which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 38, United States Code, to address appraisal fees for housing loans guaranteed by the Department of Veterans Affairs, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>VA Appraisal Modernization Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id4b581799f3f442e3acd0ddddc3662120"><enum>2.</enum><header>Appraisal fees for Department of Veterans Affairs home loans</header><subsection commented="no" display-inline="no-display-inline" id="id1533a92b7f364f12a623e72cd2bdd67c"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/37">Chapter 37</external-xref> of title 38, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/38/3731">section 3731</external-xref> the following new section:</text><quoted-block id="id73576F6B99094CAB83E73164CEDE51E8" style="USC" act-name=""><section id="idE4286150C20748A9A05360E28D2BC57A" section-type="section-one"><enum>3731A.</enum><header>Appraisal fees</header><subsection commented="no" display-inline="no-display-inline" id="id5e69e8eda07a4468bb6803f82091b2bd"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="idc115e4c5281f4020880c874a61b8f7ee"><enum>(1)</enum><header>Appraisal fee</header><text>The term <term>appraisal fee</term> means the compensation paid to an appraiser for conducting an appraisal of property in connection with a loan guaranteed, insured, or made under this chapter.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5136302e3e924d9fb0a668aa638d8dc9"><enum>(2)</enum><header>High-demand county</header><text>The term <term>high-demand county</term> means a county designated as a high-demand county under subsection (c).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id84a4b4a7b27243ca8a62dda89c56a160"><enum>(3)</enum><header>Remote county</header><text>The term <term>remote county</term> means a county designated as a remote county under subsection (c).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id05e5d21530e04f7bbcd7d5870b8d2039"><enum>(b)</enum><header display-inline="yes-display-inline">Annual inflation adjustment</header><paragraph commented="no" display-inline="no-display-inline" id="idea12b2f0d22944c68d0a252729021886"><enum>(1)</enum><header display-inline="yes-display-inline">Baseline</header><text>Not later than 180 days after the date of the enactment of the <short-title>VA Appraisal Modernization Act</short-title>, the Secretary shall establish appraisal fees for purposes of this chapter.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id121ee5814b344e65b23be6d013a1af63"><enum>(2)</enum><header>Adjustment</header><text>On January 1, 2027, and annually thereafter, the Secretary shall adjust the appraisal fees established under paragraph (1) to reflect the percentage of the increase, if any, in the purchase price of homes during the previous year, as determined by the quarterly purchase-only House Price Index published by the Federal Housing Finance Agency, rounded to the nearest $25.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idef5bfc1e644947e48138890580a8f79c"><enum>(3)</enum><header>Publication; notice</header><text display-inline="yes-display-inline">The Secretary shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf561170170514c0db60d4964b705b687"><enum>(A)</enum><text>publish the appraisal fees established under this subsection on the publicly available website of the Department of Veterans Affairs; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id667f9cc6f2cc44708ebccf628e61581d"><enum>(B)</enum><text>directly notify the appraisers on the list developed and maintained under section 3731(a)(3) of this title of such fees.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7a03c27d76fd407d891aba4923f0426d"> <enum>(c)</enum> <header>Designation of high-Demand counties and remote counties</header> <paragraph commented="no" display-inline="no-display-inline" id="id9737965c98224fd4bde3e2a3058e211f"> <enum>(1)</enum> <header display-inline="yes-display-inline">High-demand counties</header> <subparagraph commented="no" display-inline="no-display-inline" id="id6ec7514cdd524b38b8fe5a013a2783ad"> <enum>(A)</enum> <header>In general</header> <text display-inline="yes-display-inline">The Secretary shall designate a county as a high-demand county for purposes of this section if—</text>
                  <clause commented="no" display-inline="no-display-inline"
                    id="idd949095c75164c09a81529528e9a179d">
                    <enum>(i)</enum>
 <text>during the 90-day period preceding the date on which the designation is made—</text>
                    <subclause commented="no" display-inline="no-display-inline"
                      id="id6959e2e8888f479984619d062eb6518e">
                      <enum>(I)</enum>
 <text display-inline="yes-display-inline">the average time to complete an appraisal in the county exceeded the timeliness standard established under section 3731 of this title by more than three business days; or</text>
                    </subclause>
                    <subclause commented="no" display-inline="no-display-inline"
                      id="id96ed9ebe9c4c4d1694f837b7b1b1e142">
                      <enum>(II)</enum>
 <text display-inline="yes-display-inline">more than 15 percent of appraisal assignments in the county were unassigned for five or more business days due to insufficient appraiser availability; or</text>
                    </subclause>
                  </clause>
                  <clause commented="no" display-inline="no-display-inline"
                    id="id4a1dc3fcf71449f888b75f1ac43a61ab">
                    <enum>(ii)</enum>
 <text>the Secretary determines, based on data analysis and market conditions, that demand for appraisals in the county substantially exceeds available appraiser capacity.</text>
                  </clause>
                </subparagraph>
                <subparagraph commented="no" display-inline="no-display-inline"
                  id="id011b6602fc0d4c7288f815171dd8ff99">
                  <enum>(B)</enum>
                  <header>List; updates</header>
 <text>The Secretary shall—</text> <clause commented="no" display-inline="no-display-inline" id="id244130396e86481d9f8b347961af27fa"> <enum>(i)</enum> <text display-inline="yes-display-inline">maintain a list of high-demand counties designated under subparagraph (A); and</text>
                  </clause>
                  <clause commented="no" display-inline="no-display-inline"
                    id="id3cc477fd877244429216aa597a8def1b">
                    <enum>(ii)</enum>
 <text>on a quarterly basis, review and update such list.</text> </clause> </subparagraph> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id712bee2465ec4f9fb9ff33a7079e2789"> <enum>(2)</enum> <header>Remote counties</header> <subparagraph commented="no" display-inline="no-display-inline" id="id69d6f336e3884853bef74a97b97a08e8"> <enum>(A)</enum> <header>In general</header> <text display-inline="yes-display-inline">The Secretary shall designate a county as a remote county for purposes of this section if—</text>
                  <clause commented="no" display-inline="no-display-inline"
                    id="id8374b7ca18864bc495fdeb7b66ad1a11">
                    <enum>(i)</enum>
 <text display-inline="yes-display-inline">there are fewer than five appraisers on the list developed and maintained under section 3731(a)(3) of this title within 30 miles of the county's geographic center;</text>
                  </clause>
                  <clause commented="no" display-inline="no-display-inline"
                    id="id99e9183f19f74d6799df793a1741312c">
                    <enum>(ii)</enum>
 <text display-inline="yes-display-inline">the average distance traveled by an appraiser to complete an assignment in the county is greater than 40 miles one way; or</text>
                  </clause>
                  <clause commented="no" display-inline="no-display-inline"
                    id="idda38eb9568da41e4a5fdc6736c9dc203">
                    <enum>(iii)</enum>
 <text display-inline="yes-display-inline">the Secretary determines that the county is characterized by low appraiser density relative to loan volume.</text>
                  </clause>
                </subparagraph>
                <subparagraph commented="no" display-inline="no-display-inline"
                  id="iddaab5b0fa6744f37be64d42f551c67ee">
                  <enum>(B)</enum>
                  <header>List; updates</header>
 <text>The Secretary shall—</text> <clause commented="no" display-inline="no-display-inline" id="idd5c7b868a6844eb296a235583f1a9a1e"> <enum>(i)</enum> <text display-inline="yes-display-inline">maintain a list of remote counties designated under subparagraph (A); and</text>
                  </clause>
                  <clause commented="no" display-inline="no-display-inline"
                    id="idbdecc9615ead496f8180d6e5e2b919bc">
                    <enum>(ii)</enum>
 <text>on a quarterly basis, review and update such list.</text> </clause> </subparagraph> </paragraph> </subsection><subsection commented="no" display-inline="no-display-inline" id="idd9ada5671a0340189793984898be5276"> <enum>(d)</enum> <header display-inline="yes-display-inline">Appraisal fees in high-Demand counties</header> <paragraph commented="no" display-inline="no-display-inline" id="idaf3c9fedb6274d84bfb4049e1c9c0534"> <enum>(1)</enum> <header>In general</header> <text display-inline="yes-display-inline">On January 1, 2027, and annually thereafter, the Secretary shall increase the appraisal fee for appraisals made in high-demand counties to not less than 125 percent of the appraisal fee established under subsection (b).</text>
              </paragraph>
              <paragraph commented="no" display-inline="no-display-inline"
                id="id4683ffe10b8245e58b557646a7506a4b">
                <enum>(2)</enum>
                <header>Increase</header>
 <text>In carrying out paragraph (1), the Secretary may increase the appraisal fee for appraisals made in a high-demand county to not more than 150 percent of the appraisal fee established under subsection (b) if the county has been designated as a high-demand county for four quarters or more.</text>
              </paragraph>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id3984200bf3864e4d96175bc9940ff868"><enum>(e)</enum><header display-inline="yes-display-inline">Mileage reimbursement</header><paragraph commented="no" display-inline="no-display-inline" id="id9f5b32e8e8ce49469e5bc4a1317973c2"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">For any appraisal made for purposes of this chapter in a high-demand county or remote county, the Secretary shall reimburse the appraiser for mileage at the rate prescribed by the Administrator of General Services under section 5707(b) of title 5 for use on official business of privately owned automobiles.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5f4a30e3869e431db03b4af158defbe6"><enum>(2)</enum><header>Mileage</header><text display-inline="yes-display-inline">In this subsection, the term <term>mileage</term> means the round trip distance in miles between the appraiser’s place of business and the subject property.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id398ea76a8b604fa5a91e7553bc64fa49"><enum>(b)</enum><header display-inline="yes-display-inline">Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 3731 the following new item:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4c7e9012ad854c8096eb2b2505f14000"><toc><toc-entry level="section" bold="off">3731A. Appraisal fees.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section commented="no" display-inline="no-display-inline" id="id66a864d680784fdb93086880fac392d7"><enum>3.</enum><header>Report and study</header><subsection commented="no" display-inline="no-display-inline" id="id4975bc63f81742beafe26c2e3d60b211"><enum>(a)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall submit to the Committee on Finance of the Senate and the Committee on Ways and Means of the House of Representatives a report that includes the following:</text><paragraph commented="no" display-inline="no-display-inline" id="idbbae1a6e64ef4ca9845ebd04310d3e25"><enum>(1)</enum><text>An estimation of—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd0f60682ade84f10b1989e00d60db09d"><enum>(A)</enum><text>the effects of section 3731A of title 38, United States Code, as added by section 2, on government expenditures over time;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddc91e2f698024950aaacc83f3709fe01"><enum>(B)</enum><text>the impact of such section on the number of appraisers who join the appraisal network of the Department of Veterans Affairs;</text></subparagraph><subparagraph id="idb2bb86da27df4c7cae26d99c74df53fc"><enum>(C)</enum><text>the impact of such section on completion times for appraisals in high-demand counties; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcdaea4d8a2cf4c0c9e99d097bf5c56f5"><enum>(D)</enum><text>the impact of such section on the use of housing loans guaranteed, insured, or made under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/37">chapter 37</external-xref> of title 38, United States Code.</text></subparagraph></paragraph><paragraph id="ide51993addd6543ccafbe2f1eca1cabbe"><enum>(2)</enum><text>Recommendations to prevent fraud, waste, and abuse in the implementation of such section.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id26029d03da25445b85b8616d9d327af0"><enum>(b)</enum><header>Study</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id0d8245385d8c4f9195368bc07abf03f1"><enum>(1)</enum><text display-inline="yes-display-inline">conduct on a study on the feasibility and advisability of—</text><subparagraph id="id07d79c89525c4bb7906ea71d5d0e9c05"><enum>(A)</enum><text>procuring contracts for home appraisers in areas where supply cannot meet demand; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6cf8c249ac7d42c4aad657894ddb58b1"><enum>(B)</enum><text display-inline="yes-display-inline">restructuring the appraisal process of the Department of Veterans Affairs to more closely mirror the appraisal process for loans insured by the Federal Housing Administration; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc3d6f4cfd45c4a21b81e807e6cf34ac3"><enum>(2)</enum><text>submit to Congress, and make publicly available, a report on the results of such study.</text></paragraph></subsection></section></legis-body></bill>
