which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of the Treasury to mint and issue coins that are emblematic of the National Fallen Firefighters Memorial and the service and sacrifice of firefighters throughout the history of the United States.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HF6A04B94BF504A53B3AB0096AA09FD22"><section section-type="section-one" id="H44C586CE4B78465A8D57AD60BE34FD17"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Fallen Firefighters Memorial Coin Act</short-title></quote>.</text></section><section id="HF1441EC1DCD34E87BE6307151BEB4597"><enum>2.</enum><header>Coin specifications</header><subsection id="H4C0E106E0DD5480690AEA10BC9670067"><enum>(a)</enum><header>Denominations</header><text>The Secretary of the Treasury (hereafter in this Act referred to as the <quote>Secretary</quote>) shall mint and issue the following coins:</text><paragraph id="HE5B40F68AFEA446F8816ED4D1BCF4E6C"><enum>(1)</enum><header>$5 gold coins</header><text>Not more than 50,000 $5 coins, which shall—</text><subparagraph id="HCD0146ED2B3F4BC4915940FD9862F089"><enum>(A)</enum><text>weigh 8.359 grams;</text></subparagraph><subparagraph id="H763533BA5CF540399BFFD96776EEB1D9"><enum>(B)</enum><text>have a diameter of 0.850 inches; and</text></subparagraph><subparagraph id="HB21711635B1046CCB08874691808AE5F"><enum>(C)</enum><text>contain not less than 90 percent gold.</text></subparagraph></paragraph><paragraph id="HB1ECD47C97CE47B3B462AFEC848C9E4A"><enum>(2)</enum><header>$1 silver coins</header><text>Not more than 400,000 $1 coins, which shall—</text><subparagraph id="H5E3DC4397D9D4B228C5AD35E26EA7153"><enum>(A)</enum><text>weigh 26.73 grams;</text></subparagraph><subparagraph id="H76C5EE31D5C143BAB8BE4291A2854C0D"><enum>(B)</enum><text>have a diameter of 1.500 inches; and</text></subparagraph><subparagraph id="H0DEE8F1689B3446387D9A5C3F967589C"><enum>(C)</enum><text>contain not less than 90 percent silver.</text></subparagraph></paragraph><paragraph id="H6B09E2FFBC3E499C81F90D0046EBD063"><enum>(3)</enum><header>Half-dollar clad coins</header><text>Not more than 750,000 half-dollar coins which shall—</text><subparagraph id="H750B40C79AC04C98B8AF5A61EA168CBE"><enum>(A)</enum><text>weigh 11.34 grams;</text></subparagraph><subparagraph id="HA8AA2AE1F8664BBDAF2475BDDBFC53AA"><enum>(B)</enum><text>have a diameter of 1.205 inches; and</text></subparagraph><subparagraph id="H1A396323CD53406396BE5EC474CA2E1D"><enum>(C)</enum><text>be minted to the specifications for half-dollar coins contained in section 5112(b) of title 31, United States Code.</text></subparagraph></paragraph></subsection><subsection id="H8043E3A752264DE4B4CA51A7D0EF4CBC"><enum>(b)</enum><header>Legal tender</header><text>The coins minted under this Act shall be legal tender, as provided in section 5103 of title 31, United States Code.</text></subsection><subsection id="HA2B2144C7C3C471985EB1B9034D509D3"><enum>(c)</enum><header>Numismatic items</header><text>For purposes of sections 5134 and 5136 of title 31, United States Code, all coins minted under this Act shall be considered to be numismatic items.</text></subsection></section><section id="H90EDD9855B9041A9BE6C2C5CDC2A12FE"><enum>3.</enum><header>Designs of coins</header><subsection id="H541E458E9E3D4D11A228DF0A248F54F8"><enum>(a)</enum><header>Design requirements</header><paragraph id="HE939E1BA36AB4453A96BD57C6DDBFFE8"><enum>(1)</enum><header>In general</header><text>The designs of the coins minted under this Act shall be emblematic of the National Fallen Firefighters Memorial and the service and sacrifice of firefighters throughout the history of the United States.</text></paragraph><paragraph id="H626173BE2FC546F2AA1A11D23C8D2C6A"><enum>(2)</enum><header>Designation and inscriptions</header><text>On each coin minted under this Act there shall be—</text><subparagraph id="H14C78319DFB049C8A54F5338C63B8FA9"><enum>(A)</enum><text>a designation of the value of the coin;</text></subparagraph><subparagraph id="H1FE7788E92C84C119E231630FA84D7B1"><enum>(B)</enum><text>an inscription of the year <quote>2029</quote>; and</text></subparagraph><subparagraph id="H380170E1777C42A39DE3E3FA800EA0CE"><enum>(C)</enum><text>inscriptions of the words <quote>Liberty</quote>, <quote>In God We Trust</quote>, <quote>United States of America</quote>, and <quote>E Pluribus Unum</quote>.</text></subparagraph></paragraph></subsection><subsection id="HB089137FB9AE41BC83F5CE3A1C07B52F"><enum>(b)</enum><header>Selection</header><text>The designs for the coins minted under this Act shall be—</text><paragraph id="H9F38E2648EBA40188EEEE7B6639C3F8F"><enum>(1)</enum><text>selected by the Secretary, after consultation with the Commission of Fine Arts and the National Fallen Firefighters Foundation; and</text></paragraph><paragraph id="H560E74D21B1642FF97E17E8107F0085A"><enum>(2)</enum><text>reviewed by the Citizens Coinage Advisory Committee.</text></paragraph></subsection></section><section id="HE8B33BF3E88C4F7599E38AF9D1B85D79"><enum>4.</enum><header>Issuance of coins</header><subsection id="H918CC5B33EDD4DE99CC0CF9248418706"><enum>(a)</enum><header>Quality of coins</header><text>Coins minted under this Act may be issued in uncirculated and proof qualities.</text></subsection><subsection id="H34E095F1460740B58234221D745E8FBE"><enum>(b)</enum><header>Period for issuance</header><text>The Secretary may issue coins minted under this Act only during the 1-year period beginning on January 1, 2029.</text></subsection></section><section id="H4615FF10E42848BEADC3F34EB5F49E9C"><enum>5.</enum><header>Sale of coins</header><subsection id="HBC279F368DCC407CAA97C892109429F8"><enum>(a)</enum><header>Sale price</header><text>The coins issued under this Act shall be sold by the Secretary at a price equal to the sum of—</text><paragraph id="HFE9E6C3262114547851768BE3AF2C2E3"><enum>(1)</enum><text>the face value of the coins;</text></paragraph><paragraph id="H657AD9D994184128B31FDA87EEEBCAED"><enum>(2)</enum><text>the surcharge provided in section 6(a) with respect to such coins; and</text></paragraph><paragraph id="HAB9FBA57FAED4F428A7F991548408D36"><enum>(3)</enum><text>the cost of designing and issuing the coins (including labor, materials, dies, use of machinery, overhead expenses, marketing, and shipping).</text></paragraph></subsection><subsection id="H42E37F5FAA98420A906083CCCB88BE84"><enum>(b)</enum><header>Bulk sales</header><text>The Secretary shall make bulk sales of the coins issued under this Act at a reasonable discount.</text></subsection><subsection id="HAD04581949FB4D2BBC7B5E0C727E0437"><enum>(c)</enum><header>Prepaid orders</header><paragraph id="HB7E794DF4E114FCE98885CF9261D0CFA"><enum>(1)</enum><header>In general</header><text>The Secretary shall accept prepaid orders for the coins minted under this Act before the issuance of such coins.</text></paragraph><paragraph id="H0CB80446BE88477D872F301B2CE450DA"><enum>(2)</enum><header>Discount</header><text>Sale prices with respect to prepaid orders under paragraph (1) shall be at a reasonable discount.</text></paragraph></subsection></section><section id="HAEB3B578F5B2483A8FBDAEF93A65C589"><enum>6.</enum><header>Surcharges</header><subsection id="H08C8D77571574B31B081114F9A446C4D"><enum>(a)</enum><header>In general</header><text>All sales of coins issued under this Act shall include a surcharge of—</text><paragraph id="H3EC144A669FA48C9BD744E26CC9C1753"><enum>(1)</enum><text>$35 per coin for the $5 coin;</text></paragraph><paragraph id="H79758A6D2E5C4E0DBB1DF493256F3BFD"><enum>(2)</enum><text>$10 per coin for the $1 coin; and</text></paragraph><paragraph id="HD0F808C5578B4E8EB62A6AF4FB0C80D1"><enum>(3)</enum><text>$5 per coin for the half-dollar coin.</text></paragraph></subsection><subsection id="H62A721B0ACF9427690433C3FF8C97998"><enum>(b)</enum><header>Distribution</header><text>Subject to section 5134(f) of title 31, United States Code, all surcharges received by the Secretary from the sale of coins issued under this Act shall be promptly paid by the Secretary to the National Fallen Firefighters Foundation to support the mission and programs of the Foundation.</text></subsection><subsection id="HAA225B17730A4645A84BBD970D9648EE"><enum>(c)</enum><header>Audits</header><text>The National Fallen Firefighters Foundation shall be subject to the audit requirements of section 5134(f)(2) of title 31, United States Code, with regard to the amounts received under subsection (b).</text></subsection><subsection id="H9E6D1D5DE9C646D69523451DA3AE03C6"><enum>(d)</enum><header>Limitation</header><text>Notwithstanding subsection (a), no surcharge may be included with respect to the issuance under this Act of any coin during a calendar year if, as of the time of such issuance, the issuance of such coin would result in the number of commemorative coin programs issued during such year to exceed the annual 2 commemorative coin program issuance limitation under section 5112(m)(1) of title 31, United States Code (as in effect on the date of the enactment of this Act). The Secretary may issue guidance to carry out this subsection.</text></subsection></section><section id="HE57D7F332650415AB417482E58373BED"><enum>7.</enum><header>Financial assurances</header><text display-inline="no-display-inline">The Secretary shall take such actions as may be necessary to ensure that—</text><paragraph id="H38D82E8C8C5A459F9DE9418ABFE603E9"><enum>(1)</enum><text>minting and issuing coins under this Act will not result in any net cost to the United States Government; and</text></paragraph><paragraph id="HDB51B9229C23447C838F75AD4919F45A"><enum>(2)</enum><text>no funds, including applicable surcharges, are disbursed to the recipient designated in section 6 until the total cost of designing and issuing all of the coins authorized by this Act (including labor, materials, dies, use of machinery, overhead expenses, marketing, and shipping) is recovered by the United States Treasury, consistent with sections 5112(m) and 5134(f) of title 31, United States Code.</text></paragraph></section></legis-body></bill>
