Commercial driver’s licenses.</toc-entry></toc></subsection></section><title id="id69e2bf6aa37a48e7b0c524e6d29a36cb" style="OLC"><enum>I</enum><header>Keeping our roads safe</header><section id="id74e20fdfa8084cf2bb65e7b0befd07b2"><enum>101.</enum><header>Use of commercial driver’s licenses by illegal aliens in interstate commerce</header><subsection commented="no" display-inline="no-display-inline" id="id8c180299e7174eb8bba14221a8adb604"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/2">Chapter 2</external-xref> of title 18, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/18/40A">section 40A</external-xref> the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id7019de4315a94f3a8154a079e3250f4f"><section id="idb5bf7c46df0442cfb0d60d50d44b5463"><enum>40B.</enum><header>Use of commercial driver’s licenses by illegal aliens in interstate commerce</header><subsection commented="no" display-inline="no-display-inline" id="id95673e2eb82246eb8b09e46c2f4a5d18"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="id454a55d44ea14c51a13ff644c4f76a22"><enum>(1)</enum><text>the terms <term>commercial driver’s license</term> and <term>commercial vehicle</term> have the meanings given such terms in section 31301 of title 49; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id65fb0c4d05b54595b026baf4226ec843"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>covered alien</term> means an alien (as defined in section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>)) who—</text><subparagraph id="id7b80bc5f99744b8f9a73997f7c7720fa"><enum>(A)</enum><text>is described under—</text><clause id="id7f2c8122f8cb465b871f874b22eb0dfb"><enum>(i)</enum><text>section 237(a)(1)(C)(i) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227(a)(1)(C)(i)</external-xref>);</text></clause><clause id="idf0f0f77be3744a77b3063fa14258d66d"><enum>(ii)</enum><text>section 212(a)(6)(A)(i) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(6)(A)(i)</external-xref>); or</text></clause><clause id="id396f42611a624c99a607aa770bd8ed6a"><enum>(iii)</enum><text>section 236(c)(1) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1226">8 U.S.C. 1226(c)(1)</external-xref>); or</text></clause></subparagraph><subparagraph id="id7404ac14ce3d42e6af653681f39fed45"><enum>(B)</enum><text>has been paroled into the United States under section 212(d)(5) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(d)(5)</external-xref>).</text></subparagraph></paragraph></subsection><subsection id="id68c3a81fd92d4b8bbc614f3c2943b028"><enum>(b)</enum><header>Prohibition</header><text>It shall be unlawful for a covered alien to present or use a commercial driver’s license in interstate or foreign commerce.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id8d5f684044e24073bb6fe6bd627fa854"><enum>(c)</enum><header>Criminal penalties</header><paragraph commented="no" display-inline="no-display-inline" id="idaaf585539376411e8db6710c0f6302a7"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to paragraph (2)(C), a covered alien who violates subsection (b) shall be fined under this title, imprisoned for not more than 5 years, or both.</text></paragraph><paragraph id="id0483d4fd57254ed6b1c45fb7bdc39399"><enum>(2)</enum><header>Mandatory minimum sentence</header><text>Except to the extent that a greater minimum sentence is otherwise provided by any other provision of law—</text><subparagraph id="idb467bf0128cd48b1bfca58a80fe48abf"><enum>(A)</enum><text>a covered alien who, while violating subsection (b), causes a motor vehicle accident while operating a commercial vehicle shall be imprisoned for not less than 1 year;</text></subparagraph><subparagraph id="ided6b113c81e441059298f2ef2c8f3b7d"><enum>(B)</enum><text>a covered alien who, while violating subsection (b), causes a motor vehicle accident while operating a commercial vehicle which results in bodily injury shall be imprisoned for not less than 2 years; and</text></subparagraph><subparagraph id="id7fe6ac09ec544c3fad1ef9476b7f2bba"><enum>(C)</enum><text>a covered alien who, while violating subsection (b), causes a motor vehicle accident while operating a commercial vehicle which results in death shall be punished by death or by imprisonment for life.</text></subparagraph></paragraph></subsection><subsection id="id4f45e8dd89e24440aaed12e1e7f2a8bb"><enum>(d)</enum><header>State officials</header><paragraph id="id9f80231ef73c4a4887b2611ad6522cfa"><enum>(1)</enum><header>In general</header><text>It shall be unlawful for any officer, employee, or contractor of a State or local government, acting under color of law, to intentionally direct or implement the issuance of a commercial driver’s license unless, before such issuance, the officer, employee, or contractor confirms the immigration status of the applicant through the E-Verify Program described in section 403(a) of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1324a">8 U.S.C. 1324a</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/104/208">Public Law 104–208</external-xref>) or an analogous State verification program.</text></paragraph><paragraph id="idbea41fc5286944ecb8da52bd74e05d00"><enum>(2)</enum><header>Penalty</header><text>An officer, employee, or contractor of a State or local government who violates paragraph (1) shall be fined under this title, imprisoned for not more than 1 year, or both.</text></paragraph></subsection><subsection id="id73057638549140ed94c654b417a7145a"><enum>(e)</enum><header>Civil penalties</header><text>Any business, corporation, organization, or entity that knowingly provides substantial assistance to a covered alien to violate subsection (b), or conspires with a covered alien to violate subsection (b), shall be subject to a civil penalty in an amount of $50,000 per violation.</text></subsection><subsection id="ide3912e8f8cbb4a0ea8deed9fb8d9dd1a"><enum>(f)</enum><header>Individual civil remedies</header><paragraph id="id1a67ff93a2d647259a4e5de795ff1e23"><enum>(1)</enum><header>Action and jurisdiction</header><text>Any person injured in his or her person or property in a motor vehicle accident caused by a covered alien presenting or using a commercial driver’s license in interstate or foreign commerce, or his or her estate, survivors, or heirs, may bring a civil action in any appropriate district court of the United States and shall recover threefold the damages he or she sustains and the cost of the action, including attorney's fees.</text></paragraph><paragraph id="idb17a17fe47f143cc8c57299757fdd8b8"><enum>(2)</enum><header>Liability</header><text>In any civil action under paragraph (1) for an injury arising from a motor vehicle accident caused by a covered alien presenting or using a commercial driver’s license, liability may be asserted against any person, including any business, corporation, organization, or other entity, who aids and abets by knowingly providing substantial assistance for the covered alien to obtain, or who conspires with the covered alien to obtain, the commercial driver’s license.</text></paragraph></subsection><subsection id="id2b5ac850a0c248b792ef7b6ee1db900e"><enum>(g)</enum><header>Report</header><text>Not later than 180 days after the date of enactment of this section, the Attorney General shall submit to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives a written report that includes—</text><paragraph commented="no" display-inline="no-display-inline" id="id70dbc2e1530e4e4d9aae9901fac94425"><enum>(1)</enum><text display-inline="yes-display-inline">for the period beginning on such date of enactment and ending on the date of the report—</text><subparagraph id="ide5c1fe366d52406aa2a60802f9328411"><enum>(A)</enum><text>the total number of covered aliens arrested for violating subsection (b);</text></subparagraph><subparagraph id="id31b392c137e64db798e22af2ad81b93f"><enum>(B)</enum><text>a State-by-State breakdown of—</text><clause id="idf6b224cf74ce4a449cb24be02015c316"><enum>(i)</enum><text>the number of commercial driver’s licenses issued to covered aliens; and</text></clause><clause id="id4ba8f2ef212a42df9f50e97ad5e7400b"><enum>(ii)</enum><text>the number of accidents involving covered aliens arrested for violating subsection (b); and</text></clause></subparagraph><subparagraph id="id0d3c39c6c408402a95a1d06b4f0fbcea"><enum>(C)</enum><text>the number of arrests and prosecutions for violations of subsection (b); and</text></subparagraph></paragraph><paragraph id="id15c6bf0d05a04d5dbf9db07e951bb7ae"><enum>(2)</enum><text>a plan for steps the United States Government will take to stop violations of subsection (b).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idb2b7de420daa462a9278580f5ae022dd"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/2">chapter 2</external-xref> of title 18, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/18/40A">section 40A</external-xref> the following:</text><quoted-block style="USC" id="id33d960e4-05a5-4f15-8c82-9643f90c5fb4"><toc><toc-entry level="section" idref="idb5bf7c46df0442cfb0d60d50d44b5463">40B. Use of commercial driver’s licenses by illegal aliens in interstate commerce.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="idbd4d46c0180148b98d6ccb224a04f6ba"><enum>102.</enum><header>Death penalty aggravating factor</header><text display-inline="no-display-inline">Section 3592(c) of title 18, United States Code, is amended by inserting after paragraph (16) the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="ide4c7d0bc38b44e09acd058fe95ae9fd9"><paragraph id="id95d2db9d50264832bd40388e85c2021a"><enum>(17)</enum><header>Illegal alien using a commercial driver’s license and causing death in a motor vehicle crash</header><text>The defendant is a covered alien (as defined in section 40B) who presents or uses a commercial driver’s license (as defined in section 31301 of title 49) in interstate or foreign commerce and causes a motor vehicle accident while operating a commercial vehicle (as defined in section 31301 of title 49) which results in death.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id6771085c14404c70a29ea59fa5ceee00"><enum>103.</enum><header>Immigration consequences</header><subsection id="idf7952515008f4743b38557ec3a90b792"><enum>(a)</enum><header>Aggravated felony</header><text>Section 101(a)(43) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(43)</external-xref>) is amended—</text><paragraph id="id8e42bfcfe33043db99893539bab58a0e"><enum>(1)</enum><text>in subparagraph (T), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="ida0f40c3c0cea4b338641aeb5c4180ee9"><enum>(2)</enum><text>in subparagraph (U), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="id3cec3c2bf6f349e198cc5a924f4f39db"><enum>(3)</enum><text>by inserting after subparagraph (U), as amended, the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idc1306177283a489585a33aa1e1ae02d7"><subparagraph id="id6e931a11494f439f847e2bb164676a3f"> <enum>(V)</enum> <text>an offense relating to the use of a commercial driver’s license in interstate commerce by a covered alien described in section 40B of title 18, United States Code.</text>
 </subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idc24c210b3fad40958afdb364fc4d416e"><enum>(b)</enum><header>Inadmissibility</header><text>Section 212(a)(2)(F) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(2)(F)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="iddea71b194be644f7964752c9d7285afc"><subparagraph id="id90f39bf49c0e495ca7f29692d8f9867d"><enum>(F)</enum><header>Use of a commercial driver’s license by a covered alien</header><text>Any alien who a consular officer or the Attorney General knows, or has reason to believe, has engaged, is engaging, or seeks to enter the United States to engage, in an offense that is described in section 40B of title 18, United States Code (relating to the use of commercial driver's licenses by illegal aliens), is inadmissible.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></title><title id="id9329ef3f7570407cb60b9790e67d5302" style="OLC"><enum>II</enum><header>Transportation</header><section id="idd7d07336390445dca56e8ce543ca9ec9"><enum>201.</enum><header>Commercial driver’s licenses</header><text display-inline="no-display-inline">Section 31308 of title 49, United States Code, is amended—</text><paragraph id="id90cfd2a575ae4f77ad914c0247be52f1"><enum>(1)</enum><text>in the matter preceding paragraph (1), in the first sentence—</text><subparagraph commented="no" display-inline="no-display-inline" id="id40041ecdd3d64eb1a956cdb64dfec8ad"><enum>(A)</enum><text>by inserting <quote>(referred to in this section as the <term>Secretary</term>)</quote> after <quote>Secretary of Transportation</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0032c034f1b94d30913d2ddf9a73a412"><enum>(B)</enum><text>by striking <quote>After</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8a91e0f132ab4fd3989133020c62f469"><subsection commented="no" display-inline="no-display-inline" id="idfb4f6744091c4a07ad824de94f7c29ac"><enum>(a)</enum><header>Uniform standards</header><text>After</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd8f13e9d42af4f0284107b41010a45db"><enum>(2)</enum><text>in subsection (a) (as so designated)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id130d24e3f8a54034aeee05ccfd779f76"><enum>(A)</enum><text>in paragraph (1)—</text><clause commented="no" display-inline="no-display-inline" id="idbad5df09f3e34efbb41ad1fc8cee11f0"><enum>(i)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>and</quote> at the end;</text></clause><clause commented="no" display-inline="no-display-inline" id="id1e8b206d713f46cf96ed961d6080fe07"><enum>(ii)</enum><text>in subparagraph (B), by adding <quote>and</quote> after the semicolon at the end; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id3b76df0389504ce885aadfb537def257"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5eca6d565eb84c63bf8d8b740000004a"><subparagraph commented="no" display-inline="no-display-inline" id="id376e447705534990bd8f934ed0cdc726"><enum>(C)</enum><text>present written documentation to the State, obtained through an entity participating in the E-Verify Program described in section 403(a) of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1324a">8 U.S.C. 1324a</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/104/208">Public Law 104–208</external-xref>) or through a process established by the State, verifying the employment eligibility of the individual;</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddff69b30b2ac4942ab73161d5b797d10"><enum>(B)</enum><text>in paragraph (3), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfee13ae86410465182805b133f21323a"><enum>(C)</enum><text>in paragraph (4)(E), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcf2d5bd10243403eb24cca20bc56ab21"><enum>(D)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="iddf5063a73e004f70bce8d2ef728bf299"><paragraph commented="no" display-inline="no-display-inline" id="idbb139da9efc34fbbbca950a1cd06557b"><enum>(5)</enum><text>on the request of the Secretary, each State shall provide to the Secretary the written documentation described in paragraph (1)(C).</text></paragraph> <after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id24fe006a94374e0bbe329f66911e6063"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block id="idb38d818e20124f668307f532a2fa0674" display-inline="no-display-inline" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="idb625b1f62b0448fbb885d60f67617721"><enum>(b)</enum><header>Enforcement by the Attorney General</header><text>Whenever it appears to the Attorney General that a State is engaged in, or is about to engage in, any act that constitutes, or would constitute, a violation of a requirement under paragraph (1)(C) or (5) of subsection (a), the Attorney General may initiate a civil action in a district court of the United States to enjoin such violation.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id11af74d61cf34fc8b72fe5826a664fc9"><enum>(c)</enum><header display-inline="yes-display-inline">Enforcement by attorney general of a State</header><paragraph commented="no" display-inline="no-display-inline" id="id3402cc27f0114966aaf27cb355ad19c2"><enum>(1)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this subsection:</text><subparagraph commented="no" display-inline="no-display-inline" id="idb433005de33f430bab7150f2ad6323e1"><enum>(A)</enum><header>Harm</header><text display-inline="yes-display-inline">The term <term>harm</term> means—</text><clause commented="no" display-inline="no-display-inline" id="id04f4fe5c2f45481086aff392b5c7a91b"><enum>(i)</enum><text display-inline="yes-display-inline">any bodily injury suffered by a citizen of a State; or</text></clause><clause commented="no" display-inline="no-display-inline" id="ida352ef3de0684ed08b2b3d7497495909"><enum>(ii)</enum><text display-inline="yes-display-inline">any monetary loss greater than $100 suffered by a State or a citizen of a State.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4e0864039f564028a9681a8cf4ac274e"><enum>(B)</enum><header>Injured State</header><text>The term <term>injured State</term> means a State alleged, or any citizen of which is alleged, to be harmed as described in paragraph (2).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd3cf62702d234fcaa57ba80482f67035"><enum>(2)</enum><header>Action for injunctive relief</header><text display-inline="yes-display-inline">The attorney general of a State, or any other authorized State officer, alleging a violation of the requirement that the employment eligibility of an individual be verified through the E-Verify Program or other process described in subsection (a)(1)(C) before that individual is issued a commercial driver’s license, as required under that subsection, and that the violation harms that State or any citizen of that State, shall have standing to bring an action against the Secretary on behalf of the injured State or the citizens of the injured State in an appropriate district court of the United States to obtain injunctive relief requiring the Secretary to request from the State that issued the commercial driver’s license the written documentation described in subsection (a)(1)(C).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></title></legis-body></bill>
