretary would expect to affect the default risk of mortgage loans guaranteed by the Secretary;</text></clause><clause id="iddfddb085399e4d96ae7adb15ba80889b"><enum>(iii)</enum><text>shall implement the comparisons described in clauses (i) and (ii) by regulation, notice, or Dear Lender Letter; and</text></clause><clause id="id53d0f132a73d4b1b86700a6b0c2d44ab"><enum>(iv)</enum><text>may terminate the approval of a lender to originate, underwrite, or service loan guarantees for housing under this section if the Secretary determines that the mortgage loans originated, underwritten, or serviced by the lender present an unacceptable risk to the Hawaiian Housing Loan Guarantee Fund established under subsection (j)—</text><subclause id="id424bc6dc14b94c59817b877a4d432801"><enum>(I)</enum><text>based on a comparison of any of the factors set forth in this subparagraph; or</text></subclause><subclause id="ide6ec96429b28475a8ba432ffa98b3cef"><enum>(II)</enum><text>by a determination that the lender engaged in fraud or misrepresentation.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcf3145e178264bbf9289ddf5f4413e5b"><enum>(3)</enum><text>in subsection (d)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id347b144ed0284fbd8d7ae3c081addd5b"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text><clause commented="no" display-inline="no-display-inline" id="idc6378a91ab0e49d6b9add80a6bd0d3e4"><enum>(i)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>Before</quote> and inserting <quote>Except as provided in id="id7254d0b06a2c48c0907f2fa0c4e70c5e"><enum>(C)</enum><header>Exception</header><text>When the Secretary exercises its discretion to delegate direct guarantee endorsement authority pursuant to subsection (c)(4)(C)(ii), subparagraphs (A) and (B) of this paragraph shall not apply.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="idd3f1b05459ca4c108020c708cb3180f4"><enum>(B)</enum><text>by amending paragraph (2) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idBD042DB0A0AF4F05B9B2B51AFF8774DF"><paragraph id="idE90095DDF18E42BD921AE1D74869F769"><enum>(2)</enum><header>Standard for approval</header><subparagraph id="idEF7A4C641D2D41AF8A582768C4A9F3B4"><enum>(A)</enum><header>Approval</header><text>Except as provided in subparagraph (B), the Secretary may approve a loan for guarantee under this section and issue a certificate under this subsection only if the Secretary determines that there is a reasonable prospect of repayment of the loan.</text></subparagraph><subparagraph id="id1EEB1C8EA2804EC6B4308172CF36A13C"><enum>(B)</enum><header>Exceptions</header><text>When the Secretary exercises its discretion to delegate direct guarantee endorsement authority pursuant to subsection (c)(4)(C)(ii)—</text><clause commented="no" display-inline="no-display-inline" id="id8fd7d20b15fe4ffdb5f0925a81aca15e"><enum>(i)</enum><text display-inline="yes-display-inline">subparagraph (A) shall not apply; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id5d41252551d94692975e405b080f80de"><enum>(ii)</enum><text display-inline="yes-display-inline">the direct guarantee endorsement lender may issue a certificate under this paragraph as evidence of the guarantee in accordance with requirements prescribed by the id="idaa6af5d468434a58ba9ff1e41ea29c97"><enum>(C)</enum><text>in paragraph (3)(A), by inserting <quote>or, where applicable, the direct guarantee endorsement lender,</quote> after <quote>Secretary</quote>; and</text></subparagraph></paragraph><paragraph id="idac2db08a1d6546efb39da7f6e8baa506"><enum>(4)</enum><text>in subsection (j)(5)(B), by inserting after the first sentence the following: <quote>There are authorized to be appropriated for those costs such sums as may be necessary for each of fiscal years 2027 through 2033.</quote>.</text></paragraph></section><section id="H444C6D5644C34544982AD68067B33745"><enum>26.</enum><header>Rental assistance for homeless or at-risk Indian veterans</header><text display-inline="no-display-inline">Section 8(o)(19) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(o)(19)</external-xref>) is amended—</text><paragraph id="H94B1E6B96F28423BB12B9AA301441F97"><enum>(1)</enum><text>by redesignating subparagraph (D) as subparagraph (E); and</text></paragraph><paragraph id="H808E03A8175442C1A466726826AA15FD"><enum>(2)</enum><text>by inserting after subparagraph (C) the following:</text><quoted-block id="H97841C4FB963462AB9202AEE1EFADA5F" display-inline="no-display-inline" style="OLC"><subparagraph id="H83AAE0A1C355479F8566937676B8E110"><enum>(D)</enum><header>Indian veterans housing rental assistance program</header><clause id="H0B4F2037A5564CF08D209A6FDF3C5141"><enum>(i)</enum><header>Definitions</header><text>In this subparagraph:</text><subclause id="H3063C8443E4C4B01AD9C4AD2D9EF4A0F"><enum>(I)</enum><header>Eligible Indian veteran</header><text>The term <term>eligible Indian veteran</term> means an Indian veteran who is—</text><item id="HFBE84BDB00704A3D9F27580479F38B30"><enum>(aa)</enum><text>homeless or at risk of homelessness; and</text></item><item id="H176154A2245F4F978C7CD186325F9572"><enum>(bb)</enum><text>living—</text><subitem id="HDBADA52171B143BF90836D892FA94782"><enum>(AA)</enum><text>on or near a reservation; or</text></subitem><subitem id="H652CF8AB16B244A0B98087BB20EC0630"><enum>(BB)</enum><text>in or near any other Indian area.</text></subitem></item></subclause><subclause id="HDF16A7C9B02B495EAA27EE75AA5AF266"><enum>(II)</enum><header>Eligible recipient</header><text>The term <term>eligible recipient</term> means a recipient eligible to receive a grant under section 101 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4111">25 U.S.C. 4111</external-xref>).</text></subclause><subclause id="H4789E12FED1D4FBA93BA0027677920B0"><enum>(III)</enum><header>Indian; Indian area</header><text>The terms <term>Indian</term> and <term>Indian area</term> have the meanings given those terms in section 4 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4103">25 U.S.C. 4103</external-xref>).</text></subclause><subclause id="HCC6F2B6B5684487C9DA7CD763F5AB43F"><enum>(IV)</enum><header>Indian veteran</header><text>The term <term>Indian veteran</term> means an Indian who is a veteran.</text></subclause><subclause id="H32BF9FBAEEB84A8AB65F33F7F5EAF7C8"><enum>(V)</enum><header>Program</header><text>The term <term>Program</term> means the Tribal HUD–VASH program carried out under clause (ii).</text></subclause><subclause id="H967AC5C1A9C344B5AF73293134CF9D5F"><enum>(VI)</enum><header>Tribal organization</header><text>The term <term>tribal organization</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></subclause></clause><clause id="HA638E3F085D74F1A9E99F60744FB11C8"><enum>(ii)</enum><header>Program specifications</header><text>The Secretary may not use less than 5 percent of the amounts made available for rental assistance under this paragraph to carry out a rental assistance and supported housing program, to be known as the <quote>Tribal HUD–VASH program</quote>, in conjunction with the Secretary of Veterans Affairs, by awarding grants for the benefit of eligible Indian veterans.</text></clause><clause id="H06FA3697BB0146D1908BCE61BDD9C805"><enum>(iii)</enum><header>Model</header><subclause id="H91EEC0D81ACC49919FFA5A7FECB02D03"><enum>(I)</enum><header>In general</header><text>Except as provided in subclause (II), the Secretary shall model the Program on the rental assistance and supported housing program authorized under subparagraph (A) and applicable appropriations Acts, including administration in conjunction with the Secretary of Veterans Affairs.</text></subclause><subclause id="H22A20C9CAEF948CB9175DA8EAE5BE644"><enum>(II)</enum><header>Exceptions</header><item id="H4EEA8E0FCE1F4906AED3B6A84DA538EF"><enum>(aa)</enum><header>Secretary of Housing and Urban Development</header><text>After consultation with Indian tribes, eligible recipients, and any other appropriate tribal organizations, the Secretary may make necessary and appropriate modifications to facilitate the use of the Program by eligible recipients to serve eligible Indian veterans.</text></item><item id="H334AF4E5DC804B99A4ADA4956F55BEC6"><enum>(bb)</enum><header>Secretary of Veterans Affairs</header><text>After consultation with Indian tribes, eligible recipients, and any other appropriate tribal organizations, the Secretary of Veterans Affairs may make necessary and appropriate modifications to facilitate the use of the Program by eligible recipients to serve eligible Indian veterans.</text></item></subclause></clause><clause id="H470FC178ED9D42ADB7E4BC60536BD5C4"><enum>(iv)</enum><header>Eligible recipients</header><text>The Secretary shall make amounts for rental assistance and associated administrative costs under the Program available in the form of grants to eligible recipients.</text></clause><clause id="HFACAD16C3F474329B97AA5308D9BCE55"><enum>(v)</enum><header>Funding criteria</header><text>The Secretary shall award grants under the Program based on—</text><subclause id="HA0DA2559CA7C440E869D2A37818583A1"><enum>(I)</enum><text>need;</text></subclause><subclause id="H1F4DE3CC810F479694FC0BB923397D73"><enum>(II)</enum><text>administrative capacity; and</text></subclause><subclause id="H63FBC54EBFB14E98AD01C3F624655523"><enum>(III)</enum><text>any other funding criteria established by the Secretary in a notice published in the Federal Register after consulting with the Secretary of Veterans Affairs.</text></subclause></clause><clause id="H625CD989D3B94B42A842295F077945AC"><enum>(vi)</enum><header>Administration</header><text>Grants awarded under the Program shall be administered in accordance with the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4101">25 U.S.C. 4101 et seq.</external-xref>), except that recipients shall—</text><subclause id="HA3A2018CE7624AF38C16141AE1F4B245"><enum>(I)</enum><text>submit to the Secretary, in a manner prescribed by the Secretary, reports on the utilization of rental assistance provided under the Program; and</text></subclause><subclause id="H1833B7682B6646BE8A3A85ED179354E5"><enum>(II)</enum><text>provide to the Secretary information specified by the Secretary to assess the effectiveness of the Program in serving eligible Indian veterans.</text></subclause></clause><clause id="HE4C71FFDBA3E44668D8DD9E1B7FA34FE"><enum>(vii)</enum><header>Consultation</header><subclause id="HE597DDC3CE5B4C46A0E92A6DBBF561FA"><enum>(I)</enum><header>Grant recipients; tribal organizations</header><text>The Secretary, in coordination with the Secretary of Veterans Affairs, shall consult with eligible recipients and any other appropriate tribal organization on the design of the Program to ensure the effective delivery of rental assistance and supportive services to eligible Indian veterans under the Program.</text></subclause><subclause id="HDC20FB5572DC4F1080B69A34BE927D6A"><enum>(II)</enum><header>Indian Health Service</header><text>The Director of the Indian Health Service shall provide any assistance requested by the Secretary or the Secretary of Veterans Affairs in carrying out the Program.</text></subclause></clause><clause id="HA402BA60C3A9413DABF59D250173AF57"><enum>(viii)</enum><header>Waiver</header><subclause id="HD91ABAFB5EF543249A99A9114156E8C8"><enum>(I)</enum><header>In general</header><text>Except as provided in subclause (II), the Secretary may waive or specify alternative requirements for any provision of law (including regulations) that the Secretary administers in connection with the use of rental assistance made available under the Program if the Secretary finds that the waiver or alternative requirement is necessary for the effective delivery and administration of rental assistance under the Program to eligible Indian veterans.</text></subclause><subclause id="H38423CE7AE8E4EEA9785F12982258C0E"><enum>(II)</enum><header>Exception</header><text>The Secretary may not waive or specify alternative requirements under subclause (I) for any provision of law (including regulations) relating to labor standards or the environment.</text></subclause></clause><clause id="HD1BF0C23FE83493E872D232F170A7B21"><enum>(ix)</enum><header>Renewal grants</header><text>The Secretary may—</text><subclause id="H51D851453D6846C4B645AE9B5832104D"><enum>(I)</enum><text>set aside, from amounts made available for tenant-based rental assistance under this subsection and without regard to the amounts used for new grants under clause (ii), such amounts as may be necessary to award renewal grants to eligible recipients that received a grant under the Program in a previous year; and</text></subclause><subclause id="H7EBAC23F5DD045A5B464288C05C3EDD8"><enum>(II)</enum><text>specify criteria that an eligible recipient must satisfy to receive a renewal grant under subclause (I), including providing data on how the eligible recipient used the amounts of any grant previously received under the Program.</text></subclause></clause><clause id="H1B02B57A03014BCFBFEBDE5EB64182CE"><enum>(x)</enum><header>Reporting</header><text>Not later than 1 year after the date of enactment of this subparagraph, and every 5 years thereafter, the Secretary, in coordination with the Secretary of Veterans Affairs and the Director of the Indian Health Service, shall—</text><subclause id="H9BC6C3572492440E9E5822D44AACB690"><enum>(I)</enum><text>conduct a review of the implementation of the Program, including any factors that may have limited its success; and</text></subclause><subclause id="H1038F084B25A4A30AFE58E4AAEBAD3DA"><enum>(II)</enum><text>submit a report describing the results of the review under subclause (II) to—</text><item id="HE334D24560BA444E88D093E439D8BEC6"><enum>(aa)</enum><text>the Committee on Indian Affairs, the Committee on Banking, Housing, and Urban Affairs, the Committee on Veterans’ Affairs, and the Committee on Appropriations of the Senate; and</text></item><item id="HCEF089F9C1674E739D0764788A2AF7CD"><enum>(bb)</enum><text>the Subcommittee on Indian and Insular Affairs of the Committee on Natural Resources, the Committee on Financial Services, the Committee on Veterans’ Affairs, and the Committee on Appropriations of the House of Representatives.</text></item></subclause></clause><clause id="H478D3B702B534EFFB9230EC8F866E03B" commented="no" display-inline="no-display-inline"><enum>(xi)</enum><header>Impact on formula current assisted stock</header><text>For a given fiscal year’s allocation formula of the Native American Housing Block Grant program, as authorized under title I of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4111">25 U.S.C. 4111 et seq.</external-xref>), the number of qualifying low-income housing dwelling units under section 302(b)(1) of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4152">25 U.S.C. 4152(b)(1)</external-xref>) shall not be reduced due to the placement of an eligible Indian veteran assisted with amounts provided under the Program within such qualifying units.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="idfd53c5ed9e4b4acb9b4659f551c39b48"><enum>27.</enum><header>Continuum of care</header><text display-inline="no-display-inline">Title IV of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11360">42 U.S.C. 11360 et seq.</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id369e770f2ca0403180b6fd64a80f5e96"><enum>(1)</enum><text display-inline="yes-display-inline">in section 401 (<external-xref legal-doc="usc" parsable-cite="usc/42/11360">42 U.S.C. 11360</external-xref>)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd175a230a28c4ac094efb789510c5aef"><enum>(A)</enum><text>by redesignating paragraphs (32) through (35) as paragraphs (33) through (36) respectively; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9409e959085348eeb5fc537d375f5423"><enum>(B)</enum><text>by inserting after paragraph (31) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idEA6299AE4D8442ECB3CD52CA9D2EE798"><paragraph commented="no" display-inline="no-display-inline" id="id6d66b14ead854da58865ea0fbe8601c3"><enum>(32)</enum><header>Tribally designated housing entity</header><text>The term <term>tribally designated housing entity</term> has the meaning given the term in section 4 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4103">25 U.S.C. 4103</external-xref>).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id694aec8f738d4c3b92b14023433e2175"><enum>(2)</enum><text>in section 423(g) (<external-xref legal-doc="usc" parsable-cite="usc/42/11383">42 U.S.C. 11383(g)</external-xref>), by inserting <quote>Indian tribe, tribally designated housing entity,</quote> after <quote>private nonprofit organization,</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6e6b6ffa3cdd41d39022305afec62bb8"><enum>(3)</enum><text>in section 435 (<external-xref legal-doc="usc" parsable-cite="usc/42/11389">42 U.S.C. 11389</external-xref>)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id65de5964a82d44f481e3e5ac0486fe49"><enum>(A)</enum><text>by striking <quote>Notwithstanding</quote> and inserting <quote>(a) <header-in-text style="OLC" level="subsection">Eligible entities</header-in-text>.—Notwithstanding</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id59ba88515b4e4168897583cb031d48f8"><enum>(B)</enum><text>in subsection (a), as so designated, by striking <quote>(as defined in section 4 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4103">25 U.S.C. 4103</external-xref>))</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd05674d550b844b89206f5e4eca1ae75"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4AB0A70BE9E54A36A212537C3DBCA9F8"><subsection id="id2befc39701f24f26b6b919947de858d6"><enum>(b)</enum><header>Civil rights exemptions</header><paragraph commented="no" display-inline="no-display-inline" id="ide82b9dcda41548c19f4fd99a4ac605fb"><enum>(1)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this subsection:</text><subparagraph id="id5b3ec36799e74474919bb2cce5991445"><enum>(A)</enum><header>Formula area</header><text>The term <term>formula area</term> has the meaning given the term in section 1000.302 of title 24, Code of Federal Regulations, or any successor regulation.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id35168d30026b4a8aab73a1305dd31dd5"><enum>(B)</enum><header>Tribal project</header><text>The term <term>Tribal project</term> means a project in which amounts provided under this Act shall be used specifically to benefit Tribal communities or Tribal members.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id07c9075f8f2e4983803275e027c3dc07"><enum>(2)</enum><header>Exemptions</header><text display-inline="yes-display-inline">With respect to grants awarded to carry out eligible activities under this subtitle, title VI of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d">42 U.S.C. 2000d et seq.</external-xref>) and title VIII of the Civil Rights Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3601">42 U.S.C. 3601 et seq.</external-xref>) shall not apply to applications or awards for—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida9f2ead6cfad4c3a80ca331447396ccc"><enum>(A)</enum><text display-inline="yes-display-inline">projects to be carried out—</text><clause id="id201b6ef364c64b47b87ca603ad10e726"><enum>(i)</enum><text>on or off reservation or trust lands for awards made to Indian Tribes or tribally designated housing entities; or</text></clause><clause id="id5eff610789514658a8179c1601fafd0e"><enum>(ii)</enum><text>on reservation or trust lands for awards made to eligible entities; or</text></clause></subparagraph><subparagraph id="id2dbc4ba8e8fd48c68cd2c7ced3fefb33" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>Tribal projects located in Indian Housing Block Grant formula areas.</text></subparagraph></paragraph></subsection><subsection id="id1dfcb9688dcb4d5c80da6734a19606b1"><enum>(c)</enum><header>Certification</header><text>Notwithstanding section 106 of the Cranston-Gonzalez National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12706">42 U.S.C. 12706</external-xref>) and section 403 of this Act, with respect to applications for projects to be carried out on reservations or trust land using grants awarded under this subtitle—</text><paragraph id="ide765e6fd1bf24d48b07676d767bbad06"><enum>(1)</enum><text>the applications shall contain a certification of consistency with an approved Indian housing plan developed under section 102 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4112">25 U.S.C. 4112</external-xref>); and</text></paragraph><paragraph id="id841acab2409640b5803aeff4180093e0"><enum>(2)</enum><text>Indian tribes and tribally designated housing entities that are recipients of awards for projects on reservations or trust land from such funds shall certify that they are following an approved housing plan developed under section 102 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4112">25 U.S.C. 4112</external-xref>).</text></paragraph></subsection><subsection id="id53cd37f2e88d4681821571bd4ffcdfa7"><enum>(d)</enum><header>Consolidated plan exemption</header><text>A collaborative applicant for a continuum of care whose geographic area includes only reservation or trust land is not required to meet the requirement described in section 402(f)(2).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id00a86a9ee3524ab6a5453c7fb81b7ec2"><enum>(e)</enum><header>Waiver authority for Tribal participation</header><text>In administering the amounts made available under this subtitle, the Secretary may waive, or specify alternative requirements for, any provision of any statute or regulation that the Secretary administers in connection with the obligation by the Secretary or the use by the recipient of these amounts (except for requirements related to labor standards and the environment), if the Secretary finds that—</text><paragraph commented="no" display-inline="no-display-inline" id="id1af3c972e0f14e17ae0c3f7418585790"><enum>(1)</enum><text display-inline="yes-display-inline">good cause exists for the waiver or alternative requirement; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id198f9bbbb36f48a88f85fc3ac364e2d1"><enum>(2)</enum><text display-inline="yes-display-inline">such waiver or alternative requirement—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9fac919236cd44e2a1e958b923a8c862"><enum>(A)</enum><text display-inline="yes-display-inline">is necessary to modify any requirements preventing the participation of Indian tribes or tribally designated housing entities in the program under this subtitle; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5c0528af086e4ad0b53fa6e06694821d"><enum>(B)</enum><text display-inline="yes-display-inline">would expedite or facilitate the use of funds.</text></subparagraph></paragraph></subsection><subsection id="id9f00ba47a716467698a73d0f286db044"><enum>(f)</enum><header>Environmental review</header><text>Projects under this title shall be treated as assistance for special projects that are subject to section 305(c) of the Multifamily Housing Property Disposition Reform Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/42/3547">42 U.S.C. 3547</external-xref>), and subject to the regulations issued by the Secretary to implement such section, and with respect to projects under this title, an Indian tribe shall be considered a State for purposes of section 305(c) of such Act.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="id212564d3ea5b4b6fa6afd308ffd4727e"><enum>28.</enum><header>Application of Build America, Buy America requirements</header><text display-inline="no-display-inline">The requirements under the Build America, Buy America Act (<external-xref legal-doc="usc" parsable-cite="usc/41/8301">41 U.S.C. 8301</external-xref> note) and any implementing regulations or guidance do not apply to any programs, projects, or activities assisted in whole or in part with Federal financial assistance provided by the Secretary to Indian tribes, tribally designated housing entities, tribal organizations, or the Department of Hawaiian Home Lands under any program administered by the Secretary.</text></section><section id="id7165b55a569d40f1b5ceb65028194660"><enum>29.</enum><header>Formula negotiated rulemaking</header><subsection commented="no" display-inline="no-display-inline" id="idce6912b91c6c40d3bcf95a95991d53f3"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>Notwithstanding any other provision of law, the negotiated rulemaking that is initiated by the Secretary pursuant to subsection (b)(2)(C) of section 106 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4116">25 U.S.C. 4116</external-xref>) immediately following the date of enactment of this Act shall not include any changes to the regulations governing the allocation formula under section 302 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/25/4152">25 U.S.C. 4152</external-xref>).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id78537a55faa1499399cade5275358a69"><enum>(b)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in subsection (a) shall be construed as limiting the authority of the Secretary to revise such regulations governing the allocation formula under such section 302 other than as described in subsection (a).</text></subsection></section><section id="ida7d8f0856dbb437c8e77a8db0146eec6"><enum>30.</enum><header>Pilot program for housing assistance for homeless Native Americans and Alaska Natives</header><subsection id="id253c2de0d3094f1e8b01f010c79c089f"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id9acfc5d2ccb345c4b5e631cc2de39873"><enum>(1)</enum><header>Eligible American Indian and Alaska Native</header><text>The term <term>eligible American Indian and Alaska Native</term> means a member of an Indian Tribe who is homeless or at risk of homelessness, as defined in sections 103 and 401 of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11302">42 U.S.C. 11302</external-xref>, 11360).</text></paragraph><paragraph id="id71879a851a904916a33ee8048da224d6"><enum>(2)</enum><header>Eligible recipient</header><text>The term <term>eligible recipient</term> means an Indian tribe, or a tribally designated housing entity or tribal organization designated by such Indian tribe to apply for a grant on its behalf under this section.</text></paragraph><paragraph id="idac23e5e4f4d94507938adfb993c3c6b8"><enum>(3)</enum><header>Program</header><text>The term <term>Program</term> means the program established under subsection (b).</text></paragraph></subsection><subsection id="iddba710eca79244f885fdf728e4387ac5"><enum>(b)</enum><header>Establishment</header><text>The Secretary may use not more than 5 percent of the amounts made available for grants under title IV of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11360">42 U.S.C. 11360 et seq.</external-xref>) each fiscal year to carry out a housing and supportive services program, to be known as the <quote>Tribal Homeless Assistance program</quote>, by awarding grants to eligible recipients for the benefit of eligible American Indians and Alaska Natives.</text></subsection><subsection id="idf1f56478256f4572a731276cd2f49bd1"><enum>(c)</enum><header>Model; consultation</header><text>The Secretary, in coordination with the Director of the Indian Health Service, shall—</text><paragraph id="id46d64c8f376a42b3bc2b414910198150"><enum>(1)</enum><text>model the Program on the rental assistance and supported housing program authorized under section 8(o)(19) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(o)(19)</external-xref>) and applicable appropriations Acts for Native American veterans that are homeless or at risk of homelessness living on or near a reservation or other Indian areas; and</text></paragraph><paragraph id="idfc1e74d77d804f188d181206f5cced8c"><enum>(2)</enum><text>consult with eligible recipients to ensure effective delivery of grants under the Program.</text></paragraph></subsection><subsection id="id2c22f621a1d54655ab1eb02eb187dc47"><enum>(d)</enum><header>Application</header><text>Each eligible recipient applying for a grant under the Program shall submit to the Secretary an application that describes how the partnership of the eligible recipient with an Indian tribe, tribal organization, nonprofit organization, or the Indian Health Service will provide 2 years of mandatory case management services to a beneficiary of housing assistance provided under the Program, including in partnership with other qualified organizations, when appropriate.</text></subsection><subsection id="id785f0b291f094224b859da1366ff9687"><enum>(e)</enum><header>Priority</header><text>An eligible recipient that receives a grant under the Program shall prioritize providing assistance to homeless youth, families with children, and survivors of domestic violence.</text></subsection><subsection id="id7333cd9033884257a6debe8d2ee661b1"><enum>(f)</enum><header>Funding criteria</header><text>Grants awarded under the Program shall be based on need, administrative capacity, and other criteria established by the Secretary in consultation with the Indian Health Service and eligible recipients.</text></subsection><subsection id="idb6bcca3b9abc403babaf8fb0d2961106"><enum>(g)</enum><header>Administration and waiver authority</header><text>The Program shall be administered in accordance with the requirements under the Native American Housing and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4101">25 U.S.C. 4101 et seq.</external-xref>), provided that the Secretary shall be authorized to waive, or specify alternative requirements for, any provision of any statute or regulation that the Secretary administers in connection with the use of funds made available under the Program (except for requirements related to fair housing, nondiscrimination, and labor standards), upon a finding by the Secretary that any such waiver or alternative requirement is necessary for the effective delivery and administration of such assistance.</text></subsection><subsection id="idb80e5b12b4c648519745ce0740c4a589"><enum>(h)</enum><header>Renewal grants</header><text>The Secretary may set aside amounts made available under subsection (b) for renewal grants under the Program and define renewal criteria, including data reporting.</text></subsection><subsection id="ide370f723b9894c12b228c2e8cdc1e41d"><enum>(i)</enum><header>Study on barriers to implementation</header><text>Not later than 2 years after the date of enactment of this Act, and every 5 years thereafter, the Secretary, in coordination with the Director of the Indian Health Service, shall review and submit to Congress a report on the implementation of the Program, including any barriers to implementation.</text></subsection></section><section id="id200be474abea41bda74c98e4d9a7c495" commented="no"><enum>31.</enum><header>Pilot program for housing assistance for homeless Native Hawaiians</header><subsection id="idf1f9391b046b4cbb88f85e3e9d51440f"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id54ef0435c2274fc5bc96fe8c759d0b93"> <enum>(1)</enum> <header>Eligible Native Hawaiian</header> <text>The term <term>eligible Native Hawaiian</term> means a Native Hawaiian who is homeless or at risk of homelessness, as defined in sections 103 and 401 of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11302">42 U.S.C. 11302</external-xref>, 11360).</text>
 </paragraph><paragraph id="id785809e47e0647428a7a0c3ffa53ab00"><enum>(2)</enum><header>Eligible recipient</header><text>The term <term>eligible recipient</term> means the Department of Hawaiian Home Lands, a Native Hawaiian Organization, or a Native Hawaiian community-based organization.</text></paragraph><paragraph id="id7e0cfea692ee4190b60c5ee7ba6c974b"><enum>(3)</enum><header>Program</header><text>The term <term>Program</term> means the program established under subsection (b).</text></paragraph></subsection><subsection id="id1acc2fa160624e27a0231a31608f5fa6"> <enum>(b)</enum> <header>Establishment</header> <text>The Secretary may use up to 1 percent of the amounts made available for grants under title IV of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11360">42 U.S.C. 11360 et seq.</external-xref>) each fiscal year to carry out a housing and supportive services program, to be known as the <quote>Native Hawaiian Homeless Assistance program</quote>, by awarding grants to eligible recipients for the benefit of eligible Native Hawaiians in the State of Hawaii.</text>
 </subsection><subsection id="id0d77d086841b4770a4830d81fe626c06"><enum>(c)</enum><header>Model; consultation</header><text>The Secretary, in coordination with the Director of the Office of Native Hawaiian Relations in the Department of the Interior, shall—</text><paragraph id="idcd602f278bbc42cfb2997831cb06165c"><enum>(1)</enum><text>model the Program on the rental assistance and supported housing program authorized under section 8(o)(19) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(o)(19)</external-xref>) and applicable appropriations Acts for Native American veterans that are homeless or at risk of homelessness living on or near a reservation or other Indian areas; and</text></paragraph><paragraph id="id4b5921963bf24761b7bf871ce01a778a"><enum>(2)</enum><text>consult with eligible recipients to ensure effective delivery of grants under the Program.</text></paragraph></subsection><subsection id="id4247adb6a0654f868c41100cec04105b"><enum>(d)</enum><header>Application</header><text>Each eligible recipient applying for a grant under the Program shall submit to the Secretary an application that describes how the partnership of the eligible recipient with a Native Hawaiian Organization or a nonprofit organization will provide 2 years of mandatory case management services to a beneficiary of housing assistance provided under the Program, including in partnership with other qualified organizations, when appropriate.</text></subsection><subsection id="ida0da7c3ca3984fefab32afd5813c0dae"><enum>(e)</enum><header>Priority</header><text>An eligible recipient that receives a grant under the Program shall prioritize providing assistance to homeless youth, families with children, and survivors of domestic violence.</text></subsection><subsection id="idddb12961ab694074b4c7a60f650657c8"><enum>(f)</enum><header>Funding criteria</header><text>Grants awarded under the Program shall be based on need, administrative capacity, and other criteria established by the Secretary in consultation with the Office of Native Hawaiian Relations in the Department of the Interior and eligible recipients.</text></subsection><subsection id="id709cfe0cad394ba396287ca913d01f7e"><enum>(g)</enum><header>Administration and waiver authority</header><text>The Program shall be administered in accordance with the requirements under the Native American Housing and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4101">25 U.S.C. 4101 et seq.</external-xref>), provided that the Secretary shall be authorized to waive, or specify alternative requirements for, any provision of any statute or regulation that the Secretary administers in connection with the use of funds made available under the Program (except for requirements related to fair housing, nondiscrimination, labor standards, and the environment), upon a finding by the Secretary that any such waivers or alternative requirements are necessary for the effective delivery and administration of such assistance; and provided that the Secretary may by regulation provide for the release of funds for specific projects to eligible recipients under this section if the Department of Hawaiian Home Lands assumes all of the responsibilities for environmental review, decisionmaking, and action pursuant to section 806(a)(1)(B) of the Native American Housing and Self-Determination Act of 1996.</text></subsection><subsection id="id4baecb3f58bd47c2a1ead5c80e537165"><enum>(h)</enum><header>Renewal grants</header><text>The Secretary may set aside amounts made available under subsection (b) for renewal grants under the Program and define renewal criteria, including data reporting.</text></subsection><subsection id="id92f31b36f0e741e7ae1b781c7a937978"><enum>(i)</enum><header>Study on barriers to implementation</header><text>Not later than 2 years after the date of enactment of this Act, and every 5 years thereafter, the Secretary, in coordination with the Director of the Office of Native Hawaiian Relations in the Department of the Interior, shall review and submit to Congress a report on the implementation of the Program, including any barriers to implementation.</text></subsection></section><section id="id5058d46dabb0426a947cc0799d2de54b"><enum>32.</enum><header>Tribal and rural continuum of care builds program</header><subsection id="id305f012f2b0e47859abceeb1012c849a"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id5a8bf32e374d4b038dc76230cb3c780f"><enum>(1)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means an Indian tribe, a tribally designated housing entity, a Tribal organization, the Department of Hawaiian Home Lands, a Native Hawaiian organization, and a Native Hawaiian community-based organization.</text></paragraph><paragraph id="idcecc2df912954474b7edc067eefab352"><enum>(2)</enum><header>Formula area</header><text>The term <term>formula area</term> has the meaning given the term in section 1000.302 of title 24, Code of Federal Regulations, or any successor regulation.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf6543aca89a34513b631c9c1515b3df7"><enum>(3)</enum><header>Tribal project</header><text>The term <term>Tribal project</term> means a project in which amounts provided under this section shall be used specifically to benefit Tribal communities or Tribal members.</text></paragraph></subsection><subsection id="id5ee28fdec4b740fa85211ec683efc314"> <enum>(b)</enum> <header>Authorization</header> <text>The Secretary is authorized to establish and carry out a program, to be known as the <quote>Tribal and Rural Continuum of Care Builds Program,</quote> to provide competitive grants under the subtitle C of title IV of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11381">42 U.S.C. 11381 et seq.</external-xref>) for the construction, acquisition, or rehabilitation of permanent supportive housing for individuals and families experiencing homelessness or overcrowded living conditions.</text>
 </subsection><subsection id="idaeb62b837d4e4c5b9c29455b0f96c137"><enum>(c)</enum><header>Eligible activities</header><text>Of amounts made available to a recipient of a grant under this section—</text><paragraph id="id331fa7ff5e604feb99489f4030bc4593"><enum>(1)</enum><text>the eligible entity may use grant funds for capital costs, including new construction, acquisition, and rehabilitation of housing units, and any other eligible activities specified by the Secretary;</text></paragraph><paragraph id="id7bf9dbf73f6a4bca89b3b868ff47cb0b"><enum>(2)</enum><text>not more than 20 percent of total grant funds may be used for eligible supportive services, operating costs, rental assistance, or other eligible activities as described in section 423 of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11383">42 U.S.C. 11383</external-xref>); and</text></paragraph><paragraph id="id2f9574554d10421aa6ea85563131590b"><enum>(3)</enum><text>not more than 10 percent of total grant funds may be used for administrative costs.</text></paragraph></subsection><subsection id="id2117790fc4fb4f3bbc2dd945ec7ebbea"><enum>(d)</enum><header>Tribal priority</header><text>Not less than 75 percent of amounts made available under this section shall be reserved for projects that benefit Indian tribes, Tribal organizations, the Department of Hawaiian Home Lands, Native Hawaiian organizations, Native Hawaiian community-based organizations, nonprofit organizations serving Indian tribes or Native Hawaiians, or projects that take place in Indian areas.</text></subsection><subsection id="id77abb979988c44f3ada5aba81c3d0f0c"> <enum>(e)</enum> <header>Set-Aside for small States</header> <text>Not less than 25 percent of amounts made available under this section shall be reserved for eligible entities located in States with populations of less than 2,500,000, except that if the Secretary receives insufficient applications from such areas, remaining amounts may be reallocated to other eligible entities of grants under this section.</text>
 </subsection><subsection id="id29ce3e6a431f491e9956747c0754b54b"><enum>(f)</enum><header>Coordination requirements</header><text>Eligible recipients seeking a grant under this section shall demonstrate coordination with Tribes, Tribal organizations, tribally designated housing entities, the Department of Hawaiian Home Lands, Native Hawaiian organizations, Native Hawaiian community-based organizations, healthcare providers, social service agencies, or housing partners.</text></subsection><subsection id="id10829892f7794ae1baf0e4988130c30c"><enum>(g)</enum><header>Program requirements</header><text>Except as modified under this section, grants under this section shall be administered in accordance with the requirements of part 578 of title 24, Code of Federal Regulations, or any successor regulation, provided that—</text><paragraph id="id76061ca33eb64aa0b89ba78a8eb96ac3"><enum>(1)</enum><text>for purposes of environmental review, projects under this section shall be treated as assistance for special projects that are subject to section 305(c) of the Multifamily Housing Property Disposition Reform Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/42/3547">42 U.S.C. 3547</external-xref>); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb5fa2c1579fd45479aecd1a7b00d3a24"><enum>(2)</enum><text display-inline="yes-display-inline">subject to the regulations issued by the Secretary to implement such section, and with respect to projects under this section, an Indian tribe or the Department of Hawaiian Home Lands shall be considered a State for purposes of such section 305(c).</text></paragraph></subsection><subsection id="id73a0f648d2e24802bfa68b5cbe5ffcd3"><enum>(h)</enum><header>Civil rights exemptions</header><text>With respect to grants awarded to carry out eligible activities under this section, title VI of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d">42 U.S.C. 2000d et seq.</external-xref>) and title VIII of the Civil Rights Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3601">42 U.S.C. 3601 et seq.</external-xref>) shall not apply to applications or awards for—</text><paragraph commented="no" display-inline="no-display-inline" id="id655c9456007d41e4afebe5fb2b932786"><enum>(1)</enum><text display-inline="yes-display-inline">projects to be carried out—</text><subparagraph id="ida4acb6ee94f445cfbe9864b3264c0173"><enum>(A)</enum><text>on or off reservation or trust lands for awards made to Indian tribes or tribally designated housing entities; or</text></subparagraph><subparagraph id="id3474952c42ab497e90f5b384849d4f05"><enum>(B)</enum><text>on reservation or trust lands for awards made to eligible entities; or</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id16f3da04bb2949c3bef7fad9a110c6d6"><enum>(2)</enum><text>Tribal projects located in Indian Housing Block Grant formula areas.</text></paragraph></subsection><subsection id="id5347532fea774c6596dc44a20a4e1f5d"><enum>(i)</enum><header>Certification</header><text>Notwithstanding section 106 of the Cranston-Gonzalez National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12706">42 U.S.C. 12706</external-xref>) and subsection (g) of this section with respect to applications for projects to be carried out on reservations or trust land using grants awarded under this section—</text><paragraph id="id3ebf0be366e54cc7aa99c9b9757977e6"><enum>(1)</enum><text>the applications shall contain a certification that the applicant consulted with the recipient(s) required to submit an Indian housing plan developed under section 102 of the Native American Housing Assistance and Self-Determination Act (<external-xref legal-doc="usc" parsable-cite="usc/25/4112">25 U.S.C. 4112</external-xref>); and</text></paragraph><paragraph id="id88dda479d2b647519e9b94735c96e6d9"><enum>(2)</enum><text>Indian tribes and tribally designated housing entities that are recipients of awards for projects on reservations or trust land from such funds shall certify that they have consulted with the recipients required to submit an Indian housing plan developed under section 102 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4112">25 U.S.C. 4112</external-xref>).</text></paragraph></subsection><subsection id="id20f110542c624535bc99293631bd06c3"><enum>(j)</enum><header>Consolidated plan exemption</header><text>A collaborative applicant for a Continuum of Care whose geographic area includes reservation or trust land is not required to meet the requirement described in section 402(f)(2) of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11360a">42 U.S.C. 11360a(f)(2)</external-xref>) in order to be eligible for assistance under the Continuum of Care program under title IV of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11360">42 U.S.C. 11360 et seq.</external-xref>).</text></subsection><subsection id="id3fa4b9e1ac7747278bb546df3e7d4738"><enum>(k)</enum><header>Waiver authority for tribal participation</header><text>In administering the amounts made available under this section, the Secretary may waive, or specify alternative requirements for, any provision of any statute or regulation that the Secretary administers in connection with the obligation by the Secretary or the use by the recipient of these amounts (except for requirements related to labor standards and the environment), if the Secretary finds that—</text><paragraph commented="no" display-inline="no-display-inline" id="ide457239c1ab94b018f1c0bd02dcbb420"><enum>(1)</enum><text display-inline="yes-display-inline">good cause exists for the waiver or alternative requirement; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id43fc85dd890346be8d457856841d3479"><enum>(2)</enum><text display-inline="yes-display-inline">such waiver or alternative requirement is necessary to modify any requirements preventing the participation of eligible entities in the Continuum of Care Program under subtitle C of title IV of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11381">42 U.S.C. 11381 et seq.</external-xref>) or would expedite or facilitate the use of funds.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idcc28107f1ee5460a9e2b532c4e80ceea"><enum>(l)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this section—</text><paragraph id="iddb6af3e55e1a4381a42c61ef6b4a1c8c"><enum>(1)</enum><text>$25,000,000 for fiscal year 2027; and</text></paragraph><paragraph id="idf9142201556a47fcb150b30c1865aa50"><enum>(2)</enum><text>such sums as may be necessary for each fiscal year thereafter.</text></paragraph></subsection></section><section id="idc4f6584816974fb59d421e05699d5abf"><enum>33.</enum><header>HUD Tribal Intergovernmental Advisory Committee</header><subsection id="id81f4f2fa95244495b295c0544d6e852d"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id7e806eb208134cb49beee6d853079724"><enum>(1)</enum><header>Committee</header><text>The term <term>Committee</term> means the Tribal Intergovernmental Advisory Committee described in subsection (b).</text></paragraph><paragraph id="id2d79e4c12be4453383081efd57211c87"><enum>(2)</enum><header>Department</header><text>The term <term>Department</term> means the Department of Housing and Urban Development.</text></paragraph></subsection><subsection id="id056c2b45603146ca9ffea8f1efbb0d97"><enum>(b)</enum><header>Establishment</header><text>The Secretary shall maintain the Tribal Intergovernmental Advisory Committee to facilitate a formal government-to-government advisory body composed of leaders of Federally recognized tribes (or their designated employees with authority to act on their behalf) to provide policy recommendations on programs and activities of the Department that affect Indian and Alaska Native communities.</text></subsection><subsection id="id2e65522bdea340179562504ffcf7f4cd"><enum>(c)</enum><header>Membership</header><text>The Committee shall—</text><paragraph id="id596c78284eb340d5862111c0e6a8c1b3"><enum>(1)</enum><text>be composed of—</text><subparagraph id="id60e13b38de6e4f3a850811efe04b4c1c"><enum>(A)</enum><text>not more than 16 Tribal delegates, of whom, to the extent practicable—</text><clause id="id07e8e93a866943599a9fc15df9cc669c"><enum>(i)</enum><text>2 members each should be from each of the regions of the Office of Native American Programs of the Department; and</text></clause><clause id="id496fc80954c34cb8886d43c859034d3b"><enum>(ii)</enum><text>not more than 3 members should be at-large members; and</text></clause></subparagraph><subparagraph id="idb00af3015079483393e2e711e5d31cb5"><enum>(B)</enum><text>representatives of the Department, including the Secretary or a designee thereof and relevant Assistant Secretaries; and</text></subparagraph></paragraph><paragraph id="id17c299a79c1648f8a88d6b4c94ce381b"><enum>(2)</enum><text>include 2 Tribal co-chairs selected by and from among the delegates described in paragraph (1)(A).</text></paragraph></subsection><subsection id="id2efaed0f0772428c8107d264e5895148"><enum>(d)</enum><header>Duties</header><text>The Committee shall—</text><paragraph id="idf100b29684f8485f9a8ec7cb2ed89da8"><enum>(1)</enum><text>advise the Department on housing priorities for American Indian, Alaska Native, and Native Hawaiian communities;</text></paragraph><paragraph id="id2a7f36c156d2436f9b24a2a984a4b055"><enum>(2)</enum><text>recommend policy, funding, and administrative improvements for programs of the Department impacting Indian tribes;</text></paragraph><paragraph id="id368ceda7a0be42ecaa2025ed824594ed"><enum>(3)</enum><text>enhance intergovernmental communication and coordination on initiatives of the Department;</text></paragraph><paragraph id="idef8e8281076b4630844d5964d2f53163"><enum>(4)</enum><text>support region- and national-level Tribal consultation processes; and</text></paragraph><paragraph id="id7baecb59810a43339f5805dc9ac6b229"> <enum>(5)</enum> <text>ensure timely Tribally informed feedback in policy development.</text>
 </paragraph></subsection><subsection id="id06494c6c8fb14c80b67f01bb14171597"><enum>(e)</enum><header>Operations</header><text>The Committee shall—</text><paragraph id="id1690db7e01e046e3822cbe66f6aea2a5"><enum>(1)</enum><text>develop and follow internal bylaws or protocols;</text></paragraph><paragraph id="idb9520c3fe0764d7a9f64a284d5d7386d"><enum>(2)</enum><text>hold not less than 2 meetings per year, in-person or virtually;</text></paragraph><paragraph id="id2e68bf115cc948798882333a0d6c4789"><enum>(3)</enum><text>reimburse travel and participation costs; and</text></paragraph><paragraph id="idabead473ea7a437798f93f967ce92ec9"><enum>(4)</enum><text>notwithstanding subsection (c)(1)(A)(iii), be exempt from <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/10">chapter 10</external-xref> of title 5, United States Code, pursuant to section 204(b) of the Unfunded Mandates Reform Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1534">2 U.S.C. 1534(b)</external-xref>).</text></paragraph></subsection><subsection id="idebbf2ed7fa224c329e796e84af5dfd81"><enum>(f)</enum><header>Terms; alternates</header><paragraph id="idb9efaaa8db5349fdace4509951217781"><enum>(1)</enum><header>Terms</header><text>Members described in subsection (c)(1)(A) shall serve staggered 2-year terms, with initial staggering as determined by the Secretary.</text></paragraph><paragraph id="id208da9b83720402ea78d03ed186b8d5b"><enum>(2)</enum><header>Alternates</header><text>Alternates may be designated by Indian tribes to serve on the Committee in the absence of the primary delegate.</text></paragraph></subsection><subsection id="id07b03830c9ef4ed3a98a2f25bcd3be56"><enum>(g)</enum><header>Support</header><text>The Secretary shall provide staff support, logistics, meeting facilities, and administrative resources for the Committee, subject to the availability of appropriated funds.</text></subsection></section><section id="id748c26b444e3420cb0aa110503b0204f"><enum>34.</enum><header>Housing supply chain challenges</header><text display-inline="no-display-inline">The Secretary shall direct the Tribal Intergovernmental Advisory Committee of the Department of Housing and Urban Development to, not later than 1 year after the date of enactment of this Act, submit to the Committee on Banking, Housing, and Urban Affairs of the Senate and the Committee on Financial Services of the House of Representatives, and make publicly available, a report on—</text><paragraph id="idc83b5bc82b514dd690eae5f1165e3e7f"> <enum>(1)</enum> <text>housing supply chain challenges in Tribal communities;</text>
 </paragraph><paragraph id="id5369281990f041acbacadc5ca083fad7"><enum>(2)</enum><text>work with the Department of Hawaiian Home Lands on a report on housing challenges impacting Native Hawaiian communities; and</text></paragraph><paragraph id="id2edb7664e6794c5c87991d5a3c9c289f"><enum>(3)</enum><text>recommended actions for Congress and the Department of Housing and Urban Development.</text></paragraph></section><section id="idab1fdc6ccb6e44bc838a4c77277cd06d"><enum>35.</enum><header>Report on housing in Alaska</header><text display-inline="no-display-inline">The Secretary shall direct the Tribal Intergovernmental Advisory Committee of the Department of Housing and Urban Development to, not later than 180 days after the date of enactment of this Act—</text><paragraph id="id3669e874bbbd4efeae87a3418e1617ba"><enum>(1)</enum><text>extract and compile all background, issues, recommendations, and other information relevant for the State of Alaska and the State of Hawaii from reports of the Advisory Committee; and</text></paragraph><paragraph id="idb1f83f7e2bb746798da619fd55fc4a76"><enum>(2)</enum><text>submit to the Committee on Banking, Housing, and Urban Affairs of the Senate and the Committee on Financial Services of the House of Representatives, and make publicly available, a report entitled <quote>The Alaska Housing Task Force Report</quote>, and <quote>The Native Hawaiian Housing Task Force Report</quote> which shall contain the information described in paragraph (1).</text></paragraph></section></legis-body></bill>
