 involving sports and casino-style games.</official-title></form><legis-body><section id="id50cf7b521c4b4006be9b9b6cce72fd64" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prediction Markets Are Gambling Act</short-title></quote>.</text></section><section section-type="subsequent-section" commented="no" display-inline="no-display-inline" id="idea5d380d16344b32805d387750250c6b"><enum>2.</enum><header display-inline="yes-display-inline">Prohibition on certain event contracts
 involving sports and casino-style games</header><subsection commented="no" display-inline="no-display-inline" id="idb1222026931c4c4aae7a6dd63b0dd625"><enum>(a)</enum><header>Amendment to the Commodity Exchange Act</header><text display-inline="yes-display-inline">Section 5c(c) of the Commodity Exchange Act (<external-xref legal-doc="usc" parsable-cite="usc/7/7a-2">7 U.S.C. 7a–2(c)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5b206573df534338a4d728c1e75a4a2f"><paragraph commented="no" display-inline="no-display-inline" id="idaa078df7a7ab4d599b761db854cfe85c"><enum>(6)</enum><header>Prohibition on sporting and casino-style event contracts</header><subparagraph commented="no" display-inline="no-display-inline" id="id4e04e9e66a6e42d99108db62f71152d5"><enum>(A)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this paragraph:</text><clause commented="no" display-inline="no-display-inline" id="idb6adaa39f61648a2a1d2dfa0306893e0"><enum>(i)</enum><header>Casino-style game</header><text display-inline="yes-display-inline">The term <term>casino-style game</term> means any game traditionally found in a casino, including slot machine games, video poker, blackjack, roulette, craps, any other casino-style table game, bingo, lottery, and any simulation of any of those games.</text></clause><clause commented="no" display-inline="no-display-inline" id="id0a60d17448eb4a909e65513d79e54782"><enum>(ii)</enum><header>Sporting event or athletic competition</header><text display-inline="yes-display-inline">The term <term>sporting event or athletic competition</term> means any live or virtual contest involving physical activity or skill in which individuals or teams compete and performance determines an outcome or statistical result, including amateur, collegiate, and professional sports.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1f18b6686e0d46c5b27bf8c744fac389"><enum>(B)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this section, no agreement, contract, or transaction relating to any sporting event or athletic competition or any casino-style game may be listed or made available for clearing or trading on or through a registered entity.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id609e7159322e4d929335465bc177c761"><enum>(C)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this Act shall be construed to preempt any State law or rule that regulates or prohibits any agreement, contract, or transaction relating to any sporting event or athletic competition or any casino-style game.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id74fd1f8ce15b4b958d088509bbced235"><enum>(b)</enum><header>Applicability of prohibition</header><text display-inline="yes-display-inline">Paragraph (6)(B) of section 5c(c) of the Commodity Exchange Act (<external-xref legal-doc="usc" parsable-cite="usc/7/7a-2">7 U.S.C. 7a–2(c)</external-xref>) (as added by subsection (a)) shall apply to any agreement, contract, or transaction entered into on or after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
