<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 4217</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260326">March 26, 2026</action-date><action-desc><sponsor name-id="S386">Ms. Duckworth</sponsor> (for herself and <cosponsor name-id="S252">Ms. Collins</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 38, United States Code, to eliminate copayments by the Department of Veterans Affairs for preventive health services and medicines relating to preventive health services, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Copay Fairness for Veterans Act of 2026</short-title></quote>.</text></section><section id="idda1e3162dc6247f59afa1518b0939f69"><enum>2.</enum><header>Improvement to preventive health services furnished by Department of Veterans Affairs</header><subsection id="idbabbcc82321441fbb992a9e98a6a99a6"><enum>(a)</enum><header>Elimination of copayments</header><paragraph commented="no" display-inline="no-display-inline" id="id4a06799793cd4e92b40d89b9401f7954"><enum>(1)</enum><header display-inline="yes-display-inline">Medication</header><text>Section 1722A(a)(4) of title 38, United States Code, is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id5c6ea62183df4d2ba7c405812d5c1a96"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>to opioid antagonists</quote> and inserting “to—</text><quoted-block style="OLC" display-inline="no-display-inline" id="id62b2743e05754b4288f44d0890b96576"><subparagraph id="id29fd56dad50a44a0b29879735b6981d2" indent="up1"><enum>(A)</enum><text>opioid antagonists</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3b0edab672ac4acca0bf81d7bc0c9054"><enum>(B)</enum><text>by striking the period at the end and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7a702bb643e4425089a295962f4cef22"><enum>(C)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id084FA96DE68844A890232C2799B21A7F"><subparagraph id="idd2361ca0d47140889b75badd1390fb5f" indent="up1"><enum>(B)</enum><text>medication, including over-the-counter medication, that is or is part of preventive health services.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id28174dda084e47a99ae2941b3b2704af"><enum>(2)</enum><header>Hospital care and medical services</header><text>Section 1710 of such title is amended—</text><subparagraph id="idd9a1fb1e2a9e40119d6dbeaf7376c1eb"><enum>(A)</enum><text>in subsection (f)—</text><clause id="id9d0b3bac07344ad19cec414729bbc921"><enum>(i)</enum><text>by redesignating paragraph (5) as paragraph (6); and</text></clause><clause id="ida95e1bac6f024d3ca4003235b91672b2"><enum>(ii)</enum><text>by inserting after paragraph (4) the following new paragraph (5):</text> <quoted-block style="OLC" display-inline="no-display-inline" id="idfc7bc5b0f2864ca180e905419ada162b"> <paragraph id="idf0aeb8447630411e90d4bb5685e515b4" indent="up1"> <enum>(5)</enum> <text>A veteran shall not be liable to the United States under this subsection for any amounts for preventive health services the veteran receives during the course of hospital care or nursing home care provided to the veteran.</text>
                </paragraph>
                <after-quoted-block>; and</after-quoted-block>
 </quoted-block></clause></subparagraph><subparagraph id="idc48a15b76a2d4360a3723f85abdbd55a"><enum>(B)</enum><text>in subsection (g)(3), by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id11b25533e1084caf8535fc9e2687b801"><subparagraph id="idc75364874dc1475c82c8fbe78690fd1d"><enum>(C)</enum><text>Preventive health services.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="ida0e06336deca4593bc513fb1618d8a56"><enum>(3)</enum><header>Walk-in care</header><text>Section 1725A(f)(1) of such title is amended by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ide1e6ec35aefd4c53b9b3b7fc39269b8d"><subparagraph id="id98ff2d1eea0341ca8fe73ee61a9c43ea" indent="up2"><enum>(D)</enum><text>An eligible veteran shall not be required to pay the United States a copayment for preventive health services furnished under this section.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="idd5194863f1a448c493965869b3e4eb3b"><enum>(4)</enum><header>Care for survivors and dependents</header><text display-inline="yes-display-inline">Section 1781 of such title is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6af33c6891db41499d050d2439c972e8"><subsection id="id2ffa86be346f473e9689def15fc0a807"><enum>(f)</enum><text>No individual covered under subsection (a) shall be required to pay the United States a copayment for preventive health services furnished under this section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idc93c0e3221bd479aabd48721b064e6f2"><enum>(b)</enum><header>Definitions</header><text>Section 1701(9) of such title is amended—</text><paragraph id="id6ceb7087b8934321b91d447c2d00ff6d"><enum>(1)</enum><text>by amending subparagraph (G) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id30737b5868df4e3c9629061bafe21537"><subparagraph commented="no" display-inline="no-display-inline" id="id1953fe42ea5b4e0eabe137b0669ffc94"><enum>(G)</enum><text display-inline="yes-display-inline">immunizations against infectious diseases, including each immunization—</text><clause commented="no" display-inline="no-display-inline" id="id63d149d0d6a94f5ba79847c52ba7c864"><enum>(i)</enum><text display-inline="yes-display-inline">on the recommended adult immunization schedule at the time such immunization is indicated on that schedule;</text></clause><clause commented="no" display-inline="no-display-inline" id="id388cade3d55941f487c967cd3156bcf3"><enum>(ii)</enum><text display-inline="yes-display-inline">that has in effect a recommendation from the Advisory Committee on Immunization Practices of the Centers for Disease Control and Prevention with respect to the individual receiving the immunization; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id5c3ea1dbe6d24524b279d847e1125276"><enum>(iii)</enum><text display-inline="yes-display-inline">that is recommended by the largest single-discipline professional organization for the relevant field or a major labor or professional organization that exclusively represents the relevant clinical professional, specialty, or disorder;</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idab8d89a15fa444bda65b051f6424f871"> <enum>(2)</enum> <text display-inline="yes-display-inline">in subparagraph (K), by striking <quote>; and</quote> and inserting a semicolon;</text>
        </paragraph><paragraph id="idc5639837377a42839450adfd4e08ba28">
          <enum>(3)</enum>
 <text>by redesignating subparagraph (L) as subparagraph (N); and</text> </paragraph><paragraph id="ida56bccb8f75f47638d6a808ca203e8a8"><enum>(4)</enum><text>by inserting after subparagraph (K) the following new subparagraphs:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf35214ba35994618983b256f077fa6c4"><subparagraph id="idee22e7a4ca324b9387cc67b0e7595f07"><enum>(L)</enum><text>evidence-based items or services that—</text><clause commented="no" display-inline="no-display-inline" id="id1bb6b7133b9b4c2894a3e074107cc981"><enum>(i)</enum><text display-inline="yes-display-inline">have in effect a rating of <quote>A</quote> or <quote>B</quote> in the current recommendations of the United States Preventive Services Task Force; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id7c7cfaa2c14c47efa4d08156b9916b35"><enum>(ii)</enum><text display-inline="yes-display-inline">are recommended by the largest single-discipline professional organization for the relevant field or a major labor or professional organization that exclusively represents the relevant clinical professional, specialty, or disorder;</text></clause></subparagraph><subparagraph id="id564cc476b3b3411389ed3c31f135522d"><enum>(M)</enum><text>with respect to preventive care, screenings, and contraceptive services, such services shall include, at minimum—</text><clause id="idf1ed7e71ee5c41789642e8f637f11034"><enum>(i)</enum><text>screening for anxiety, breast cancer, cervical cancer, human immunodeficiency virus infection, intimate partner and domestic violence, diabetes in and after pregnancy, and urinary incontinence;</text></clause><clause id="id0d33967fbcf1481b9d349572bb931127"><enum>(ii)</enum><text>counseling for intimate partner and domestic violence, and sexually transmitted infections;</text></clause><clause id="id95f25763417d4d4088e923e178298901"><enum>(iii)</enum><text>breastfeeding services and supplies;</text></clause><clause id="idf00c9a59c1224ffda6d7b7261c3da708"><enum>(iv)</enum><text>contraception, including—</text><subclause commented="no" display-inline="no-display-inline" id="idcea1df9b5ab74663bed944958798a72c"> <enum>(I)</enum> <text display-inline="yes-display-inline">any drug, device, or biological product intended for use in the prevention of pregnancy, whether specifically intended to prevent pregnancy or for other health needs, that is approved, cleared, authorized, or licensed under section 505, 510(k), 513(f)(2), 515, or 564 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/355">21 U.S.C. 355</external-xref>, 360(k), 360c(f)(2), 360e, 360bbb–3) or section 351 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/262">42 U.S.C. 262</external-xref>);</text>
 </subclause><subclause commented="no" display-inline="no-display-inline" id="id69e04e6a4a9c499ea1ac0e418fe211c2"><enum>(II)</enum><text display-inline="yes-display-inline">any services related to providing the safe and effective use of such drug, device, or product; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idfa029f0b2e1248ceb785fbd76d830b06"><enum>(III)</enum><text display-inline="yes-display-inline">any related services approved, granted, or cleared by the Food and Drug Administration;</text></subclause></clause><clause id="idd99fbcc14f604aeea4b45c588fe7da87"><enum>(v)</enum><text>obesity prevention in midlife women; and</text></clause><clause id="idcb82ebc3cf614e62a210f67bfc3e5994"><enum>(vi)</enum><text>well-woman preventative visits; and</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id6ccc2032c21f4b27847cbc353d5f7937"><enum>(c)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section or the amendments made by this section shall be construed to—</text><paragraph id="id993f09e50bd543faab67608125b948c8"><enum>(1)</enum><text>remove preventive health services, including medications, from such services and medications for which a veteran would be exempt from paying the United States a copayment; or</text></paragraph><paragraph id="id8430afaae4f24129adf263134be5bc42"><enum>(2)</enum><text>prevent coverage under the laws administered by the Secretary of Veterans Affairs of preventive health services, screenings, and contraceptive services, if such preventive health services, screenings, and contraceptive services are provided in accordance with evidence-based medical standards of care, which may include those recommendations provided for in the Preventive Services Guidelines of the Health Resources and Services Administration.</text></paragraph></subsection><subsection id="ida81c32d661f64520906f9691f634a823"><enum>(d)</enum><header>Effective date</header><text display-inline="yes-display-inline">This section and the amendments made by this section shall take effect on the date that is 180 days after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
