<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 4261</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260326">March 26, 2026</action-date><action-desc><sponsor name-id="S229">Mrs. Murray</sponsor> (for herself, <cosponsor name-id="S288">Ms. Murkowski</cosponsor>, <cosponsor name-id="S406">Mr. Kelly</cosponsor>, and <cosponsor name-id="S383">Mr. Sullivan</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To award grants to eligible entities to support the prevention of youth homelessness.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preventing Youth Homelessness Demonstration Act of 2026</short-title></quote>.</text></section><section id="id66fae4c47abf451eb5a981388403592c"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id363c7d7750494c09b64e8a720723fc58"><enum>(1)</enum><header>Appropriate committees of congress</header><text>The term <term>appropriate committees of Congress</term> means—</text><subparagraph id="ide263fdddde814a93a460a696198e806f"><enum>(A)</enum><text>the Committee on Appropriations of the Senate;</text></subparagraph><subparagraph id="ida379ec367041456099f0d6a28e75fb56"><enum>(B)</enum><text>the Committee on Health, Education, Labor, and Pensions of the Senate;</text></subparagraph><subparagraph id="id8eb139537c804ca89432f964d4b7d0f4"><enum>(C)</enum><text>the Committee on Appropriations of the House of Representatives; and</text></subparagraph><subparagraph id="id1c8296fdab2c4a04b72aef1fb6387506"> <enum>(D)</enum> <text>the Committee on Education and Workforce of the House of Representatives.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id31e392d4762d4e8b9d0f91dc3a4e071d"><enum>(2)</enum><header>At-risk of homelessness</header><text>The term <term>at-risk of homelessness</term>, with respect to an individual, means that the individual is more likely than not to imminently experience homelessness, which shall be determined by the Secretary with respect to an individual based on—</text><subparagraph commented="no" display-inline="no-display-inline" id="id06f6994022f04ab0960d6a707b1630d3"><enum>(A)</enum><text display-inline="yes-display-inline">research and data at the time of the determination; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id011bd9b2979447c7bad9a29595f1cd49"><enum>(B)</enum><text display-inline="yes-display-inline">the circumstances and demographics of the individual.</text></subparagraph></paragraph><paragraph id="id2beae3691fcd465f9befde67f9778db5"><enum>(3)</enum><header>Continuum of Care</header><text>The term <term>Continuum of Care</term> has the meaning given the term in section 578.3 of title 24, Code of Federal Regulations, or any successor regulations.</text></paragraph><paragraph id="id71CB79957CA1420E8DF92DB5FC2C090D"><enum>(4)</enum><header>Covered individual</header><text>The term <term>covered individual</term> means—</text><subparagraph id="idA1D1550BB9DB4402B134EEA63DE1D067"><enum>(A)</enum><text>an individual who is between the ages of 12 and 26 and who is—</text><clause commented="no" display-inline="no-display-inline" id="id09a381130d0c43278cf09ac52d623b34"><enum>(i)</enum><text display-inline="yes-display-inline">at-risk of homelessness; or</text></clause><clause id="id722627A6560B4AACBA0DD56380055CF6"><enum>(ii)</enum><text>at risk of entering, or transitioning out of, a public system, foster care, the juvenile justice system, or a residential behavioral health system; or</text></clause></subparagraph><subparagraph id="id938794E4F65E4EF69E3FBE0BECE78E54"> <enum>(B)</enum> <text>a child of an individual described in subparagraph (A).</text>
 </subparagraph></paragraph><paragraph id="id9e5ea19c1341441d865acea37063316e"><enum>(5)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means any of the following:</text><subparagraph id="id6804a204641f4139a755a0c6e4d304a8"><enum>(A)</enum><text>A State agency, including a State educational agency.</text></subparagraph><subparagraph id="id5ff4c453788949268c256629dbad814b"><enum>(B)</enum><text>A city, county, or other unit of general local government.</text></subparagraph><subparagraph id="idf288178d21c94c6bae45c7315644c44e"><enum>(C)</enum><text>A local educational agency.</text></subparagraph><subparagraph id="id3a5ba51e37204fba9ddc53e647a60d87"><enum>(D)</enum><text>A Continuum of Care.</text></subparagraph><subparagraph commented="no" id="idae9c54c98cc84b3483842f35c5695ca3"><enum>(E)</enum><text>An Indian Tribe, Native Hawaiian organization, or tribally designated housing entity.</text></subparagraph><subparagraph id="id20f75e07a43142109a0a8d09d3502efa"><enum>(F)</enum><text>Any entity eligible for assistance under section 312 of the Runaway and Homeless Youth Act (<external-xref legal-doc="usc" parsable-cite="usc/34/11212">34 U.S.C. 11212</external-xref>).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb254f624537e4edb96dbb97d8a791274"><enum>(6)</enum><header>Homelessness</header><text>The term <term>homelessness</term> means being—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb1c1a4dd690144a8968af6bc78666e4b"><enum>(A)</enum><text display-inline="yes-display-inline">a homeless child or youth (as defined in section 725 of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11434a">42 U.S.C. 11434a</external-xref>)); or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8cea5c8e6de4435f922769d02f71a69c"><enum>(B)</enum><text display-inline="yes-display-inline">homeless (as defined in section 387 of the Runaway and Homeless Youth Act (<external-xref legal-doc="usc" parsable-cite="usc/34/11279">34 U.S.C. 11279</external-xref>)).</text></subparagraph></paragraph><paragraph id="ID569E39A7AE294A8BB8194A9568303F9E"><enum>(7)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the <act-name parsable-cite="ISDA">Indian Self-Determination and Education Assistance Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="id06b6411d8bbb443083d115b10ccd4df9"><enum>(8)</enum><header>Local educational agency</header><text>The term <term>local educational agency</term> has the meaning given the term in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph><paragraph id="idf016b4ecb6f54ea8bfb9024fda67bfa0"><enum>(9)</enum><header>Native hawaiian organization</header><text>The term <term>Native Hawaiian organization</term> has the meaning given the term in section 6207 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7517">20 U.S.C. 7517</external-xref>).</text></paragraph><paragraph id="id0bab00112d5b4906af3ba1d92386c90d"><enum>(10)</enum><header>Prevention of homelessness</header><text>The terms <term>prevention of homelessness</term> and <term>prevent homelessness</term> mean the act of, through policies, practices, or interventions, reducing the likelihood that a covered individual who is currently housed will imminently experience homelessness.</text></paragraph><paragraph id="id0d6e90eac55e497fbd2037ff715511c1"><enum>(11)</enum><header>Rural area</header><text>The term <term>rural area</term> has the meaning given the term in section 601(b) of the Rural Electrification Act of 1936 (<external-xref legal-doc="usc" parsable-cite="usc/7/950bb">7 U.S.C. 950bb(b)</external-xref>).</text></paragraph><paragraph commented="no" id="idc051e054c4ca49afa42d43fff93d57ec"><enum>(12)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Health and Human Services, acting through the Assistant Secretary for the Administration for Children and Families of the Department of Health and Human Services.</text></paragraph><paragraph id="idADA87768E27B4B3B8CCC68DE5B6C5C32"><enum>(13)</enum><header>State</header><text>The term <term>State</term> means—</text><subparagraph id="id100b2aea02a94ac4b6fd4d5bb04a043e"><enum>(A)</enum><text>any State of the United States;</text></subparagraph><subparagraph id="idb56577fdfcda450fbdbb73bd71e812fb"><enum>(B)</enum><text>the District of Columbia; and</text></subparagraph><subparagraph id="id557014fea77244a6a4af3fb9a0d36c86"><enum>(C)</enum><text>the Commonwealth of Puerto Rico.</text></subparagraph></paragraph><paragraph id="id3e5fc8278b224949a0fcf330603ad0f0"><enum>(14)</enum><header>State educational agency</header><text>The term <term>State educational agency</term> has the meaning given the term in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph></section><section id="id797ca740cdf0464eac839b873b420b1c"><enum>3.</enum><header>Preventing Youth Homelessness Demonstration Grant Program</header><subsection id="id2f9720e9e59943b2a77f6ec6b8f73714"><enum>(a)</enum><header>Program established; consultation</header><paragraph commented="no" display-inline="no-display-inline" id="id633b763ac50047f689c6e962874adb2f"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish a grant program, to be known as the <quote>Preventing Youth Homelessness Demonstration Grant Program</quote> (referred to in this section as the <term>Program</term>), under which the Secretary shall make grants to eligible entities to identify and implement strategies and services for covered individuals in order to prevent homelessness.</text></paragraph><paragraph id="idd3ce526e6ab94c889cc39a5493bed538"> <enum>(2)</enum> <header>Consultation with other Federal agencies</header> <text>In establishing the Program under paragraph (1), the Secretary shall—</text>
                    <subparagraph id="id1c44e18deaae4609b1b3f3e832f714ef">
                        <enum>(A)</enum>
 <text>consult with—</text> <clause id="id7de31142687a4e9a9195cd4af83eb1c7"> <enum>(i)</enum> <text>the Secretary of Housing and Urban Development;</text>
                        </clause>
                        <clause id="id3e21ea4866974c3daa6977df71cef2e9">
                            <enum>(ii)</enum>
 <text>the Executive Director of the United States Interagency Council on Homelessness;</text>
                        </clause>
                        <clause id="id8f9b51e0c32843fa800478a8a7602d6b">
                            <enum>(iii)</enum>
 <text>the Secretary of Education;</text> </clause> <clause id="id0fae88427b8b472eaa37de2248c66df0"> <enum>(iv)</enum> <text>the Attorney General;</text>
                        </clause>
                        <clause id="idb420be0a332a400590a76c4f804a198f">
                            <enum>(v)</enum>
 <text>the Secretary of the Interior;</text> </clause> <clause id="id5c6b2ccf64f54c6b8b846c1956a58d91"> <enum>(vi)</enum> <text>the Secretary of Agriculture;</text>
                        </clause>
                        <clause id="id5301282391914da199636fafb0119074">
                            <enum>(vii)</enum>
 <text>the Secretary of Labor;</text> </clause> <clause id="id53b56ca5d49e4f54828970a1bd766711"> <enum>(viii)</enum> <text>the Assistant Secretary for Mental Health and Substance Use of the Department of Health and Human Services; and</text>
                        </clause>
                        <clause id="id3c17a60feade4b27a495c3e5f62314d9">
                            <enum>(ix)</enum>
 <text>the head of any other agency that the Secretary determines to be appropriate; and</text>
                        </clause>
                    </subparagraph>
                    <subparagraph id="id3e79df0bafcc49d081590700ab85250d">
                        <enum>(B)</enum>
 <text>ensure that the Program complements and enhances, and does not conflict with, other initiatives and programs that serve covered individuals.</text>
                    </subparagraph>
 </paragraph></subsection><subsection id="id36fc9c7e7c894f7bbfa6c737782890f2"><enum>(b)</enum><header>Application</header><text>An eligible entity desiring a grant under the Program shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require, including—</text><paragraph id="iddb82a14771094a13a3e33f119737345c"><enum>(1)</enum><text>a coordinated community prevention plan that—</text><subparagraph id="idf465de1c8db24982afd997806e081dc4"><enum>(A)</enum><text>assesses the scale and scope of need for activities for the prevention of homelessness for covered individuals within the community that will be served by the eligible entity with grant funds;</text></subparagraph><subparagraph id="iddc16ae97a1f6419fa08306ef03d075eb"><enum>(B)</enum><text>outlines how the eligible entity will identify and support covered individuals who are most at-risk of homelessness in the community; and</text></subparagraph><subparagraph id="id422c1652993546b59bc5e1ed30a68537"><enum>(C)</enum><text>outlines how grant funds will be used, in accordance with subsection (d), along with other funding sources, to implement targeted strategies that meet the needs of covered individuals; and</text></subparagraph></paragraph><paragraph id="id5ec71165ffb544c4a781915df96e6f29"><enum>(2)</enum><text>a description of how the eligible entity plans—</text><subparagraph id="id9ce02f489a7b41679a331cf2a00b3fb3"><enum>(A)</enum><text>to establish cross-system partnerships with Federal, State, or local agencies for the prevention of homelessness for covered individuals and with other entities or organizations that serve youth in the community, such as—</text><clause id="id0F944F617849496396A0460F3D48DAA5"><enum>(i)</enum><text>a local educational agency;</text></clause><clause id="id0321901756DD4B35BCB480AA2A5B8D1B"><enum>(ii)</enum><text>a public housing agency;</text></clause><clause id="id242c15d6ffd241759512716b78695373"><enum>(iii)</enum><text>a Continuum of Care;</text></clause><clause id="id1535D86036B94662A6A308AA87123068"><enum>(iv)</enum><text>a housing provider;</text></clause><clause id="id6B803285BE6C46F1BB420414445A3522"><enum>(v)</enum><text>a State, Tribal, or local child welfare agency;</text></clause><clause id="idCE081301AC0641859A004D92388ED19F"><enum>(vi)</enum><text>a behavioral health and substance use disorder provider;</text></clause><clause id="id1779A5240AF2400181A9C06B8E4F0A89"><enum>(vii)</enum><text>a delinquency prevention program;</text></clause><clause id="idAE2848D7F786418391A64BD509AB8F90"><enum>(viii)</enum><text>the juvenile court system;</text></clause><clause id="id5C2DFC90B453403D95B41845EF3E02C6"><enum>(ix)</enum><text>an organization that serves pregnant or parenting youth and their children; and</text></clause><clause id="id4C07749721C545879DEEC43FB57DC5FA"><enum>(x)</enum><text>any other agency or organization with the capacity to identify risk factors for homelessness for covered individuals; and</text></clause></subparagraph><subparagraph id="idcef45079b5104af7a65c897413f28e84"><enum>(B)</enum><text>deliver trauma-informed collaborative interventions to address the risk factors described in subparagraph (A)(x).</text></subparagraph></paragraph></subsection><subsection id="idef9f8395d25e47ab8c0a22cf04d37fb4"><enum>(c)</enum><header>Award of grants</header><paragraph id="idc3fe09d5d6d54ebba2dad43536b6065c"><enum>(1)</enum><header>Factors considered in award of grants</header><text>In selecting eligible entities to receive grants under the Program, the Secretary, to the maximum extent practicable, shall consider—</text><subparagraph id="id3e880a0ae878411f9a5ea083be6eafd5"><enum>(A)</enum><text>an eligible entity’s established partnerships with local stakeholders for the prevention of homelessness for covered individuals in order to deliver collaborative interventions;</text></subparagraph><subparagraph id="id296325e18ab64240a336bb0634996dd2"><enum>(B)</enum><text>the comparative geographic diversity of the applicant in relation to other eligible entities receiving grants under the Program;</text></subparagraph><subparagraph id="idba8abf65ea524fde96451102375cacaa"><enum>(C)</enum><text>the extent to which an applicant's proposed use of grant funds may duplicate or conflict with other programs; and</text></subparagraph><subparagraph id="idfcaccf26f90b470ea9f5797aa3513300"><enum>(D)</enum><text>the opportunity to sustain and grow progress achieved through prior Federal investments in youth homelessness prevention, including progress achieved through a grant awarded under the Runaway and Homeless Youth Prevention Demonstration Program pursuant to section 343 of the Runaway and Homeless Youth Act (<external-xref legal-doc="usc" parsable-cite="usc/34/11243">34 U.S.C. 11243</external-xref>).</text></subparagraph></paragraph><paragraph id="ide715518d7fd24e4d8600e0e6b05ab3cc"><enum>(2)</enum><header>Grants reserved</header><text>Each fiscal year, the Secretary shall award—</text><subparagraph id="idd477efb82e944d7799a4219ddf135fe9"><enum>(A)</enum><text>not less than 5 percent of the total amount of grant funding made available to carry out this section to 1 or more Indian Tribes and Native Hawaiian organizations;</text></subparagraph><subparagraph id="id00d779b2ead74c32b185ec17fa7d6001"><enum>(B)</enum><text>not less than 10 percent of the total amount of grant funding made available to carry out this section to 1 or more eligible entities that serve a rural area; and</text></subparagraph><subparagraph id="id1251fefe3b3a48c5986297dc0b9355cc"><enum>(C)</enum><text>beginning with the third fiscal year of administering the Program, not less than 5 percent of the total amount of grant funding made available to carry out this section to 1 or more eligible entities that received a grant under section 4 in a previous fiscal year.</text></subparagraph></paragraph><paragraph id="id9061adce0ed048769ff1a767579d257b"><enum>(3)</enum><header>Award term; amount</header><subparagraph commented="no" display-inline="no-display-inline" id="id09d521c7215447fb89d35b6bc551b432"><enum>(A)</enum><header>In general</header><text>The period of a grant awarded under the Program shall be 5 years.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc8020e98804142c981659ac75c953d7c"><enum>(B)</enum><header display-inline="yes-display-inline">Amount</header><text display-inline="yes-display-inline">The amount of a grant awarded under the Program shall be not less than $3,000,000 and not greater than $7,500,000.</text></subparagraph></paragraph></subsection><subsection id="idbc017aabd94f443b83007463610ea1e5"><enum>(d)</enum><header>Use of funds</header><paragraph id="idc049e61314554212ab90471d282080d0"><enum>(1)</enum><header>In general</header><text>An eligible entity that receives a grant under the Program shall use the grant funds for the prevention of homelessness for covered individuals, which shall be carried out after consideration of recommendations of the Youth Homelessness Prevention Council established in accordance with paragraph (2), and shall include 1 or more of the following activities:</text><subparagraph id="idd6246193f0ed46098851b3f2de30e006"><enum>(A)</enum><text>Primary prevention services to support covered individuals in crises, such as case management, physical and behavioral health services, employment support and job training, conflict resolution, educational programming, child care, supports for pregnant or parenting youth and young adults and their children, short-term housing, and direct financial assistance or material resources to help with achieving economic stability and overcoming housing instability.</text></subparagraph><subparagraph id="id34e761c73d6e4d80b37b9b415f2195b2"><enum>(B)</enum><text>Improvement of cross-system collaboration and collaboration among programs within the applicable community to better identify and serve covered individuals, such as the design of a comprehensive well-being service system for covered individuals before and during periods of crisis.</text></subparagraph></paragraph><paragraph commented="no" id="id0f658aa6c60b4e428ad3db1b21e7a1b9"><enum>(2)</enum><header>Youth Homelessness Prevention Council</header><subparagraph commented="no" id="idAFCCB59C937D437292DC6C82B2D112EF"><enum>(A)</enum><header>Composition</header><text>An eligible entity that receives a grant under the Program shall establish a Youth Homelessness Prevention Council, which shall be comprised—</text><clause commented="no" id="idCB7D8F2BC2434AEE837297053EFC5A86"><enum>(i)</enum><text>primarily of youth and young adults—</text><subclause commented="no" id="id0E7192DAF2AC44F8A8436FE8339C5102"><enum>(I)</enum><text>who are experiencing homelessness;</text></subclause><subclause commented="no" id="idBB3E7117D74F4DFFA55C1CB6F4C0BADE"><enum>(II)</enum><text>who have experienced homelessness; or</text></subclause><subclause commented="no" id="idAA02D78A29C44EB687FF277AE9BDD5B9"><enum>(III)</enum><text>who were prevented from experiencing homelessness due to a specific intervention; and</text></subclause></clause><clause commented="no" id="id218B525E605342AEBDC9BF26CAB617AF"><enum>(ii)</enum><text>of representatives from child welfare systems, local educational agencies, the youth justice system, or behavioral health providers.</text></clause></subparagraph><subparagraph commented="no" id="idB7D5EDF0C04643259AEF3066CE32366F"><enum>(B)</enum><header>Duties</header><text>A Youth Homelessness Prevention Council established under subparagraph (A) shall be responsible for providing recommendations to the eligible entity about grant activities.</text></subparagraph></paragraph><paragraph id="id1f2281aa6955446da292aefe943119cd"><enum>(3)</enum><header>Time limitations</header><text>With respect to a grant awarded to an eligible entity under the Program, the eligible entity—</text><subparagraph id="idf0837e0b9c974050ab83da32fcad05b0"><enum>(A)</enum><text>except as provided in subparagraph (B), shall expend the grant amounts during the 3-year period beginning on the date on which the eligible entity is awarded the grant; and</text></subparagraph><subparagraph id="idf3830876e6324adebe602a3cb772a38a"><enum>(B)</enum><text>during the 2-year period beginning on the date that is 3 years after the date on which the entity is awarded the grant, shall continue to measure and evaluate the activities supported with the grant.</text></subparagraph></paragraph></subsection><subsection id="idf4ade4924b67431f8c5ddb0c0ab45b52"><enum>(e)</enum><header>Federal share</header><paragraph id="id2c5982033be64843a622e5a015d8c756"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the Federal share of any project for which the Secretary awards a grant under the Program shall not exceed 90 percent.</text></paragraph><paragraph id="id7b6595204dc540fa870ffe8b6b191cc4"><enum>(2)</enum><header>Exception</header><text>The Secretary may grant a waiver with respect to the limitation on the Federal share of a project described in paragraph (1) if—</text><subparagraph id="id213c61f46fd8433080173b2748d053a5"><enum>(A)</enum><text>the applicant with respect to the project petitions the Secretary for the waiver; and</text></subparagraph><subparagraph id="ide51ee9a0df8f4d4890d63ca24e1705d9"><enum>(B)</enum><text>the Secretary determines that the petition described in subparagraph (A) demonstrates financial need.</text></subparagraph></paragraph></subsection><subsection id="id62c6a2bfe9f14a8bb01173a01fd17162"><enum>(f)</enum><header>Reporting and information requirements</header><paragraph id="id87C094FD2E64433F9866970FB6B52637"><enum>(1)</enum><header>Report</header><text>Not later than 15 months after the date on which an eligible entity is awarded a grant under the Program, and annually thereafter for the duration of the grant period, the eligible entity shall submit to the Secretary a report that describes—</text><subparagraph commented="no" id="ida0241c95bbcd40a0b29f862d6fc90dd8"><enum>(A)</enum><text>how the eligible entity used grant funds during the preceding 15-month or 1-year period, as applicable;</text></subparagraph><subparagraph commented="no" id="idBFF3029DFF0F4B3D8CE08C2B6FF63296"><enum>(B)</enum><text>the measurement and evaluation of the activities carried out by the eligible entity with grant funds during such period; and</text></subparagraph><subparagraph commented="no" id="id05ecb010ecb344a5a969b72a5a93a121"><enum>(C)</enum><text>the progress of the eligible entity towards fulfilling the objectives for which the grant was awarded.</text></subparagraph></paragraph><paragraph commented="no" id="idCEB34C6D2CC342AEA5D6528AF6030FE9"><enum>(2)</enum><header>Additional requirements</header><text>The Secretary may establish—</text><subparagraph id="id599198902f7b48cf8b98853679a503c8"><enum>(A)</enum><text>mechanisms to ensure appropriate use of, and compliance with respect to all terms regarding, grant funds awarded under the Program; and</text></subparagraph><subparagraph id="id10cb5ad35d004dd49babc15c277a5992"><enum>(B)</enum><text>additional reporting and information requirements for any recipient of a grant under the Program.</text></subparagraph></paragraph></subsection><subsection commented="no" id="id50dd10e520e0430eaa15c9b007d36af7"><enum>(g)</enum><header>Administrative costs</header><text>An eligible entity receiving a grant under the Program may use not greater than 10 percent of the amount of the grant for administrative costs in carrying out the activities described in subsection (d) and preparing and submitting a report under subsection (f)(1) (including relevant evaluation activities).</text></subsection><subsection commented="no" id="idec799b6dd4314bab957a51854b53ea68"><enum>(h)</enum><header>Supplement not supplant</header><text>Funds made available to an eligible entity under the Program shall be used by the eligible entity to supplement, and not supplant, other Federal, State, Tribal, and local funds that would otherwise be used by the eligible entity to carry out activities described in this section.</text></subsection><subsection id="id60dced0466f447e88a9a2df817df901e"><enum>(i)</enum><header>Reservation of funds</header><text>The Secretary may reserve not more than 10 percent of amounts made available for a fiscal year to carry out this section for the implementation and administration of the Program, which shall include—</text><paragraph id="id10bb52c2d58a423ba0f3c02f1309187e"><enum>(1)</enum><text>providing technical support and assistance to eligible entities, including ensuring consistency in data collection and reporting;</text></paragraph><paragraph id="id2799e794dccb4c35aea585b55e628032"><enum>(2)</enum><text>providing assistance to eligible entities to prepare the applications of those eligible entities with respect to grants awarded under the Program;</text></paragraph><paragraph id="id334410a5af6941ccb548f13d8fffef4a"><enum>(3)</enum><text>developing the report required under section 5; and</text></paragraph><paragraph id="id5741ea09248a467d9075ebefd916bda6"><enum>(4)</enum><text>conducting outreach to eligible entities regarding opportunities to apply for such a grant.</text></paragraph></subsection><subsection id="id1bb38e3407854d30af757bc2908990e8"><enum>(j)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section—</text><paragraph id="idec8a6eb8dfda413986ac0e9dc21ca2a7"><enum>(1)</enum><text>$85,000,000 for each of fiscal years 2026 through 2030; and</text></paragraph><paragraph id="id864e8b465cfb4250a6c5e65e4275dbb8"><enum>(2)</enum><text>such sums as may be necessary for fiscal year 2031 and each fiscal year thereafter.</text></paragraph></subsection></section><section id="idfff851d7f4204f93b9dc4dc058c09658"><enum>4.</enum><header>Preventing Youth Homelessness Capacity Grant Program</header><subsection id="id68b4ef3c387e4404a2554d4188439598"><enum>(a)</enum><header>Program established; consultation</header><paragraph id="id707caa5969764e15a3cba60466d907cd"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish a grant program, to be known as the <quote>Preventing Youth Homelessness Capacity Grant Program</quote> (referred to in this section as the <term>Capacity Grant Program</term>) under which the Secretary shall make planning grants to eligible entities to better assess the causes of and extent of homelessness of covered individuals within the communities served by such eligible entities to enable such eligible entities to apply for a grant under section 3.</text></paragraph><paragraph id="id4e2ad906bbb748af8e7f978288c74e7c"><enum>(2)</enum><header>Consultation with other Federal agencies</header><text>In establishing the Capacity Grant Program under paragraph (1), the Secretary shall—</text><subparagraph id="ida476d518802f41eba79d00548e298474"><enum>(A)</enum><text>consult with—</text><clause id="id80e1affa28a74a7b8103098008d18aa7"><enum>(i)</enum><text>the Secretary of Housing and Urban Development;</text></clause><clause id="id2e43fd97a9d440c89cbe8e0cba733c04"><enum>(ii)</enum><text>the Executive Director of the United States Interagency Council on Homelessness;</text></clause><clause id="idf2f57eeec41e4eae977a4ad2ca85bec1"><enum>(iii)</enum><text>the Secretary of Education;</text></clause><clause id="id0b6833d280bb4de49f8261400a6deb0c"><enum>(iv)</enum><text>the Attorney General;</text></clause><clause id="id562ecf6e1b504b998d607daf3b848f19"><enum>(v)</enum><text>the Secretary of the Interior;</text></clause><clause id="id2087939b035647fe8c68b35eed005b90"><enum>(vi)</enum><text>the Secretary of Agriculture;</text></clause><clause id="id62b80a6a77994e9981f88dd2e189945f"><enum>(vii)</enum><text>the Secretary of Labor;</text></clause><clause id="id276b5509160641dbbf755128c2cd8ad0"><enum>(viii)</enum><text>the Assistant Secretary for Mental Health and Substance Use at the Department of Health and Human Services; and</text></clause><clause id="idb383a98ab9b74ce0b5e8469608679917"><enum>(ix)</enum><text>the head of any other agency that the Secretary determines to be appropriate; and</text></clause></subparagraph><subparagraph id="idd573947aa80041bbb31017bbd3e7477c"><enum>(B)</enum><text>ensure that the Capacity Grant Program complements and enhances, and does not conflict with, other initiatives and programs for the prevention of homelessness for covered individuals.</text></subparagraph></paragraph></subsection><subsection id="id4e7a2527653e4ae987b062c51863f4b0"><enum>(b)</enum><header>Application</header><text>An eligible entity desiring a grant under the Capacity Grant Program shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require, including a coordinated community capacity-building plan that details—</text><paragraph id="id37edfce12da74287a2ccdc366458d8b3"><enum>(1)</enum><text>how the eligible entity plans to identify and solicit potential members of a Youth Homelessness Prevention Council as described in subsection (d)(1);</text></paragraph><paragraph id="id6626e0995f2245b4bdf9c861bbd4dc21"><enum>(2)</enum><text>the other entities the eligible entity plans to collaborate with to carry out the grant, which may include—</text><subparagraph id="id780c462212e8448abdec826e4587542a"><enum>(A)</enum><text>a government agency for the prevention of homelessness for covered individuals and other entities or organizations that serve youth in the community, such as local educational agencies;</text></subparagraph><subparagraph id="id90d66d4080cd43ed96783e36cf5ead71"><enum>(B)</enum><text>a Continuum of Care;</text></subparagraph><subparagraph id="id224353394c4e4dfda0fbfafdfde2bdb3"><enum>(C)</enum><text>a housing provider;</text></subparagraph><subparagraph id="id306c523f2d564b99990a675c845645ac"><enum>(D)</enum><text>a State, Tribal, or local child welfare agency;</text></subparagraph><subparagraph id="id15387e776162491ea813e3d1a6d77293"><enum>(E)</enum><text>a behavioral health and substance use disorder provider;</text></subparagraph><subparagraph id="id9dfb2d40155147689d087c65a520ce48"><enum>(F)</enum><text>a delinquency prevention program;</text></subparagraph><subparagraph id="idaacebe82164f436da350e3e87c0f0af6"><enum>(G)</enum><text>the juvenile court system;</text></subparagraph><subparagraph id="id71e8cb062263456fb2c4b3299a15f174"><enum>(H)</enum><text>an organization that serves pregnant or parenting youth and their children; and</text></subparagraph><subparagraph id="id59ea180baf39478a93f86daa5f72ee20"><enum>(I)</enum><text>any other agency or organization with the capacity to identify risk factors for youth homelessness;</text></subparagraph></paragraph><paragraph id="id91cbdb82139c40b8b993448d43be743d"><enum>(3)</enum><text>existing gaps within the eligible entity’s capacity to measure the drivers of and extent of homelessness for covered individuals in the communities served by the eligible entity;</text></paragraph><paragraph id="idf4df048b2394467f9ee38ac5e66f3f91"><enum>(4)</enum><text>the tools, systems, and procedures the eligible entity will develop and use to identify and measure the drivers of and extent of homelessness for covered individuals in the communities served by the eligible entity; and</text></paragraph><paragraph id="idcb256622771f45e7a93638c6e0dc88b7"><enum>(5)</enum><text>additional funding sources that the eligible entity plans to use to support capacity building and work to prevent homelessness for covered individuals after the end of the grant period.</text></paragraph></subsection><subsection id="ida3dc61deb86d4ca3ad2c194075ac666e"><enum>(c)</enum><header>Award of grants; use of funds</header><paragraph id="id93eacee8176e47929340bdf775bca899"><enum>(1)</enum><header>Factors considered in award of grants</header><text>In selecting eligible entities to receive grants under the Capacity Grant Program, the Secretary, to the maximum extent practicable, shall consider—</text><subparagraph id="id1fbe170a8794485e8633b6addc128afe"><enum>(A)</enum><text>an eligible entity’s established partnerships with local stakeholders for the prevention of homelessness for covered individuals, including entities described in subsection (b)(2)(A);</text></subparagraph><subparagraph id="id281e6bc1a0314672ad2f327a0cfa0b37"><enum>(B)</enum><text>the comparative geographic diversity of the applicant in relation to other eligible entities receiving grants under the Capacity Grant Program;</text></subparagraph><subparagraph id="id6b343d1e568743e8b3f2267db3b3cd53"><enum>(C)</enum><text>the extent to which an applicant’s proposed use of grant funds may duplicate or conflict with other programs; and</text></subparagraph><subparagraph id="id43d56693860e46cdb6c9df6d77738348"><enum>(D)</enum><text>the extent to which an applicant will be able to sustain local homelessness prevention activities for covered individuals after the grant performance period.</text></subparagraph></paragraph><paragraph commented="no" id="idd681f616fc7945e895e5ce9a5983d08a"><enum>(2)</enum><header>Grants reserved</header><text>Each fiscal year, the Secretary shall award—</text><subparagraph commented="no" id="idfd0ae8f7fa46493b84e379480f817a01"><enum>(A)</enum><text>not less than 5 percent of the total grant funding made available to carry out this section to 1 or more Indian Tribes or Native Hawaiian organizations; and</text></subparagraph><subparagraph commented="no" id="id642e38623dc34efc8f87929e1010654f"><enum>(B)</enum><text>not less than 5 percent of the total grant funding made available to carry out this section to 1 or more eligible entities that serve a rural area.</text></subparagraph></paragraph><paragraph id="id4339876424284E96BF3EB28FE55FD7DA"><enum>(3)</enum><header>Award term; amount</header><subparagraph commented="no" display-inline="no-display-inline" id="idD5E8F522F6064131AE033058E99B85C5"><enum>(A)</enum><header>In general</header><text>The period of a grant awarded under the Capacity Grant Program shall be 18 months.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5BA383449E054C50A3AD87F7B215227D"><enum>(B)</enum><header display-inline="yes-display-inline">Amount</header><text display-inline="yes-display-inline">The amount of a grant awarded under the Capacity Grant Program shall be not less than $500,000 and not greater than $1,500,000.</text></subparagraph></paragraph></subsection><subsection id="id716984f384034a47885775372fdf06db"><enum>(d)</enum><header>Use of funds</header><text>An eligible entity that receives a grant under the Capacity Grant Program shall use the grant funds—</text><paragraph id="idFAD4AE48FEB64C2289109D3C0539804F"><enum>(1)</enum><text>to identify and solicit potential members to serve on a Youth Homelessness Prevention Council established under section 3(d)(2);</text></paragraph><paragraph id="id57DD1B4A6CE54FEE9EB6A65D29334FCA"><enum>(2)</enum><text>to identify and measure the drivers of and extent of homelessness for covered individuals in the communities served by the eligible entity; and</text></paragraph><paragraph id="id7E615FFCAB604F01BD13AE5D4A3DD272"><enum>(3)</enum><text>to develop and use tools, systems, and procedures for such identification and measurement.</text></paragraph></subsection><subsection id="idcc07e6e8a3b74a7b98236e8becf193a3"><enum>(e)</enum><header>Federal share</header><paragraph commented="no" display-inline="no-display-inline" id="iddc70761a954e4861b86ff8db14eb9f34"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Except as provided in paragraph (2), the Federal share of any project for which the Secretary awards a grant under the Capacity Grant Program shall not exceed 90 percent.</text></paragraph><paragraph id="id799d7f4b46cd4a149656fb75e2ca1872"><enum>(2)</enum><header>Exception</header><text>The Secretary may grant a waiver with respect to the limitation on the Federal share of a project described in paragraph (1) if—</text><subparagraph id="id7ee4e685b00d4f8781f38d6bc80bf062"><enum>(A)</enum><text>the applicant with respect to the project petitions the Secretary for the waiver; and</text></subparagraph><subparagraph id="id90eebbbafff741169d6fa1131c40b842"><enum>(B)</enum><text>the Secretary determines that the petition described in subparagraph (A) demonstrates financial need.</text></subparagraph></paragraph></subsection><subsection id="idb9ad06516df94320acdd8c54ead08db9"><enum>(f)</enum><header>Reporting and information requirements</header><paragraph commented="no" display-inline="no-display-inline" id="ida1cb2571f9db4573839225f2b961d83e"><enum>(1)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 18 months after the date on which an eligible entity is awarded a grant under the Capacity Grant Program, the eligible entity shall submit to the Secretary a report that describes—</text><subparagraph id="id0437dc40b9664d4c8779aa0c43cece5a"><enum>(A)</enum><text>how the eligible entity used grant funds during the preceding 18-month period; and</text></subparagraph><subparagraph id="idd465b1c39e6d472d86b7c5486b109a25"><enum>(B)</enum><text>the progress of the eligible entity towards fulfilling the objectives for which the grant was awarded.</text></subparagraph></paragraph><paragraph id="id122f8a7e9a4248fcb443a5dd5d87c71e"><enum>(2)</enum><header>Additional requirements</header><text>The Secretary—</text><subparagraph id="ida5ce24774dc04e1989aee058db8f46fe"><enum>(A)</enum><text>shall establish mechanisms to ensure appropriate use of, and compliance with respect to all terms regarding, grant funds awarded under the Capacity Grant Program; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6f215e24e6124727b95baf196d25085d"><enum>(B)</enum><text display-inline="yes-display-inline">may establish additional reporting and information requirements for any recipient of a grant under the Capacity Grant Program.</text></subparagraph></paragraph></subsection><subsection id="id4aa82417505040bc96216a4bb37e77cf"><enum>(g)</enum><header>Supplement not supplant</header><text>Funds made available to an eligible entity under the Capacity Grant Program shall be used by the eligible entity to supplement, and not supplant, other Federal, State, Tribal, and local funds that would otherwise be used by the eligible entity to carry out activities described in this section.</text></subsection><subsection id="id45e0dc83697f450a837b58951dce2292"><enum>(h)</enum><header>Reservation of funds</header><text>The Secretary may reserve not more than 10 percent of amounts made available for a fiscal year to carry out this section for the implementation and administration of the Capacity Grant Program, which shall include—</text><paragraph id="idffa8b9ee55db4edba511381f0994eae8"><enum>(1)</enum><text>providing technical support and assistance to eligible entities, including ensuring consistency in data collection and reporting;</text></paragraph><paragraph id="idb6c59e283d2a4223adafb2e868779822"><enum>(2)</enum><text>providing assistance to eligible entities to prepare the applications of those eligible entities with respect to grants awarded under the Capacity Grant Program; and</text></paragraph><paragraph id="ida13958d7f84b4dacb065964cf3ae5d6f"><enum>(3)</enum><text>conducting outreach to eligible entities regarding opportunities to apply for such a grant.</text></paragraph></subsection><subsection id="id027f09131d4f440c8eec0246931da145"><enum>(i)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section—</text><paragraph id="id457145e5e8da4eb28705337c11919a1e"><enum>(1)</enum><text>$20,000,000 for each of fiscal years 2026 through 2030; and</text></paragraph><paragraph id="ide1d36bc8cac0443ca80636fdb95d996d"><enum>(2)</enum><text>such sums as may be necessary for fiscal year 2031 and each fiscal year thereafter.</text></paragraph></subsection></section><section id="idf86d8b0baad3438688f77091fe2ac54e"><enum>5.</enum><header>Reporting and evaluation</header><subsection id="id13c4ad7604894fb6b982fd21594fab25"><enum>(a)</enum><header>Reporting requirements</header><paragraph id="idada29eacf8754396bcfd2a633ecce782"><enum>(1)</enum><header>In general</header><text>Not later than 2 years after the date on which the Secretary begins awarding grants under this Act, and annually thereafter, the Secretary shall submit to the appropriate committees of Congress a report that documents, for the 1-year or 2-year period, as applicable, preceding the report—</text><subparagraph id="id033525755cec44f3a0547a3e8ddd117f"><enum>(A)</enum><text>evaluations of the activities carried out under this Act, including outcomes of grant recipients and the effectiveness of efforts for the prevention of homelessness for covered individuals; and</text></subparagraph><subparagraph id="id97c836517c2c4a9d9f86e54c852c30cd"><enum>(B)</enum><text>a list of each grant awarded under this Act, which shall include—</text><clause id="idbd82fff852024bd98347b5124a28cda6"><enum>(i)</enum><text>the amount of each such grant;</text></clause><clause id="id861075635c3e4af99ed6a0fdd7c35460"><enum>(ii)</enum><text>the recipient of each such grant; and</text></clause><clause id="idaf7d663413e7495989bd69663f71d9a7"><enum>(iii)</enum><text>the purpose for which each such grant was awarded.</text></clause></subparagraph></paragraph><paragraph id="id5e37bb3d2ea84ed597d877229d4f553b"><enum>(2)</enum><header>Public availability</header><text>The Secretary shall make each report submitted under paragraph (1) publicly available in an online format that—</text><subparagraph id="id57b9a4056dea42f6ad34f4a905059c3d"><enum>(A)</enum><text>facilitates access and ease of use;</text></subparagraph><subparagraph id="id4ecdeed39e2740818d4e2ff9e41f82ec"><enum>(B)</enum><text>is searchable; and</text></subparagraph><subparagraph id="id6897552e8abd4ae18212836fd8d068d0"><enum>(C)</enum><text>is accessible—</text><clause id="id36ddd00573bf4406baa1d23c91221de5"><enum>(i)</enum><text>to individuals with disabilities; and</text></clause><clause id="id66c51ce8fc2546ddb7cdd980bdd3f344"><enum>(ii)</enum><text>in languages other than English.</text></clause></subparagraph></paragraph></subsection><subsection id="id8b41e2ab943e4c98b434d4352457ce55"><enum>(b)</enum><header>Authority To contract and enter into other arrangements</header><text>The Secretary may award grants and enter into contracts, cooperative agreements, and other arrangements with Federal agencies, public and private organizations, and other entities with expertise that the Secretary determines appropriate in order—</text><paragraph id="id17f92e25b9f949b29f02aa6500a46735"><enum>(1)</enum><text>to evaluate the impact and efficacy of activities supported by grants awarded under this Act;</text></paragraph><paragraph id="id34b77ec71b624e7181828a2c712bb585"><enum>(2)</enum><text>to develop data methods and systems to support and monitor the prevention of homelessness for covered individuals; and</text></paragraph><paragraph id="ida6a34bbe797a4331b91633d64eb8c518"><enum>(3)</enum><text>to develop, catalog, disseminate, and promote the exchange of best practices, both with respect to and independent of grants awarded under this Act, in order to prevent homelessness for covered individuals.</text></paragraph></subsection><subsection id="id5efb0b541e234a24b1204d2f07823915"><enum>(c)</enum><header>Consultation and public engagement</header><paragraph commented="no" display-inline="no-display-inline" id="id241c76b20e0c4e88959a02e45d2fb7f4"><enum>(1)</enum><header>Required consultation</header><text display-inline="yes-display-inline">In carrying out subsection (a), and to further the objectives described in paragraphs (1) and (2) of subsection (b), the Secretary shall conduct ongoing collaboration and consultation with—</text><subparagraph id="id7aa9353a0a0444ff98ec08db8788c84f"><enum>(A)</enum><text>the Secretary of Housing and Urban Development;</text></subparagraph><subparagraph id="idb75a280cbf6f4f108ed52d54a03a6aa0"><enum>(B)</enum><text>the Executive Director of the United States Interagency Council on Homelessness;</text></subparagraph><subparagraph id="id364fd23d75ad447abd6fa5e27f4b0ee7"><enum>(C)</enum><text>the Secretary of Education;</text></subparagraph><subparagraph id="id7467bc92449c4173b4c0448b7481337a"><enum>(D)</enum><text>the Attorney General;</text></subparagraph><subparagraph id="id305740cbd06a453c968d1995a5282bd6"><enum>(E)</enum><text>the Secretary of the Interior;</text></subparagraph><subparagraph id="id1cdc6932172d45c096ed5b9afec42a4f"><enum>(F)</enum><text>the Secretary of Agriculture;</text></subparagraph><subparagraph id="id0d0603ad377f4bdd9a16bb43d6b84e92"><enum>(G)</enum><text>national, State, Tribal, and local organizations that work to prevent homelessness for covered individuals;</text></subparagraph><subparagraph id="idec7b58c336464796a217152e7c393045"><enum>(H)</enum><text>researchers, academics, and philanthropic organizations with established expertise in preventing homelessness for covered individuals;</text></subparagraph><subparagraph id="idb6018a0df8a24accbd7ba7c9140d65d2"><enum>(I)</enum><text>other agencies, organizations, entities, and community stakeholders, as determined appropriate by the Secretary; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida4859015d4ca47cbb0c4e4cd8d4bb3cf"><enum>(J)</enum><text>youth and young adults—</text><clause commented="no" display-inline="no-display-inline" id="ida137973833b849d3bded51916d3fc36d"><enum>(i)</enum><text display-inline="yes-display-inline">who are experiencing homelessness;</text></clause><clause commented="no" display-inline="no-display-inline" id="id251d85711c614da3a5e769cd34cf2fdc"><enum>(ii)</enum><text display-inline="yes-display-inline">who have experienced homelessness; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id99e1b14458754d529e4dbf89c20f6aa2"><enum>(iii)</enum><text display-inline="yes-display-inline">who were prevented from experiencing homelessness due to a specific intervention.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0184fadd7f194876a3b119b3284bb17d"><enum>(2)</enum><header>Additional consultation</header><text display-inline="yes-display-inline">In carrying out subsection (a), and to further the objectives described in paragraphs (1) and (2) of subsection (b), the Secretary may consult and collaborate with parents or caregivers that are caring for or have cared for covered individuals.</text></paragraph></subsection><subsection id="ide83c517fe20f431090abc07a2294378c"><enum>(d)</enum><header>Technical support and assistance</header><text>To the maximum extent practicable, and to ensure consistency in data reporting and to meet the objectives of this section, the Secretary shall provide—</text><paragraph id="idF9E42ACBBB1C402F9B371D379099E997"><enum>(1)</enum><text>technical support and assistance to grant recipients;</text></paragraph><paragraph commented="no" id="idAAD73F9772DE4EA583E9B35E24B42BDF"><enum>(2)</enum><text>assistance to eligible entities in preparing applications for grants awarded under this Act; and</text></paragraph><paragraph id="id5CAFB8453CA644F3A5D7665231B96313"><enum>(3)</enum><text>other resources for grant recipients.</text></paragraph></subsection><subsection id="idde4b82bf0d3647fab277884ae4a90c00"><enum>(e)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated such sums as may be necessary to carry out this section, which shall remain available until expended.</text></subsection></section><section id="iddf058bc047f44d808f9b2c6303ecd14d"><enum>6.</enum><header>General provisions</header><subsection id="id6bb7450a00614774ae0797dd4729489b"><enum>(a)</enum><header>Nondiscrimination</header><paragraph id="id76aae5b4b2d14f16a43066c56ff1f83b"><enum>(1)</enum><header>In general</header><text>No individual in the United States may, on the basis of actual or perceived race, color, religion, national origin, sex, gender identity, sexual orientation, age, or disability, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity that is funded in whole or in part with funds made available to carry out this Act.</text></paragraph><paragraph id="idbe29fe6ee7dc4fc98756cd11922b8c1b"><enum>(2)</enum><header>Enforcement</header><text>The Secretary shall effectuate paragraph (1) with respect to any program or activity described in that paragraph by issuing regulations and taking actions consistent with section 602 of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d-1">42 U.S.C. 2000d–1</external-xref>).</text></paragraph><paragraph id="id88f2d07e4e6b4669a208cbd13a85eba6"><enum>(3)</enum><header>Judicial review</header><text>Judicial review of an action taken by the Secretary under paragraph (2) shall be available to the extent provided in section 603 of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d-2">42 U.S.C. 2000d–2</external-xref>).</text></paragraph></subsection><subsection id="idd2e60651ed2a46e2a9ab25ccd6dee403"><enum>(b)</enum><header>Audit and oversight</header><text>Beginning with the first fiscal year for which amounts are made available to carry out an activity authorized under this Act, and for each of the 4 fiscal years thereafter, there is authorized to be appropriated to the Office of Inspector General for the Department of Health and Human Services $1,000,000 for audits and oversight of funds made available to carry out this Act, which shall remain available until expended.</text></subsection></section></legis-body></bill>
