which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Energy Policy and Conservation Act to require States to include supporting the physical security, cybersecurity, and resilience of local distribution systems in State energy security plans, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H5F2FEC32D1134888A839A03080C31EF1"><section section-type="section-one" id="H9CD2E2EFD3C148B8B982DEF472544AE0"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Securing Community Upgrades for a Resilient Grid Act</short-title></quote> or the <quote><short-title>SECURE Grid Act</short-title></quote>.</text></section><section id="H2814A7FF236343318FBDC90EF6400CDD"><enum>2.</enum><header>Consideration of the security of local distribution systems in State energy security plans</header><text display-inline="no-display-inline">Section 366 of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6326">42 U.S.C. 6326</external-xref>) is amended—</text><paragraph id="HF0A0714FABBE4E5AB9FDFEDB63F8455D"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id83bca5cd43e447aebb050dd61a1b6d23"><enum>(A)</enum><text>by redesignating paragraph (2) as paragraph (3); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id03ecab567fc245e5b3719cebd1493701"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting after paragraph (1) the following:</text><quoted-block style="OLC" id="H6150EC0DEAAD41DFBD590D85492FEE61"><paragraph id="H51D78E93C210459FB49544D7A73C1223"><enum>(2)</enum><header>Local distribution system</header><text display-inline="yes-display-inline">The term <term>local distribution system</term> means any energy infrastructure owned and operated by an electric utility at a voltage of 100 kilovolts or less.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HBF6027E34CCF4C20B0F58266B3A761B3"><enum>(2)</enum><text>in subsection (b)(2), in the matter preceding subparagraph (A), by inserting <quote>, and suppliers of equipment for the generation, transmission, and distribution of electricity to,</quote> after <quote>owners and operators of</quote>;</text></paragraph><paragraph id="H229D3970DB224F5ABD7151CBFC26F84E"><enum>(3)</enum><text>in subsection (c)—</text><subparagraph id="H0A529CB0710347DB9AC422057608F9FC"><enum>(A)</enum><text>by striking paragraph (3) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H8B015912C0A74E058C8C36EB9FB4E4C5"><paragraph id="H1B9110C497F04ABBA6D80CEEC15BA8BC"><enum>(3)</enum><text display-inline="yes-display-inline">address potential hazards to each energy sector or system, including—</text><subparagraph id="H1773F3EBD7244719A7F2454CDAC3F0FD"><enum>(A)</enum><text>physical threats and vulnerabilities, including—</text><clause id="HBE947818BA3A4B3AA3A262348EEBD249"><enum>(i)</enum><text>weather-related threats and vulnerabilities;</text></clause><clause id="H7CB9684C44F74B538C5BA3732B5F08F0"><enum>(ii)</enum><text>physical attacks on local distribution systems and the bulk-power system; and</text></clause><clause id="H0AEF451A64BC448395A9BE69C0581BED"><enum>(iii)</enum><text display-inline="yes-display-inline">supply chain risks for equipment for the generation, transmission, and distribution of electricity; and</text></clause></subparagraph><subparagraph id="H1536BBC550FF47FD84BC4180092F5E9C"><enum>(B)</enum><text>cybersecurity threats and vulnerabilities, including threats to, and vulnerabilities of, local distribution systems that may impact the bulk-power system;</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="HECB80C9750B6423DB0C9EAE7652310C1"><enum>(B)</enum><text display-inline="yes-display-inline">by striking paragraph (5) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H0277871AC54F4F55AA83A32FF4F2C564"><paragraph id="H813939A8DFE94D37AE874046CACCF9A1"><enum>(5)</enum><text display-inline="yes-display-inline">provide a risk mitigation approach to enhance reliability and end-use resilience, including methods of responding to, mitigating, and recovering from potential hazards described in paragraph (3); and</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HDF206FEDC6354B0584589A74A3394F2B"><enum>(4)</enum><text>in subsection (d)(3)—</text><subparagraph id="HE509AA7412554F81BA364D10BA6E0494"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="H88198DB3081C4C258078C26863FF470F"><enum>(B)</enum><text display-inline="yes-display-inline">by redesignating subparagraph (B) as subparagraph (C); and</text></subparagraph><subparagraph id="H82AFB10F7AA94359B2795909E8882A76"><enum>(C)</enum><text>by inserting after subparagraph (A) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H6D84DEE090AF4DE8AF601E1F15E58805"><subparagraph id="H178090C122644C108B4023154BB44C7E"><enum>(B)</enum><text display-inline="yes-display-inline">supplying equipment for the generation, transmission, and distribution of electricity; and</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H7D5AAB0438A042D29B5C7E96E5DDE879"><enum>(5)</enum><text>in subsection (e)—</text><subparagraph id="H0D299FDEC8E74E87B153E8E9F8A0207C"><enum>(A)</enum><text>in paragraph (2), by redesignating subparagraphs (A) and (B) as clauses (i) and (ii), respectively, and indenting appropriately;</text></subparagraph><subparagraph id="HB6F336E06FBB420C93A93EBD000BD1F3"><enum>(B)</enum><text>by redesignating paragraphs (1) and (2) as subparagraphs (A) and (B), respectively, and indenting appropriately;</text></subparagraph><subparagraph id="H484B2E2065A543E0B86215D7347896ED"><enum>(C)</enum><text>in the matter preceding subparagraph (A) (as so designated), by striking <quote>A State is not eligible</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HE8786C31CC154CCC826230E1D504C310"><paragraph id="H50FF6A8C1F2C4A31925E13EAB8F55BDA"><enum>(1)</enum><header>Submission required</header><text display-inline="yes-display-inline">A State is not eligible</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H3B7E0ADB7C244C8FA4CB2725AFC87E67"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H17868BC2ECAF43DCBB1A6652D6BFCAE3"><paragraph id="H8DBAB4C5218A412BB3A1DF7F2EEFDE71"><enum>(2)</enum><header>State determination</header><text display-inline="yes-display-inline">A submission under paragraph (1) is not required to be approved by the Secretary.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc3146ef3512f4b6d975ad54b6cd732d9"><enum>(6)</enum><text>in subsection (f), by striking <quote>may</quote> and inserting <quote>shall</quote>;</text></paragraph><paragraph id="H38B4410BAEF8405D921BE55363D381E8"><enum>(7)</enum><text display-inline="yes-display-inline">in subsection (h), in the matter preceding paragraph (1), by inserting <quote>, local distribution system,</quote> after <quote>electric utility</quote>; and</text></paragraph><paragraph id="HFA355253AE194C28B3FCCF8207E05CD0"><enum>(8)</enum><text>by striking subsection (i) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id25ea0bd1ad1d47b792c47bb92e319a9e"><subsection commented="no" display-inline="no-display-inline" id="ida3ee2df96bef4c92a1a17988771ddff8"><enum>(i)</enum><header>Sunset</header><text>This section shall expire on September 30, 2031.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="idb86f1867fe874ad4a4c82fea58ffabcb"><enum>3.</enum><header>GAO report</header><subsection id="id599e118d00b641bca5dc9d469b8aeee5"><enum>(a)</enum><header>Definition of State energy security plan</header><text>In this section, the term <term>State energy security plan</term> has the meaning given the term in section 366(a) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6326">42 U.S.C. 6326(a)</external-xref>).</text></subsection><subsection id="id3790353ba3864c4f81c5bfa611f9d406"><enum>(b)</enum><header>Report</header><text>Not later than September 30, 2030, the Comptroller General of the United States shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Energy and Natural Resources of the Senate a report on the efficacy of State energy security plans that includes—</text><paragraph id="id04c959ebb75f407b8c22cd852046ca2b"><enum>(1)</enum><text>an evaluation of whether and how State energy security plans have improved the ability of States—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6380b46501f7465e8db6f5220195bf3b"><enum>(A)</enum><text display-inline="yes-display-inline">to identify, assess, and mitigate risks to energy infrastructure and supply chains; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8fb8b66836494eebb8fe6a32a2b71d20"><enum>(B)</enum><text display-inline="yes-display-inline">to plan for, respond to, and recover from events that disrupt energy supply;</text></subparagraph></paragraph><paragraph id="id2de80496bdb749a69eea773a0b986f5b"><enum>(2)</enum><text>recommendations for—</text><subparagraph id="id88f5d9057f2a4d4fb4453c4145962184"><enum>(A)</enum><text>improving the ability of States described in paragraph (1); and</text></subparagraph><subparagraph id="idd06c1cdb398646b399f9c6009847be60"><enum>(B)</enum><text>actions the Secretary of Energy may take to improve coordination with States with respect to identifying, assessing, and mitigating risks to energy infrastructure and supply chains and planning for, responding to, and recovering from events that disrupt energy supply;</text></subparagraph></paragraph><paragraph id="id7add1bb5a1bc4b498f14c3fb686b1f13"><enum>(3)</enum><text>information on Federal financial assistance made available to States under part D of title III of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6321">42 U.S.C. 6321 et seq.</external-xref>) that was used to implement State energy security plans;</text></paragraph><paragraph id="id0ea3889092c6469ca97665018a51ca61"><enum>(4)</enum><text>information on activities carried out by States using that financial assistance;</text></paragraph><paragraph id="ided759cbefdc84022849837c08d863d2d"><enum>(5)</enum><text>an analysis of the efficacy of the implementation of section 366 of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6326">42 U.S.C. 6326</external-xref>) (as amended by this Act); and</text></paragraph><paragraph id="id429c77dc6f484ffaaff838ab74b9ce8a"><enum>(6)</enum><text>information on State use of assistance provided under section 366(f) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6326">42 U.S.C. 6326(f)</external-xref>) (as amended by this Act), including any revisions of State energy security plans made by States resulting from assistance provided under that section.</text></paragraph></subsection><subsection id="ide7dbd89c876543edbb242ae45e778e58"><enum>(c)</enum><header>Protected information</header><text>The report required under subsection (b) shall be submitted in a form that may be made available to the public, except that any information protected from disclosure under section 366(h) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6326">42 U.S.C. 6326(h)</external-xref>) shall be included in the report in an annex that shall not be publicly disclosed, consistent with that section.</text></subsection></section></legis-body></bill>
