<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 4209</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260325">March 25, 2026</action-date><action-desc><sponsor name-id="S383">Mr. Sullivan</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Controlled Substances Act to extend the limitations period for certain offenses resulting in death or serious bodily injury.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section id="id93b7ef1b19ff4b78903a05742d1c20f6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Timely Investigation and Maximum Enforcement for Overdose Justice Act</short-title></quote> or the <quote><short-title>TIME for Overdose Justice Act</short-title></quote>.</text></section><section id="S1"><enum>2.</enum><header>Limitations</header><text display-inline="no-display-inline">Section 401(b) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/841">21 U.S.C. 841(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id03BF64A05F454F19BDC46060D1EEE7DE"><paragraph id="id10711ea7d17c4f128638406cbc511bec" indent="up1"><enum>(8)</enum><text>Notwithstanding section 3282 of title 18, United States Code, an indictment may be found or an information instituted at any time without limitation for any violation of subsection (a) described in paragraph (1) of this subsection, or conspiracy to commit a violation of such subsection (a) under section 406, if death or serious bodily injury results from the use of such substance.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
