which was read twice and referred to the <committee-name committee-id="SSHR00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date date="20260804">August 4, 2026</action-date><action-desc>Reported by <sponsor name-id="S373">Mr. Cassidy</sponsor>, with an amendment</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To establish that a State-based education loan program is excluded from certain requirements relating to a preferred lender arrangement.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id3BB2FB445D6243A2AC52B632AB21490D" changed="deleted" reported-display-style="strikethrough" committee-id="SSHR00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>State-Based Education Loan Awareness Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="id227074BACB66408CB58C1E02B0DD0E9B" changed="deleted" reported-display-style="strikethrough" committee-id="SSHR00"><enum>2.</enum><header>State-based education loan programs</header><text display-inline="no-display-inline">Section 151 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1019">20 U.S.C. 1019</external-xref>) is amended—</text><paragraph id="idb37bf0418d674b998808812f7482a8b4"><enum>(1)</enum><text>in paragraph (8)(B)—</text><subparagraph id="id3616bc981fb641468fd5e6f8a19b483a"><enum>(A)</enum><text>in clause (i), by striking <quote>or</quote> after the semicolon;</text></subparagraph><subparagraph id="idc13da7a26d91412ba8808eb4826c3552"><enum>(B)</enum><text>in clause (ii), by striking the period at the end and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph id="id837f58ef4b3546c5918606abafbbcace"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idc0b7e117e47f41c6a7c49ee42875c086" changed="deleted" reported-display-style="strikethrough" committee-id="SSHR00"><clause id="id12e61a8714f64fac9bc4aa181266681d"><enum>(iii)</enum><text>arrangements or agreements with respect to education loans made under a State-based education loan program.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idb234bbc27a5e4f60a2a6a85064fbad99"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id56E79E8EB7974E049D70003760FB1403" changed="deleted" reported-display-style="strikethrough" committee-id="SSHR00"><paragraph id="id33ee137352494ba0b3f62a9cc39f1f0a"><enum>(10)</enum><header>State-based education loan program</header><text>The term <term>State-based education loan program</term> means an education loan program that—</text><subparagraph id="id57b04241b2c84984bb8a93d82f2559f7"><enum>(A)</enum><text>is provided by a State agency, State authority, or nonprofit organization, separately or jointly;</text></subparagraph><subparagraph id="idf419cf3bb603496ba65071cc7e8b2fb5"><enum>(B)</enum><text>makes loans that are not funded, insured, or guaranteed by the Federal Government;</text></subparagraph><subparagraph id="id5e95efb14c3d49a2a3a78044f5d79112"><enum>(C)</enum><text>is authorized, established, or chartered by State law, or otherwise approved by the State;</text></subparagraph><subparagraph id="id262a6f9e984d4242a50a1d2660fcdf3b"><enum>(D)</enum><text>offers one or more loans for which the interest rate and fees, as calculated in accordance with sections 106 and 107 of the Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1605">15 U.S.C. 1605</external-xref>; 1606), are at least as favorable as the interest rate and fees of the Direct PLUS loans authorized under part D of title IV at the time such loan is originated; and</text></subparagraph><subparagraph commented="no" id="idd56adab6e0a6419e90835df71e1fca3a"><enum>(E)</enum><text>is available only to a borrower who has been advised, such as in a financial aid offer, by an institution of higher education (as defined under section 102)—</text><clause commented="no" id="id093AF49830434A3EBCDFC036D235FFBE"><enum>(i)</enum><text>that the borrower has the opportunity to exhaust eligibility for Federal education loans made under part D of title IV prior to accepting a private education loan; and</text></clause><clause commented="no" id="idD1CDD0179CC244709A65D7C917E7A5C9"><enum>(ii)</enum><text>of the interest rates, fees, and benefits of such Federal education loans, including income-driven repayment options, opportunities for loan forgiveness, forbearance or deferment options, interest subsidies, and tax benefits.</text></clause></subparagraph></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section section-type="section-one" id="idae720bee-191a-4ab9-995e-d3684bf6b206" changed="added" reported-display-style="italic" committee-id="SSHR00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>State-Based Education Loan Awareness Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="id86122d28-33fd-41c3-b596-11b078caaf20" changed="added" reported-display-style="italic" committee-id="SSHR00"><enum>2.</enum><header>State-based education loan programs</header><text display-inline="no-display-inline">Section 151 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1019">20 U.S.C. 1019</external-xref>) is amended—</text><paragraph id="idaa64f460-f258-4de1-b0a9-5a36a8762745"><enum>(1)</enum><text>in paragraph (8)(B)—</text><subparagraph id="idf7bcb446-2002-4db0-bb38-afc7d37588d1"><enum>(A)</enum><text>in clause (i), by striking <quote>or</quote> after the semicolon;</text></subparagraph><subparagraph id="id81778754-20d9-4de8-be7b-585ca142bfa2"><enum>(B)</enum><text>in clause (ii), by striking the period at the end and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph id="id935fb6ab-6df8-4dd2-afa7-cefbd8debbf7"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idc7215774-319b-4314-8522-0f497116a58f" changed="added" reported-display-style="italic" committee-id="SSHR00"><clause id="ide48bb645-74d4-4e17-b88e-51c33aca2196"><enum>(iii)</enum><text>arrangements or agreements with respect to education loans made under a State-based education loan program.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idd0a2d5df-8d2b-47f5-9f3d-e07608673fc3"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block id="id4a53a741-86a3-4534-acff-582228e92ae5" display-inline="no-display-inline" style="OLC" changed="added" reported-display-style="italic" committee-id="SSHR00"><paragraph id="idf144b51c-d57c-42c5-9f67-f86fce6972f4"><enum>(10)</enum><header>State-based education loan program</header><text>The term <term>State-based education loan program</term> means an education loan program that—</text><subparagraph id="idff3b114b-0e55-452c-a6d5-de2779515e76"><enum>(A)</enum><text>is provided by a State agency, State authority, or nonprofit organization, separately or jointly;</text></subparagraph><subparagraph id="id04782c59-ab9b-46f5-95c2-a252bc7eb3bc"><enum>(B)</enum><text>makes loans that are not funded, insured, or guaranteed by the Federal Government;</text></subparagraph><subparagraph id="id54cae835-491a-4a2f-8d18-ffef6249791d"><enum>(C)</enum><text>is authorized, established, or chartered by State law, or otherwise approved by the State;</text></subparagraph><subparagraph id="id3e127dba-be1b-4fc2-a7c3-a055f4926ac1"><enum>(D)</enum><text>offers one or more loans for which the interest rate and fees, as calculated in accordance with sections 106 and 107 of the Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1605">15 U.S.C. 1605</external-xref>, 1606), are at least as favorable as the interest rate and fees of the Federal Direct PLUS loans authorized under part D of title IV at the time such loan is originated; and</text></subparagraph><subparagraph commented="no" id="idf02dd591-b5c6-49f6-bd7e-0e28a3f5cecf"><enum>(E)</enum><text>is available only to a borrower who has been advised, such as in a financial aid offer, by an institution of higher education (as defined in section 102)—</text><clause commented="no" id="ide5e94d5b-2031-4122-abbd-6fa8806a76d3"><enum>(i)</enum><text>that the borrower should exhaust Federal student loan eligibility under part D of title IV prior to accepting a private education loan; and</text></clause><clause id="id41c323d0-6fce-4040-8776-6022ff3e23bc" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text>of the interest rates, fees, and benefits of such Federal education loans, including income-driven repayment options, opportunities for loan forgiveness, forbearance or deferment options, interest subsidies, and tax benefits.</text></clause></subparagraph></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></section><section id="id5cb14a7930c44f9c975e464ebff7aa9f" commented="no" changed="added" reported-display-style="italic" committee-id="SSHR00"><enum>3.</enum><header>GAO report on changes in trends of student loan borrowers</header><subsection commented="no" display-inline="no-display-inline" id="id13516654994b4590905f03490ef9666d"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, the Comptroller General of the United States shall prepare and submit a report to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Education and Workforce of the House of Representatives on changes in trends of student loan borrowers at institutions of higher education. </text></subsection><subsection commented="no" display-inline="no-display-inline" id="ida6be15f83ca4419cbfdac5a78fcb8af6"><enum>(b)</enum><header>Areas of examination</header><text display-inline="yes-display-inline">The report required under subsection (a) shall examine, in particular—</text><paragraph id="idfb5aed66b8524b1a8805549d02b326d3" commented="no"><enum>(1)</enum><text>the implementation of student loan changes made by the amendments made under title VIII of the Act titled <quote>An Act to provide for reconciliation pursuant to title II of H. Con. Res. 14</quote> (<external-xref legal-doc="public-law" parsable-cite="pl/119/21">Public Law 119–21</external-xref>; 139 Stat. 72), including—</text><subparagraph id="id99a361bf38924c84a64280717292d123" commented="no"><enum>(A)</enum><text>the average total amount borrowed by students, disaggregated by source, including the aggregate total combined amount of Federal, State-based, institutional, and private education loans;</text></subparagraph><subparagraph id="id1e988cfb4c034ef39c431ffe4e1c7734" commented="no"><enum>(B)</enum><text>changes during the 2-year period following the effective dates of the changes made by the amendments made under such title VIII in the rates of borrowing—</text><clause commented="no" display-inline="no-display-inline" id="id1824137b95c848e6998d88f2479cad68"><enum>(i)</enum><text display-inline="yes-display-inline">Federal, State-based, institutional, and private education loans for undergraduate and graduate borrowers; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id6a8f95ae537645d297200c2d34a42b42"><enum>(ii)</enum><text display-inline="yes-display-inline">on behalf of dependent students under the Federal Direct PLUS Loan program under part D of title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087a">20 U.S.C. 1087a et seq.</external-xref>); and </text></clause></subparagraph><subparagraph id="id451c35a751374de2ba6e9ab8376e1a29" commented="no"><enum>(C)</enum><text>the average amount borrowed in Federal, State-based, institutional, and private education loans, disaggregated by—</text><clause commented="no" display-inline="no-display-inline" id="idf70dd94ee8f84acabff1d2efee062ec7"><enum>(i)</enum><text display-inline="yes-display-inline">enrollment status as a first-time student or non-first-time student;</text></clause><clause commented="no" display-inline="no-display-inline" id="id4210da6c79e84c049489dd01ea4bae82"><enum>(ii)</enum><text display-inline="yes-display-inline">enrollment status as a full-time student or part-time student;</text></clause><clause commented="no" display-inline="no-display-inline" id="id0a23363ef2ea4c9da0e83267ba765a5e"><enum>(iii)</enum><text display-inline="yes-display-inline">type of degree or certificate sought by the student for whom the loan was awarded; </text></clause><clause commented="no" display-inline="no-display-inline" id="idf30d8a89e8b6401db689e1672c0906c7"><enum>(iv)</enum><text display-inline="yes-display-inline">Federal Pell Grant recipient status under section 401 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a">20 U.S.C. 1070a</external-xref>); and </text></clause><clause commented="no" display-inline="no-display-inline" id="idfcf812d4cde54f859a5f12b89bf8a0d8"><enum>(v)</enum><text display-inline="yes-display-inline">program of study of the student for whom the loan was awarded;</text></clause></subparagraph></paragraph><paragraph id="id5a8cc2748fba43e9a7208852681566ee" commented="no"><enum>(2)</enum><text>the availability of State-based education loan programs (as defined in section 151 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1019">20 U.S.C. 1019</external-xref>)) for students or parents of students at institutions of higher education, including the extent to which States expand existing or create new State-based education loan programs;</text></paragraph><paragraph id="idebb6e8ce27874a30b6baa9ca874f7077" commented="no"><enum>(3)</enum><text>the differences in interest rates for Federal, State-based, institutional, and private education loans;</text></paragraph><paragraph id="idf42dcceb2e114b82b70047f9dfdaee85" commented="no"><enum>(4)</enum><text>the extent to which students or parents of students borrow both Federal education loans and State-based education loans, institutional education loans, or private education loans, or some combination thereof; and </text></paragraph><paragraph id="idaac32d38ab2746ba8f8545bfa0e90978" commented="no"><enum>(5)</enum><text>changes in outcomes for borrowers of Federal, State-based, institutional, and private education loans, both in the aggregate and disaggregated, to the extent practicable, by—</text><subparagraph commented="no" display-inline="no-display-inline" id="id41ec2b3c913b435ebdb89de1564d82bc"><enum>(A)</enum><text>type of institution of higher education (whether public, private nonprofit, or proprietary);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8299bba8a80a4fa09dc8fbf60b4d4b25"><enum>(B)</enum><text display-inline="yes-display-inline">program of study; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd77f4227d3e447c995ccfc4e078f1547"><enum>(C)</enum><text display-inline="yes-display-inline">repayment rate;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5e2223ae173342ed8065e4dd76dcae1c"><enum>(D)</enum><text display-inline="yes-display-inline">delinquency rate;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6f71dac87739471ebc9b7f292ee18846"><enum>(E)</enum><text display-inline="yes-display-inline">default rate;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id48df702a8253456da2c40ffda0a951bc"><enum>(F)</enum><text display-inline="yes-display-inline">use of deferment or forbearance; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf79c62338b934b0b84b38c287fb264ee"><enum>(G)</enum><text display-inline="yes-display-inline">rate of principal reduction. </text></subparagraph></paragraph></subsection></section></legis-body><endorsement><action-date>August 4, 2026</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
