<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Disaster Recovery Improvement Act</short-title></quote>.</text></section> <section commented="no" display-inline="no-display-inline" id="id382d4ad3e27e4d779f39d30a971ef1da"><enum>2.</enum><header>Findings; sense of Congress</header> <subsection id="id1da172c1cea94375826063ef82af708e"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text>
<paragraph id="id1f68e941e25f431dae1db1361b7d2b6b"><enum>(1)</enum><text>Numerous programs administered by Federal agencies, while not dedicated exclusively to disaster recovery, play a critical role in supporting and expediting recovery efforts.</text></paragraph> <paragraph id="ide07beee7b06b48d2b195757943fbc06a"><enum>(2)</enum><text>The delayed delivery of Federal disaster relief funding to local communities in the wake of recent natural disasters, including Hurricane Helene, revealed new and longstanding bottlenecks in Federal disaster response.</text></paragraph>
<paragraph id="idc2b54819d1e244a5adc78fcc7e1dc9e2"><enum>(3)</enum><text>State and local governments should have greater input in how the Federal Government administers disaster relief assistance and responsibility for responding to natural disasters.</text></paragraph></subsection> <subsection id="id53fd63c5dd6b4d2696ed9c0ca66ceac7"><enum>(b)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that Federal agencies must incorporate recommendations from State and local governments to improve their disaster response capability.</text></subsection></section>
<section commented="no" display-inline="no-display-inline" id="idd30d0d6bc47a4e66ab052699c506f791"><enum>3.</enum><header>Disaster Recovery Improvement Task Force</header>
<subsection commented="no" display-inline="no-display-inline" id="id195d7fb7cf7b4b5b8d506d63e9d778c9"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, the Administrator of the Federal Emergency Management Agency shall establish an interagency task force on expediting disaster relief funding to be known as the <quote>Disaster Recovery Improvement Task Force</quote>.</text></subsection> <subsection id="idab064544e72f4becb26d515ea096224d"><enum>(b)</enum><header>Membership</header> <paragraph commented="no" display-inline="no-display-inline" id="id7b4f8bdd25284b898a5c9b1dea8edd92"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The interagency task force established under subsection (a), shall consist of—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="id47b0dce75a304269a433c778ad6f277a"><enum>(A)</enum><text display-inline="yes-display-inline">a senior official from the Federal Emergency Management Agency, appointed by the Administrator of the Federal Emergency Management Agency, to serve as chair;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id207532abf62f4e1c8f91f0ab87ead4a5"><enum>(B)</enum><text display-inline="yes-display-inline">a senior official, appointed by the head of the respective agency of the official, experienced in handling disaster recovery matters from each of—</text>
<clause commented="no" display-inline="no-display-inline" id="ida6986ed67c0f41dbab0ffdda8738bebf"><enum>(i)</enum><text display-inline="yes-display-inline">the Small Business Administration;</text></clause> <clause commented="no" display-inline="no-display-inline" id="id8cb1bdedbad2415e8ade61f805cd769d"><enum>(ii)</enum><text display-inline="yes-display-inline">the Department of Housing and Urban Development;</text></clause>
<clause commented="no" display-inline="no-display-inline" id="id230c63da1e014aa1b0c52c20c918d449"> <enum>(iii)</enum> <text>the Department of Agriculture;</text> </clause> <clause commented="no" display-inline="no-display-inline" id="idf0430f7b51174850bdfa01c3e270eddb"><enum>(iv)</enum><text display-inline="yes-display-inline">the Department of Health and Human Services;</text></clause>
<clause commented="no" display-inline="no-display-inline" id="id1d6f3195e2014bda8743646ff8f292f7"><enum>(v)</enum><text>the Department of Labor;</text></clause> <clause commented="no" display-inline="no-display-inline" id="id329c89fbc74143089f5951a4a2c677ab"><enum>(vi)</enum><text>the Department of Transportation;</text></clause>
<clause commented="no" display-inline="no-display-inline" id="id101a74bbd9d24974a9ab79bdeef0ed25"><enum>(vii)</enum><text display-inline="yes-display-inline">the Department of Commerce;</text></clause> <clause commented="no" display-inline="no-display-inline" id="id29be38fe1e504b21a0e52a6803ab6db7"><enum>(viii)</enum><text display-inline="yes-display-inline">the Department of the Treasury;</text></clause>
<clause commented="no" display-inline="no-display-inline" id="idec4b332ad2de45198a4eb536402de060"><enum>(ix)</enum><text display-inline="yes-display-inline">the Department of the Interior;</text></clause> <clause commented="no" display-inline="no-display-inline" id="id65350ce241914a10a19ada489781da66"><enum>(x)</enum><text display-inline="yes-display-inline">the Environmental Protection Agency;</text></clause>
<clause commented="no" display-inline="no-display-inline" id="idc084c4ec2d9e4c9385dcdeee4c0d1e29"><enum>(xi)</enum><text display-inline="yes-display-inline">the Army Corp of Engineers; and</text></clause> <clause commented="no" display-inline="no-display-inline" id="id3fac9550dba04733977daf2d2373b280"><enum>(xii)</enum><text>the Office of Management and Budget;</text></clause></subparagraph>
<subparagraph id="id69693f77e88c43a28f66309e3128969b"> <enum>(C)</enum> <text>4 state governors, jointly appointed by the Chairs and Ranking Members of the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name> and the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure of the House of Representatives</committee-name>, representing States that, during the 3-year period immediately preceding appointment to the interagency task force, have experienced a major disaster, as defined in section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>), of which—</text> <clause commented="no" display-inline="no-display-inline" id="idd55cc6541ac34843a3536a735d09ea42"> <enum>(i)</enum> <text display-inline="yes-display-inline">1 was a hurricane;</text> </clause> 
<clause commented="no" display-inline="no-display-inline" id="idd2872b1db47643619d8aa58e54fc1907"> <enum>(ii)</enum> <text>1 was a wildfire;</text> </clause> <clause commented="no" display-inline="no-display-inline" id="idba8183580e874f11bab2994b54dc42a9"> <enum>(iii)</enum> <text>1 was a tornado; and</text> </clause> 
<clause commented="no" display-inline="no-display-inline" id="id4eb3220380794da4ba73b9ba6a0d518b"> <enum>(iv)</enum> <text>1 was an earthquake; and</text> </clause> </subparagraph> <subparagraph id="id2a03ca7b4d7643fdae0f799cfc2b2f68"> <enum>(D)</enum> <text>4 county commissioners, jointly appointed by the Chairs and Ranking Members of the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name> and the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure of the House of Representatives</committee-name>, representing a county in a State that, during the 3-year period immediately preceding appointment to the interagency task force, have experienced a major disaster, as defined in section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>), of which—</text> 
<clause commented="no" display-inline="no-display-inline" id="idc68c474934d74a2fb552fef7e03d2025"> <enum>(i)</enum> <text display-inline="yes-display-inline">1 was a hurricane;</text> </clause> <clause commented="no" display-inline="no-display-inline" id="id30d9b9ff075443d8adbed5d89bdf39d2"> <enum>(ii)</enum> <text>1 was a wildfire;</text> </clause> 
<clause commented="no" display-inline="no-display-inline" id="id97f692621c364874ae45b1e5a2b0f120"> <enum>(iii)</enum> <text>1 was a tornado; and</text> </clause> <clause id="idc64ee0a9700542348ba2a60d169ef756" commented="no" display-inline="no-display-inline"> <enum>(iv)</enum> <text>1 was an earthquake.</text> </clause> </subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="ida0b5e54aec3a4add9bf16a6d483d731f"> <enum>(2)</enum> <header>Advisory members</header> <text>Members of Congress representing the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name> and the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure of the House of Representatives</committee-name> may serve on the interagency task force established under subsection (a) as advisory members in a non-voting capacity.</text> </paragraph></subsection> <subsection id="id24f2fb9f6d1d4112a0f5bd35441d4bdb"><enum>(c)</enum><header>Reports</header> <paragraph commented="no" display-inline="no-display-inline" id="id2a6f0895c95c43cd89986d47645ac150"> <enum>(1)</enum> <header>In general</header> <text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the interagency task force established under subsection (a) shall submit to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name>, the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure of the House of Representatives</committee-name>, and the <committee-name committee-id="HHM00">Committee on Homeland Security of the House of Representatives</committee-name> and make publicly available a report that—</text> 
<subparagraph id="idecfdbf394d8a47b9921ca2a361a131ee"> <enum>(A)</enum> <text>identifies the programs, including temporary programs, for which Congress appropriates funds to aid recovery purposes relating to the consequences of natural disasters;</text> </subparagraph> <subparagraph id="idc48d5a9d938e4a33aa940297e4d23731"> <enum>(B)</enum> <text>contains recommendations for Federal agencies on the most effective way to expedite disaster relief efforts, including recommendations to—</text> 
<clause commented="no" display-inline="no-display-inline" id="id97c77ba583f4409eaf7a985bee367b1f"> <enum>(i)</enum> <text display-inline="yes-display-inline">streamline the establishment and administration of temporary programs;</text> </clause> <clause commented="no" display-inline="no-display-inline" id="idd4bfc84ac62343eebd78f029558ce88e"> <enum>(ii)</enum> <text display-inline="yes-display-inline">improve the timeliness, accessibility, and clarity of applications for funding; and</text> </clause> 
<clause commented="no" display-inline="no-display-inline" id="id6220c6e861124e389ac3d24cf96c694b"> <enum>(iii)</enum> <text display-inline="yes-display-inline">reduce delays in the review and obligation of funds with respect to applications received;</text> </clause> </subparagraph> <subparagraph id="idb570624149b040f592f4d53de102e4a9"> <enum>(C)</enum> <text>identifies the different types of funding mechanisms for which Congress provides appropriations to Federal agencies for disaster relief, including grants, loans, reimbursements, and contract authority;</text> </subparagraph> 
<subparagraph id="idbb88225d609547c782c11f18e2e88e52"> <enum>(D)</enum> <text>contains recommendations to Federal agencies and Congress on the most effective way to expedite the expenditure of the funds identified under subparagraph (C) toward disaster relief;</text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id3eee9cc1f2df4df5bebcbbc62fe955a9"> <enum>(E)</enum> <text>contains recommendations for Federal agencies and Congress to strengthen State capacity to prepare for, respond to, and recover from natural disasters;</text> </subparagraph> 
<subparagraph id="id15ff9dab295c49039bfbce4fff7be087"> <enum>(F)</enum> <text>identifies factors that cause delays in disaster relief program funding being made available or obligated, including during transitions from one presidential administration to another presidential administration;</text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="idcfb460d1b75b41bdb2bcf95f0cfdfb9d"> <enum>(G)</enum> <text display-inline="yes-display-inline">includes recommendations on how outgoing and incoming Presidential administrations can equip themselves to set up and deliver disaster relief aid without delay, including an assessment of actions required of both outgoing and incoming Presidential administrations to ensure continuity and uninterrupted delivery of disaster relief funding;</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="id4697036edd5f4f8f97d0e44b8b274628"> <enum>(H)</enum> <text>evaluates barriers within Federal agencies and across Federal agencies that delay the obligation or expenditure of disaster relief funds and provides recommendations to address those barriers; and</text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id4f7301d94eee4c17856c1a36acda5cb4"> <enum>(I)</enum> <text>assesses specific actions taken by Federal agencies over time that have improved or hindered interagency coordination, State and local engagement, and the timely delivery of disaster relief funding.</text> </subparagraph> </paragraph>
<paragraph id="id30af07e85d744c6fb30f93915cfb4c14"><enum>(2)</enum><header>Recommendations</header><text>In making recommendations for the report under paragraph (1), the interagency task force shall make recommendations for ways to expedite making available and obligating specific funding appropriated by Congress to certain agencies, including—</text> <subparagraph id="idda2e08291cb0474d92d6e75066cf7ca2"> <enum>(A)</enum> <text>to the Federal Emergency Management Agency, including with respect to Public Assistance funding under section 406 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5172">42 U.S.C. 5172</external-xref>) and Hazard Mitigation Grant Program funding under section 404 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>);</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="idf94b2547dbea43a781dd4d60a41335d2"><enum>(B)</enum><text>to the Department of Housing and Urban Development, including with respect to funding under the Community Development Block Grant Disaster Recovery program;</text></subparagraph> <subparagraph id="ida2cdd0ef349d4f788844c27dad914f1f"><enum>(C)</enum><text>to the Department of Agriculture, including with respect to funding for necessary expenses relating to losses of revenue or quality or production of crops as a consequence of a major disaster, as defined in section 404 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>);</text></subparagraph>
<subparagraph id="idf0cd346b2fc5446da7a70239dfe93053" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">to the Department of Agriculture, including with respect to Forest Service operations, forest and rangeland research, state, private, and tribal forestry, and National Forest System funding for necessary expenses relating to the consequences of disaster relief;</text></subparagraph> <subparagraph id="id88a7bc0cdbe14a8c94cc27de9c8bbf59"><enum>(E)</enum><text>to the Department of Labor, including with respect to Disaster Recovery Dislocated Worker Grant funding under section 170 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3225">29 U.S.C. 3225</external-xref>);</text></subparagraph>
<subparagraph id="idec4f214b1bea4768b045cbc218fdc252"><enum>(F)</enum><text>to the Department of Commerce, including with respect to Economic Development Administration funding under the Public Works and Economic Development Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3121">42 U.S.C. 3121 et seq.</external-xref>);</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id175df1d049ac47a9995fc5cfe2fc2cfd"><enum>(G)</enum><text>to the Department of the Interior, including with respect to National Park Service Historic Preservation Fund and construction funding for necessary expenses relating to the consequences of disaster relief; and</text></subparagraph>
<subparagraph id="idfa6e690502294c7ebc00f017f7c7f3de"><enum>(H)</enum><text>to the Environmental Protection Agency, including with respect to Clean Water State Revolving Fund funding under title VI of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1381">33 U.S.C. 1381 et seq.</external-xref>).</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="idab5bea916cc7449a84bb62ac5ac67497"><enum>(3)</enum><header>Implementation report</header><text>Not later than 180 days after the date on which the interagency task force submits the report under paragraph (1), the interagency task force shall submit to the congressional committees described in that paragraph a report detailing—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="id1703ade7a2f24f9abb618a930647aec3"><enum>(A)</enum><text display-inline="yes-display-inline">which of the recommendations contained in the report under paragraph (1) shall be implemented by Federal agencies and why those recommendations in the report not being implemented are not selected for implementation;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="idc36cedde3ea5451db64fa569b2ecb4ec"><enum>(B)</enum><text>how the recommendations selected for implementation will be carried out; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id00ee4a36c183488e88f9db8b4e4dad87"><enum>(C)</enum><text>legislative recommendations for Congress to support the recommendations selected for implementation.</text></subparagraph></paragraph></subsection> <subsection id="idefd7758098764015958d07efb67c4a6e"><enum>(d)</enum><header>No additional funding</header><text>No additional funds are authorized to be appropriated to carry out this Act.</text></subsection>
<subsection id="ide64f30bfd1f94391bbd41e1140592501"><enum>(e)</enum><header>Termination</header><text>The interagency task force established under subsection (a) shall terminate on the date that is 90 days after the date on which the interagency task force submits the report under subsection (c)(3).</text></subsection></section> </legis-body> </bill>
