<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 4255</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260326">March 26, 2026</action-date><action-desc><sponsor name-id="S317">Mr. Barrasso</sponsor> (for himself, <cosponsor name-id="S388">Ms. Hassan</cosponsor>, <cosponsor name-id="S410">Ms. Lummis</cosponsor>, <cosponsor name-id="S337">Mr. Coons</cosponsor>, <cosponsor name-id="S288">Ms. Murkowski</cosponsor>, and <cosponsor name-id="S259">Mr. Reed</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for phased-in payment of Social Security Disability Insurance payments during the waiting period for individuals with a terminal illness.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Expedited Disability Insurance Payments for Terminally Ill Individuals Act of 2026</short-title></quote>.</text></section><section id="idD9103ECC33E24F5483DAF2547A597164"><enum>2.</enum><header>Phased-in payment of SSDI benefits during the waiting period for the terminally ill</header><subsection id="id79DAD65699894852BF64E26F3FF41E61"><enum>(a)</enum><header>In general</header><text>Section 223 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/423">42 U.S.C. 423</external-xref>) is amended—</text><paragraph id="id55AF2185B1104DC7B19059BE1558E536"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="id5CF77B38871A40A6897B2C07407C4703"><enum>(A)</enum><text>in paragraph (1), in the matter following subparagraph (E), by striking <quote>or (iii)</quote> and inserting <quote>(iii) subject to paragraph (2)(B), for each month beginning with the first month during all of which the individual is determined under subparagraph (D) of subsection (d)(2) to be under a disability and in which he becomes so entitled to such insurance benefits, or (iv)</quote>;</text></subparagraph><subparagraph id="idC31193E6434D49A4B09116E51D6B9616"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="idC82753FC8B834A5FB55B6BC85E71D747"><enum>(i)</enum><text>in the matter preceding subparagraph (A), by striking <quote>section 202(q) and</quote> and inserting <quote>paragraph (3) of this subsection, section 202(q), and</quote>;</text></clause><clause id="id6AEA415D97E24D2B901DCC2E13B1F957"> <enum>(ii)</enum> <text>in subparagraph (A), by striking <quote>or</quote> at the end; and</text>
 </clause><clause id="idFA0845067E534F8EACAD067FDF173A39"><enum>(iii)</enum><text>in subparagraph (B), by striking <quote>clause (ii) of paragraph (1)</quote> and inserting <quote>clause (ii), (iii), or (iv) in the matter following subparagraph (E) of paragraph (1)</quote>; and</text></clause></subparagraph><subparagraph id="idC0BD99C451104BA5AFBFBA158FD7B2C1"><enum>(C)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id04EBEAA7BF664F72A9369F8A181CC519"><paragraph id="id438974E6EAA045EF94DF53DB12CDA405" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idC7B57593E08D479BA564F429C6FFF7C2"><enum>(A)</enum><text>For purposes of paragraph (2), in any case in which clause (iii) in the matter following subparagraph (E) of paragraph (1) of this subsection is applicable to an individual, the amount of the individual's monthly disability insurance benefit for the earliest period of 2 consecutive calendar months throughout which the individual has been entitled to such insurance benefits shall be equal to the product of the benefit amount determined for the individual under paragraph (2) (before application of this paragraph) and—</text><clause id="idBEDA8E5666E44BBB87B7B471CA41F0B2" indent="up1"><enum>(i)</enum><text>for the first calendar month, 50 percent; and</text></clause><clause id="idD9A247C487C54792A70482BF67A53415" indent="up1"><enum>(ii)</enum><text>for the second calendar month, 75 percent.</text></clause></subparagraph><subparagraph id="id81239804F7BA4E998D864ED878266F1C" indent="up1"><enum>(B)</enum><text>If an individual who has been determined under subparagraph (D) of subsection (d)(2) to be under a disability has been entitled to a disability insurance benefit on such basis for 12 consecutive calendar months, the individual's disability insurance benefit for any month during the subsequent period of 12 consecutive calendar months shall be equal to—</text><clause id="id6D0C8A0A30F04856AC8C299BA604C29F"><enum>(i)</enum><text>the benefit amount determined for the individual under paragraph (2) (before application of this paragraph); minus</text></clause><clause id="idD78447CE92004E54B66908279799F81E"><enum>(ii)</enum><text>the quotient obtained by dividing the total amount of disability insurance benefits provided to the individual during the earliest period of five consecutive calendar months for which the individual was entitled to such benefits on such basis by 12.</text></clause></subparagraph><subparagraph id="id43B16E4ECECE46959805967460BCBA23" indent="up1"><enum>(C)</enum><text>If an individual who has been determined under subparagraph (D) of subsection (d)(2) to be under a disability has been entitled to a disability insurance benefit on such basis for 24 consecutive calendar months, the individual's disability insurance benefit for any subsequent month shall be equal to 95 percent of the benefit amount determined for the individual under paragraph (2) (before application of this paragraph).</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idDAE40E2802734C2DB671A65E7E20292E"><enum>(2)</enum><text>in subsection (d)(2), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF65F9E983E7A4F789DB3E453E2846C08"><subparagraph id="id24F16AA69AA14E4CB041AADE0EE649D6" indent="up1"><enum>(D)</enum><text>For purposes of clause (iii) in the matter following subparagraph (E) of paragraph (1) of subsection (a), an individual shall be determined to be under a disability upon submission of a diagnosis of a terminal illness (as defined in section 1861(dd)(3)(A)) that has been certified by not less than 2 physicians (as defined in section 1861(r)(1)) who are not related (as described in <external-xref legal-doc="usc" parsable-cite="usc/26/267">section 267(c)(4)</external-xref> of the Internal Revenue Code of 1986) and are not in the same physician group practice.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idF35F9A4B8D074368960827090E5FEBDF"><enum>(b)</enum><header>Reports to Congress</header><paragraph id="idF832E2519B274065AB7CFFEAB387CCF8"><enum>(1)</enum><header>Report by Social Security Administration</header><text>Not later than 1 year after the date of the enactment of this Act, and each year thereafter, the Commissioner of the Social Security Administration, in coordination with the Inspector General of the Social Security Administration, shall submit to the relevant committees of Congress a report that evaluates the provision of disability insurance benefits to terminally ill individuals, including—</text><subparagraph id="id54C6CA5048BF482DB83E6FF87F4403BC"><enum>(A)</enum><text>the total number of individuals who—</text><clause id="id5971EFBBAA0843B4AABFC536A724345C"><enum>(i)</enum><text>file applications for disability insurance benefits (as determined under section 223(a)(3) of the Social Security Act) based on a diagnosis of a terminal illness;</text></clause><clause id="id4115B8CD15264BA6B645813BCC46F6A5"><enum>(ii)</enum><text>receive such benefits;</text></clause><clause id="id851A5C79A4CA4475BB9559D3CC881480"><enum>(iii)</enum><text>die within 6 months of first receiving such benefits;</text></clause><clause id="id2A3492D991A84ECFA8E31DCCD36F069C"><enum>(iv)</enum><text>die within 12 months of first receiving such benefits;</text></clause><clause id="idAD291FCF00244E1599C3E8F7D568222B"><enum>(v)</enum><text>receive such benefits during the period described in section 223(a)(3)(B) of the Social Security Act; and</text></clause><clause id="idE6F9D116C18F47A79D9123C55695CDBB"><enum>(vi)</enum><text>receive such benefits during the period described in section 223(a)(3)(C) of the Social Security Act;</text></clause></subparagraph><subparagraph id="id13694FA7F0AD4817A978BC6D94966E6F"><enum>(B)</enum><text>the total amount expended, including related administrative expenses, for the provision of disability insurance benefits under section 223(a)(3) of the Social Security Act to individuals diagnosed with a terminal illness; and</text></subparagraph><subparagraph id="idD8EDBFBA95674CFB9C895002627D527D"><enum>(C)</enum><text>recommendations for such legislation and administrative actions as are determined appropriate for preventing fraud, waste, and abuse related to such benefits.</text></subparagraph></paragraph><paragraph id="idE09F23CCB991405EBF307709A667B499"><enum>(2)</enum><header>Report by Government Accountability Office</header><text>Not later than 2 years after the date of the enactment of this Act, the Comptroller General of the United States shall submit a report to the relevant committees of Congress that evaluates the provision of disability insurance benefits to terminally ill individuals and provides recommendations for such legislation and administrative actions as are determined appropriate to improve the provision of such benefits to such individuals.</text></paragraph></subsection><subsection id="idE31D76811C7D43C891372CEC066188A9"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to benefits payable for months beginning after December 31, 2026.</text></subsection></section></legis-body></bill>
