which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend section 5316 of title 31, United States Code, to include concerning money instruments relating to certain countries in reports under that section, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Somali Currency Airport Smuggling through Hawalas Fraud Act</short-title></quote> or the <quote><short-title>Stop Somali CASH Fraud Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="iddfb55e94fc8c44efa8f4e8b6a6217254"><enum>2.</enum><header>Amendment</header><text display-inline="no-display-inline">Section 5316 of title 31, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id4fde1dd2e9d04565a4f99c2e5ee0a906"><enum>(1)</enum><text>by redesignating subsections (c) and (d) as subsections (d) and (e), respectively; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4d0ed4ca8d8f487ba26db055b685dc6e"><enum>(2)</enum><text>by inserting after subsection (b) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2da65b374e1743beab277b3c11ad0f26"><subsection commented="no" display-inline="no-display-inline" id="id3c8ea3fe909f4849aa2918a2e5d4d726"><enum>(c)</enum><header>Money instruments or currency relating to certain countries</header><paragraph commented="no" display-inline="no-display-inline" id="id390e8f1d08f44437bf7ff755f7aaa841"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A report under subsection (a)(1)(A) shall be filed not less than 72 hours before the monetary instrument or currency leaves the United States if the monetary instrument or currency is transported by an alien, as defined in section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>), who is a national of a country—</text><subparagraph commented="no" display-inline="no-display-inline" id="id417442fdc3264810bad243c3c6185c5e"><enum>(A)</enum><text display-inline="yes-display-inline">designated by the Secretary of State under section 1753(c) of the Export Control Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4813">50 U.S.C. 4813(c)</external-xref>);</text></subparagraph><subparagraph id="id4ed69ec908a24bccb5fd50b2389bded7"><enum>(B)</enum><text>designated by the Secretary of State under section 40 of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2780">22 U.S.C. 2780</external-xref>);</text></subparagraph><subparagraph id="ided869a6ef1094d1bb775d4e2cb4ea8d9"><enum>(C)</enum><text>designated by the Secretary of State under section 620A of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2371">22 U.S.C. 2371</external-xref>);</text></subparagraph><subparagraph id="ide19b5051aaa14d02b1300db33b372722"><enum>(D)</enum><text>designated as a state sponsor of terrorism by the Secretary of State under section 219 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1189">8 U.S.C. 1189</external-xref>); or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id26e2a36fb3ba40c5924ada38ed094769"><enum>(E)</enum><text display-inline="yes-display-inline">that is identified as a high-risk country in the Department of State’s January 14, 2026, press release titled, <quote>Immigrant Visa Processing Updates for Nationalities at High Risk of U.S. Public Benefits Reliance</quote>.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida5d1d8baac614b9eafd48095c05fd1cb"><enum>(2)</enum><header>Report contents</header><text display-inline="yes-display-inline">In addition to other information required under this section, a report under paragraph (1) shall also contain the following information:</text><subparagraph commented="no" display-inline="no-display-inline" id="id7f21b0752e7348e989ee2d2c3b78c01a"><enum>(A)</enum><header>Person transporting currency or monetary instruments</header><text>With respect to the individual transporting currency or monetary instruments:</text><clause commented="no" display-inline="no-display-inline" id="id4aab842e7124481993528dbabd725e8e"><enum>(i)</enum><text>Any identity or travel documents, including number, issue date, and expiry date, that was issued to such individual during the immediately preceding 5-year period (including any refugee travel document, temporary protected status travel authorization document, advance parole document, or other travel authorization issued by the Secretary of Homeland Security or Secretary of State), whether valid or expired.</text></clause><clause commented="no" display-inline="no-display-inline" id="id1822f558d7aa45e8bbd57a00a96c3e2a"><enum>(ii)</enum><text display-inline="yes-display-inline">Any individual taxpayer identification numbers (ITIN) used during the immediately preceding 5-year period.</text></clause><clause id="id6822538901ec43ec8c65ccb5817117e3"><enum>(iii)</enum><text>Any alien registration numbers used during the immediately preceding 5-year period.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id42a942f832594bb3ba8dec4d1fd4df77"><enum>(B)</enum><header>Beneficiary or recipient of currency</header><text>With respect to the beneficiary or recipient of currency:</text><clause id="id7968f307de5546a992a7b4e57811e0a7"><enum>(i)</enum><text>Name.</text></clause><clause id="id8329012540a84e22977afafe63a190ad"><enum>(ii)</enum><text>Address.</text></clause><clause id="id679aa821d58e43138424f7298b142b24"><enum>(iii)</enum><text>Date of birth.</text></clause><clause commented="no" display-inline="no-display-inline" id="id2392fa13a7c44437ab63a22950f1fc37"><enum>(iv)</enum><text>Place of birth.</text></clause><clause id="id883dce5fd9f345259cdf1e67686bd6d7"><enum>(v)</enum><text>Any phone numbers, including home, work, and mobile numbers.</text></clause><clause id="id2ef5584a927c4eea824897a8bd0be2ce"><enum>(vi)</enum><text>Any email addresses, including personal and work.</text></clause><clause commented="no" display-inline="no-display-inline" id="iddba0c27cea124403a5ea6ab62c257214"><enum>(vii)</enum><text>Passport or national identification number, including any photo identification, whether valid or expired.</text></clause></subparagraph><subparagraph id="id0d0097fd9e0d4d77a4567bcc525a479f"><enum>(C)</enum><header>Source</header><text>Whether the currency or monetary instruments are funded from any Federal, State, or local government contract or benefit program, and if so, whether those funds were provided to any entity in which the person transporting the currency or monetary instruments has any ownership interest.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
