<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 4273</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260326">March 26, 2026</action-date><action-desc><sponsor name-id="S406">Mr. Kelly</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To install and maintain warning signage informing travelers of dangerous areas or routes near the southern border of the United States that have been identified in relevant Department of State Travel Advisories.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Nicholas Douglas Quets Border Travel Safety Act</short-title></quote>.</text></section><section id="idb2606b9837fe41cc975c4f9060f7b5b0"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph commented="no" display-inline="no-display-inline" id="idc90987c9acc845b085cf11658863a5d0"> <enum>(1)</enum> <text display-inline="yes-display-inline">On October 18, 2024, while traveling in the Mexican state of Sonora near Puerto Peñasco, Nicholas Quets was targeted by armed criminals associated with the Sinaloa Cartel and the 31-year-old American was tragically shot and killed in a violent attack.</text>
 </paragraph><paragraph id="id6a0e51264bb647e7a2a55ac6c8f55a42" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>The brutal murder of Nicholas Quets reflects the ongoing threat posed by transnational criminal organizations and cartel violence in the region.</text></paragraph><paragraph id="id220a67d0aa064e8eafecd19a173f8b26"><enum>(3)</enum><text>Nicholas Quets was shot while traveling along the Altar-Caborca highway (Federal Highway 2) in Sonora, which is frequently listed under a <quote>Reconsider Travel</quote> advisory.</text></paragraph><paragraph id="id4aa14a19e9664b12a458dea992073388"><enum>(4)</enum><text>It is not known if Nicholas Quets was aware of any travel advisories on his chosen route.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd9af3c75d359499b9cc2de4a5cd51d05"><enum>(5)</enum><text display-inline="yes-display-inline">The Department of State issues Travel Advisories to inform United States citizens and other travelers of safety and security risks in foreign countries and regions.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id38c90d36242c4990a7c4784d7d95c3a9"><enum>(6)</enum><text display-inline="yes-display-inline">Department of State Travel Advisories identify certain foreign regions, including areas near United States land borders, that present elevated safety or security risks due to criminal activity, violence, kidnapping, or other threats.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id77630dcf308b4e598ae80df3938c280c"><enum>(7)</enum><text display-inline="yes-display-inline">Individuals entering or departing the United States through land ports of entry may not be aware that nearby areas identified in Department of State Travel Advisories pose heightened safety or security risks.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id949c6f90882f4c288339712561024549"><enum>(8)</enum><text display-inline="yes-display-inline">Clear and visible signage at land ports of entry and surrounding areas would improve traveler awareness of such risks and promote public safety.</text></paragraph></section><section id="id9316f36cdefc4c8fad61206af1a60976"><enum>3.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that clear and visible signage displaying travel advisories at land ports of entry along the land boundary between the United States and Mexico are necessary to improve traveler awareness of safety or security risks due to criminal activity, violence, kidnapping, or other threats.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idd36dbdbd06c14fb0be2afe4ba546db88"><enum>4.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="idcdf25639b9724847b7fdce319c03110d"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id55de3c510b7d4ab5935621f55aeb93a5"><enum>(A)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idba53cec8b0eb462fa77b42ef8150d0a3"><enum>(B)</enum><text>the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb2b5c11973364423a4af7229842b46c3"> <enum>(C)</enum> <text>the <committee-name committee-id="HHM00">Committee on Homeland Security of the House of Representatives</committee-name>; and</text>
                </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id27a7c35e0e49439b993cb0d8ceb021c1">
                    <enum>(D)</enum>
 <text>the <committee-name committee-id="HFA00">Committee on Foreign Affairs of the House of Representatives</committee-name>.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5d752ffb72114f5fa834ce5460293863"><enum>(2)</enum><header display-inline="yes-display-inline">Land port of entry</header><text display-inline="yes-display-inline">The term <term>land port of entry</term> means a port of entry along an international land border between the United States and Mexico.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddc281ef2efd840dab3e6e6f06817e3a2"><enum>(3)</enum><header>Travel advisory</header><text display-inline="yes-display-inline">The term <term>Travel Advisory</term> means the country-specific or region-specific safety advisory issued by the Department of State to inform travelers of security risks abroad.</text></paragraph></section><section id="id3383d96a7df547a5a1197fcbe106d520"><enum>5.</enum><header>Warning signage for travelers near land ports of entry along the southern border</header><subsection id="id49abe781275746409e6e2b6b592e2755"><enum>(a)</enum><header>Establishment</header><text>The Secretary of Homeland Security, acting through the Commissioner of U.S. Customs and Border Protection, in consultation with the Secretary of State, shall establish and carry out a program to install and maintain warning signage informing travelers of dangerous areas or routes near the southern border of the United States that have been identified in relevant Department of State Travel Advisories.</text></subsection><subsection id="id2beb72495a6a4334ba46c78c7de81d4f"><enum>(b)</enum><header>Responsibilities of Secretary of State</header><text>The Secretary of State shall—</text><paragraph id="id54af219c492d4905a7bcaac26061b670"><enum>(1)</enum><text>identify areas or routes near the United States land border with Mexico that are designated as dangerous in any Department of State Travel Advisory;</text></paragraph><paragraph id="idb0867c61433543519cbec305abb151e6"><enum>(2)</enum><text>provide the Commissioner of U.S. Customs and Border Protection with updated advisory information necessary for the content of warning signage; and</text></paragraph><paragraph id="id5a21705857ca4fd28d5dfc670ed96314"><enum>(3)</enum><text>provide the Secretary of Homeland Security with the appropriate content and messaging of such signage.</text></paragraph></subsection><subsection id="id27c8f9a19d98430996cc23db200ccc56"><enum>(c)</enum><header>Coordination</header><text>In carrying out this Act, the Secretary of Homeland Security, acting through the Commissioner of U.S. Customs and Border Protection, shall coordinate with the Secretary of State, appropriate State transportation and public safety agencies, and relevant State, local, and tribal government officials.</text></subsection></section><section id="id9225516ef55e4d489cc6182c82c44b71"><enum>6.</enum><header>Placement of signage</header><subsection id="id4fc2782f02714a01b4823c3abd9d23cc"><enum>(a)</enum><header>In general</header><text>The Secretary of Homeland Security, acting through the Commissioner of U.S. Customs and Border Protection, shall install, maintain, and update warning signage described in this Act.</text></subsection><subsection id="idb7144fb62bc44403b77ad1b72ad31316"><enum>(b)</enum><header>Locations</header><text>Warning signage developed pursuant to this Act shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id1b24f1a15e3343b4ae96e0d5b6bd6dee"><enum>(1)</enum><text display-inline="yes-display-inline">be placed—</text><subparagraph id="id7495a6c2acea4b7192081f00c2db0571"><enum>(A)</enum><text>at appropriate United States land ports of entry along the border with Mexico;</text></subparagraph><subparagraph id="id47f77afa0caf4dedb2f050d1a936c7cb"><enum>(B)</enum><text>on all roadways and routes approaching, and in areas immediately adjacent to, such ports of entry where travelers are likely to cross the international boundary;</text></subparagraph><subparagraph id="id81bdcc37e2664c31ad731f535619b229"><enum>(C)</enum><text>at any additional locations determined appropriate by the Secretary of Homeland Security, in consultation with State and local transportation authorities, to ensure adequate traveler awareness;</text></subparagraph><subparagraph id="idb2d2eb73e3f8404c848f7fb42a7979d5"><enum>(D)</enum><text>in locations that are clearly visible to motorists and pedestrians; and</text></subparagraph><subparagraph id="id273cdb581b36483cb9845f4479831e79"><enum>(E)</enum><text>in sufficient proximity to allow travelers to make informed travel decisions; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf8c2ba1458ee40f3910dcf75e464ed69"><enum>(2)</enum><text display-inline="yes-display-inline">include the words <quote>pursuant to the <short-title>Nicholas Douglas Quets Border Travel Safety Act</short-title></quote>.</text></paragraph></subsection><subsection id="id90fcd38aa4104d7c99d637c4a4f98832"><enum>(c)</enum><header>Coordination with State and local authorities</header><text>In placing signage pursuant to this section, the Secretary of Homeland Security shall coordinate with—</text><paragraph id="id79de1021a73e441d820b0a77646507c7"><enum>(1)</enum><text>State departments of transportation;</text></paragraph><paragraph id="id0a7dd16a36074438b6c33e49fb6e84d5"><enum>(2)</enum><text>local government officials; and</text></paragraph><paragraph id="id75de697524d4416b93d0e642e0e7b67c"><enum>(3)</enum><text>other appropriate authorities responsible for roadway infrastructure near the international border of the United States.</text></paragraph></subsection><subsection id="id96b01da15570431db18bf52d816dbb10"><enum>(d)</enum><header>Content of signage</header><text display-inline="yes-display-inline">Signage required under this Act shall—</text><paragraph commented="no" display-inline="no-display-inline" id="ideab74f8564e84eb89deb1991685093df"><enum>(1)</enum><text display-inline="yes-display-inline">clearly warn travelers of nearby areas or routes identified as dangerous in Department of State Travel Advisories;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id03aa9d42a8634ac0b6d6b04f98077d88"><enum>(2)</enum><text display-inline="yes-display-inline">provide a reference to additional safety information, including the Department of State travel advisory website or a QR code linking to such information;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5b1c5c69809b44e6b05f4e83039ccf64"><enum>(3)</enum><text>be displayed in a format that—</text><subparagraph commented="no" display-inline="no-display-inline" id="id5da7b252aff141f7bada2e3ae5d1cf38"><enum>(A)</enum><text display-inline="yes-display-inline">can be swiftly and easily updated to provide timely information to travelers based on the Department of State’s Travel Advisory risk indicators, including crime, terrorism, unrest, health, natural disaster, time-limited event, kidnapping or hostage-taking, wrongful detention, and others; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2497d50e847447a8bc812e1f0325a998"><enum>(B)</enum><text display-inline="yes-display-inline">may include details regarding recent incidents that illustrate the threat level for travelers from the United States;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide92e8b201f564f239be490236076f205"><enum>(4)</enum><text display-inline="yes-display-inline">be displayed in English and Spanish, and any additional languages the Secretary, in consultation with the Department of State, determines appropriate; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3d348ebeb3f14c6eb27093d7e54faab1"><enum>(5)</enum><text display-inline="yes-display-inline">include any other safety information the Secretary of State determines appropriate.</text></paragraph></subsection></section><section id="id5e5d3247c3034951826205f7c2192247"><enum>7.</enum><header>Reviews and updates</header><subsection commented="no" display-inline="no-display-inline" id="id759700dc741e451c880937e3a09db3fe"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary of Homeland Security, in consultation with the Secretary of State, shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id1828ca4f924e43c29737049f4ef5b39a"><enum>(1)</enum><text display-inline="yes-display-inline">annually review warning signage to ensure accuracy and visibility; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idaa98adca7b35444881854088bd5ff678"><enum>(2)</enum><text display-inline="yes-display-inline">update such signage as necessary to reflect changes in Department of State Travel Advisories.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7a37e68439d847e6af70b9159afb1334"><enum>(b)</enum><header>Identification of critical changes</header><text>The Secretary of State shall notify the Secretary of Homeland Security whenever critical changes have occurred that require warning signage to be updated.</text></subsection></section><section id="id3063f8a648d648c39934847ceeef8578"><enum>8.</enum><header>Reports to Congress</header><subsection commented="no" display-inline="no-display-inline" id="id30de4ab0a0584a289f151328dd70eb8b"><enum>(a)</enum><header display-inline="yes-display-inline">Implementation report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Secretary of Homeland Security, in consultation with the Secretary of State and the Commissioner of U.S. Customs and Border Protection, shall submit a report to the appropriate congressional committees that describes—</text><paragraph commented="no" display-inline="no-display-inline" id="id153e61a1774a493597987a251a7c7e25"><enum>(1)</enum><text display-inline="yes-display-inline">the implementation of the signage program required under this Act;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2ba0ea1a0c524357a8f6a7f260beb1f4"><enum>(2)</enum><text display-inline="yes-display-inline">the locations where signage has been installed;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc51103940bd94eefa4583f04e6d4ef3c"><enum>(3)</enum><text display-inline="yes-display-inline">plans for updating such signage; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id948a62e5d3a848e6b7aa2a8bce4be637"><enum>(4)</enum><text display-inline="yes-display-inline">any recommendations for improving traveler awareness of dangerous areas identified in Travel Advisories.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ide124c77065f7476e9ef5034a131017f4"><enum>(b)</enum><header>GAO report</header><text>The Comptroller General of the United States shall submit a report to the appropriate congressional committees that—</text><paragraph commented="no" display-inline="no-display-inline" id="ida79dd13b0fe347bd962b6395bd234cbe"><enum>(1)</enum><text display-inline="yes-display-inline">describes the efficacy of the travel advisory warnings for travelers; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id88ef1279d5c344128258e0db65ef1d75"><enum>(2)</enum><text display-inline="yes-display-inline">indicates whether there are modernizations to warning delivery that the Department of State or the Department of Homeland Security could undertake to ensure travelers have adequate awareness to potential travel-related dangers.</text></paragraph></subsection></section><section id="id6a3d72ba9921462e80bd5d9ad3dbab92"><enum>9.</enum><header>Rule of construction regarding use of force in Mexico</header><text display-inline="no-display-inline">Nothing in this Act may be construed as authorizing the use of force against Mexico or any entity or individual within Mexico.</text></section></legis-body></bill>
