<official-title>To make continuing appropriations for Federal Emergency Management Agency pay and operations in the event of a Federal Government shutdown, and for other purposes.</official-title>

<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Pay FEMA Personnel Act of 2026</short-title></quote>.</text></section> <section id="id73284d512a814136b81e0d8deabdfd42"><enum>2.</enum><header>Continuing appropriations for FEMA personnel</header> <subsection id="id9a74b2f8b2e54654b288b7444981c404"><enum>(a)</enum><header>In general</header><text>There is appropriated to the Administrator of the Federal Emergency Management Agency (in this Act referred to as the <term>Administrator</term>) for fiscal year 2026, out of amounts in the Treasury not otherwise appropriated, for the period beginning February 14, 2026, during which interim or full-year appropriations for fiscal year 2026 are not in effect such sums as may be necessary—</text>
<paragraph commented="no" display-inline="no-display-inline" id="iddf61291f947848e78debeb906922f369"><enum>(1)</enum><text display-inline="yes-display-inline">to provide standard rates of pay, allowances, pay differentials, benefits, and other payments otherwise payable on a regular basis to employees of the Federal Emergency Management Agency whose services are required to carry out the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>);</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id53b261c8332a4e4786a27a8099b30797"><enum>(2)</enum><text display-inline="yes-display-inline">to provide standard rates of pay, allowances, pay differentials, benefits, and other payments otherwise payable on a regular basis to employees of the Federal Emergency Management Agency whose services are required to administer Federal assistance through grants, contracts, and cooperative agreements not relating to the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>); and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="idf69174d7c22940279df3bd9006fba52c"><enum>(3)</enum><text display-inline="yes-display-inline">to support all other activities necessary for the administration of every grant program administered by the Federal Emergency Management Agency.</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="id6b03bfc31dec46348267491ad6147c23"><enum>(b)</enum><header>Rule of construction</header><text>Nothing in subsection (a) shall be construed to prohibit the Administrator from awarding or disbursing grant program funding.</text></subsection>
<subsection id="id36f24ad33b1b48a69142f1f4c3711cb1"><enum>(c)</enum><header>Charge to future appropriations</header><text>Expenditures made with amounts appropriated pursuant to subsection (a) shall be charged to the applicable appropriation, fund, or authorization whenever an Act in which such applicable appropriation, fund, or authorization is included is enacted into law.</text></subsection></section> <section id="id12887af90cf04fa6843618697a9e2644"><enum>3.</enum><header>Termination</header><text display-inline="no-display-inline">Amounts made available and authority granted under this Act shall be available until the earliest of the following dates:</text>
<paragraph id="id59372d77b58140feb5e542c8f8ce739b"><enum>(1)</enum><text>The date of enactment into law of an appropriation (including a continuing appropriation) for any purpose for which amounts are made available under section 2(a).</text></paragraph> <paragraph id="id636b79ffa62c48a3ae20e1d7c6f6f594"><enum>(2)</enum><text>The date of enactment into law of the applicable regular or continuing appropriations resolution or other Act without any appropriation for any purpose for which amounts are made available under section 2(a).</text></paragraph>
<paragraph id="id6356159bbfe6487a9ab74790b97d9948"><enum>(3)</enum><text>September 30, 2026.</text></paragraph></section> <section id="id4c8afa92ce6042a7a421a7df976354cf"><enum>4.</enum><header>Retroactive effective date</header><text display-inline="no-display-inline">This Act shall take effect as if enacted on February 13, 2026.</text></section>
