<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 4174</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260324">March 24, 2026</action-date><action-desc><sponsor name-id="S432">Mr. Gallego</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide a premium payment to employees who worked without receiving pay during the shutdown of the Department of Homeland Security of 10 percent of the pay the employees should have received during the shutdown.</official-title></form><legis-body><section id="idb224f5f1420e4697b034d83fde1b5262" section-type="section-one"><enum>1.</enum><header>Premium payment to DHS workers required to work without pay during shutdown</header><subsection commented="no" display-inline="no-display-inline" id="id25c85d940fe44a349eb094a58b499be4"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="iddea44bad811d4d088a8a07c26f5046f1"><enum>(1)</enum><header display-inline="yes-display-inline">Covered lapse in appropriations</header><text>The term <term>covered lapse in appropriations</term> means the lapse in appropriations that began on February 14, 2026.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb412a8cbe4d1493ea737a449a804a3d5"><enum>(2)</enum><header>Hours worked without pay</header><text>The term <term>hours worked without pay</term>, with respect to an unpaid employee, means any hours worked by the unpaid employee during the covered lapse in appropriations for which the unpaid employee did not receive pay during the period of the covered lapse in appropriations.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id856f8f5a76074e8db8893cb227ff7128"><enum>(3)</enum><header>Unpaid employee</header><text>The term <term>unpaid employee</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="id646ce5689114481a985cfc4260bcd613"><enum>(A)</enum><text display-inline="yes-display-inline">means an employee—</text><clause commented="no" display-inline="no-display-inline" id="idbade7d17c2fb4ff6897ca707fdd6ac14"><enum>(i)</enum><text display-inline="yes-display-inline">employed by an agency affected by the covered lapse in appropriations;</text></clause><clause commented="no" display-inline="no-display-inline" id="id0c896fe8ed3943ad979c79b83504ed66"><enum>(ii)</enum><text>who performed work for the agency described in clause (i) during the covered lapse in appropriations; and</text></clause><clause id="id85cd8de2f7384d6ab41684818a75ecd3" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text>who did not receive pay for any of the work described in clause (ii) during the period of the covered lapse in appropriations; and</text></clause></subparagraph><subparagraph id="ida29638e892714d488f9a286a48421ffe"><enum>(B)</enum><text>does not include an employee of an agency affected by the covered lapse in appropriations who received pay during the period of the covered lapse in appropriations for any of the work performed by the employee during the covered lapse in appropriations.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idadf680a88ae94f179b5e6903c7a9ac15"><enum>(b)</enum><header>Premium payment</header><text>Not later than 1 day after the end of the covered lapse in appropriations, the head of each agency employing unpaid employees shall make a 1-time payment to each unpaid employee of the agency in the amount equal to 10 percent of the product obtained by multiplying—</text> <paragraph commented="no" display-inline="no-display-inline" id="id04ff0f75ad4b4a2c8938d6bf49d6c382"> <enum>(1)</enum> <text>the number of hours worked without pay by the unpaid employee; by</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4315f39abb8e462f9990817bb02050d9"><enum>(2)</enum><text>the hourly rate of basic pay of the unpaid employee.</text></paragraph></subsection></section></legis-body></bill>
