which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Consolidated Farm and Rural Development Act to expand eligibility of Department of Agriculture loans and grants for fishing and mariculture businesses, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>American Seafood Competitiveness Act of 2026</short-title></quote>.</text></section><section id="idd0b9c2e8057c4d558d8898fe9811d468"><enum>2.</enum><header>Department of Agriculture loans and grants for fishing and mariculture businesses</header><subsection id="id5ec6cd62d845496b88dfbbacb5b2d7c9"><enum>(a)</enum><header>Definitions of farmer and farming</header><text>Section 343(a) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1991">7 U.S.C. 1991(a)</external-xref>) is amended—</text><paragraph id="idbaf0f1b0ffc143ca95b09f743ed45345"><enum>(1)</enum><text>in paragraph (1), by striking <quote>farming.</quote> and inserting <quote>farming, commercial fishing, or fish processing.</quote>;</text></paragraph><paragraph id="id66e9010fdd984413b85864ea0bffc8ab"><enum>(2)</enum><text>in paragraph (2), by striking <quote>farming.</quote> and inserting <quote>farming, commercial fishing, and fish processing.</quote>; and</text></paragraph><paragraph id="idb52c58141eda42eeb236387deb3fcacb"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idbeac96518c4349c79eb1b56caff79258"><paragraph id="id62f1d596821c44fbbd7e69dca9fd1932"><enum>(14)</enum><header>Commercial fishing</header><text>The term <term>commercial fishing</term> means fishing (as defined in section 3 of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1802">16 U.S.C. 1802</external-xref>)) in which the fish harvested, either in whole or in part, are intended to enter commerce or enter commerce through sale, barter, or trade.</text></paragraph><paragraph id="idaa772d8c44234ceaafb1b2a5bbac72f8"><enum>(15)</enum><header>Commercial fishing vessel</header><text>The term <term>commercial fishing vessel</term> means a fishing vessel and a fish processing vessel (as those terms are defined in section 2101 of title 46, United States Code).</text></paragraph><paragraph id="id6b2c450f32e34e62807e06e95c3f4f0f"><enum>(16)</enum><header>Fish</header><text>The term <term>fish</term> has the meaning given the term in section 2101 of title 46, United States Code.</text></paragraph><paragraph id="id283900ec36584082bf07523a7054f946"><enum>(17)</enum><header>Fish processing</header><text>The term <term>fish processing</term> means the processing of fish for commercial use or consumption.</text></paragraph><paragraph id="id5b4af69cf866495a93e18e9796ec1767"><enum>(18)</enum><header>Fish processing facility</header><text>The term <term>fish processing facility</term> means a facility or vessel, boat, ship, or other craft used or equipped for fish processing.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idcfb2d1c2f85b48298e647b236d193bad"><enum>(b)</enum><header>Farm ownership loans</header><paragraph id="idb1c0dd2d8b154bcfb18b5816f6c41de3"><enum>(1)</enum><header>Eligibility</header><text>Section 302(a) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1922">7 U.S.C. 1922(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idd1211fc9d3414dbc978b48517c79b842"><paragraph id="id0b884e50c65847f2961d1127ce51257a"><enum>(3)</enum><header>Eligibility of wild-caught fish and shellfish</header><text>Notwithstanding any other provision of this Act, for purposes of direct and guaranteed farm loans under this subtitle—</text><subparagraph id="id27f95d12d86942538199afc9cdebacc9"><enum>(A)</enum><text>the terms <quote>farmer</quote> and <quote>rancher</quote> shall include an individual or entity engaged in commercial fishing or fish processing; and</text></subparagraph><subparagraph id="id5952844925544ab395244ff77820c291"><enum>(B)</enum><text>the terms <quote>farm</quote> and <quote>ranch</quote> shall include—</text><clause id="idccd7cbc7043949d690f391ff94768b22"><enum>(i)</enum><text>a commercial fishing vessel; and</text></clause><clause id="idbcd709fcd84c4514b92d68f8d1c4f033"><enum>(ii)</enum><text>a fish processing facility.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="idd7c8d8d7e935401fbced0f35555cd09c"><enum>(2)</enum><header>Purposes</header><text>Section 303(a) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1923">7 U.S.C. 1923(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5975d064e6cc4097b5ea0607eebbec71"><paragraph id="id349b8643e9dc47b0bd53f77aeb5d85ac"><enum>(3)</enum><header>Commercial fishery participants; fish processors</header><subparagraph id="idf9cba41b82884e049ba87c6ad4030b6a"><enum>(A)</enum><header>Commercial fishery participants</header><text>An individual or entity engaged in commercial fishing may only use a direct or guaranteed loan under this subtitle for—</text><clause id="id9fe3d0b9af8144e38748a145ac3b0b60"><enum>(i)</enum><text>acquiring a commercial fishing permit;</text></clause><clause id="id02637d2f074b4e4cbd25d1fee03159f0"><enum>(ii)</enum><text>acquiring a commercial fishing vessel; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id1c8813fd71014c128797e5fc04db3e0e"><enum>(iii)</enum><text>making capital improvements to a commercial fishing vessel.</text></clause></subparagraph><subparagraph id="idff335d7c2a3b4a219e782513814165e4"><enum>(B)</enum><header>Fish processors</header><text>An individual or entity engaged in fish processing may use a direct or guaranteed loan under this subtitle for acquiring or making capital improvements to a fish processing facility.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idaff4b21a024d452ea3787f3a9e3eac48"><enum>(c)</enum><header>Farm operating loans</header><paragraph id="id0f77c3dff0fd414aaa7885e5be27f3c2"><enum>(1)</enum><header>Eligibility</header><text>Section 311(a) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1941">7 U.S.C. 1941(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idafe974ebb2664122b38da51d9f0e3282"><paragraph id="id33af165382094a568e1520566ae46747"><enum>(3)</enum><header>Eligibility of wild-caught fish and shellfish</header><text>Notwithstanding any other provision of this Act, for purposes of direct and guaranteed farm loans under this subtitle—</text><subparagraph id="ida57a302d91234324aa0076ee030d45f7"><enum>(A)</enum><text>the terms <quote>farmer</quote> and <quote>rancher</quote> shall include an individual or entity engaged in commercial fishing or fish processing; and</text></subparagraph><subparagraph id="id531d2b83dee2448cbc8cb54d45f2ac90"><enum>(B)</enum><text>the terms <quote>farm</quote> and <quote>ranch</quote> shall include—</text><clause id="id67b41cbd8bd3441cb479de7abf30ad1f"><enum>(i)</enum><text>a commercial fishing vessel; and</text></clause><clause id="id62bd63a96f8643fd9d153b826a3889a3"><enum>(ii)</enum><text>a fish processing facility.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id637da99c35f64f6ea2cb96005aec77d7"><enum>(2)</enum><header>Purposes</header><text>Section 312 of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1942">7 U.S.C. 1942</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ide91bc53bd88143d280b10dc44a2377f1"><subsection id="id29ed724c63d0432c947da959e7fc64dc"><enum>(f)</enum><header>Commercial fishery participants; fish processors</header><paragraph id="id8962dd420c524d6eb49e65d24a8a5d5a"><enum>(1)</enum><header>Commercial fishery participants</header><text>An individual or entity engaged in commercial fishing may only use a direct or guaranteed loan under this subtitle for the costs associated with operating and maintaining a commercial fishing vessel.</text></paragraph><paragraph id="id66e0b34cb9a340108284436f3fd7cdff"><enum>(2)</enum><header>Fish processors</header><text>An individual or entity engaged in fish processing may use a direct or guaranteed loan under this subtitle for the costs associated with operating and maintaining a fish processing facility.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4e780dbf7e26411d861ce21bd4fceee6"><enum>(d)</enum><header>Local agriculture market program</header><paragraph id="ide6c1214a28a34b3290e1740e1111a745"><enum>(1)</enum><header>Farmers’ markets and local food promotion program</header><text>Section 210A(d)(6) of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1627c">7 U.S.C. 1627c(d)(6)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id90c758c819c24dedb472cc0cab31bab5"><subparagraph id="id85f12552aad445cc909d6d6a02a548b2"><enum>(F)</enum><header>Eligibility of wild-caught fish and shellfish</header><text>For purposes of this paragraph—</text><clause id="id61dc98c1fcfb46d6951b3c8759132bbe"><enum>(i)</enum><text>an agricultural commodity or product described in subsection (a)(12) shall include fish (as defined in section 2101 of title 46, United States Code) that is caught, taken, or harvested from the wild; and</text></clause><clause id="id3f3f2470a6f6484c897b98c5396f9b6b"><enum>(ii)</enum><text>the eligible activities described in paragraph (2) shall include domestic seafood marketing.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id28103a3b70c449dfbd80a8aa88997ca6"><enum>(2)</enum><header>Waiver of matching funds requirements</header><text>Section 210A(i) of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1627c">7 U.S.C. 1627c(i)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idc756edc6199745e88d8c969eba68827d"><paragraph id="id8ed7eae766dd479dac3e4053b936f73a"><enum>(4)</enum><header>Waiver of matching funds requirements</header><text>The Secretary may waive a requirement for a recipient of a grant under this section to provide matching funds, or reduce the amount of matching funds required to be provided, if the recipient is engaged in commercial fishing or fish processing (as those terms are defined in section 343(a) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1991">7 U.S.C. 1991(a)</external-xref>)).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id0712d52306fb4dbba06cb98fd3df7396"><enum>(e)</enum><header>Implementation and coordination</header><paragraph id="id6b07094bc79646ac846e4237561d63eb"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary of Agriculture shall take such actions as are necessary to ensure the successful and effective integration of individuals and entities in the commercial fishing industry, including those engaged in commercial fishing or fish processing (as those terms are defined in section 343(a) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1991">7 U.S.C. 1991(a)</external-xref>)), into each program of the Department of Agriculture for which those individuals and entities are made eligible under the amendments made by this section.</text></paragraph><paragraph id="idea9a17fe793a407b991c0752188c55ce"><enum>(2)</enum><header>Technical assistance and guidance</header><text>In carrying out paragraph (1), the Secretary of Agriculture shall—</text><subparagraph id="ideef5073cb9d548618b5f3f322ce94a84"><enum>(A)</enum><text>provide outreach and technical assistance to participants in the commercial fishing industry, including through cooperative agreements and public-private and other partnerships, to promote awareness of and access to relevant programs;</text></subparagraph><subparagraph id="id5613960aa8f84f99b1b20aa6c9da2469"><enum>(B)</enum><text>provide guidance and training to relevant agency personnel of the Department of Agriculture, including through cooperative agreements and public-private and other partnerships, to ensure program services are effectively delivered to the commercial fishing industry; and</text></subparagraph><subparagraph id="id34d3b55f6f6d42cab31a8baac301c271"><enum>(C)</enum><text>coordinate, as appropriate, with the National Oceanic and Atmospheric Administration and other relevant Federal and State agencies to implement the amendments made by this section.</text></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id77ed42fe86c74a1980140c965b5b0940"><enum>3.</enum><header>Extension of credit to businesses providing services to producers or harvesters of aquatic products</header><subsection id="id74380591a7744668837ef4e6a25c2885"><enum>(a)</enum><header>Farm credit banks</header><paragraph id="idb5bd4fdd02f54505bcca187c9600e18d"><enum>(1)</enum><header>Eligibility for credit and financial services</header><text>Section 1.9 of the Farm Credit Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/12/2017">12 U.S.C. 2017</external-xref>) is amended—</text><subparagraph id="id62e726fb9e794676ab975cd1ed0d6314"><enum>(A)</enum><text>in paragraph (2), by striking <quote>or</quote> at the end;</text></subparagraph><subparagraph id="idc3efa516cc25464696229b87eb134342"><enum>(B)</enum><text>by redesignating paragraph (3) as paragraph (4); and</text></subparagraph><subparagraph id="ide2d9bca363984acb92b8ac106cf92a67"><enum>(C)</enum><text>by inserting after paragraph (2) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf8ff9d53e0c24bd786464b5b749ee5da"><paragraph id="id485091074c2a47a18d0897f600a3e4a5"><enum>(3)</enum><text>persons furnishing to producers or harvesters of aquatic products services directly related to their operating needs; or</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id8f13e2bfba2446769a977e0aed8ad09f"><enum>(2)</enum><header>Purposes for extensions of credit</header><text>Section 1.11(c)(1) of the Farm Credit Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/12/2019">12 U.S.C. 2019(c)(1)</external-xref>) is amended by inserting <quote>and to persons furnishing services directly related to the operating needs of producers or harvesters of aquatic products</quote> after <quote>needs</quote>.</text></paragraph></subsection><subsection id="ide5d98bbebf3b44e8bb8776e711efbbe1"><enum>(b)</enum><header>Production credit associations</header><text>Section 2.4(a) of the Farm Credit Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/12/2075">12 U.S.C. 2075(a)</external-xref>) is amended—</text><paragraph id="id39c82bf352564391b28a7cccabefeee3"><enum>(1)</enum><text>in paragraph (2), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="id466272fef2cf4352938146e3f54ed03a"><enum>(2)</enum><text>in paragraph (3), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="idff9467cbb23f4ee99081c1129eba8e0e"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idfcacf3ac605d4f11bcb448755c882370"><paragraph id="id33b68904d4f243db87d4c1d7bfeeea7d"><enum>(4)</enum><text>persons furnishing to producers or harvesters of aquatic products services directly related to their operating needs.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
