which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Agricultural Marketing Act of 1946 to establish a mandatory price reporting program for fertilizer, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fertilizer Transparency Act of 2026</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id952f0bcb11bf41f085a76e22fac67034"><enum>2.</enum><header>Fertilizer mandatory reporting</header><text display-inline="no-display-inline">Subtitle A of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1621">7 U.S.C. 1621 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idAFF71B97935A460D800D4637D237A46B"><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idfec30b573e7d4d97bb0f23cee6aa7f39"><enum>210B.</enum><header>Fertilizer mandatory reporting</header><subsection commented="no" display-inline="no-display-inline" id="idc3bcc0f6408f49c59105c2847b7842f5"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="idcdf716ffbe7d4c429d2eb5b79eff1cc9"><enum>(1)</enum><header>Affiliate</header><text display-inline="yes-display-inline">The term <term>affiliate</term> means, with respect to a manufacturer or wholesaler (excluding a cooperative), a person that directly or indirectly owns, controls, or holds, with voting power, not less than 5 percent of the outstanding voting securities of the manufacturer or wholesaler (excluding a cooperative).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id42107943993a40ffab02724bc965080e"><enum>(2)</enum><header>Cooperative</header><subparagraph commented="no" display-inline="no-display-inline" id="id4b1a3d443f994e90b5b42c3c983db056"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>The term <term>cooperative</term> means—</text><clause commented="no" display-inline="no-display-inline" id="id147bad5980f740b7adabc6f396868f19"><enum>(i)</enum><text display-inline="yes-display-inline">an association of agricultural producers acting pursuant to—</text><subclause commented="no" display-inline="no-display-inline" id="idee72965911594bae9f2075e66979a4fd"><enum>(I)</enum><text display-inline="yes-display-inline">the Act entitled <quote>An Act to authorize association of producers of agricultural products</quote> (commonly known as the <quote>Capper-Volstead Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/7/291">7 U.S.C. 291 et seq.</external-xref>);</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id06f5be173a6c4e179674c747ae9d0c41"><enum>(II)</enum><text display-inline="yes-display-inline">the Agricultural Adjustment Act (<external-xref legal-doc="usc" parsable-cite="usc/7/601">7 U.S.C. 601 et seq.</external-xref>), reenacted with amendments by the Agricultural Marketing Agreement Act of 1937; or </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id810ee0927e524cfa9d0dde320fbac854"><enum>(III)</enum><text display-inline="yes-display-inline">the Act of July 2, 1926 (commonly known as the <quote>Cooperative Marketing Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/7/451">7 U.S.C. 451 et seq.</external-xref>);</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idc1026cc53afa4387884f88df22280345"><enum>(ii)</enum><text display-inline="yes-display-inline">a farmers' cooperative organization described in subsection (b)(1) of <external-xref legal-doc="usc" parsable-cite="usc/26/521">section 521</external-xref> of the Internal Revenue Code of 1986 and exempt from taxation under subsection (a) of that section; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id26414087476f431492943c3f89b60206"><enum>(iii)</enum><text>an association of agricultural producers otherwise operating on a cooperative basis for the benefit of its members.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1052bff90e85464d957afed61c5511c3"><enum>(B)</enum><header>Inclusions</header><text>The term <term>cooperative</term> includes any entity not less than 25 percent of which is owned by a cooperative, as defined in subparagraph (A).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3ff64f7101b24e49864ef75765520867"><enum>(3)</enum><header>Marketed</header><text display-inline="yes-display-inline">The term <term>marketed</term> means the sale or other disposition in commerce of—</text><subparagraph commented="no" display-inline="no-display-inline" id="id37cfcf87f4554770abcc989219e8e9c7"><enum>(A)</enum><text display-inline="yes-display-inline">nitrogen, phosphorous, or potassium for use as fertilizer; or </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idac43b255a0d8449e8398a4d8d06f890c"><enum>(B)</enum><text display-inline="yes-display-inline">a fertilizer product.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id990f049e6fe04ce4a78819a54e660e50"><enum>(4)</enum><header>Retailer</header><text>The term <term>retailer</term> means a person or entity that primarily sells fertilizer products at retail.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb7c257b33b994cb09b43a56378c59f4b"><enum>(5)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph><paragraph id="ideb8ce0c5cb084ad2b7f3de263c3064d5"><enum>(6)</enum><header>Wholesaler</header><text>The term <term>wholesaler</term> means any person or entity, not including a cooperative, engaged in the business of buying and selling fertilizer or fertilizer products for resale or distribution.</text></paragraph></subsection><subsection id="id6a0eff858e7043508895da4cf19275c4"><enum>(b)</enum><header>Establishment</header><text>The Secretary shall establish a program of fertilizer and fertilizer product price information reporting that will—</text><paragraph id="id38f9a6f5f4dd46c39e321981086f6ca6"><enum>(1)</enum><text>provide timely, accurate, and reliable market information that can be readily understood by farmers and market participants;</text></paragraph><paragraph id="id98477e4a3dd64863a9ba85b1d69f232b"><enum>(2)</enum><text>facilitate more informed marketing decisions; and</text></paragraph><paragraph id="id33ff9baae82c41a0bd72a1c38673d86a"><enum>(3)</enum><text>promote competition in the fertilizer and fertilizer products industry. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id420fff4eff1246e8ac3680fd3910f346"><enum>(c)</enum><header>General reporting provisions applicable to manufacturers, wholesalers, and the Secretary</header><text>Whenever the prices or quantities of fertilizer or fertilizer products are required to be reported or published under this section, the prices or quantities shall be categorized so as to clearly delineate—</text><paragraph id="id378d23b5317145909cc6bc8dab2e8142"><enum>(1)</enum><text>the prices or quantities, as applicable, of the fertilizer or fertilizer product marketed in the United States by a domestic manufacturer or wholesaler or an affiliate of a domestic manufacturer or wholesaler; and</text></paragraph><paragraph id="id53b303b4987b4f849f848e348f20d1e2"><enum>(2)</enum><text>the prices or quantities, as applicable, of the fertilizer or fertilizer product marketed in the United States by a foreign manufacturer or wholesaler or an affiliate of a foreign manufacturer or wholesaler.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idb021f787923d456a8a39ffa5e9f4d56e"><enum>(d)</enum><header>Weekly reporting</header><paragraph commented="no" display-inline="no-display-inline" id="id929c39298f6c41d3bd41e077b492ea65"><enum>(1)</enum><header display-inline="yes-display-inline">Nitrogen, phosphorous, and potassium</header><text display-inline="yes-display-inline">The corporate officers or officially designated representatives of each manufacturer or wholesaler of nitrogen, phosphorous, or potassium for use as fertilizer shall report to the Secretary at least weekly—</text><subparagraph commented="no" display-inline="no-display-inline" id="id91835b2df4ba44af8607d3de8bc21c62"><enum>(A)</enum><text display-inline="yes-display-inline">the prices, as marketed, for nitrogen, phosphorous, or potassium, as applicable; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id90c83c96d32d425391a4076490c24be5"><enum>(B)</enum><text>the quantities of nitrogen, phosphorous, or potassium, as applicable, manufactured and marketed, as applicable.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id253157f5aa614d08b9344100c7600bc5"><enum>(2)</enum><header>Fertilizer products</header><text display-inline="yes-display-inline">The corporate officers or officially designated representatives of each manufacturer or wholesaler of a fertilizer product shall report to the Secretary at least weekly—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6423192879714ae8807a989c46649a8b"><enum>(A)</enum><text display-inline="yes-display-inline">the prices for the fertilizer product; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5afc9935c9684d9b97ab170613120fda"><enum>(B)</enum><text display-inline="yes-display-inline">the quantity of the fertilizer product manufactured or marketed, as applicable.</text></subparagraph></paragraph><paragraph id="idaf0a76502b534e5dbfe8ace5c087275f"><enum>(3)</enum><header>Mandatory reporting exemption for cooperatives and non-manufacturer retailers; voluntary reporting</header><text>The Secretary shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id8b4d6d3cb6894c42b4b5b12f333b50ab"><enum>(A)</enum><text display-inline="yes-display-inline">exempt all cooperatives and retailers (except for retailers that are also manufacturers) from any mandatory price reporting under this section; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2667f22fd5ba461b94dc21c9f0a1b3cb"><enum>(B)</enum><text display-inline="yes-display-inline">provide a mechanism for cooperatives and retailers to voluntarily and confidentially report the prices and quantities described in subparagraphs (A) and (B) of paragraphs (1) and (2)—</text><clause commented="no" display-inline="no-display-inline" id="id39f50cdca36949a6bd0d247388dd90b5"><enum>(i)</enum><text display-inline="yes-display-inline">directly to the Secretary; or </text></clause><clause commented="no" display-inline="no-display-inline" id="ida5b74818253c449fbf359983e89fddd0"><enum>(ii)</enum><text display-inline="yes-display-inline">through the program established under subsection (e).</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7e7f7ba872cf42588fc0f9b645ef1873"><enum>(4)</enum><header>Publication</header><text display-inline="yes-display-inline">The Secretary shall make the information reported to the Secretary under this subsection available to the public—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida37fdead19004e3db3f465fb712fcbec"><enum>(A)</enum><text display-inline="yes-display-inline">not less frequently than weekly; and</text></subparagraph><subparagraph id="id479c051afdbd4d0387976c46a4343cd4"><enum>(B)</enum><text>in a manner that ensures the information is published—</text><clause commented="no" display-inline="no-display-inline" id="idd25b7dfd95904757887857fd07b098b6"><enum>(i)</enum><text display-inline="yes-display-inline">on a national basis; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id19b7bf943ba341c6900b57305380b59f"><enum>(ii)</enum><text display-inline="yes-display-inline">on a regional or statewide basis, as the Secretary determines to be appropriate.</text></clause></subparagraph></paragraph><paragraph id="id4e0655a420e64c4cb2bdb513ca1a9dcb"><enum>(5)</enum><header>Competitive effects analysis</header><text>The Secretary may conduct a competitive effects analysis of the information reported to the Secretary under this subsection. </text></paragraph></subsection><subsection id="id0ec4c0c2cd8c4bc780c209be91dd98cd"><enum>(e)</enum><header>Fertilizer retail survey</header><paragraph commented="no" display-inline="no-display-inline" id="ide6dd8636cac743c489d44e5750cb479b"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish a program within Market News of the Agricultural Marketing Service—</text><subparagraph commented="no" display-inline="no-display-inline" id="idbacf8d4628f045fab486ee695d2918e8"><enum>(A)</enum><text display-inline="yes-display-inline">to conduct not less frequently than weekly surveys of retail fertilizer prices;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0d1c32f7ddee49019164167766305536"><enum>(B)</enum><text display-inline="yes-display-inline">to obtain commercially available estimates of the retail prices described in subparagraph (A); and</text></subparagraph><subparagraph id="idcbfe9018ce714b4d808787d36185b24d"><enum>(C)</enum><text>to provide State or regional estimates or benchmarks and formulas to allow estimation of local prices.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9110184fcdc54bf9813f4ebd34bc26fe"><enum>(2)</enum><header>Maintenance of existing activities</header><text>The program established under paragraph (1) shall supplement, and not supplant, existing input price collection activities of the Secretary.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ida70e7ef4feb944dba52c326d69782970"><enum>(f)</enum><header>Summary of data</header><paragraph id="iddfa77f4b9c484f6faefc812ece6f417a"><enum>(1)</enum><header>In general</header><text>The Secretary shall, directly or through 1 or more cooperative agreements with 1 or more affiliated agricultural research programs, not less frequently than weekly summarize and make available on a dashboard or other resource easily accessible to farmers and market participants—</text><subparagraph commented="no" display-inline="no-display-inline" id="iddff1557bd42d4a70a834e8a914a84bcc"><enum>(A)</enum><text display-inline="yes-display-inline">the information reported to the Secretary under subsection (d); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf92a32c28f2c487da4642adc4cbc81d4"><enum>(B)</enum><text display-inline="yes-display-inline">the retail survey prices and commercially available estimates obtained under subsection (e).</text></subparagraph></paragraph><paragraph id="id8a4e80da119c4022871828984a4ccc5f"><enum>(2)</enum><header>Protection of confidentiality</header><text>In carrying out paragraph (1), the Secretary shall aggregate the information and data in a manner that prevents confidential business information and the identity of persons, including parties to a contract, from being disclosed publicly.</text></paragraph><paragraph id="idfb1611aa1d80478fb8c9ac70dc37fce1"><enum>(3)</enum><header>Disclosure by Federal Government employees</header><subparagraph id="id36c77358021248ad945937937020e75e"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), no officer, employee, or agent of the United States shall, without the consent of the manufacturer, wholesaler, or other person concerned, divulge or make known in any manner any facts or information regarding the business of the manufacturer, wholesaler, or other person that was acquired through reporting required under subsection (d).</text></subparagraph><subparagraph id="id23658d3483694386aa20b41c985cbb0d"><enum>(B)</enum><header>Exception</header><text>Information obtained by the Secretary under subsection (d) may be disclosed—</text><clause id="idaec3beb23f8549d99f7f385f6b607347"><enum>(i)</enum><text>to agents or employees of the Department of Agriculture in the course of their official duties under this subtitle;</text></clause><clause id="idd56578fd0ff149d2b2b0aacd1c89eadc"><enum>(ii)</enum><text>as directed by the Secretary or the Attorney General, for enforcement purposes; or</text></clause><clause id="id9604693a57284964b38a972e7428d354"><enum>(iii)</enum><text>by a court of competent jurisdiction.</text></clause></subparagraph><subparagraph id="id6d8f068e2c644931a30773acf956cf63"><enum>(C)</enum><header>Disclosure under freedom of information act</header><text>Notwithstanding any other provision of law, no facts or information obtained under this subtitle shall be disclosed in accordance with section 552 of title 5, United States Code.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id25f1ec98ae1045e3873290abc2b2a669"><enum>(g)</enum><header>Review</header><text display-inline="yes-display-inline">Not less frequently than once every 2 years, the Secretary shall review the information required to be reported to the Secretary by manufacturers and wholesalers under this section.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idbe0b80982fb94ce88ff42d242003cbaf"><enum>(h)</enum><header>Outdated information</header><text display-inline="yes-display-inline">If the Secretary determines under a review under subsection (g) that information required to be reported under this section no longer accurately reflects the methods by which nitrogen, phosphorous, and potassium for use as fertilizer or fertilizer products are valued and priced by manufacturers and wholesalers, the Secretary shall, after public notice and an opportunity for comment, promulgate regulations to specify additional information that shall be reported under this section.</text></subsection><subsection id="id80376604eda24184a96740de63c82e31"><enum>(i)</enum><header>Application of antitrust laws</header><paragraph commented="no" display-inline="no-display-inline" id="id3e63bd6217444861bc07b45dde68ab1d"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Nothing in this section modifies, impairs, or supersedes the operation of any of the antitrust laws. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0b1266cf646049bfabe661024e1dc8ce"><enum>(2)</enum><header>Definition of antitrust laws</header><text display-inline="yes-display-inline">In this subsection, the term <quote>antitrust laws</quote>—</text><subparagraph commented="no" display-inline="no-display-inline" id="id92ea0bd65ab04ed0824decac3333cb1b"><enum>(A)</enum><text display-inline="yes-display-inline">has the meaning given the term in subsection (a) of the first section of the Clayton Act (<external-xref legal-doc="usc" parsable-cite="usc/15/12">15 U.S.C. 12</external-xref>); and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8ec30b37ce01407aa947977a647b4c91"><enum>(B)</enum><text display-inline="yes-display-inline">includes section 5 of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/45">15 U.S.C. 45</external-xref>) to the extent that such section applies to unfair methods of competition.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
