which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Transportation to establish a working group to review and establish guidance and best practices for responding to electric vehicle fires, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Responder and Recovery Safety in EV Fires Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id479dc43372204d0da45b0fb4d2bcea93"><enum>2.</enum><header>Electric Vehicle Fire Response Working Group</header><subsection commented="no" display-inline="no-display-inline" id="id2aa4ea964fe54dd795bdbd53b322403e"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id8c58267c8bac4c4783c98dba9cc9d964"><enum>(1)</enum><header>Electric vehicle</header><text>The term <term>electric vehicle</term> means a car, bus, or truck, including an automobile or commercial medium- or heavy-duty on-highway vehicle (as those terms are defined in section 32901(a) of title 49, United States Code), that—</text><subparagraph commented="no" display-inline="no-display-inline" id="idbd84e293313042338ffffff927dde415"><enum>(A)</enum><text display-inline="yes-display-inline">is manufactured primarily for use on public roads or highways; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id025285cc61384b35b47dd0aaf5bca45b"><enum>(B)</enum><text display-inline="yes-display-inline">contains a battery or similar energy storage device that provides motive power to propel the car, bus, or truck.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbc1f204bf6f24fd09e846ff0ef08e12f"><enum>(2)</enum><header>Public road</header><text>The term <term>public road</term> has the meaning given the term in section 101(a) of title 23, United States Code.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9738d24b70d945f799acd5a1f04e3e4b"><enum>(3)</enum><header>Roadside incident</header><text display-inline="yes-display-inline">The term <term>roadside incident</term> means an incident involving an electric vehicle that occurs on a public road or any area adjacent to a public road as a result of the use of the electric vehicle on the public road, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="id004b51dd5d4948bfa4da137a3cfcb998"><enum>(A)</enum><text display-inline="yes-display-inline">on the shoulder or median of a public road;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2f8cc0c2094e4ec98d2de043f671ef7e"><enum>(B)</enum><text display-inline="yes-display-inline">at a charging station for electric vehicles that is open to the public; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc4a87bce755346c7815a8d3ce8c1eee7"><enum>(C)</enum><text>on a parking deck or lot that is open to the public.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id010d884b11c24ee69a6d30ce01b6445b"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Transportation.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc06153f412804422b02c377d6bbb0b3c"><enum>(5)</enum><header>Working group</header><text>The term <term>working group</term> means the Electric Vehicle Fire Response Working Group established under subsection (b).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9954333c911349cd97621fface46758f"><enum>(b)</enum><header>Establishment</header><text>Not later than 90 days after the date of enactment of this Act, the Secretary shall establish a working group, to be known as the <quote>Electric Vehicle Fire Response Working Group</quote>.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id7319630657ca4c27aaf7d33bbaa9f826"><enum>(c)</enum><header>Composition</header><text>The working group shall be composed of not fewer than 22 members, including—</text><paragraph commented="no" display-inline="no-display-inline" id="id360b6fa29f5e4cd79f86106688d7055b"><enum>(1)</enum><text display-inline="yes-display-inline">at least 2 representatives of the towing industry, appointed by the Secretary from among individuals nominated by appropriate entities operating in or representing the towing industry, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf896173ed77d47f190a63d9f9002fdee"><enum>(A)</enum><text display-inline="yes-display-inline">if nominated, at least 2 representatives nominated by the Towing and Recovery Association of America (commonly known as the <quote>TRAA</quote>); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3731271c800a451d8fa2d724d87bf32d"><enum>(B)</enum><text>such other representatives of the towing industry as the Secretary determines to be appropriate;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida4df06c028c54a6f83690a8f59296127"><enum>(2)</enum><text>at least 6 representatives of emergency response personnel, appointed by the Secretary from among individuals nominated by appropriate entities representing emergency response personnel who may respond to electric vehicle fires, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="idcbd0a010bb04482fb0b4d89d557f6c9b"><enum>(A)</enum><text display-inline="yes-display-inline">if nominated—</text><clause commented="no" display-inline="no-display-inline" id="iddc1621ebda174bce9d0d1974e1de7651"><enum>(i)</enum><text display-inline="yes-display-inline">at least 1 representative nominated by the International Association of Fire Chiefs (commonly known as the <quote>IAFC</quote>);</text></clause><clause commented="no" display-inline="no-display-inline" id="id5a6b707211d44c8590825155be689395"><enum>(ii)</enum><text>at least 1 representative nominated by the International Association of Fire Fighters (commonly known as the <quote>IAFF</quote>);</text></clause><clause commented="no" display-inline="no-display-inline" id="idb80d080cd7904d18a82d16ce46442397"><enum>(iii)</enum><text>at least 1 representative nominated by the National Volunteer Fire Council (commonly known as the <quote>NVFC</quote>);</text></clause><clause commented="no" display-inline="no-display-inline" id="id56e1b01f13e24a0b9e63239d1902a828"><enum>(iv)</enum><text>at least 1 representative nominated by the International Association of Chiefs of Police (commonly known as the <quote>IACP</quote>);</text></clause><clause commented="no" display-inline="no-display-inline" id="id383e8bbe983942f289bc65c021f0189a"><enum>(v)</enum><text>at least 1 representative nominated by the National Association of State Emergency Medical Services Officials (commonly known as the <quote>NASEMSO</quote>); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id4c48753360364b2e91935454dc574140"><enum>(vi)</enum><text>at least 1 representative nominated by the American Public Works Association (commonly known as the <quote>APWA</quote>); and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id44488b32a5c94c3c94c5094f8dc6c552"><enum>(B)</enum><text>such other representatives of emergency response personnel as the Secretary determines to be appropriate;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id51fed30d59bf4e24a0866ee99322fcbc"><enum>(3)</enum><text>at least 6 representatives of the automotive industry, appointed by the Secretary from among individuals nominated by appropriate entities operating in or representing original equipment manufacturers of electric vehicles or the component parts of electric vehicles, including—</text><subparagraph id="ide0bf44ad7de242ef908e3f73d83d9ed1"><enum>(A)</enum><text>if nominated—</text><clause id="id7a70c94b5e324dd091fa110eb38f4038"><enum>(i)</enum><text>at least 1 representative nominated by the Zero Emission Transportation Association (commonly known as the <quote>ZETA</quote>);</text></clause><clause id="idf31d222c278f4a6aa1b632d58a775e9d"><enum>(ii)</enum><text>at least 1 representative of manufacturers of electric buses;</text></clause><clause id="id1295b35212b048ca91908e00fb496023"><enum>(iii)</enum><text>at least 1 representative of manufacturers of electric commercial medium- or heavy-duty on-highway vehicles;</text></clause><clause id="iddb30810d8713450a911821354e256ccc"><enum>(iv)</enum><text>at least 1 representative of manufacturers of electric vehicle batteries;</text></clause><clause id="id9f2bbc61645e4fcfb0db9872a5c9ceb5"> <enum>(v)</enum> <text>at least 1 representative of manufacturers or installers of electric vehicle supply equipment; and</text>
 </clause><clause id="idb5024be30c1a466da98602f91b5ab5d9"><enum>(vi)</enum><text>at least 1 representative of manufacturers of electric vehicles; and</text></clause></subparagraph><subparagraph id="id1a0261b2171945bb9df20532d1294ee1"><enum>(B)</enum><text>such other representatives of the electric vehicle manufacturing industry as the Secretary determines to be appropriate;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc4ffd411e55144858f5e487f96f4197b"><enum>(4)</enum><text>at least 4 representatives of research, standards-setting, or training organizations with expertise relating to the risks of electric vehicle fires and electric vehicle fire response, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="id289c79f259d74c77bb38491e14533cbd"><enum>(A)</enum><text display-inline="yes-display-inline">if nominated—</text><clause commented="no" display-inline="no-display-inline" id="id245235b3eba2477d832ce7698bfee556"> <enum>(i)</enum> <text display-inline="yes-display-inline">at least 1 representative nominated by the National Fire Protection Association (commonly known as the <quote>NFPA</quote>);</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id08ca0f0aefee4420b7ee6d44e47cd245"><enum>(ii)</enum><text display-inline="yes-display-inline">at least 1 representative nominated by the Emergency Responder Safety Institute (commonly known as the <quote>ERSI</quote>);</text></clause><clause id="id5e36dcd99b204dedab70ae979b338240"><enum>(iii)</enum><text>at least 1 representative nominated by the Fire Safety Research Institute of UL Research Institutes (commonly known as <quote>UL–FSRI</quote>); and</text></clause><clause id="id3b1690e8a2444b9f8446b250bbda53ea"> <enum>(iv)</enum> <text>at least 1 representative nominated by the Society of Automotive Engineers International (commonly known as the <quote>SAE</quote>); and</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide2c0d4c264d24bb3bd7514c8c0676ef5"><enum>(B)</enum><text>such other representatives of research, standards-setting, or training organizations as the Secretary determines to be appropriate;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id36eabffc9ec6466bb95be2bd11e5c906"><enum>(5)</enum><text display-inline="yes-display-inline">1 representative of the National Transportation Safety Board, appointed by the National Transportation Safety Board;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id99ec7e50ad8a40bf9f7d4aaeea206606"><enum>(6)</enum><text display-inline="yes-display-inline">1 representative of the National Highway Traffic Safety Administration, appointed by the Secretary, acting through the Administrator of the National Highway Traffic Safety Administration;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id09c0dc9bf9424ec188dfe03483775294"><enum>(7)</enum><text>1 representative of the Federal Highway Administration, appointed by the Secretary, acting through the Administrator of the Federal Highway Administration;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1bd1185bf80440e09d2e647f6806f410"><enum>(8)</enum><text display-inline="yes-display-inline">1 representative of the United States Fire Administration, appointed by the Administrator of the United States Fire Administration; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide43754c856bc4747bc14115a0e160c01"><enum>(9)</enum><text>such other representatives of a Federal agency as the Secretary determines to be appropriate, such as representatives of—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf59aa1aece8343eab063616c49bff5d4"><enum>(A)</enum><text display-inline="yes-display-inline">the Department of Transportation (including any relevant agency or modal administration of the Department of Transportation);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3bc9a248145146d4b781203b447ee914"><enum>(B)</enum><text display-inline="yes-display-inline">the Department of Energy;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id23d428cde9264147a2de20f2ac2f7f43"><enum>(C)</enum><text display-inline="yes-display-inline">the intelligence community (as defined in section 3 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003</external-xref>)); or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8f9cbe9af59640f7afb02d0523c78bc7"><enum>(D)</enum><text display-inline="yes-display-inline">Federal law enforcement agencies.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8dd213ee957e4cea9e3b9db4e8f4dfa4"><enum>(d)</enum><header>Head</header><text display-inline="yes-display-inline">The Secretary shall select 1 member of the working group to serve as head of the working group.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="ida1411e212d064bc39433ab4e28ccd12e"><enum>(e)</enum><header>Compensation</header><text>Members of the working group shall serve without compensation.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id3d91a16cb480481e97fd36106a02485b"><enum>(f)</enum><header>Duties</header><text>The working group shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id068d0d308e8a46ffb6056616e44d8f82"><enum>(1)</enum><text>continuously review—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd91eb7bfd94b4347bc7dd2c5ef2d0d49"><enum>(A)</enum><text display-inline="yes-display-inline">known and developing risks relating to electric vehicle fires and electric vehicle fire response;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id656f98c8ea1e4a2d9c4ccbc99a702ddb"><enum>(B)</enum><text display-inline="yes-display-inline">existing best practices, standards, and guidance relating to electric vehicle fire response; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6c852b491c0646c5b69625a7520903b7"><enum>(C)</enum><text>roadside incidents involving electric vehicle fires, including any response procedures utilized; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id35d725b70d344af6be4e01dfbc9845fb"><enum>(2)</enum><text>based on that review, periodically issue or update best practices and guidance for responding to electric vehicle fires.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idb1703f6edfc04174a0d8b29a1561fd76"><enum>(g)</enum><header>Database</header><paragraph commented="no" display-inline="no-display-inline" id="id7d4b3be4afde4c61a308713c0dc2c2ac"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The working group shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id0b0f959280724fd9bc74d0d996b92c93"><enum>(A)</enum><text display-inline="yes-display-inline">report roadside incidents involving electric vehicle fires for inclusion in the database established and maintained pursuant to section 9 of the Federal Fire Prevention and Control Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/15/2208">15 U.S.C. 2208</external-xref>) (also known as the <quote>National Emergency Response Information System</quote> or the <quote>NERIS</quote>); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id123a1cd6f7b74f8a95d4c99f8ff4e44c"><enum>(B)</enum><text>coordinate with the United States Fire Administration to maintain and update that database, including by ensuring that the database includes, to the maximum extent practicable, the information described in paragraph (3) with respect to roadside incidents.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id782d15d959b242079c50936766d0a19f"><enum>(2)</enum><header>Publication</header><text>The Administrator of the United States Fire Administration shall publish the information in the reports required by paragraph (1) in the database described in that paragraph.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id34fd879f315b4587b2c43bf275fe0b2f"><enum>(3)</enum><header>Contents</header><text>To the maximum extent practicable, the reports required by paragraph (1) shall include, with respect to each roadside incident reported—</text><subparagraph commented="no" display-inline="no-display-inline" id="id38992651e5614b7993595a6b13b26844"><enum>(A)</enum><text display-inline="yes-display-inline">the location of the incident;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3b38d11cf47e48b6899a5a5e65d1404c"><enum>(B)</enum><text>the time of the incident and response;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf20beecaa3e64433b742698802a33ddd"><enum>(C)</enum><text>the conditions at the scene, such as—</text><clause commented="no" display-inline="no-display-inline" id="id81193c647636453faae6bbbdeb6a32af"><enum>(i)</enum><text display-inline="yes-display-inline">the weather;</text></clause><clause commented="no" display-inline="no-display-inline" id="idbf15c68c653b4cc497e52b8f111364b2"><enum>(ii)</enum><text display-inline="yes-display-inline">the presence or absence of daylight;</text></clause><clause commented="no" display-inline="no-display-inline" id="id2d17a71dd8114c3789641881a73a5233"><enum>(iii)</enum><text>the presence or absence of passengers, pedestrians, or other vehicles; and</text></clause><clause commented="no" id="id08c27bde05cb48aea3c4ba2916d3cdc6"><enum>(iv)</enum><text>such other conditions as the working group determines to be relevant;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id273fb68e16e446ccb7a02fb81b09686b"><enum>(D)</enum><text>the practices and procedures used to respond to the electric vehicle fire;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfc785703a9dd41c7abf676af7be53f36"><enum>(E)</enum><text>the results of the incident and response; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id06464bbf369c4796adc23ed003c9847d"><enum>(F)</enum><text>such other information relating to a roadside incident as the working group determines to be appropriate.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9c84f9d71295455ab3990cd1e36143f2"><enum>(h)</enum><header>Annual report</header><text>The working group shall submit to Congress and make publicly available an annual report on the work of the working group during the previous year, including—</text><paragraph commented="no" display-inline="no-display-inline" id="idd2e9cbc5f874450fbff8e06a8d70ac9f"><enum>(1)</enum><text display-inline="yes-display-inline">a summary of any best practices and guidance issued or updated; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb867ac7be1c8466c98f0eae60678dfa5"><enum>(2)</enum><text display-inline="yes-display-inline">a summary of any issues for which new or updated best practices or guidance is being considered.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idf282adeddb984d4c928953868ad60fa2"><enum>(i)</enum><header>FACA</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/10">Chapter 10</external-xref> of title 5, United States Code (commonly referred to as the <quote><act-name parsable-cite="FACA">Federal Advisory Committee Act</act-name></quote>), shall not apply to the working group.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="ida6a5563d16834e87b8868def520f396a"><enum>(j)</enum><header>Administrative expenses</header><paragraph commented="no" display-inline="no-display-inline" id="id4c9b176fcfbf4892866d86c2dee2656a"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall provide administrative support for the working group in a manner consistent with the provision of support services under section 1011 of title 5, United States Code.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idedaaaf6c02d84d4dae82ee58198f6793"><enum>(2)</enum><header>Funding</header><text display-inline="yes-display-inline">The Secretary shall use existing funds available to the Secretary to carry out paragraph (1).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id15491dcd8cd0429985340a66ada15708"><enum>(k)</enum><header>Termination</header><text>The working group shall terminate on the date that is 10 years after the date on which the working group is established under subsection (b).</text></subsection></section></legis-body></bill>
