<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 4271</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260326">March 26, 2026</action-date><action-desc><sponsor name-id="S413">Mr. Padilla</sponsor> (for himself and <cosponsor name-id="S435">Mr. Sheehy</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 5, United States Code, to provide rest and recuperation leave for employees engaged in wildland firefighting, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" changed="not-changed"><section section-type="section-one" id="id13a60cb2-72e7-4aba-89f0-49f8b3ebb1be" changed="not-changed"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Support our Firefighters Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id8552cbdd-739b-4446-b8f8-0b014f128a1a" changed="not-changed"><enum>2.</enum><header>Rest and recuperation leave for employees engaged in wildland firefighting</header><subsection id="id7611dd1b-746e-4ccc-abbb-1ac64d9d295d" changed="not-changed"><enum>(a)</enum><header>In general</header><text>Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/63">chapter 63</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id3290941b-54ea-4be7-80d5-f12e654bb3a7" changed="not-changed"><section id="idbdddad20-4c55-4cf3-9c38-7c2b2673b0a1" changed="not-changed"> <enum>6329e.</enum> <header>Rest and recuperation leave for employees engaged in wildland firefighting</header> <subsection id="id0d40cff4-ec01-42e0-96e0-722db9def7f9" changed="not-changed"> <enum>(a)</enum> <header>Definitions</header> <text>In this section—</text>
                            <paragraph id="idc7278cb3-806f-44f6-8f46-56b92950e39b" changed="not-changed">
                                <enum>(1)</enum>
 <text>the term <term>applicable Secretary</term> means the Secretary of Agriculture or the Secretary of the Interior, as applicable to a covered employee;</text>
                            </paragraph>
                            <paragraph id="idae9fe8d9-bfe4-483f-9f31-cea512d062d3" changed="not-changed">
                                <enum>(2)</enum>
 <text>the term <term>covered employee</term> means an employee of the Forest Service or the Department of the Interior who—</text>
                                <subparagraph id="id970ff7b5-2252-4220-a8d1-5b7e6490ed2f" changed="not-changed">
                                    <enum>(A)</enum>
 <text>qualifies as a wildland firefighter based on the definitions of the terms <quote>firefighter</quote> and <quote>wildland firefighter</quote> in section 5332a(a) (applying the definition of <quote>employee</quote> in section 6301(2) in lieu of the definition of <quote>employee</quote> in section 5331(a)); or</text>
                                </subparagraph>
                                <subparagraph id="id5b0aa98c-23ae-43c1-86fe-1ba4f60a605a" changed="not-changed">
                                    <enum>(B)</enum>
 <text>is certified by the applicable Secretary to perform wildland fire incident-related duties during the period the employee is deployed to respond to a qualifying incident; and</text>
                                </subparagraph>
                            </paragraph>
                            <paragraph commented="no" display-inline="no-display-inline" id="idb7554283-5ada-4776-b68f-0bbcc8ddb29f" changed="not-changed">
                                <enum>(3)</enum>
 <text>the term <term>qualifying incident</term> has the meaning given the term in section 5545c(a).</text>
                            </paragraph>
                        </subsection>
                        <subsection id="idc5d33818-0f56-4209-947e-ae1239d3b058" changed="not-changed">
                            <enum>(b)</enum>
                            <header>Rest and recuperation leave</header>
                            <paragraph id="ideae39fa9-c883-484e-ba53-f7dfcc359918" changed="not-changed">
                                <enum>(1)</enum>
                                <header>In general</header>
 <text>A covered employee may receive paid rest and recuperation leave following the completion of service in which the covered employee is deployed to respond to a qualifying incident, subject to the policies prescribed under this subsection.</text>
                            </paragraph>
                            <paragraph commented="no" display-inline="no-display-inline" id="idfe3d3f6d-1c13-40e4-ae00-124c2ab7d71c" changed="not-changed">
                                <enum>(2)</enum>
                                <header>Prescription of policies</header>
 <text display-inline="yes-display-inline">The Secretary of Agriculture and the Secretary of the Interior shall, in the sole and exclusive discretion of the Secretaries acting jointly, prescribe uniform policies described in paragraph (1) after consulting with the other applicable Secretary.</text>
                            </paragraph>
                            <paragraph commented="no" display-inline="no-display-inline" id="idd63edada-57c4-46a3-87e1-f504d6ba7109" changed="not-changed">
                                <enum>(3)</enum>
                                <header>Content of policies</header>
 <text>The policies prescribed under paragraph (2) may include—</text>
                                <subparagraph commented="no" display-inline="no-display-inline" id="id07df707b-588d-472b-b2c5-b43a2384fb9d" changed="not-changed">
                                    <enum>(A)</enum>
 <text display-inline="yes-display-inline">a maximum period of days in which a covered employee is deployed to respond to a qualifying incident, which shall—</text>
                                    <clause commented="no" display-inline="no-display-inline" id="idaeec2b3f-5c4b-4ef2-8937-4241ea3ac34e" changed="not-changed">
                                        <enum>(i)</enum>
 <text display-inline="yes-display-inline">begin on the date on which the covered employee departs from the official duty station of the covered employee and end on the date on which the covered employee returns to the official duty station of the covered employee; and</text>
                                    </clause>
                                    <clause commented="no" display-inline="no-display-inline" id="idf30655e4-000e-4788-8ea3-7a134dc2e184" changed="not-changed">
                                        <enum>(ii)</enum>
 <text>be followed by a minimum number of days of rest and recuperation for the covered employee;</text>
                                    </clause>
                                </subparagraph>
                                <subparagraph commented="no" display-inline="no-display-inline" id="idf79413b77fec4413a640556feabfefd5" changed="not-changed">
                                    <enum>(B)</enum>
 <text>a requirement to use 3 days of rest and recuperation leave after a 14-day period during which the covered employee is deployed to respond to a qualifying incident, excluding travel to and from assignments; or</text>
                                </subparagraph>
                                <subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="id5d81736ebf4747619997f313a87341b7">
                                    <enum>(C)</enum>
 <text>a requirement to use 4 days of rest and recuperation leave after a 21-day period during which the covered employee is deployed to respond to a qualifying incident, including travel to and from assignments.</text>
                                </subparagraph>
                            </paragraph>
                        </subsection>
                        <subsection id="id6847c946-941d-4989-bb12-b74978c1cf91" changed="not-changed">
                            <enum>(c)</enum>
                            <header>Use of leave</header>
                            <paragraph commented="no" display-inline="no-display-inline" id="id3e95985a-dd53-430e-9166-9feba44d7446" changed="not-changed">
                                <enum>(1)</enum>
                                <header display-inline="yes-display-inline">In general</header>
 <text>Rest and recuperation leave granted under this section—</text> <subparagraph commented="no" display-inline="no-display-inline" id="idf6a6d1e7-9c84-406e-861d-ee092ef29c45" changed="not-changed"> <enum>(A)</enum> <text display-inline="yes-display-inline">shall be used during scheduled hours within the tour of duty of the applicable covered employee established for leave-charging purposes;</text>
                                </subparagraph>
                                <subparagraph commented="no" display-inline="no-display-inline" id="idb89cd670-0481-4846-8ee3-16b893b44b27" changed="not-changed">
                                    <enum>(B)</enum>
 <text display-inline="yes-display-inline">shall be paid in the same manner as annual leave;</text>
                                </subparagraph>
                                <subparagraph commented="no" display-inline="no-display-inline" id="id0ebdb2ab-3b11-45a4-80a5-4a2703782a22" changed="not-changed">
                                    <enum>(C)</enum>
 <text display-inline="yes-display-inline">shall be used immediately after a qualifying incident; and</text>
                                </subparagraph>
                                <subparagraph commented="no" display-inline="no-display-inline" id="id6b91c70d-692b-45ad-8425-54c1de6a7aaf" changed="not-changed">
                                    <enum>(D)</enum>
 <text display-inline="yes-display-inline">may not be set aside for later use.</text>
                                </subparagraph>
                            </paragraph>
                            <paragraph commented="no" display-inline="no-display-inline" id="ide24bf62d-4b24-426e-be3f-f70933fe6a63" changed="not-changed">
                                <enum>(2)</enum>
                                <header>No payment</header>
 <text display-inline="yes-display-inline">A covered employee may not receive any payment for unused rest and recuperation leave granted under this section.</text>
                            </paragraph>
                        </subsection>
                        <subsection id="idbcb2057e-2d16-46fc-ae14-1f4f3ce619a3" changed="not-changed">
                            <enum>(d)</enum>
                            <header>Intermittent work schedule</header>
 <text>A covered employee with an intermittent work schedule—</text> <paragraph commented="no" display-inline="no-display-inline" id="id125c2f00-c46e-467a-a2f8-5694fcf55a86" changed="not-changed"> <enum>(1)</enum> <text display-inline="yes-display-inline">shall be excused from duty during the same period of time that other covered employees in the same circumstances are entitled to rest and recuperation leave; and</text>
                            </paragraph>
                            <paragraph commented="no" display-inline="no-display-inline" id="id1c81f627-b88b-4aca-a05d-4512c5830bb2" changed="not-changed">
                                <enum>(2)</enum>
 <text display-inline="yes-display-inline">shall receive a payment as if the covered employee were entitled to rest and recuperation leave under subsection (b).</text>
                            </paragraph>
                        </subsection>
 </section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id365717ef-bbea-40bc-b770-09847a0240d4" changed="not-changed"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of sections for subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/63">chapter 63</external-xref> of title 5, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/5/6329d">section 6329d</external-xref> the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb9a8a3b6-8a9c-4cdf-bc48-74bd6895f109" changed="not-changed"><toc changed="not-changed"><toc-entry bold="off" level="section" changed="not-changed">6329e. Rest and recuperation leave for employees engaged in wildland firefighting.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id678616de-2ebe-47f3-83be-a5b73d9a5302" changed="not-changed"><enum>3.</enum><header>Transfer authority</header><text display-inline="no-display-inline">Notwithstanding section 40803(c)(2) of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6592">16 U.S.C. 6592(c)(2)</external-xref>), not more than $5,000,000 of the unobligated balances of amounts made available under the heading <quote><header-in-text level="appropriations-small" style="appropriations">Wildland Fire Management</header-in-text></quote> under the heading <quote><header-in-text level="appropriations-intermediate" style="OLC">Forest Service</header-in-text></quote> under the heading <quote><header-in-text level="appropriations-major" style="OLC">Department of Agriculture</header-in-text></quote> in title VI of division J of that Act (<external-xref legal-doc="public-law" parsable-cite="pl/117/58">Public Law 117–58</external-xref>; 135 Stat. 1410) pursuant to section 40803(c)(2)(B) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6592">16 U.S.C. 6592(c)(2)(B)</external-xref>) may, as necessary to continue uninterrupted the Federal wildland firefighter base salary increase described in section 40803(d)(4)(B) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6592">16 U.S.C. 6592(d)(4)(B)</external-xref>), including premium pay authorized under section 1701 of the Extending Government Funding and Delivering Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/5/5547">5 U.S.C. 5547</external-xref> note) (as amended by this Act), be transferred to and merged with the amounts made available under the heading <quote><header-in-text level="appropriations-small" style="OLC">Wildland Fire Management</header-in-text></quote> under the heading <quote><header-in-text level="appropriations-intermediate" style="OLC">Department-wide programs</header-in-text></quote> under the heading <quote><header-in-text level="appropriations-major" style="OLC">Department of the Interior</header-in-text></quote> in title VI of division J of that Act (<external-xref legal-doc="public-law" parsable-cite="pl/117/58">Public Law 117–58</external-xref>; 135 Stat. 1393).</text></section><section changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idf51495942bac41cd866708e5eb23df48"><enum>4.</enum><header>Waiver of overtime caps for wildland firefighters</header><text display-inline="no-display-inline">Section 1701 of the Extending Government Funding and Delivering Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/5/5547">5 U.S.C. 5547</external-xref> note) is amended—</text><paragraph id="idc811f044510c44a3b7a066fb66fa71f9"><enum>(1)</enum><text>in subsection (a)(1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="ide6136c399f4d457bae74c8eec8d0ac96"><enum>(A)</enum><text>in the first sentence, by striking <quote>or 2022 or 2023 or 2024</quote> and inserting <quote>or any calendar year thereafter</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide92129969c4246489fb2df88eb12181e"><enum>(B)</enum><text>in the second sentence—</text><clause commented="no" display-inline="no-display-inline" id="iddccda995f2e1465cb008e547e77949dc"><enum>(i)</enum><text>by striking <quote>Services</quote> and inserting <quote>services</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id6e8f768cc5fb4f7f89eba3a1d14cca52"><enum>(ii)</enum><text>by striking <quote>subsection</quote> and inserting <quote>subsection.</quote>;</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0e7d51676e704632a845d132327957e6"><enum>(2)</enum><text>in subsection (b), by striking <quote>2021 or 2022 or 2023 or 2024</quote> and inserting <quote>the applicable calendar year</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idad6324d28c304bcb93d384c7993dfafd"><enum>(3)</enum><text>in subsection (c), by striking <quote>2021 or 2022 or 2023 or 2024</quote> and inserting <quote>the applicable calendar year</quote>.</text></paragraph></section></legis-body></bill>
