<subsection commented="no" display-inline="no-display-inline" id="id45c380397f7e479189a7b5aecd9a499c"> <enum>(a)</enum> <header>Reduction in hours of full-Time service</header> <text>Section 139(b) of the National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12593">42 U.S.C. 12593(b)</external-xref>) is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="idf3a78ff7d42f4618a42de619c7bb792f"> <enum>(1)</enum> <text>in paragraph (1), by striking <quote>An individual</quote> and inserting <quote>Except as provided in paragraph (3), an individual</quote>; and</text> </paragraph>

<subsection commented="no" display-inline="no-display-inline" id="id88012d78b2b347e18ecfb177b44db0aa"><enum>(b)</enum><header>Season of service</header><text>The National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12501">42 U.S.C. 12501 et seq.</external-xref>) is amended—</text> <paragraph id="id54533988b0904ae2881beec60041f185"><enum>(1)</enum><text>in section 153(d) (<external-xref legal-doc="usc" parsable-cite="usc/42/12613">42 U.S.C. 12613(d)</external-xref>)—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="ida437af362ee64cf5918ecb14f21b9f61"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>nine months</quote> and inserting <quote>eight weeks</quote>; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="idc84f18a8a156477b9e0319e9e9fcaad9"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>such period</quote> and inserting <quote>year. A period of service performed by an individual in an originally-agreed to term of service and service performed in the term of any renewed agreement shall constitute a single term of service for purposes of section 146(b)(1), and the individual shall not be considered to have received more than the value of 1 national service educational award for service during those 2 terms for purposes of section 146(c).</quote>; and</text></subparagraph></paragraph>
<paragraph id="id4cd697d7e2e24bba8c33d96181267114"><enum>(2)</enum><text>in section 156(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/12616">42 U.S.C. 12616(a)</external-xref>), by striking <quote>with between three and six weeks of</quote>.</text></paragraph></subsection></section> <section id="idbf3a373e4e7e40289b8871bab2f441c3"><enum>102.</enum><header>National Civilian Community Corps term extension authority</header><text display-inline="no-display-inline">Section 139(b)(4)(A) of the National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12593">42 U.S.C. 12593(b)(4)(A)</external-xref>) is amended—</text>
<paragraph commented="no" display-inline="no-display-inline" id="id38678f45a0294823bbd35db156a4e80e"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>An individual</quote> and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id4AA2EF76C0CA491C839F3CE0DBA35431"> <clause commented="no" display-inline="no-display-inline" id="id183d9f242bb44d33a88a6ef71e9a1efe"><enum>(i)</enum><header>Disaster relief</header><text>An individual</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></paragraph>

<clause commented="no" display-inline="no-display-inline" id="idb9997f1b1176486296448fb3021f27ae"><enum>(ii)</enum><header>Other programs</header><text display-inline="yes-display-inline">An individual in an approved national service position in a program under section 152(a) may, upon the approval of the Director of the National Civilian Community Corps, continue in a term of service for up to 180 days beyond the period otherwise specified in section 153(d) or 90 days beyond the period otherwise specified in section 154(c).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idd8409c041dc646848cb81cf480207bc7"><enum>103.</enum><header>Increased age eligibility range for the National Civilian Community Corps</header><text display-inline="no-display-inline">Section 153(b)(1) of the National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12613">42 U.S.C. 12613(b)(1)</external-xref>) is amended by striking <quote>24</quote> and inserting <quote>26</quote>.</text></section>
<section id="id4063d284a216496e99b3455b31599a74"><enum>104.</enum><header>Timekeeping</header>
<subsection commented="no" display-inline="no-display-inline" id="id07ae28b1640c4149b6a096b77b96dd4b"><enum>(a)</enum><header>Application</header><text>Section 131(e) of the National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12583">42 U.S.C. 12583(e)</external-xref>) is amended—</text> <paragraph id="id9c48b97fbd0f456397efd0bc96d693f8"><enum>(1)</enum><text>by redesignating paragraphs (1) and (2) as subparagraphs (A) and (B), respectively, and aligning the margins of those subparagraphs with the margins of subparagraphs (A) and (B) of section 131(d)(1) of that Act;</text></paragraph>
<paragraph id="id80f9f8f78fd34c5894c286d04dc840dc"><enum>(2)</enum><text>by striking <quote>Except as</quote> and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="idc5cd74403f90428f8fa9c1e47c4f13c7"> <paragraph id="idcc290e86a2f94bab8bad22ac2bb98022"><enum>(1)</enum><header>In general</header><text>Except as</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph>
<paragraph id="ide772344d54ac4d5c8526e2318fbf6e63"><enum>(3)</enum><text>in subsection (e)—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id2a7563754a9f440fa11221c6287c2882"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), as so designated—</text>
<clause id="id80f62feb6e4c4c3bb0a15a68e9376462"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>and</quote> at the end;</text></clause> <clause id="idc7cd23e85c4746078c54b9605670de43"><enum>(ii)</enum><text>in subparagraph (B), by striking the period and inserting <quote>; and</quote>; and</text></clause>
<clause id="idd97fe432751a44d7b3b3a022ba69f5c6"><enum>(iii)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="idd07368a8ea034702af275fc3a523445d"> <subparagraph id="id7a4ad670d5d14f0fb30d58e747c32b55"><enum>(C)</enum><text>ensure that records supporting the provision of any living allowance or other benefit provided to any participant in a national service program described in subparagraph (A) or (B) accurately reflect the national service performed and meet the requirements of paragraph (2).</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph></paragraph>
<paragraph id="id300cd079789142bd95e14717e4601cad"><enum>(4)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id9ea9b8b5a2fd41fba4ecee9627331d9f"> <paragraph id="id2d81febef94d4878829a08d5d1e00644"><enum>(2)</enum><header>Records</header><text>Such an applicant that receives assistance under section 121 shall, in maintaining the records described in paragraph (1)(C) with respect to a participant described in that paragraph—</text>
<subparagraph id="idc3d1c30b02184bd3b5410d34aedc1cb0"><enum>(A)</enum><text>ensure that each charge for such an allowance or benefit is accurate, allowable, properly allocated, and incorporated into the official records of the applicant;</text></subparagraph> <subparagraph id="iddcb7e10aafda48f2ad45e473f333416b"><enum>(B)</enum><text>reflect the total, actual national service program service activity by the participant and account separately for service activity under the grant for the recipient and other work activity for the recipient that is not for a national service program, in such a manner as to ensure that the participant is credited for national service time under the grant, only for service activity under the grant;</text></subparagraph>
<subparagraph id="idd05c2ced89c94211a160d448550c72e9"><enum>(C)</enum><text>accurately support the distribution of such an allowance or benefit of the participant among specific activities or cost objectives if the participant provides service activity under the grant for the recipient and other work activity for the recipient that is not for a national service program; and</text></subparagraph> <subparagraph id="id068465cdca2e48d49bc35074120be08d"><enum>(D)</enum><text>include the same information, according to the same standards, for—</text>
<clause id="idf712888f9e8b4bbea2df4b3df30f9e94"><enum>(i)</enum><text>funds provided through cost-sharing requirements and used to provide the allowance or benefit; and</text></clause> <clause id="ide39cbd63da7a41559b43142b87342fc9"><enum>(ii)</enum><text>funds provided through a Federal award and so used.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="id79b3289b77f94221a20df256a0727340"><enum>(b)</enum><header>Certification</header><text>Section 146A of the National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12602a">42 U.S.C. 12602a</external-xref>) is amended—</text> <paragraph id="id5f37da65614f4c47a606908e6179d550"><enum>(1)</enum><text>by redesignating subsection (b) as subsection (c); and</text></paragraph>
<paragraph id="id65330da6d08046fd9bacc233ff4b8801"><enum>(2)</enum><text>by inserting after subsection (a) the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="idd8bdf49bfdfa42c79b88fd05f338a24c"> <subsection id="id1fb63f7f956b48109290a0111d181f90"><enum>(b)</enum><header>Timekeeping</header><text>The entity shall submit records to the Corporation, upon the individual’s completion of the requirements for a term of service, that support such completion, that accurately reflect the national service performed, and that meet the requirements of section 131(e)(2). Such records shall be held by the Corporation to facilitate administration of the National Service Trust for a period of not less than 5 years beginning on the date of that submission.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section>
<section commented="no" display-inline="no-display-inline" id="id37882cf486b64b5586a05a08d28db04d"><enum>105.</enum><header>Spending flexibility</header>
<subsection commented="no" display-inline="no-display-inline" id="id60993e45cb904c77a48ef6b7eca241eb"><enum>(a)</enum><header>Reinvestment of unobligated and expiring funds</header><text display-inline="yes-display-inline">Section 196 of the National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12651g">42 U.S.C. 12651g</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id006BDB55F5DE4ECEAA3A62411D4C6700"> <subsection commented="no" display-inline="no-display-inline" id="id14896eaafb6146dd93a49f82e28cce3c"><enum>(d)</enum><header>Reinvestment of unobligated and expiring funds</header> <paragraph commented="no" display-inline="no-display-inline" id="ide2f2e5a6d9024fa2ba5be587f72f68df"><enum>(1)</enum><header>Establishment of fund</header><text display-inline="yes-display-inline">There is established in the Treasury of the United States a fund to be known as the <quote>Unobligated and Expiring Amounts Fund</quote>, referred to in this subsection as the <quote>Fund</quote>.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id84beb933500040e7ae872afcda9a3f69"><enum>(2)</enum><header>Amounts in fund</header>
<subparagraph commented="no" display-inline="no-display-inline" id="id18acd25f56c043c0944eeb27b404f4b7"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B), any amounts appropriated for expenses of the Corporation to carry out the national service laws that are unobligated and would otherwise expire on September 30 of a fiscal year shall, on such September 30 of that fiscal year, be transferred to the Fund and remain available until expended.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id7bae65acad724930b3e55524da15adfa"><enum>(B)</enum><header>Inspector general opinion</header><text display-inline="yes-display-inline">The Corporation may only make a transfer under subparagraph (A) of amounts described in such subparagraph that are unobligated and would otherwise expire on—</text>
<clause commented="no" display-inline="no-display-inline" id="idb5762f200e0945fe8d41aab7abf157cc"><enum>(i)</enum><text display-inline="yes-display-inline">September 30 of the first fiscal year in which the Inspector General of the Corporation has issued an opinion, without qualification, certifying the accuracy of the Corporation's financial statements issued through the integrated accounting and financial management system maintained under section 194(c)(2) with respect to the fiscal year preceding such fiscal year; or</text></clause> <clause commented="no" display-inline="no-display-inline" id="id65373a75f3f340989a954b55818905f0"><enum>(ii)</enum><text>September 30 of each fiscal year thereafter.</text></clause></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id692f68e541e546fca6bbf21535226b0c"><enum>(3)</enum><header>Use of fund</header><text display-inline="yes-display-inline">The Corporation may use amounts available in the Fund to—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id3af036d8dd81449abae9eb3c97e9cd3e"><enum>(A)</enum><text display-inline="yes-display-inline">provide for additional awards and deposits of funds for positions under section 121 of this Act and sections 102, 201, 211, and 213 of the Domestic Volunteer Service Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/42/4952">42 U.S.C. 4952</external-xref>, 5001, 5011, 5013); or</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id86c83cbb65d24ddca18cc108c795630a"><enum>(B)</enum><text display-inline="yes-display-inline">modernize technology used in the administration of the national service laws.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection commented="no" display-inline="no-display-inline" id="idf917fc92592f465195a765e606b57cfd"><enum>(b)</enum><header>Expenditure of investment income in the National Service Trust</header> <paragraph commented="no" display-inline="no-display-inline" id="id0a531ab9355040d8b1a7e6a3652aeb0b"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 145(c) of the National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12601">42 U.S.C. 12601(c)</external-xref>) is amended—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="id0566a55e09af4ecba1456a598c149244"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (1) and (2) as subparagraphs (A) and (B), respectively, and indenting appropriately;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id944628e4cd2942cabc901675bdbbef2c"><enum>(B)</enum><text display-inline="yes-display-inline">in the matter preceding subparagraph (A) (as so redesignated)—</text>
<clause commented="no" display-inline="no-display-inline" id="id96fd4ed7d99d4c4388d5febf52dca6cd"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>to the extent provided for in advance by appropriation</quote> and inserting <quote>as described in paragraph (2)</quote>; and</text></clause> <clause commented="no" display-inline="no-display-inline" id="iddfc58f51d8cb4598b18ef08926413cf8"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking <quote>Amounts</quote> and inserting the following:</text>

<paragraph commented="no" display-inline="no-display-inline" id="id9a50d4e8d9d74aa781be94d6b891a9fd"><enum>(1)</enum><header>Use of amounts in trust</header><text>Amounts</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id7d73dde9b69841208b66932a9e0cf48b"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>

<paragraph id="id9964a76decc84e8e836fe43ef29d5388"><enum>(2)</enum><header>Availability of amounts in trust</header>
<subparagraph commented="no" display-inline="no-display-inline" id="iddbf34e8dfba44e0ab104b6ca8e9a0bc6"><enum>(A)</enum><header>Appropriations</header><text display-inline="yes-display-inline">Amounts in the National Service Trust that are described in paragraph (1) of subsection (a) shall be available under paragraph (1) of this subsection to the extent provided for in advance by appropriation.</text></subparagraph> <subparagraph id="id9f75c74f927b4a9d94a6bdf9c631d40f"><enum>(B)</enum><header>Other amounts</header><text>Amounts in the National Service Trust that are described in paragraph (2), (3), (4), or (5) of subsection (a) shall be available under paragraph (1) of this subsection without further appropriation and without fiscal year limitation.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="idc507f35b787c4fd9bee4326367c58ac2"><enum>(2)</enum><header>Conforming amendment</header><text>Section 149 of the National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12606">42 U.S.C. 12606</external-xref>) is amended by striking subsection (d).</text></paragraph></subsection></section> <section id="idec1a4c46c66844b4ba8353d34942397f" commented="no"><enum>106.</enum><header>Volunteer generation fund</header><text display-inline="no-display-inline">Section 198P(f) of the National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12653p">42 U.S.C. 12653p(f)</external-xref>) is amended by striking <quote>exceed—</quote> and all that follows through the period at the end and inserting <quote>exceed 75 percent of such cost.</quote>.</text></section>
<section id="id9eaf0107fab942f79b9df9258396d658"><enum>107.</enum><header>State Commissions</header>
<subsection id="idc8604b2ce87246d792db3eb42f028444"><enum>(a)</enum><header>Exception for seniors programs</header><text>Section 178(h) of the National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12638">42 U.S.C. 12638(h)</external-xref>) is amended by striking the period and inserting the following: “, unless—</text> <quoted-block style="OLC" display-inline="no-display-inline" id="idc2faa3e8d9a544e9a965f6be40c6ebc2"> <paragraph id="id4cb0dd6b880745d780a0d9df3279cfd6"><enum>(1)</enum><text>such State Commission applies to be a sponsor for a project authorized under title II of the Domestic Volunteer Service Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/42/5000">42 U.S.C. 5000 et seq.</external-xref>); or</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="idc97850a05804440a846832c1ee40c3ab"><enum>(b)</enum><header>Natural disaster placement flexibility</header><text>That section 178(h) is further amended by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id0a7786f75a9542a9b97e4b5c4319c632"> <paragraph id="id2f0b4f7c606f446983e24b93a81baed2"><enum>(2)</enum><text>a natural disaster has been declared in such State, as determined by the Governor, in which case such State Commission may direct up to 25 percent of its allotted funds under section 129(e) that remain unobligated on the date of the declaration, for recruitment of participants for disaster response from the period beginning on the date of the declaration and ending on the last day of the full fiscal year following the date of that declaration.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="id88c49687b6724b9a86a3c52c2659b0cb"><enum>(c)</enum><header>Prevention of duplicative subgrant recipient review</header><text>Section 185 of the National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12644b">42 U.S.C. 12644b</external-xref>) is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="ide21cdece018348daa977a65ff930323d"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsection (b) as subsection (c); and</text></paragraph>

<subsection commented="no" display-inline="no-display-inline" id="idb7ed15063bb54a34a95523a39a7eb931"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 192 of the National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12651a">42 U.S.C. 12651a</external-xref>) is amended—</text> <paragraph id="ide059be434139440ca0a888fe434162ec"><enum>(1)</enum><text>in subsection (a)(1)(A), by inserting <quote>a financial expert with a background relating to financial controls, auditing, or private or public accounting, and including</quote> after <quote>including</quote>;</text></paragraph>
<paragraph commented="no" id="idbccb9fb7d9114833aabc65fb0d8cef1c"><enum>(2)</enum><text>in subsection (c), by inserting <quote>from the date on which the member takes office</quote> before the period; and</text></paragraph> <paragraph commented="no" id="idbc031947d9d0442e84dd03f10e191ee1"><enum>(3)</enum><text>in subsection (d)—</text>

<paragraph commented="no" display-inline="no-display-inline" id="id7651c063efbf46c1be861b2a420401ce"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The amendments made by paragraphs (2) and (3) of subsection (a) shall apply to members of the Board of Directors of the Corporation for National and Community Service appointed under section 192 of the National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12651a">42 U.S.C. 12651a</external-xref>) on or after the date of enactment of this Act.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id53472db0bc664da79f26b8859c7a1c95"><enum>(2)</enum><header>Financial expert</header><text display-inline="yes-display-inline">The amendment made by subsection (a)(1) shall apply on the earlier of—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="id769e131b6d2943f58e085a5362c203ef"><enum>(A)</enum><text display-inline="yes-display-inline">the first day, after the date of enactment of this Act, on which there is a vacancy in the Board of Directors of the Corporation for National and Community Service; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="idc1552a3696c84d4292c53d85bda8a051"><enum>(B)</enum><text display-inline="yes-display-inline">the day that is 5 years after the date of enactment of this Act.</text></subparagraph></paragraph></subsection></section>
<section id="ida0777f961c5747289b5da98d1ac9322d" commented="no"><enum>112.</enum><header>Comprehensive service site resource</header>
<subsection commented="no" display-inline="no-display-inline" id="idbf4dedf315f14701b3140aa3ba211462"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Corporation shall require that a recipient of an award of financial assistance under the national service laws, that enters into an agreement (which may include making a subaward) with an organization to host participants under the national service laws, submit the information described in subsection (b) not later than 60 days after the award recipient enters into the agreement.</text></subsection> <subsection commented="no" display-inline="no-display-inline" id="id1757c331d3a445e3a5d303c9e9fb1155"><enum>(b)</enum><header>Information</header><text>The information described in this subsection is—</text>
<paragraph id="ide96afae033194d129ca9e542f1ee4a34" commented="no"><enum>(1)</enum><text>the name of the organization with which the recipient enters into the agreement;</text></paragraph> <paragraph id="id6de0d2fe06994405b65214af534e92d4" commented="no"><enum>(2)</enum><text>all physical addresses for any site at which the recipient or the organization has agreed to host participants under the national service laws; and</text></paragraph>
<paragraph id="id8f627d1b82a04657a5e272b0e8643981" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text>the location of a website for the recipient and, if applicable, the organization.</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="idfe596e30eb324e959658574bd94d328a"><enum>(c)</enum><header>Resource</header><text display-inline="yes-display-inline">The Corporation shall use the information for the creation of a comprehensive virtually accessible service site resource, to be updated on an annual basis.</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="id30253f7cfbcd4f3e8210eef65efa412f"><enum>(d)</enum><header>Definition</header><text>In this section, the terms <term>Corporation</term> and <term>national service laws</term> have the meanings given the terms in section 101 of the National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12511">42 U.S.C. 12511</external-xref>).</text></subsection></section> <section id="id8128f0fc3d6b42668e579a616d4e2e88" commented="no"><enum>113.</enum><header>Evaluation transparency</header><text display-inline="no-display-inline">Section 179 of the National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12639">42 U.S.C. 12639</external-xref>) is amended—</text>

<paragraph commented="no" display-inline="no-display-inline" id="id90f9ac1a31714b119ddf0344a8ffafaf"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Corporation shall by regulation provide for the payment of national service educational awards, summer of service educational awards, and silver scholar educational awards to permit eligible individuals (including recipients of awards transferred in accordance with section 148(g)) to participate in an eligible career pathway program.</text></paragraph> <paragraph id="id0465813840744e62b975ad4f5b3c17dd"><enum>(2)</enum><header>Eligible career pathway program</header><text>The term <term>eligible career pathway program</term> means a program that—</text>

<paragraph commented="no" display-inline="no-display-inline" id="id6f5af24f554a463aa81ceac4d94caa6c"><enum>(1)</enum><header>Full-time</header><text display-inline="yes-display-inline">An individual described in section 146(a) who, except as provided in paragraph (2), successfully completes a required full-time term of national service under section 139(b)(1) may elect to receive a stipend of an amount described in subsection (b) in lieu of a national service educational award. The Corporation may not provide a stipend under this subsection to an individual who receives a national service educational award under this subtitle for the completion of such term of national service.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id1a214654b2644d41bb8b714270de4911"><enum>(2)</enum><header>Partial completion of service</header><text display-inline="yes-display-inline">If an individual serving in an approved national service position is released in accordance with section 139(c)(1)(A) from completing the full-time term of service agreed to by the individual, the Corporation may provide the individual with a stipend under paragraph (1) in the amount described under subsection (b) that is applicable for the individual and that corresponds to the quantity of the term of service actually completed by the individual.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="id3f98f4cef48b479c87a1223a25a22ae8"><enum>(b)</enum><header>Amount</header><text display-inline="yes-display-inline">A stipend under subsection (a)(1) shall be set at a rate that is equivalent to the rate set for stipends provided to volunteers under section 105(a)(1)(B) of the Domestic Volunteer Service Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/42/4955">42 U.S.C. 4955(a)(1)(B)</external-xref>).</text></subsection> <subsection commented="no" display-inline="no-display-inline" id="id4f5bac66036548bfab231099cadfd768"><enum>(c)</enum><header>Terms</header><text display-inline="yes-display-inline">A stipend under subsection (a)(1) shall be provided in the same manner and in accordance with any regulations prescribed with respect to stipends provided to volunteers under section 105(a) of the Domestic Volunteer Service Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/42/4955">42 U.S.C. 4955(a)</external-xref>).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection>

<subsection commented="no" display-inline="no-display-inline" id="iddc269e11f52542349bcc1801e06ecb7d"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="idaa21a7cfb7a548f999254b99b2c6d068"><enum>(1)</enum><header>Agency</header><text>The term <term>agency</term> means an agency, office, or other establishment in the executive branch of the Federal Government.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id0214b96911074be8ab1681f57e54a4b3"><enum>(2)</enum><header display-inline="yes-display-inline">Competitive service</header><text>The term <term>competitive service</term> has the meaning given the term in section 2102 of title 5, United States Code.</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="id1fcebe0d49f649b286535d6d0c27cfe5"><enum>(b)</enum><header>In general</header><text>Notwithstanding any provision of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/33">chapter 33</external-xref> of title 5, United States Code, governing appointments in the competitive service, and under such regulations as the Director of the Office of Personnel Management shall prescribe, the head of any agency may, in accordance with subsections (c) and (e), noncompetitively appoint any individual who is certified under subsection (d) to a position in the competitive service for which the individual is otherwise qualified.</text></subsection>
<subsection id="id87b86416d5e04700987a30584001c432"><enum>(c)</enum><header>Appointment in permanent position</header><text>Any person appointed to a permanent position under subsection (b) shall—</text> <paragraph id="id89c1c8e4834a4d01b25980bc25eb0897"><enum>(1)</enum><text>become a career-conditional employee, unless the employee has otherwise completed the service requirements for career tenure; and</text></paragraph>
<paragraph id="id9b5d383ba0724db588585488b33f92dc"><enum>(2)</enum><text>acquire competitive status upon completion of any prescribed probationary period.</text></paragraph></subsection> <subsection id="id6c453acdbce94fd596ab66ada49bd51c"><enum>(d)</enum><header>Certification of individual</header> <paragraph commented="no" display-inline="no-display-inline" id="ide418fe8005224feda20405194090d4c2"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Chief Executive Officer may certify an individual under this subsection if the individual successfully completed—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="ida7f99297b9464140a8ed738c8d8218f1"><enum>(A)</enum><text display-inline="yes-display-inline">a term of national service as a member or team leader, as described in paragraph (1) or (4) of section 155(b), in the AmeriCorps National Civilian Community Corps program component described in section 153;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id4a734dd6dab64a0fa4a6d717d6872525"><enum>(B)</enum><text display-inline="yes-display-inline">a period of service of not less than one year as a volunteer or designated volunteer leader under part A of title I of the Domestic Volunteer Service Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/42/4951">42 U.S.C. 4951 et seq.</external-xref>); or</text></subparagraph>
<subparagraph id="id4ec5a039f36d48d1ae6ef976194b41a8"><enum>(C)</enum><text>not less than 1,700 hours of service as described in section 139(b)(1) as a participant under section 137.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="idb52baa140522405c9402352170078d86"><enum>(2)</enum><header>Reliance on other certifications</header><text display-inline="yes-display-inline">In making any certification under paragraph (1), the Chief Executive Officer may rely on a certification made by the entity that selected the individual for, and supervised the individual in, the service described in subparagraph (A), (B), or (C) of such paragraph.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id64d7dd9aa8124ab3800b8e2df8d5cba6"><enum>(3)</enum><header>Erroneous or incorrect certification</header><text display-inline="yes-display-inline">If the Chief Executive Officer determines that a certification under paragraph (1) is erroneous or incorrect, the Corporation shall, after considering the full facts and circumstances surrounding the erroneous or incorrect certification, take action as permitted under law.</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="id0f1fa177f5484aad9f16b9c0ce2dde09"><enum>(e)</enum><header>Period of appointment</header><text display-inline="yes-display-inline">The head of any agency may make an appointment of an individual under subsection (b)—</text>
<paragraph commented="no" display-inline="no-display-inline" id="id61dccdc011d442a1a54cffec96d62f46"><enum>(1)</enum><text display-inline="yes-display-inline">not later than 1 year after the date of completion by the individual of the service described in subparagraph (A), (B), or (C) of subsection (d)(1); or</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id79f349508d604f55baa1d37b1872caad"><enum>(2)</enum><text display-inline="yes-display-inline">not later than 3 years after such date in the case of an individual who, following such service, was engaged—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="iddf4f0844d52d4641bc69b0c974f202c1"><enum>(A)</enum><text display-inline="yes-display-inline">in military service;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="idb8d1882f038649998317d19faa729bd6"><enum>(B)</enum><text display-inline="yes-display-inline">in the pursuit of studies at a recognized institution of higher education, as defined in section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>); or</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="idc639e8a8b7484bea9ab189353242424b"><enum>(C)</enum><text display-inline="yes-display-inline">in other activities that, as determined by the head of such agency, warrant an extended time period before the appointment.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="idcc20128a7bba4676a39340e935c3de37"><enum>(b)</enum><header>Domestic Volunteer Service Act of 1973</header><text>Section 415 of the Domestic Volunteer Service Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/42/5055">42 U.S.C. 5055</external-xref>) is amended—</text>

<subsection commented="no" display-inline="no-display-inline" id="id9795a599d8254d6fb71c7f62857e8c60"><enum>(b)</enum><header>Definition of national service laws</header><text>For purposes of this section, the term <term>national service laws</term> has the meaning given such term in section 101 of the National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12511">42 U.S.C. 12511</external-xref>).</text></subsection></section>
