which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Agricultural Foreign Investment Disclosure Act of 1978 to require reports to contain geospatial data, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Property Location Oversight and Transparency Act of 2026</short-title></quote> or the <quote><short-title>PLOT Act of 2026</short-title></quote>.</text></section><section id="id0ace8e5936e14ea2b5212e74ea7c956b"><enum>2.</enum><header>Geospatial data requirements</header><text display-inline="no-display-inline">Section 2 of the Agricultural Foreign Investment Disclosure Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/7/3501">7 U.S.C. 3501</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id66e0705c609745b6ab8a206b52f1cd30"><subsection id="id23e733ce5355402b8793e323c6031cd0"><enum>(g)</enum><header>Geospatial data collection</header><paragraph id="idf7ca862ddab94ba3a0b509a9368ba061"><enum>(1)</enum><header>In general</header><text>Any person that submits a report under this section shall include in the report geospatial data delineating the property boundaries of the applicable agricultural land.</text></paragraph><paragraph id="id9c1a799eb0234f8cb840375b6dcb9a52"><enum>(2)</enum><header>Format</header><text>The geospatial data required under paragraph (1) shall be submitted in an open-source format compatible with widely available geographic information system software, such as a quantum geographic information system or equivalent format, approved by the Secretary.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida43385baf32849e8b112edd19fa4260e"><enum>(3)</enum><header>Accessibility</header><subparagraph id="idc0e280d770e24d549da95c91c2648b84"><enum>(A)</enum><header>In general</header><text>The Secretary may make geospatial data submitted in reports under this section available to Federal, State, and local agencies and the public for purposes of oversight, transparency, and national security.</text></subparagraph><subparagraph id="ide3e2e83a04a64b7a9bbaa5eb670d5557" commented="no"><enum>(B)</enum><header>National security applications</header><text>The Secretary, in consultation with the Director of National Intelligence and the Secretary of Defense, shall use geospatial data submitted in reports under this section to identify potential national security concerns relating to foreign ownership of agricultural land, including proximity to military installations, critical infrastructure, and sensitive environmental areas.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id5ff419a3db974324b1439cdb67f76d61"><enum>3.</enum><header>Foreign adversaries</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary of Agriculture shall revise section 781.2 of title 7, Code of Federal Regulations, to require that—</text><paragraph commented="no" display-inline="no-display-inline" id="idee2f7a65412b47c9b71fdf5e7511a1ca"><enum>(1)</enum><text display-inline="yes-display-inline">in the case of a person that submits a report under section 2 of the Agricultural Foreign Investment Disclosure Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/7/3501">7 U.S.C. 3501</external-xref>) relating to a transaction involving a person associated with a foreign adversary (as defined in section 9 of the Agricultural Foreign Investment Disclosure Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/7/3508">7 U.S.C. 3508</external-xref>))—</text><subparagraph commented="no" display-inline="no-display-inline" id="id0379468736274d1b88718293487d5e0f"><enum>(A)</enum><text display-inline="yes-display-inline">the percentage under subsection (k)(1) shall be 5 percent;</text></subparagraph><subparagraph id="id4668615532b04c14a9f16fc5d18d4e9c"><enum>(B)</enum><text>the percentage under subsection (k)(2) shall be 10 percent; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9aaf1562dad54a14b269e980727e60c2"><enum>(C)</enum><text>the percentage under subsection (k)(3) shall be 20 percent; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6d28b1861dc9495f8a485079fffac583"><enum>(2)</enum><text>any person that submits a report under section 2 of the Agricultural Foreign Investment Disclosure Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/7/3501">7 U.S.C. 3501</external-xref>) shall disclose any foreign adversary (as so defined), or any person affiliated with a foreign adversary, that holds an interest in that person that is 5 percent or greater.</text></paragraph></section><section id="id59674bedaa3f40909f83d1c36dd9cc7f"><enum>4.</enum><header>Investigative actions</header><text display-inline="no-display-inline">Section 4 of the Agricultural Foreign Investment Disclosure Act of (<external-xref legal-doc="usc" parsable-cite="usc/7/3503">7 U.S.C. 3503</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id6960692ce0224e03ba1363410b473143"><enum>(1)</enum><text>by striking the section designation and all that follows through <quote>The Secretary</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id170616159a86430b8ef05a9f97ba100c"><section commented="no" display-inline="no-display-inline" id="id20c41d958f9243a194b177afb34fc6de"><enum>4.</enum><header>Investigative actions</header><subsection commented="no" display-inline="no-display-inline" id="id9b93d5e0ce274e5f9a8c704251c4b4dc"><enum>(a)</enum><header>In general</header><text>The Secretary</text></subsection></section><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="ide0499962087840ea8217120c1f1b7e65"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block id="ida5fdf6906d2147198199db1cf8f78968" display-inline="no-display-inline" style="OLC"><subsection id="idba78880b43a44160ac11e15f602d1b0d"><enum>(b)</enum><header>Enforcement prioritization</header><text>The Secretary shall prioritize enforcement actions, including investigations, audits, compliance reviews, and penalties, for transactions involving foreign adversaries, with priority given to persons associated with the People's Republic of China.</text></subsection><subsection id="id498d04a69558424f85d42c980b130f3e" commented="no"><enum>(c)</enum><header>Referrals to CFIUS</header><text>The Secretary shall refer to the Committee on Foreign Investment in the United States any transaction that the Secretary determines may pose a national security risk.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="idad0639e6d58341409a03603fc6756d98"><enum>5.</enum><header>Definition of foreign adversary</header><text display-inline="no-display-inline">Section 9 of the Agricultural Foreign Investment Disclosure Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/7/3508">7 U.S.C. 3508</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id7ccd33408e8d4bf7be90c1f9022849f7"><enum>(1)</enum><text>by striking the section designation and all that follows through <quote>this Act—</quote> in the matter preceding paragraph (1) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idc70f9c6c4faf4eb0b4dadd4528a96517"><section commented="no" display-inline="no-display-inline" id="id13880035f0af4b11a160d613737aa8a7"><enum>9.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text></section><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide41d9ed001fe4d2eb1c3c1c4bc21f337"><enum>(2)</enum><text>in each of paragraphs (1) through (6)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id51c702dd45784047817dc1fafe0cd919"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>the term</quote> and inserting <quote>The term</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idca0320b961f3475db88aecb2aac4e088"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting a paragraph heading, the text of which comprises the term defined in that paragraph;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2a7bc9cec1cb45629d85d5f38f0607ca"><enum>(3)</enum><text>in each of paragraphs (1) through (4), by striking the semicolon at the end of the paragraph and inserting a period;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida7b0a4da80624029ba460cd39dec42d7"><enum>(4)</enum><text>in paragraph (5), by striking <quote>; and</quote> and inserting a period;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcc51fd704f3748a4a552ecc07ca6445e"><enum>(5)</enum><text>by redesignating paragraphs (2) through (6) as paragraphs (3) through (7), respectively; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide5b9b6405ac64b68a7ddeb617778bbab"><enum>(6)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idbfb96b08c17b44498f56ddf6e8409ec1"><paragraph id="id602e714c762544a48ef1dc3dd167d13c"><enum>(2)</enum><header>Foreign adversary</header><text>The term <term>foreign adversary</term> has the meaning given the term in section 791.2 of title 15, Code of Federal Regulations (or a successor regulation), including the entities described in section 791.4 of that title (or a successor regulation).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id1c17489b77e14cb081d4c3ab8d5720b6"><enum>6.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act and the amendments made by this Act shall take effect on the date that is 180 days after the date of enactment of this Act.</text></section></legis-body></bill>
