Conforming amendments to other laws.</toc-entry></toc></subsection><subsection id="HF91469A39A3C437CA58B8A2E1CAF7A03"><enum>(b)</enum><header>References</header><text display-inline="yes-display-inline">Except as otherwise expressly provided in this Act, wherever in this Act an amendment or repeal is expressed in terms of an amendment to, or repeal of, a section or other provision, the reference shall be considered to be made to that section or other provision of the National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12501">42 U.S.C. 12501 et seq.</external-xref>).</text></subsection></section><section id="HD59007E1383C47359AC9F344C2B86C8C"><enum>3.</enum><header>Establishment of AmeriCorps Administration</header><subsection id="H10FFD714ADEE4166B82AB7F88FE3E398"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 191 (<external-xref legal-doc="usc" parsable-cite="usc/42/12651">42 U.S.C. 12651</external-xref>) is amended—</text><paragraph commented="no" id="H991C4007798C44909BF2D481C72C4B14"><enum>(1)</enum><text>by striking <quote>a Corporation for National and Community Service</quote> and inserting <quote>an AmeriCorps Administration</quote>; and</text></paragraph><paragraph id="HACE5F7744C6D4B44875F965A95B98547"><enum>(2)</enum><text>by striking <quote>The Corporation shall be a Government corporation, as defined in section 103</quote> and inserting <quote>The Administration shall be an Executive department, as defined in section 101.</quote>.</text></paragraph></subsection><subsection id="H95A0BF7C6A924A389EEE3492278B28B5"><enum>(b)</enum><header>Conforming amendment</header><text>Section 101 of title 5, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idbfe06b1097b540ce8cda2538ca0ef349"><list level="subsection"><list-item>The AmeriCorps Administration.</list-item></list><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HAFF30BF1E1CF4FFD8A464876864233E7"><enum>4.</enum><header>Advisory Board</header><subsection id="HC08E24878CAF43E1B503F5E4C08FC273"><enum>(a)</enum><header>Appointment and terms</header><text display-inline="yes-display-inline">Section 192 (<external-xref legal-doc="usc" parsable-cite="usc/42/12651a">42 U.S.C. 12651a</external-xref>) is amended—</text><paragraph id="H827A69BCD40C4092A7A4833D5B931BE9"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="H7B677751C00A464DA87F09A2DB925F50"><enum>(A)</enum><text>by striking paragraph (1) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HE13974C50B37483FB5026268C61FA8DC"><paragraph id="H1BA710C9EDAE4EB2A06ECB16FDCFE443"><enum>(1)</enum><header>Advisory Board</header><subparagraph id="H33218E7A38834384930B9B0AE9FC8061"><enum>(A)</enum><header>Initial board members</header><clause id="H64B4E7C02949415A8B5DF564E0B02E4D"><enum>(i)</enum><header>Board of Directors members electing to serve</header><text>There shall be in the Administration an Advisory Board initially composed of the voting members of the Board of Directors of the Corporation for National and Community Service (as in existence the day before the date of enactment of the <short-title>ACTION for National Service Act</short-title>) who elect to serve on the Advisory Board.</text></clause><clause id="H11A044105CE54696B71C090DD96AD107"><enum>(ii)</enum><header>Appointed initial members</header><text>If fewer than seven members of the Board of Directors elect to serve, the Administrator shall appoint additional members to achieve a total of seven members of the Advisory Board, to serve for the term of their predecessors. For purposes of this section, members appointed under this clause shall be treated as if they had been voting members described in clause (i).</text></clause><clause id="H19624FE1AF884BB18548FB90B1A4B74D"><enum>(iii)</enum><header>Board of seven members</header><text>After the expiration of the terms of the members described in clauses (i) and (ii), and the seven appointments set forth in subparagraph (B), the Advisory Board shall be composed of seven members.</text></clause></subparagraph><subparagraph id="H95F19E8067E642959876303197AB0DA6"><enum>(B)</enum><header>Appointment of replacement members</header><text>Upon the expiration of the term of any of the first seven members of the Advisory Board whose term shall expire, a new member of the Advisory Board shall be appointed as follows:</text><clause id="HD5A941160C4C492B8B3FFF0034F46684"><enum>(i)</enum><text display-inline="yes-display-inline">The first three members shall be appointed by the President, and shall include—</text><subclause id="HE4FE58095B0E40CE9CD0A21C9B66C536"><enum>(I)</enum><text display-inline="yes-display-inline">an individual not younger than 18 or older than 25 who—</text><item display-inline="no-display-inline" id="H9F40BC02329347DA93C19DA8DF227FD2"><enum>(aa)</enum><text>has served in a school-based or community-based service-learning program; or</text></item><item id="HB1418676025443FA96A409B1D2B23D2C"><enum>(bb)</enum><text>is or was a participant or a supervisor in a program; and</text></item></subclause><subclause id="H5022E99730044C88A4BE27D11DB61665"><enum>(II)</enum><text>an individual who—</text><item id="HB1A34C99A77D4B66A8283A014C3F3844"><enum>(aa)</enum><text>is age 55 or older; and</text></item><item id="H8D0B0E32022B4A66AF5938681E9F9596"><enum>(bb)</enum><text>has served in the National Senior Service Corps, in a program carried out under title II of the Domestic Volunteer Service Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/42/5000">42 U.S.C. 5000 et seq.</external-xref>) or served in a service-based or community-based program under subtitle B of title I.</text></item></subclause></clause><clause id="H58D530EB3BC14044A97B28FD9A0DBD47"><enum>(ii)</enum><text display-inline="yes-display-inline">The next member shall be appointed by the Speaker of the House of Representatives.</text></clause><clause id="H97DE94785A0345BCA877B4BDB1453B85"><enum>(iii)</enum><text display-inline="yes-display-inline">The next member shall be appointed by the minority leader of the House of Representatives.</text></clause><clause id="H2F7A8589DB044112BA6F3BC452757A67"><enum>(iv)</enum><text display-inline="yes-display-inline">The next member shall be appointed by the majority leader of the Senate.</text></clause><clause id="HE64BC77447414FEA8146FA56E7BCA6E7"><enum>(v)</enum><text display-inline="yes-display-inline">The next member shall be appointed by the minority leader of the Senate.</text></clause></subparagraph><subparagraph id="H27FCD7831BB24F69BD90401798961CB4"><enum>(C)</enum><header>Expiration of the term of remaining initial members</header><text display-inline="yes-display-inline">Upon the expiration of the terms on the Advisory Board of the remaining members (after the first seven) who served on the Board of Directors of the Corporation for National and Community Service (as in effect the day before the date of enactment of the <short-title>ACTION for National Service Act</short-title>), no new members shall be appointed to replace those remaining members.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H22A5497EE784433EBD0951700EEF318B"><enum>(B)</enum><text>in paragraph (2)(D), by striking <quote>the Board</quote> and inserting <quote>the Advisory Board (referred to in this subtitle as the <quote>Board</quote>)</quote>; and</text></subparagraph></paragraph><paragraph id="H2B69DE376DA842C9A81AD1CB3E9C2D85"><enum>(2)</enum><text>by striking subsections (c), (d), and (e) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H425BAA3F9BE64262BB265E3765AD2BC2"><subsection id="HEF01C59B85FF447DA81972450BD08326"><enum>(c)</enum><header>Terms</header><text display-inline="yes-display-inline">Members appointed in accordance with any of clauses (i) through (v) of subsection (a)(1)(B) or under subsection (d) shall serve for a term of 5 years.</text></subsection><subsection id="HC7F8F92233B94FC38C1AE71BC26BD7E5"><enum>(d)</enum><header>Appointment of new members and vacancies</header><text display-inline="yes-display-inline">When the term of a member appointed in accordance with any of clauses (i) through (v) of subsection (a)(1)(B) expires, or if a vacancy occurs on the Advisory Board, a new member shall be appointed by the appointing individual and in the manner described in that clause, and, in the case of a vacancy, shall serve for the remainder of the term for which the predecessor of such member was appointed. The vacancy shall not affect the power of the remaining members to execute the duties of the Board.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H6AD426CF26FC44E7BDA3F2C98E4EF679"><enum>(b)</enum><header>Meetings and duties</header><text display-inline="yes-display-inline">Section 192A (<external-xref legal-doc="usc" parsable-cite="usc/42/12651b">42 U.S.C. 12651b</external-xref>) is amended—</text><paragraph id="HB7345390B5E5449B825A5CD3A41A0632"><enum>(1)</enum><text>in subsection (a), by striking <quote>3 times each year</quote> and inserting <quote>four times each year, with one of the four meetings being an annual meeting to review the Administration’s long-term and strategic goals,</quote>; and</text></paragraph><paragraph id="H1F7E10C9C28143A7BC3B2C92F8D44AB3"><enum>(2)</enum><text>by striking subsections (e), (f), and (g) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HEEFDC2283401478F9252CE4B52E5948D"><subsection id="HDDC17F59D87441408089BC8BFA2EB21C"><enum>(e)</enum><header>Advisory duties</header><text>The Board shall have responsibility for making recommendations to the Director concerning the programs and activities of the Administration and the overall policy for the Administration and shall—</text><paragraph id="H6A1BC6C157504B7BA350E652B5D09F47"><enum>(1)</enum><text display-inline="yes-display-inline">advise the Director with respect to policies, programs, and procedures for carrying out the Director’s functions, duties, or responsibilities under this Act;</text></paragraph><paragraph id="HEC16B990B24B42A88FB70DAAB07F81D6"><enum>(2)</enum><text>advise the Director on establishing requirements and criteria for qualifying service programs, and on monitoring and evaluating the performance of personnel in carrying out programs and activities;</text></paragraph><paragraph id="H96C68CC6B61B4245A1EC4104C577FF36"><enum>(3)</enum><text display-inline="yes-display-inline">make recommendations regarding priorities for the applications for service programs submitted for approval under this Act;</text></paragraph><paragraph id="H24091FF8A97648ECBA15BAF01FF767D5"><enum>(4)</enum><text>review and make recommendations to the Director—</text><subparagraph id="H9D2C2B9A3B7F41EB9379FA94A667BC14"><enum>(A)</enum><text>with respect to any grants, allotments, contracts, financial assistance, or other payment of the Administration; and</text></subparagraph><subparagraph id="HB2585AF5DAA0484AA6712364A0BBB03F"><enum>(B)</enum><text>regarding the regulations, standards, policies, procedures, programs, and initiatives of the Administration;</text></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H2EE2E28B818B47B5BC36BB2D7BA541A5"><enum>(5)</enum><text display-inline="yes-display-inline">review, and advise the Director regarding, the actions of the Director with respect to the personnel of the Administration, and with respect to such standards, policies, procedures, programs, and initiatives as are necessary or appropriate to carry out the programs and activities of the Administration, including those carried out under the national service laws on the day before the date of enactment of the <short-title>ACTION for National Service Act</short-title>;</text></paragraph><paragraph id="H9138140EA83E429186F40FBF1C3E057F"><enum>(6)</enum><text>make recommendations relating to a program of research for the Administration with respect to national and community service programs;</text></paragraph><paragraph id="HB6D1518F50494C74800A7C53B7955685"><enum>(7)</enum><text>ensure effective dissemination of information regarding the programs and activities of the Administration;</text></paragraph><paragraph id="H2CB79E62A54747CEA5DA70E0DCE50CBE"><enum>(8)</enum><text>prepare and make recommendations to the Director and the appropriate committees of Congress for changes in the national service laws resulting from the studies and demonstrations conducted by the Administration, which recommendations shall be submitted to the Director and the appropriate committees of Congress not later than January 1 of each year;</text></paragraph><paragraph id="H240812E190E947CFB877DF0B35F9F082"><enum>(9)</enum><text>make recommendations to the Director on candidates to serve on the Board of the National Service Foundation described in section 199P; and</text></paragraph><paragraph id="HFCD96872EF0843DEB0127245EF0DB516"><enum>(10)</enum><text>advise on such other matters as the Director may request.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="H8A3BF05440DC42249569EDA81E1E192E"><enum>5.</enum><header>Director</header><subsection id="H906A8B21DD254D92884435E07D5B11A4"><enum>(a)</enum><header>Appointment</header><text>Section 193(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/12651c">42 U.S.C. 12651c</external-xref>) is amended—</text><paragraph id="H473F7F15A5E945238C64034C8010F896"><enum>(1)</enum><text>by striking <quote>an individual who shall serve as Chief Executive Officer of the Corporation, and</quote> and inserting <quote>a Director,</quote>; and</text></paragraph><paragraph commented="no" id="H47EECCBF9EA74E898A8297B3DF0596A8"><enum>(2)</enum><text>by adding at the end the following: <quote>and who shall hold the same rank and status as the head of an executive department listed in section 101 of title 5, United States Code.</quote>.</text></paragraph></subsection><subsection commented="no" id="H0395E2F83F7B474ABB9AA94C4F7C41F4"><enum>(b)</enum><header>Duties</header><text>Section 193A(b) (<external-xref legal-doc="usc" parsable-cite="usc/42/12651d">42 U.S.C. 12651d(b)</external-xref>) is amended—</text><paragraph commented="no" id="HE33A4D1C9AF641AA8E6DCD0B969271C4"><enum>(1)</enum><text>in paragraph (24), by striking <quote>and</quote> at the end;</text></paragraph><paragraph commented="no" id="H40CBEEEF8530427CB57510C46BEBB58A"><enum>(2)</enum><text>in paragraph (25), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph commented="no" id="HB8CB6B56B36944DFBD5ACACA5BBC5F0D"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H82B009F7A90C454B8EA487724B9809C5"><paragraph commented="no" id="HA0902D26ADC94A589146ED28BC992571"><enum>(26)</enum><text>notwithstanding any other provision of law—</text><subparagraph commented="no" id="HA47B16F80DE846AA8870C9F6D68B7513"><enum>(A)</enum><text>make grants to or contracts with Federal and other public departments or agencies, and private nonprofit organizations, for the assignment or referral of volunteers under the provisions of title I of the Domestic Volunteer Service Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/42/4951">42 U.S.C. 4951 et seq.</external-xref>) (except as provided in section 108 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4958">42 U.S.C. 4958</external-xref>)), which may provide that the agency or organization shall pay all or a part of the costs of the program; and</text></subparagraph><subparagraph commented="no" id="H2254B197CF8D40B986BDDCDF645E90C5"><enum>(B)</enum><text>enter into agreements with other Federal agencies or private nonprofit organizations for the support of programs under the national service laws, which—</text><clause commented="no" id="H2A5F446819DA460998C6C84291B949E3"><enum>(i)</enum><text>may provide that the agency or organization shall pay all or a part of the costs of the program, except as is provided in section 121(b); and</text></clause><clause commented="no" id="H38500CE8C4BC4C18A4EC2E775E581918"><enum>(ii)</enum><text>shall provide that the program (including any program operated by another Federal agency) will comply with all requirements related to evaluation, performance, and other goals applicable to similar programs under the national service laws, as determined by the Administration.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H12E64B95EAFA457CB83BAD10B93F3F6E"><enum>(c)</enum><header>Initial Director</header><text display-inline="yes-display-inline">The Chief Executive Officer of the Corporation for National and Community Service (as in existence the day before the date of enactment of this Act) may serve as the initial Director of the AmeriCorps Administration.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id90750ef8c7044ea389d926d7872997b0"><enum>(d)</enum><header>Conforming amendment</header><text>Section 19(d)(1) of title 3, United States Code, is amended by inserting <quote>, Director of the AmeriCorps Administration</quote> after <quote>Secretary of Homeland Security</quote>.</text></subsection></section><section commented="no" id="HEEB4AD3E058346B1A1607889F6F4A05A"><enum>6.</enum><header>National service educational awards</header><text display-inline="no-display-inline">Section 147(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/12603">42 U.S.C. 12603(a)</external-xref>) is amended—</text><paragraph commented="no" id="H5B9775ADCD304C5E9FAFBA2049CDD48F"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>Except as provided</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H70CB0D0F449C4FF999236CE7A522644A"><paragraph commented="no" id="H5BD90B632C57406E898C1C952FEBDEA0"><enum>(1)</enum><header>In general</header><text>Except as provided</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="H953571D221E74E05B331FCF958038A20"><enum>(2)</enum><text>by striking <quote>shall receive a national service educational award</quote> and all that follows through <quote>appropriations)</quote> and inserting <quote>shall be entitled to a national service educational award equal to the award amount specified in paragraph (2)</quote>; and</text></paragraph><paragraph commented="no" id="HF518302460F648B08D141D8D7549BE1B"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HFF81400A3BB5441E84B69FD765E1CFAA"><paragraph commented="no" id="H01375F59A8664C02ADCDB73E6F760A0A"><enum>(2)</enum><header>Award amount</header><text>The award referred to in paragraph (1), payable to an individual described in such paragraph, shall be in an amount that is equal to twice the amount of the national average of the yearly cost for in-State tuition and fees at public, 4-year institutions of higher education, for the award year for which the national service position is approved by the Administration.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA32549349DAB4F688460FF068FF683C8"><enum>(3)</enum><header>Definition</header><text>In this subsection, the term <term>institution of higher education</term> has the meaning given the term in section 148(h).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section commented="no" id="HF28557733D7A483983AC5494662B3062"><enum>7.</enum><header>Interagency working group</header><text display-inline="no-display-inline">The Director of the AmeriCorps Administration, using funds made available under section 501(a)(5) of the National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12681">42 U.S.C. 12681(a)(5)</external-xref>), shall establish an interagency working group to—</text><paragraph commented="no" id="HF20381E4AD35494C88C91D9432E9D947"><enum>(1)</enum><text>evaluate and make recommendations regarding a process for evaluating the eligibility, for national service educational awards, of individuals who have participated in national service programs that are not administered under this Act but are described in section 123(2) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12573">42 U.S.C. 12573(2)</external-xref>);</text></paragraph><paragraph commented="no" id="H2CEEDC9624BD4AFE8E3CA2EB1A49CA71"><enum>(2)</enum><text display-inline="yes-display-inline">evaluate the feasibility and advisability of granting Federal hiring preference under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/33">chapter 33</external-xref> of title 5, United States Code, to an individual who has completed a term of service in an approved national service position equivalent in duration to the term described in section 139(b)(1) and is entitled to the award authorized under section 147(a)(2) of that Act (as amended by section 6 of this Act) for that service; and</text></paragraph><paragraph commented="no" id="H376749D0934A4D5291A3D9C16BDD8A0B"><enum>(3)</enum><text display-inline="yes-display-inline">not later than 12 months after the date of enactment of this Act, prepare and submit to Congress a report containing the results of the evaluations described in paragraphs (1) and (2).</text></paragraph></section><section id="H746110E19B8A4CA98B056821379E51F3"><enum>8.</enum><header>National Service Foundation</header><subsection id="H3DB19792482E43E7B8EB2EAEDF28A21E"><enum>(a)</enum><header>Elimination of current authority for donations of property</header><text display-inline="yes-display-inline">Section 196(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/12651g">42 U.S.C. 12651g(a)</external-xref>) is amended—</text><paragraph id="HA09740BEB1ED41ADB1157E58ED5F5285"><enum>(1)</enum><text display-inline="yes-display-inline">by striking paragraph (2);</text></paragraph><paragraph id="HDB4D232589FF4EE6A20258981621191D"><enum>(2)</enum><text>by redesignating clause (iii) of paragraph (1)(C) as paragraph (2); and</text></paragraph><paragraph id="HD7EB030BA17F4A4CABAC3505F16224D6"><enum>(3)</enum><text>in paragraph (2), as redesignated by paragraph (2) of this subsection, by striking all that precedes <quote>this term</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H99D08C27333D49A2847D7A53E282BECE"><paragraph id="H1011FB58323E4F39A558D252595A6985"><enum>(2)</enum><header>Inherently governmental function</header><text>As used in this subsection,</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H78923FD758CB4CD789546D36B25D6B2E"><enum>(b)</enum><header>Foundation</header><text display-inline="yes-display-inline">Title I (<external-xref legal-doc="usc" parsable-cite="usc/42/12511">42 U.S.C. 12511 et seq.</external-xref>) is further amended by adding at the end the following new subtitle:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H54A611E0C060497489752A272AD8A402"><subtitle id="H3B01DE64C21C40D99D9D18D04CEC6504"><enum>K</enum><header>National Service Foundation</header><section id="HB24FA8D895D843B98F1B5FEB8951EB7A"><enum>199P.<?LEXA-Enum 199P.?></enum><header>National Service Foundation</header><subsection id="HC24A49447AFF4EAEBDBCDE26D1FCEE00"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">In order to encourage private gifts of real and personal property or any income from that property or other interest in that property for the benefit of, or in connection with, the Administration, and its activities, services, or former participants, and through those gifts to further the mission and purpose of the Administration and to provide greater opportunities for volunteer service, there is established a charitable and nonprofit corporation to be known as the National Service Foundation (referred to in this subtitle as the <quote>Foundation</quote>) to accept and administer such gifts.</text></subsection><subsection id="H32DCCAC1F95F4F0E9CF4E5E01383C3DA"><enum>(b)</enum><header>Board of the Foundation</header><paragraph id="H1F3E1923180C4DD2B116C6DC969557CE"><enum>(1)</enum><header>In general</header><text>The National Service Foundation shall consist of a Board of the Foundation, having as members the Director of the Administration, as an ex officio, nonvoting member, and not less than 6 individuals, who are not officers or employees of the Federal Government, appointed by the Director after considering the recommendations of the Advisory Board described in section 192.</text></paragraph><paragraph id="HB55FEFCB87954151ABB6A6A7B7CCFDD5"><enum>(2)</enum><header>Terms</header><subparagraph id="H35DC0240C32C4FCB9C998B4063F72904"><enum>(A)</enum><header>Initial members</header><text>The terms of the initial members of the Board of the Foundation shall be staggered to assure continuity of administration.</text></subparagraph><subparagraph id="H5AB5EF52FB1142E8B0AFDA0A0CE710ED"><enum>(B)</enum><header>Subsequent members</header><text>A subsequent member shall serve for a term of 6 years.</text></subparagraph><subparagraph id="HA3BEDCFA29004AF595D34464CEA7006A"><enum>(C)</enum><header>Vacancies</header><text>If a vacancy occurs on the Board of the Foundation, a new member shall be appointed by the Director and serve for the remainder of the term for which the predecessor of such member was appointed. The vacancy shall not affect the power of the remaining members to execute the duties of the Board of the Foundation.</text></subparagraph></paragraph><paragraph id="HAD6EC88DC1D54F82B6B81C3DA75D9DF7"><enum>(3)</enum><header>Chairman</header><text>The Director shall be the Chairman of the Board of the Foundation.</text></paragraph><paragraph id="H599860CD6DED43F0AF05D3787EC68B0D"><enum>(4)</enum><header>Status</header><text>Members and staff of the Board of the Foundation shall not be considered to be officers or employees of the Federal Government.</text></paragraph><paragraph id="HC9EECCDB2488408B93F4CA96D2ADFD65"><enum>(5)</enum><header>Quorum</header><text>A majority of the members of the Board of the Foundation serving at any one time shall constitute a quorum for the transaction of business, and the Foundation shall have an official seal, which shall be judicially noticed.</text></paragraph><paragraph id="HF79B174C415D49A0933DA1FB332727F9"><enum>(6)</enum><header>Meetings</header><text>The Board of the Foundation shall meet at the call of the Chairman, and not less often than once each year.</text></paragraph><paragraph id="HC9723575091B49A4B48FC48A75569BF9"><enum>(7)</enum><header>Compensation and travel expenses</header><subparagraph id="HD8FEC5B61C52493AA518D46051361192"><enum>(A)</enum><header>Compensation</header><text display-inline="yes-display-inline">A member of the Board of the Foundation shall serve without compensation. Notwithstanding section 1342 of title 31, United States Code, the Board may accept and use voluntary and uncompensated services as the Commission determines necessary.</text></subparagraph><subparagraph id="HDBCBA4C0D47041C5AC2A2FB81E97BFFA"><enum>(B)</enum><header>Travel expenses</header><text display-inline="yes-display-inline">A member of the Board shall be allowed travel expenses (out of Foundation funds), including per diem in lieu of subsistence, at rates authorized for employees of agencies under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code, while away from the member's home or regular places of business in the performance of services for the Board.</text></subparagraph></paragraph></subsection><subsection id="HA7559B53CF4A439585541329CB6A7E29"><enum>(c)</enum><header>Authorization To accept and use gifts and bequests</header><text display-inline="yes-display-inline">The Foundation is authorized to accept, receive, solicit, hold, administer, and use any gifts, devises, or bequests, either absolutely or in trust of real or personal property or any income from the property or other interest in the property for the benefit of or in connection with, the Administration, its activities, or its services. The Foundation may not accept any such gift, devise, or bequest that entails any expenditure other than from the resources of the Foundation. An interest in such real property includes, among other things, easements or other rights for preservation, conservation, protection, or enhancement by and for the public of natural, scenic, historic, scientific, educational, inspirational, or recreational resources. A gift, devise, or bequest relating to property may be accepted by the Foundation even though the property is encumbered, restricted, or subject to beneficial interests of private persons, if any current or future interest in the property is for the benefit of the Administration, its activities, or its services.</text></subsection><subsection id="HB71D1921792F418BB7E581211F0338A9"><enum>(d)</enum><header>Use of funds, investment</header><paragraph id="H6DE7830C11774ECEB4EE2D567544727F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as otherwise required by the instrument of transfer to the Foundation, the Foundation may sell, lease, invest, reinvest, retain, or otherwise dispose of or deal with any property transferred to the Foundation or income from the property as the Board of the Foundation may from time to time determine to be appropriate. The Foundation shall not engage in any business, nor shall the Foundation make any investment, that may not lawfully be engaged in or made by a trust company in the District of Columbia, except that the Foundation may make any investment authorized by the instrument of transfer, and may retain any property accepted by the Foundation.</text></paragraph><paragraph id="HB6D113312775418BB5C988F9FAEC52FA"><enum>(2)</enum><header>Services and facilities</header><text display-inline="yes-display-inline">The Foundation may utilize the services and facilities of the Administration, and such services and facilities may be made available on request to the extent practicable without reimbursement.</text></paragraph></subsection><subsection id="HB5EEDDF15FD84A0891C77BF339CB3CA4"><enum>(e)</enum><header>Succession, liability, and powers</header><paragraph id="HFA3A0B6641A64391B5C1103E7CDCE530"><enum>(1)</enum><header>Succession</header><text display-inline="yes-display-inline">The Foundation shall have perpetual succession, with all the usual powers and obligations of a corporation acting as a trustee, including the power to sue and to be sued in its own name.</text></paragraph><paragraph id="H74AFB345CB404E5EBCC77621FE5C6E04"><enum>(2)</enum><header>Liability</header><text display-inline="yes-display-inline">Notwithstanding paragraph (1), the members of the Board of the Foundation shall not be personally liable for acts or omissions related to the Foundation, except for malfeasance.</text></paragraph><paragraph id="HAC2A005A4DB140BDB39816FEFC6B9FA8"><enum>(3)</enum><header>Powers</header><text display-inline="yes-display-inline">The Foundation shall have the power to enter into contracts, to execute instruments, and generally to do any and all lawful acts necessary or appropriate to its purposes.</text></paragraph></subsection><subsection id="H255F3C4574A34CD3ACF47FABA120023F"><enum>(f)</enum><header>Bylaws</header><text display-inline="yes-display-inline">In carrying out the provisions of this Act, the Board of the Foundation may adopt bylaws, rules, and regulations necessary for the administration of its functions and enter into contracts for any necessary services.</text></subsection><subsection id="H3723E1E3B76249A8B51490521E8A2A56"><enum>(g)</enum><header>Tax exempt status</header><paragraph id="H6A6EFD4E9B88437A9590046976F58360"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Foundation and any income or property received or owned by it, and all transactions relating to such income or property, shall be exempt from all Federal, State, and local taxation.</text></paragraph><paragraph id="H42F743EE4CA04F148A0E4091322738F5"><enum>(2)</enum><header>Contributions to local government</header><text display-inline="yes-display-inline">The Foundation may, however, in the discretion of the Board of the Foundation—</text><subparagraph id="H1E452961E4F34D5CACA3B49D701034E4"><enum>(A)</enum><text display-inline="yes-display-inline">contribute toward the costs of local government in amounts not in excess of those costs that it would be obligated to pay such government if it were not exempt from taxation because of this subsection or because of its status as a charitable and nonprofit corporation; and</text></subparagraph><subparagraph id="HD22D4A8EAC5D403C8EEAB735EA6BB78A"><enum>(B)</enum><text display-inline="yes-display-inline">agree to so contribute property transferred to the Foundation and the income derived from the property if such agreement is a condition of the transfer.</text></subparagraph></paragraph><paragraph id="H4EFA52194CA6453DA8FACD45E20BF755"><enum>(3)</enum><header>Use of the United States</header><text display-inline="yes-display-inline">Contributions, gifts, and other transfers made to or for the use of the Foundation shall be regarded as contributions, gifts, or transfers to or for the use of the United States.</text></paragraph></subsection><subsection id="H06FC112CB336421CB928AEAEA2762016"> <enum>(h)</enum> <header>Nonliability of the United States</header> <text display-inline="yes-display-inline">The United States shall not be liable for any debts, defaults, acts, or omissions of the Foundation.</text>
 </subsection><subsection id="H454C98FD4D6848A79A1F7D1373364766"><enum>(i)</enum><header>Reports</header><text display-inline="yes-display-inline">The Foundation shall, as soon as practicable after the end of each fiscal year, prepare and submit to Congress an annual report on its proceedings and activities, including a full and complete statement of its receipts, expenditures, and investments.</text></subsection><subsection id="H38FAB6AB244F450D98B91FE04A5B92D5"><enum>(j)</enum><header>Initial Funding</header><text display-inline="yes-display-inline">For the purposes of assisting the Foundation in establishing an office and meeting initial administrative, project, and other startup expenses, there is authorized to be appropriated $2,500,000 for fiscal year 2027. Such funds shall remain available to the Foundation until they are expended for authorized purposes.</text></subsection></section></subtitle><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HAC3647E32E8E4B1DB4F4936A37C90E30"><enum>9.</enum><header>21st Century American service outreach program</header><text display-inline="no-display-inline">Subtitle F of title I (<external-xref legal-doc="usc" parsable-cite="usc/42/12631">42 U.S.C. 12631 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H30B02AA69A084EA9926C18F403AA733C"><section id="H3E7C8F452AB841CB88EAEE280D69C05B"><enum>189E.</enum><header>21st Century American service outreach program</header><subsection id="HCB1080618A4C48048954326C6E2C2435"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HA088A7FBEA174C97822437F0EEC4C6D4"><enum>(1)</enum><header>Covered individual</header><text>The term <term>covered individual</term> means an individual who is not younger than age 17 or older than age 30.</text></paragraph><paragraph id="H3989663EA32A4AC589637A826B512999"><enum>(2)</enum><header>National service program</header><text>The term <term>national service program</term> means a program under—</text><subparagraph id="HCA66FE299B974EF598742D9A45D5BBF8"><enum>(A)</enum><text>this Act; or</text></subparagraph><subparagraph id="HCA56E1E200944D679097A36AA465B869"><enum>(B)</enum><text>title I of the Domestic Volunteer Service Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/42/4951">42 U.S.C. 4951 et seq.</external-xref>).</text></subparagraph></paragraph></subsection><subsection id="H34F97E037A8E48CFB2FFD99A988B8DB0"><enum>(b)</enum><header>Program</header><text>In order to ensure that every covered individual who may want to participate in service programs is informed of the opportunities to participate, the Administration shall—</text><paragraph id="H8717C704537742CC803F19696AEB5EE6"><enum>(1)</enum><text>determine how the Administration will work with Federal or State agencies and other entities to—</text><subparagraph id="HB6704B8E3B7C4B3ABBA3BD39231D1878"><enum>(A)</enum><text>contact each covered individual upon such individual's 17th birthday to notify the individual about—</text><clause id="HA7F5C55978D0430FBE78AC4862D73434"><enum>(i)</enum><text>the individual's eligibility to participate in national service programs;</text></clause><clause id="HEB53204C60424F99BD771B5EC77B1A7F"><enum>(ii)</enum><text>the national service programs and how to apply for a specific program;</text></clause><clause id="HFB05AAE0F9984099B5B60C474A52E33E"><enum>(iii)</enum><text>other service programs for which the individual may be eligible, including service with the Peace Corps (as established by the Peace Corps Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2501">22 U.S.C. 2501 et seq.</external-xref>)) and military service; and</text></clause><clause id="H44C9950A9D2B4E03827F6A83EA6487C7"><enum>(iv)</enum><text>the individual's option to opt out of receiving any notifications, or just notifications in a paper format, under this paragraph; and</text></clause></subparagraph><subparagraph id="H27796BD7A03A4B898EDEA47C1D8A7384"><enum>(B)</enum><text>after contacting a covered individual under subparagraph (A), notify the individual every 2 years thereafter of the information described in clauses (i) through (iv) of subparagraph (A), unless—</text><clause id="H0F02172E37A44435AC32B8AD92BF6235"><enum>(i)</enum><text>the individual is serving in a national service program or other program described in subparagraph (A); or</text></clause><clause id="HB2049E616E5949BC9F1F5825DE229969"><enum>(ii)</enum><text>the individual has opted out of receiving such notifications under subparagraph (A)(iv);</text></clause></subparagraph></paragraph><paragraph id="HA794565CDF9845E7AA94DCFA851EAD4B"><enum>(2)</enum><text>determine how the Administration will enable covered individuals to, and then enable eligible individuals to, apply for a specific national service program and ensure that such application process is the most effective process for the purpose of applying for such a program; and</text></paragraph><paragraph id="H13344BF18249499B95203929234F16AF"><enum>(3)</enum><text>develop a long-term strategy to gradually increase the number of opportunities in national service programs so that any covered individual who applies to and is eligible to participate in a national service program will be offered at least one service position.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H5F06097824D84977B777659F81345933"><enum>10.</enum><header>Living allowance amounts</header><subsection id="H4B06B39A454B41B7AF2D6F75BE3FA05A"><enum>(a)</enum><header>Domestic Volunteer Service Act of 1973</header><text display-inline="yes-display-inline">Section 105(b) of the Domestic Volunteer Service Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/42/4955">42 U.S.C. 4955(b)(2)</external-xref>) is amended—</text><paragraph id="HD62D86C3A0BB4E989702147F43E3C0BC"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2)—</text><subparagraph id="HBC9B0DD8E83F46D08E36F227DC26CD18"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>95 percent</quote> and inserting <quote>175 percent</quote>; and</text></subparagraph><subparagraph id="H1A25E7EC4B6844ADA3A70323CF435E2B"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking <quote>105 percent</quote> and inserting <quote>210 percent</quote>; and</text></subparagraph></paragraph><paragraph id="HD5F07C86F844481D9B2AAB89E9EA5C9C"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H1C886AA47975476D8DF6CDAFF6494BDA"><paragraph id="H143A0ECFDE44480986DB424ED4DE1A6A" indent="up1"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H5F3E926DD74C4ECA9167A87BF83A2B62"><enum>(A)</enum><text>A stipend or allowance under this subsection shall not be increased as a result of amendments made by the <short-title>ACTION for National Service Act</short-title>, or any other amendment made to this subsection unless the funds appropriated for carrying out this part are sufficient to maintain for the fiscal year in question a number of participants to serve under this part at least equal to the number of such participants serving during the preceding fiscal year.</text></subparagraph><subparagraph id="H844A74D3856D43989FBDA1AA1E36C6B2" indent="up1"><enum>(B)</enum><text>In the event that sufficient appropriations for any fiscal year are not available to increase any such stipend or allowance provided to the minimum amount specified in paragraph (2), the Director shall increase the stipend or allowance to such amount as appropriations for such year permit consistent with subparagraph (A).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HE373F732053C4402B87DA78EE02B4C23"><enum>(b)</enum><header>National and Community Service Act of 1990</header><paragraph commented="no" id="HA67553F049BF488F863D56702406FD51"><enum>(1)</enum><header>National Civilian Community Corps living allowances</header><text>Section 158(b) (<external-xref legal-doc="usc" parsable-cite="usc/42/12618">42 U.S.C. 12618(b)</external-xref>) is amended—</text><subparagraph commented="no" id="H97C2097EB7C844BDB9079F5BE986CE4B"><enum>(A)</enum><text>by striking <quote>The Director</quote> the first place it appears and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H150B7AC1431142298791F1B6BD152240"><paragraph commented="no" id="H0CD7C5514E3D49599388A556D0E290FE"><enum>(1)</enum><header>In general</header><text>The Director</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" id="H51007C39940445839C406AD980B25634"><enum>(B)</enum><text>by striking <quote>100 percent</quote> and inserting <quote>200 percent</quote>; and</text></clause><clause id="H4AF5BF19E05F4A1E8BF5A96142A5DF65"><enum>(ii)</enum><text>increase the number of the approved positions in each fiscal year through fiscal year 2035, so that the number of approved positions in fiscal year 2036 is sufficient to support the goal in paragraph (2);</text></clause></subparagraph><subparagraph id="HDEAD724357AE48CFB6CC1F171F7373E8"><enum>(B)</enum><text>ensure that the increases described in subparagraph (A)(ii) are achieved through an appropriate balance of full- and part-time service positions;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H74F8011B35ED4307A13C53681068EDBA"><enum>(C)</enum><text>not later than 1 year after the date of enactment of the <short-title>ACTION for National Service Act</short-title>, submit a report to the authorizing committees on the status of the plan described in subparagraph (A);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5A41D1818668411C9CA4F3C2F6DB6B2D"><enum>(D)</enum><text>not later than 8 years after the date of enactment of the <short-title>ACTION for National Service Act</short-title>, submit a report to the authorizing committees on the progress of the Administration towards the goal described in paragraph (2), and the potential for exceeding that goal in fiscal year 2036 and beyond; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBE88E507EC974AE396008BA08920BB9F"><enum>(E)</enum><text>subject to the availability of appropriations and quality service opportunities, implement the plan described in subparagraph (A).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H0D398529FB6F470BA50B04D167BC4170"><enum>12.</enum><header>Report on matching requirements</header><text display-inline="no-display-inline">Not later than 90 days after the date of enactment of this Act, the Director of the AmeriCorps Administration shall submit to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Education and Workforce of the House of Representatives a report on any recommendations for changes needed to matching funds or share requirements for recipients of funding for programs under the AmeriCorps Administration to achieve the 10-year goal described in section 501(b)(2) of the National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12681">42 U.S.C. 12681(b)(2)</external-xref>) and increase the number of national service programs, activities, and participants, in underserved communities.</text></section><section id="H4B430C7FB5FA48E58C387CD048A47148"> <enum>13.</enum> <header>Exclusion from gross income of national service educational awards</header> <subsection id="HF6EDD3EB361146DFAE92C7D1DF1A4CF4"> <enum>(a)</enum> <header>In general</header> <text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/117">Section 117</external-xref> of the Internal Revenue Code of 1986 (relating to qualified scholarships) is amended by adding at the end the following new subsection:</text>
