<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Trucking Security and CCP Disclosure Act of 2026</short-title></quote>.</text></section> <section id="idff9b217e5de646b58f094d072dcc881e"><enum>2.</enum><header>Certification requirement for motor carriers transporting Department of Defense freight</header><text display-inline="no-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/157">Chapter 157</external-xref> of title 10, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/10/2631a">section 2631a</external-xref> the following new section:</text>

<section id="idBEC146634CCD4CFAAA64DA884C742D61" section-type="section-one"><enum>2631b.</enum><header>Certification regarding affiliations with Chinese military companies for surface transportation contracts</header>
<subsection id="id4cd3820dd5684b15b30e2e095f542296"><enum>(a)</enum><header>Certification required</header>
<paragraph commented="no" display-inline="yes-display-inline" id="id4fa171c5e3af44e4ad9eb2472473563b"><enum>(1)</enum><text>No contract for the transportation of cargo by motor carrier for the Department of Defense (including contracts awarded by the United States Transportation Command or the Military Surface Deployment and Distribution Command) may be awarded to, or performed by, any covered carrier unless such covered carrier submits a certification described in subsection (b).</text></paragraph> <paragraph id="id96a572f7e5f1487ba0bf7337a88f3e66" indent="up1"><enum>(2)</enum><text>The requirement under paragraph (1) shall apply to prime contractors, subcontractors, and owner-operators at all tiers.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="ida855685afab041a8832dbbbb49e93500"><enum>(b)</enum><header>Contents of certification</header><text display-inline="yes-display-inline">A certification under this section shall state that, to the best of the covered carrier's knowledge after reasonable inquiry—</text> <paragraph id="id59fd8817420b4460ae1e2832ec9f014a"><enum>(1)</enum><text>the covered carrier is not owned or controlled by, and does not have significant business relationships with, any entity identified on the most recent list of Chinese military companies required under section 1260H of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/283">Public Law 116–283</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/113">10 U.S.C. 113</external-xref> note); and</text></paragraph>
<paragraph id="id118f51d0291a4f489ca426d06652473c"><enum>(2)</enum><text>the covered carrier will require the same certification from any subcontractor or owner-operator it engages for performance of the contract.</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="id74a475879fe44e6fbd548bb1847e25c0"> <enum>(c)</enum> <header>Flow-Down and recordkeeping</header> <text display-inline="yes-display-inline">Prime contractors shall include the substance of this certification requirement in all subcontracts and lease agreements for Department of Defense freight transportation. Covered carriers shall maintain records of certifications for not less than 5 years.</text> </subsection>
<subsection id="id0b61c4fbb385439d845ade1bff110d8d"><enum>(d)</enum><header>Penalties</header><text>Any covered carrier that knowingly provides a false certification under this section shall be subject to suspension or debarment from Department of Defense contracting and civil penalties under section 1001 of title 18.</text></subsection> <subsection id="idc210dbc3aaf143d5995562b9919a542d"><enum>(e)</enum><header>Implementation</header><text>The Secretary of Defense shall prescribe regulations to implement this section not later than 180 days after the date of the enactment of this section, including integration into existing carrier approval processes of the Military Surface Deployment and Distribution Command.</text></subsection>
<subsection id="ida31b3deee9cb429ca3af6ce4b5f89f1c"><enum>(f)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="id7917a24d32314d14b8e6d12a3454d25a"><enum>(1)</enum><header>Covered carrier</header><text>The term <term>covered carrier</term> means any motor carrier, subcontractor, or owner-operator providing surface transportation services.</text></paragraph>
<paragraph id="idfcb9223705cd4f9e8fe96a8d2d13d803"><enum>(2)</enum><header>Significant business relationships</header><text>The term <term>significant business relationships</term> shall have the meaning given by the Secretary of Defense in regulations.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="idc10f4d6657c54d5b9b5a58a4c93291bb"> <enum>3.</enum> <header>Establishment of national security registry for motor carriers handling department of defense freight</header> <subsection id="idf263a168139e4fcebb398e2565e0ea67"> <enum>(a)</enum> <header>In general</header> <text>Subtitle IV of title 49, United States Code, is amended by inserting after chapter 139 the following:</text>

<section id="idca80197c9dae425d84f3c9df29331189"> <enum>14001.</enum> <header>Definition of registry</header> <text display-inline="no-display-inline">In this chapter, the term <term>registry</term> means the Secure Defense Freight Carrier Registry established under section 14002.</text> </section> <section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id7312dea63ba9466fb5a28185687c3b53"> <enum>14002.</enum> <header display-inline="yes-display-inline">Establishment of registry</header> <text display-inline="no-display-inline">Not later than 1 year after the date of the enactment of this chapter, the Secretary, acting through the Administrator of the Federal Motor Carrier Safety Administration and in coordination with the Secretary of Defense, shall establish and maintain a registry, to be known as the <quote>Secure Defense Freight Carrier Registry</quote>, of motor carriers approved to transport freight for the Department of Defense.</text> </section> 
<section commented="no" display-inline="no-display-inline" id="idb5002d1775964f5d99ab79216b706126"> <enum>14003.</enum> <header>Eligibility and approval</header> 
<subsection id="id35ff4880bdef4fb3b10aee0d65011061"> <enum>(a)</enum> <header>Eligibility requirements</header> <text>To be included in the registry, a motor carrier shall—</text> <paragraph id="id6348b18288f44de987b3c72768421dd7"> <enum>(1)</enum> <text>hold valid operating authority from the Federal Motor Carrier Safety Administration;</text> </paragraph> 
<paragraph id="ide25881a3c2fd4428ab15c6516448e4f9"> <enum>(2)</enum> <text>meet all applicable Department of Defense carrier qualification standards;</text> </paragraph> <paragraph id="ida8ee938143de4727ac2bfa9849372079"> <enum>(3)</enum> <text>undergo enhanced national security vetting, including—</text> 
<subparagraph id="id82ca7949dd9d4a66af58bc3876f095aa"> <enum>(A)</enum> <text>screening for ownership, control, or significant business relationships with—</text> <clause commented="no" display-inline="no-display-inline" id="id4e742e68334942a4900a9e87582ce2bb"> <enum>(i)</enum> <text display-inline="yes-display-inline">an entity identified on the list maintained by the Department of Defense under section 1260H of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="usc" parsable-cite="usc/10/113">10 U.S.C. 113</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/116/283">Public Law 116–283</external-xref>); or</text> </clause> 
<clause commented="no" display-inline="no-display-inline" id="idfc2d097be3a442f0aa3f10902a582142"> <enum>(ii)</enum> <text display-inline="yes-display-inline">any other foreign adversary entity designated by the Secretary of Defense; and</text> </clause> </subparagraph> <subparagraph id="idd56d01043766453cb8ef6b8ade8c2a1d"> <enum>(B)</enum> <text>verification that drivers and personnel with access to Department of Defense freight meet security standards comparable to those required under Transportation Worker Identification Credential programs or other relevant Federal security programs; and</text> </subparagraph> </paragraph> 
<paragraph id="ide7c68c51dba0450b9bbc473409add262"> <enum>(4)</enum> <text>submit to periodic revetting not less frequently than once every 2 years.</text> </paragraph> </subsection> <subsection id="id01915de031184d17b82a7d63db7d2433"> <enum>(b)</enum> <header>Application and approval process</header> <paragraph commented="no" display-inline="no-display-inline" id="idba5ba7df1dfb41b8ae2f2a7d528e450f"> <enum>(1)</enum> <header>In general</header> <text display-inline="yes-display-inline">The Secretary shall establish a streamlined application process for inclusion on the registry.</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="id038c698df45a4e94ac144f5247c8ddcc"> <enum>(2)</enum> <header>Requirement</header> <text display-inline="yes-display-inline">The process established under paragraph (1) shall include coordination with existing Department of Defense carrier approval systems.</text> </paragraph> </subsection> </section> <section id="id65deaec24923489c8f56b04e83c382d0"> <enum>14004.</enum> <header>Use of registry</header> <subsection commented="no" display-inline="no-display-inline" id="id211734554e24459c9ec9b57aad017fc3"> <enum>(a)</enum> <header display-inline="yes-display-inline">Prohibition</header> <text>Subject to subsection (b), beginning 1 year after the date of the enactment of this chapter, a motor carrier may not bid on or perform a Department of Defense freight transportation contract unless the motor carrier is included in the registry.</text> </subsection> 
<subsection id="ide326cf2d7a194738ac5c49d4bb2408d1"> <enum>(b)</enum> <header>Waivers</header> <text>The Secretary of Defense may grant waivers from the prohibition under subsection (a) for exigent circumstances.</text> </subsection> </section> </chapter> <after-quoted-block>.</after-quoted-block> </quoted-block> </subsection> <subsection id="idec2bfac25496404784cc4cdc4d158962"> <enum>(b)</enum> <header>Clerical amendment</header> <text>The analysis for subtitle IV of title 49, United States Code, is amended by inserting after the item relating to chapter 139 the following:</text>
