which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To direct the Secretary of Agriculture to provide grants and direct or guaranteed loans to increase domestic fertilizer production for United States farmers.</official-title></form><legis-body><section commented="no" display-inline="no-display-inline" section-type="section-one" id="idcaf65a5ce0f843aaba45d0a4364205ef"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Homegrown Fertilizer Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id034185ed8a164c25806d9ab421aa135c"><enum>2.</enum><header>Fertilizer for American farmers</header><subsection commented="no" display-inline="no-display-inline" id="ida3f7a8ffa13a403c8885c41dc5e2dd2a"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="ida092411f162d42bfa14bb6ab71b9528f"><enum>(1)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means an entity eligible for a grant or loan under this section in accordance with subsection (c).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb8f5b32740b748d1a414e30030ef93e2"><enum>(2)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of Agriculture, acting through the Under Secretary for Rural Development.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id648efb3e82644eebb76765c0e5b8e2d5"><enum>(3)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id4066bd9ddfdf4a618bf3835e689ba0c3"><enum>(A)</enum><text display-inline="yes-display-inline">the 50 States; and</text></subparagraph><subparagraph id="id76c8e0f425c44ea4971bdd11da93ea04" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>the District of Columbia.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2f35b06b78324c888272d4fb5605ae07"><enum>(4)</enum><header>United States</header><text>The term <term>United States</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id16c05a1709e34df681530d3421f5eac1"><enum>(A)</enum><text display-inline="yes-display-inline">the States;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idafef493222364dc8b0f2a2bbe168d79c"><enum>(B)</enum><text>the territories of the United States; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc9d522890cbe4d949be6f64280107c2a"><enum>(C)</enum><text>the territory of Indian Tribes.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ide24f29699ab244db9624bb55f147c62d"><enum>(b)</enum><header>Grants and loans</header><text>The Secretary shall provide grants and direct or guaranteed loans to assist eligible entities in increasing or expanding the manufacturing, processing, and storage of fertilizer and nutrient alternatives in the United States.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id3ef09bfefa8f47e9a9423afaa680e617"><enum>(c)</enum><header>Eligible entities</header><paragraph commented="no" display-inline="no-display-inline" id="idead8e7d3852c41d1ac033b4f89e5bbac"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>To be eligible for a grant or loan under this section, an entity shall be—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9e14ddad70ef41279fd4cb2bcf7a58bd"><enum>(A)</enum><text display-inline="yes-display-inline">an independently owned and operated—</text><clause commented="no" display-inline="no-display-inline" id="id03d4919af3684959bc1727c6e526d8f5"><enum>(i)</enum><text display-inline="yes-display-inline">for-profit business or corporation;</text></clause><clause commented="no" display-inline="no-display-inline" id="id428fb1bae21b436cbe7b03198df0bf36"><enum>(ii)</enum><text display-inline="yes-display-inline">nonprofit organization;</text></clause><clause commented="no" display-inline="no-display-inline" id="id5754e340fd0f47dc94ba7afead39eae4"><enum>(iii)</enum><text display-inline="yes-display-inline">producer-owned cooperative or corporation; or </text></clause><clause commented="no" display-inline="no-display-inline" id="id6ca7e2f3b7a2415185daae9a4c26f773"><enum>(iv)</enum><text display-inline="yes-display-inline">certified benefit corporation;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd4b715204eea4158a9da6b437e3fc3c2"><enum>(B)</enum><text display-inline="yes-display-inline">an Indian Tribe or Tribal organization; or</text></subparagraph><subparagraph id="id1ef2fe9a738742088e5bd2a58d2df7ab" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>a State or local government.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9fa067bcd4254947a8c93d81e56dbf22"><enum>(2)</enum><header>Requirements</header><text>To be eligible for a grant or loan under this section, an entity described in paragraph (1) shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="idbb71bdc949e44be9b75c6d4495688b89"><enum>(A)</enum><text display-inline="yes-display-inline">be physically located within the United States;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id547a7ceec2a5446da12d5c5cd26ee4e8"><enum>(B)</enum><text>comply with all Federal, State, Tribal, and local regulations governing fertilizer and nutrient manufacturing, processing, storage, distribution, and waste management; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc1e2e9c9d0364a778d1cfb8fc8c985a7"><enum>(C)</enum><text>certify to the Secretary that the entity does not hold a market share (in manufacturing, processing, or distribution) greater than or equal to the entity that holds the fourth-largest share of that market for nitrogen, phosphate, potash, or any combination of thereof.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idc822d6ca7ff046eb9e43d9774c38a1ad"><enum>(d)</enum><header>Priorities</header><text>In awarding grants and loans under this section, the Secretary shall give priority to eligible entities that will use the grant or loan for a proposal for a project—</text><paragraph commented="no" display-inline="no-display-inline" id="id6684149ccc974d64a2723230d5e9f5fb"><enum>(1)</enum><text display-inline="yes-display-inline">that will improve on fertilizer production methods and efficient use technologies to promote innovation in fertilizers, nutrient alternatives, and biostimulants; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1c88bdc3e0364e37b09b6f0c291475d4"><enum>(2)</enum><text>the additional fertilizer or nutrient alternative manufacturing, processing, or storage capacity created by which will be dedicated to United States agricultural commodity production; or</text></paragraph><paragraph id="id2c83c5ec4c304b84b30d8609f6f12d67"><enum>(3)</enum><text>that demonstrates the project will improve competition, increase options, and reduce prices or volatility of fertilizer products or nutrient alternatives important for farmers.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id72fd39348b92429d8c493e8d65d62eb2"><enum>(e)</enum><header>Eligible activities</header><text>An eligible entity that receives a grant or loan under this section may use the grant or loan for—</text><paragraph id="id36d82ee373064e9688f9c110ad84b617"><enum>(1)</enum><text>building a new facility, buying an existing facility, or purchasing land for a facility;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0c559f980c244aeda1b49cf29337e3a2"><enum>(2)</enum><text display-inline="yes-display-inline">covering predevelopment costs, such as engineering and other professional fees;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3f417dcd62dc49ffba184dedba0b20ba"><enum>(3)</enum><text display-inline="yes-display-inline">providing working capital to expand capacity or increase outputs;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5999ff4780594c1d8d94d859eaf9dfb6"><enum>(4)</enum><text display-inline="yes-display-inline">modernizing or expanding an existing facility, including making updates to existing buildings or constructing new buildings on site;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb14e754a53d94c46ab343f1501f3e65d"><enum>(5)</enum><text display-inline="yes-display-inline">purchasing or modernizing processing and manufacturing equipment;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id120a217563fa491780acd48f927785f4"><enum>(6)</enum><text display-inline="yes-display-inline">developing, customizing, and installing equipment, devices, and technology to improve processing functions, worker conditions, or safety;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id347c45f18c814a7d912bbcae00de745c"><enum>(7)</enum><text display-inline="yes-display-inline">installing or updating equipment that reduces emissions, increases fertilizer use efficiency, or improves air and water quality;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9bf95e31488448c4be60adb4e6343eb8"><enum>(8)</enum><text display-inline="yes-display-inline">ensuring legal compliance with packaging and labeling requirements, such as sealing, boxing, labeling, and conveying;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id80d26d407d944e1ba7ae0ac2e689a28c"><enum>(9)</enum><text display-inline="yes-display-inline">confirming legal compliance with occupational and safety regulations;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcbeb05bc19a64852b6b204d02f0c9c20"><enum>(10)</enum><text display-inline="yes-display-inline">engaging in workforce recruitment, training, apprenticeships, and retention to ensure expansion projects are adequately staffed; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id56102eb5ea4e42d7ab79c3215736c0c9"><enum>(11)</enum><text>increasing domestic storage of fertilizer or nutrient alternatives; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd0535a5118d244f9a4cb3f4c7f2a94c1"><enum>(12)</enum><text>such other activities as the Secretary determines to be appropriate.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7f6b3abe9747487ca1ed3944f23bef92"><enum>(f)</enum><header>Grant amount</header><paragraph commented="no" display-inline="no-display-inline" id="id9afa35f0fc984b249b63853175bcfe3e"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>The amount of a grant under this section shall not exceed $100,000,000.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4a1d576c533a4c31af799c446dd75718"><enum>(2)</enum><header>Matching funds</header><text>An eligible entity that receives a grant under this section shall provide non-Federal matching funds in an amount that is equal to the amount of the grant.</text></paragraph></subsection><subsection id="idbebe2217d75e4a629996abe123985790"><enum>(g)</enum><header>Loan terms and conditions</header><text>Except as otherwise provided in this section, the terms and conditions of a loan under this section shall be the same as the terms and conditions of a business and industry direct or guaranteed loan under section 310B(g) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1932">7 U.S.C. 1932(g)</external-xref>).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idfb8d5a5583c549b4b91cbd09f9c5ce48"><enum>(h)</enum><header display-inline="yes-display-inline">Duration</header><paragraph commented="no" display-inline="no-display-inline" id="id74a98ac1f5ae45cf8f39f80f7a15f594"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>The Secretary may provide a grant or loan under this section for a project that is not longer than 5 years.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idee0b39ed0e48404d90be86ca65feb5f9"><enum>(2)</enum><header>Extension</header><text display-inline="yes-display-inline">The Secretary may extend the period described in paragraph (1) if the Secretary determines an extension is appropriate.</text></paragraph></subsection><subsection id="idadf074ea57c64ee7820a71830846fdd2"><enum>(i)</enum><header>Combination and nonsupplantation of other funds</header><paragraph commented="no" display-inline="no-display-inline" id="id2b1ad88e4e9e40b8b03dad0c34c23e69"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall use the amounts made available to carry out this section to supplement, and not supplant, funds provided under other Federal, State, or local laws. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id49cf74aff64b4321a0c849939b84b214"><enum>(2)</enum><header>Coordination</header><text display-inline="yes-display-inline">The Secretary shall coordinate with other Federal agencies, such as the Department of Energy, and State, regional, or local agencies to allow applicants under this section to package proposals to be considered under relevant authorities jointly.</text></paragraph></subsection><subsection id="id074c91afa0e7422fbb11ca4015200f5f"><enum>(j)</enum><header>Condition</header><text>As a condition on receipt of a grant or loan under this section, the grant or loan recipient shall repay the grant or loan in full if any company or facility developed through the project using the grant or loan, or most or all of the assets of such company or facility, is sold, is transferred, or otherwise changes ownership, during the 10-year period beginning on the completion of the project, to an entity that holds a market share (in manufacturing, processing, or distribution) greater than or equal to the entity that holds the fourth-largest share of that market for nitrogen, phosphate, potash, or any combination of thereof.</text></subsection><subsection id="idb3d2aa10e31046a1ad9285c5543c9296"><enum>(k)</enum><header>Funding</header><text display-inline="yes-display-inline">In addition to other available funds, the Secretary may use the authority under section 5 of the Commodity Credit Corporation Charter Act (<external-xref legal-doc="usc" parsable-cite="usc/15/714c">15 U.S.C. 714c</external-xref>) to transfer such sums of the funds of the Commodity Credit Corporation from available borrowing authority as the Secretary determines to be appropriate to carry out this section. </text></subsection></section></legis-body></bill>
