which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To authorize, if applicable, the Secretary of Labor to annually establish a 2-tiered wage rate for H–2A workers that distinguishes between entry-level and experience-level workers and to annually establish a compensation adjustment factor to account for the value of housing provided to H–2A workers.</official-title></form><legis-body><section id="idb690850c3b0148539d8c751e1daba380" section-type="section-one"><enum>1.</enum><header>Short titles</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Farmworker Access and Retention Modernization Stability Act</short-title></quote> or the <quote><short-title>FARM Stability Act</short-title></quote>.</text></section><section section-type="subsequent-section" commented="no" display-inline="no-display-inline" id="id1633208470274d5fa93f76f983ee2197"><enum>2.</enum><header display-inline="yes-display-inline">Annual wage rates and adjustments for H–2A workers</header><text display-inline="no-display-inline">Section 218(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1188">8 U.S.C. 1188(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id015fdc1b99774e3599bb3a387f984eb5"><paragraph commented="no" display-inline="no-display-inline" id="id359df463ee134db4b5afaf054c2b97f1" indent="up1"><enum>(3)</enum><text>If the Secretary of Labor determines a minimum wage rate other than the Federal or State minimum wage rate applicable to agricultural employment is required to be paid to H–2A workers, the Secretary shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id2ddc863426594c049a3880ac6759b19b"><enum>(A)</enum><text display-inline="yes-display-inline">annually establish a 2-tiered wage rate based on the skill level required for H–2A occupations that—</text><clause commented="no" display-inline="no-display-inline" id="id44647da7ebc14676a06acb458dfe325f"><enum>(i)</enum><text display-inline="yes-display-inline">classifies positions requiring entry-level workers as Skill Level I;</text></clause><clause commented="no" display-inline="no-display-inline" id="id3ece25ed5e2d45db907e8901c7ee3ac8"><enum>(ii)</enum><text display-inline="yes-display-inline">classifies positions requiring experience-level workers with formal education, training certificates, or significant experience in agricultural operations as Skill Level II; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id1ef5deb9dfee4f30b149df6236e369dd"><enum>(iii)</enum><text display-inline="yes-display-inline">sets the wage rate for Skill Level II H–2 A workers higher than the wage rate for Skill Level I H–2A workers; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc7bcdcb4ddec481b976b04970659cd58"><enum>(B)</enum><text display-inline="yes-display-inline">account for the value of housing provided to H–2A workers by—</text><clause commented="no" display-inline="no-display-inline" id="idd59df1b702d64fff8db24688a4e71383"><enum>(i)</enum><text display-inline="yes-display-inline">annually establishing a compensation adjustment factor to the wage rate established for each State pursuant to subparagraph (A);</text></clause><clause commented="no" display-inline="no-display-inline" id="id0d1f8b007bd84113a88b9e96839daa6b"><enum>(ii)</enum><text display-inline="yes-display-inline">computing such compensation adjustment factor as an equivalent hourly rate based on the weighted statewide average of fair market rents for a 4-bedroom housing unit available from the Department of Housing and Urban Development; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id9e1ab61f07db4762995eeb4d7676e7e3"><enum>(iii)</enum><text display-inline="yes-display-inline">keeping such compensation adjustment factor at or below 30 percent of the relevant wage rate established pursuant to subparagraph (A).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
