which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend <external-xref legal-doc="public-law" parsable-cite="pl/89/108">Public Law 89–108</external-xref> to modify the authorization of appropriations for State and Tribal, municipal, rural, and industrial water supplies, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" changed="not-changed"><section section-type="section-one" id="id54dfc65f-bfd1-4c84-a0f6-e23b34088962" changed="not-changed"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Dakota Water Resources Act Amendments of 2026</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idcf145805-314e-4697-ab2c-70ce61b8609a" changed="not-changed"><enum>2.</enum><header>Authorization of appropriations for State and Tribal, municipal, rural, and industrial water service</header><text display-inline="no-display-inline">Section 10 of <external-xref legal-doc="public-law" parsable-cite="pl/89/108">Public Law 89–108</external-xref> (79 Stat. 433; 100 Stat. 424; 106 Stat. 4669; 114 Stat. 2763A–291; 140 Stat. 74) is amended—</text><paragraph id="id73e90ea6-f099-462e-afd2-89ba74436976" changed="not-changed"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="id854d0f9c-1e56-49b2-a57d-d4b2311045c1" changed="not-changed"><enum>(A)</enum><text>in paragraph (1)—</text><clause commented="no" display-inline="no-display-inline" id="id70a92824-126b-4032-99a5-6a3c6718c449" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">by redesignating subparagraph (D) as subparagraph (E); and</text></clause><clause commented="no" display-inline="no-display-inline" id="idf8a750ef-73e8-4e71-b029-deb2840126c9" changed="not-changed"><enum>(ii)</enum><text>by inserting after subparagraph (C) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id42f99575-b71b-48e3-997a-d90b7504d623" changed="not-changed"><subparagraph commented="no" display-inline="no-display-inline" id="id3a8069ff-87a4-4773-9758-7e32f399aa9c" changed="not-changed"><enum>(D)</enum><header>Additional amounts for certain projects</header><clause commented="no" display-inline="no-display-inline" id="ide971f2db-cae6-42ef-9ab9-46cc82c2249c" changed="not-changed"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to clauses (ii) through (iv), in addition to the amounts made available under subparagraphs (A), (B), and (C), there are authorized to be appropriated to carry out section 7(a)—</text><subclause commented="no" display-inline="no-display-inline" id="id3b7fd66e-42bf-4403-aba2-6baffd9db506" changed="not-changed"><enum>(I)</enum><text display-inline="yes-display-inline">$120,000,000, as indexed, to complete all phases of the Northwest Area Water Supply Biota Water Treatment Plant and Pump Station Project, as described in the record of decision dated August 21, 2015;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id3b50101b-87b9-4e1e-8e0b-cc00c35bc494" changed="not-changed"><enum>(II)</enum><text display-inline="yes-display-inline">$404,000,000, as indexed, to complete the McClusky Canal and Missouri River North Alternative for the Eastern North Dakota Alternate Water Supply Project, as described in the record of decision issued by the Bureau of Reclamation on January 15, 2021;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id538fc63b-8833-44a6-815a-010965a1fad9" changed="not-changed"><enum>(III)</enum><text display-inline="yes-display-inline">$50,000,000, as indexed, for the Southwest Pipeline Project to complete—</text><item commented="no" display-inline="no-display-inline" id="id3134f385145d4561bf7238e4a84cff22" changed="not-changed"><enum>(aa)</enum><text display-inline="yes-display-inline">the supplementary raw water intake and pump station described in the environmental assessment prepared by the Bureau of Reclamation entitled <quote>Finding of No Significant Impact of Environmental Assessment for Southwest Pipeline Project, Oliver, Mercer, North Dunn Service Area in Southwest North Dakota</quote> and dated April 2009;</text></item><item commented="no" display-inline="no-display-inline" id="idff378d39f062444eb7e40cb3821c1eb4" changed="not-changed"><enum>(bb)</enum><text display-inline="yes-display-inline">the main transmission line upgrades described in the final supplemental environmental assessment prepared by the Bureau of Reclamation entitled the <quote>Final Supplemental Environmental Assessment for Partial Funding of Design and Construction of an Expansion Water Treatment Plant in the City of Dickinson, North Dakota and Associated Water Transmission Facilities in Southwest North Dakota</quote> and dated February 2015;</text></item><item commented="no" display-inline="no-display-inline" id="id0f4379a6cfc34348a5fcd8c5a5996327" changed="not-changed"><enum>(cc)</enum><text display-inline="yes-display-inline">strategic hydraulic improvements; and</text></item><item commented="no" display-inline="no-display-inline" id="id18b7606d07574795aeb3b99491d7e29a" changed="not-changed"><enum>(dd)</enum><text display-inline="yes-display-inline">rural distribution expansion; and</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="ideccb3e57-0419-4539-b998-4668f7f3be56" changed="not-changed"><enum>(IV)</enum><text display-inline="yes-display-inline">$63,000,000, as indexed, for North Dakota rural water districts for water treatment and rural distribution expansion, to include the South Central Regional Water District North Burleigh Water Treatment Plant Expansion and Phase One of the Northeast North Dakota Long-Term Water Supply Project.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id51bea3fe-e0e5-43b6-9906-a7a20a45b911" changed="not-changed"><enum>(ii)</enum><header>Transfers</header><text display-inline="yes-display-inline">Any amounts made available under any of subclauses (I) through (IV) of clause (i) may be transferred among the projects described in those subclauses, subject to the limitation that the initial amount authorized for any 1 project described in any of those subclauses may not be increased by more than 50 percent as a result of any transfers authorized under this clause.</text></clause><clause id="id9f223aa3a1964116bfca3133e9c49d6d" changed="not-changed"><enum>(iii)</enum><header>Final engineering reports</header><text>Of the amounts made available under subclauses (III) and (IV) of clause (i), the Secretary may use such amounts as are necessary to complete the final engineering reports, to be completed not later than 2 years after the date of enactment of the <short-title>Dakota Water Resources Act Amendments of 2026</short-title>, that determine the scope of, and identify the features necessary to complete, the projects described in those subclauses, as determined by the Secretary.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="ida89c1565-9781-49a4-8575-959af7056177" changed="not-changed"><enum>(B)</enum><text>in paragraph (2)—</text><clause commented="no" display-inline="no-display-inline" id="id5788aba5-8c67-4631-a920-01f455e9422c" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">by redesignating subparagraph (C) as subparagraph (D); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id8660d3cb-648d-49b8-8da6-d9381ff3a023" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">by inserting after subparagraph (B) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id49f78dfb-08a3-4bb3-ba69-49355a1bb112" changed="not-changed"><subparagraph commented="no" display-inline="no-display-inline" id="id306bf85c-b8a8-46bc-8d53-b9597501884a" changed="not-changed"><enum>(C)</enum><header>Other amounts</header><clause id="id297689db-79bf-4fe6-b6e8-518ec0152b53" changed="not-changed"><enum>(i)</enum><header>In general</header><text>In addition to the amounts made available under subparagraphs (A)(ii) and (B), there is authorized to be appropriated to carry out section 7(d) $743,000,000, as indexed.</text></clause><clause id="id7ae218c6-ad16-4a73-9ed1-eedcfe9a4df0" changed="not-changed"><enum>(ii)</enum><header>Allocation</header><text>The amount under clause (i) shall be allocated as follows:</text><subclause id="id62a13bb6-80e8-4f7b-b083-89369dc20ba0" changed="not-changed"><enum>(I)</enum><text>Not more than $118,000,000, as indexed, shall be made available to the Secretary to complete the Spirit Lake Rural Water System within the Fort Totten Indian Reservation.</text></subclause><subclause id="id4f994155-cc3c-4433-adbe-0f53b4e342b1" changed="not-changed"><enum>(II)</enum><text>Not more than $275,000,000, as indexed, shall be made available to the Secretary to complete the Three Affiliated Tribes Rural Water System within the Fort Berthold Indian Reservation.</text></subclause><subclause id="idcec6b8fd-084f-4fbc-beb7-e361a5096128" changed="not-changed"><enum>(III)</enum><text>Not more than $240,000,000, as indexed, shall be made available to the Secretary to complete the Standing Rock Rural Water System within the Standing Rock Indian Reservation.</text></subclause><subclause id="id5250fc7f-f1e6-4191-b59e-5bb7f2a62a04" changed="not-changed"><enum>(IV)</enum><text>Not more than $98,000,000, as indexed, shall be made available to the Secretary to complete the Turtle Mountain Rural Water System within the Turtle Mountain Indian Reservation.</text></subclause><subclause id="id613b5b16-e4ed-40a4-b65b-2a658fb6c665" changed="not-changed"><enum>(V)</enum><text>$12,000,000, as indexed, shall be made available to the Secretary—</text><item changed="not-changed" commented="no" display-inline="no-display-inline" id="idfcefc238c6804ab08f103598cce47870"><enum>(aa)</enum><text display-inline="yes-display-inline">to complete a feasibility study for the construction of a municipal, rural, and industrial water system to meet the drinking water needs of the Lake Traverse Rural Water System within the Lake Traverse Indian Reservation; and</text></item><item changed="not-changed" commented="no" display-inline="no-display-inline" id="id1a1b716c806346ccbc7a18400a78ecf4"><enum>(bb)</enum><text display-inline="yes-display-inline">after completion of the feasibility study and a determination by the Secretary that the proposed project under item (aa) is technically and financially feasible in accordance with the reclamation laws, to begin construction of the municipal, rural, and industrial water system identified as the preferred alternative in the feasibility study.</text></item></subclause></clause><clause id="iddf01f916-1c2d-46ea-95fd-57e7f4182c0a" changed="not-changed"><enum>(iii)</enum><header>Final engineering reports</header><text>Of the amounts made available under clause (i), the Secretary may use such amounts as are necessary to complete final engineering reports, to be completed not later than 2 years after the date of enactment of the <short-title>Dakota Water Resources Act Amendments of 2026</short-title>, that determine the scope of, and identify the features necessary to complete, each of the rural water systems described in subclauses (I) through (IV) of clause (ii), as determined by the Secretary.</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id305df69d-1506-4be5-805f-eb886c4fe060" changed="not-changed"><enum>(2)</enum><text>in subsection (c)(2), by striking subparagraph (B) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ide6887ed4-8d92-483f-838c-f3f55298bbe8" changed="not-changed"><subparagraph commented="no" display-inline="no-display-inline" id="idc75ca80f-ae25-4faa-9efd-bac37ef65faf" changed="not-changed"><enum>(B)</enum><text>$75,000,000 to carry out section 11, to remain available until expended.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="ida7f86e12-71b8-428d-a940-0d9e0253f590" changed="not-changed"><enum>(3)</enum><text>by striking subsection (e) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf6429900-194f-40d2-9283-a64a36f53895" changed="not-changed"><subsection id="idff495a62-b1c2-439c-9a1d-40e953b5e287" changed="not-changed"><enum>(e)</enum><header>Indexing</header><paragraph id="id6d5d175f-b2dc-4b26-8e29-ab4ec6fd2494" changed="not-changed"><enum>(1)</enum><header>In general</header><text>The $200,000,000 amount under subsection (a)(1)(B), the $200,000,000 amount under subsection (b)(1)(B), and the funds authorized under subparagraphs (A) and (B) of subsection (b)(2) shall be indexed as necessary to allow for ordinary fluctuations of construction costs incurred after the date of enactment of the Dakota Water Resources Act of 2000, as indicated by engineering cost indices applicable for the type of construction involved.</text></paragraph><paragraph id="id0afe35ce725f4d2198ec71efc1863153"><enum>(2)</enum><header>Additional amounts</header><text>The $50,000,000 amount under subsection (a)(1)(C) shall be indexed as necessary to allow for ordinary fluctuations of construction costs incurred after the date of enactment of the Energy and Water Development and Related Agencies Appropriations Act, 2026, as indicated by engineering cost indices applicable for the type of construction involved.</text></paragraph><paragraph id="id3fbacece-3dbb-4654-a0f0-b6d55c550ba1" changed="not-changed"><enum>(3)</enum><header>Other amounts</header><text>The funds authorized under subsections (b)(1)(D) and (b)(2)(C) shall be indexed as necessary to allow for ordinary fluctuations of construction costs incurred after the date of enactment of the <short-title>Dakota Water Resources Act Amendments of 2026</short-title>, as indicated by engineering cost indices applicable for the type of construction involved.</text></paragraph><paragraph id="id7c018235-d475-435b-a683-9b4111da9f46" changed="not-changed"><enum>(4)</enum><header>Other cost ceilings</header><text>All other authorized cost ceilings under this Act shall remain unchanged.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idfa34bdbd-b599-457d-9702-7877c85f7fcc" changed="not-changed"><enum>3.</enum><header>Natural Resources Trust</header><text display-inline="no-display-inline">Section 11(a)(2)(B) of <external-xref legal-doc="public-law" parsable-cite="pl/89/108">Public Law 89–108</external-xref> (79 Stat. 433; 100 Stat. 424; 114 Stat. 2763A–292) is amended by striking <quote>and (b)(1)(B)</quote> and inserting <quote>, (b)(1)(B), and (b)(1)(D)</quote>.</text></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause" changed="not-changed"/></bill>
