which was read twice and referred to the <committee-name committee-id="SLIA00">Committee on Indian Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Federal Meat Inspection Act to authorize Tribal meat inspection under that Act by Tribal personnel, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Promoting Regulatory Independence, Mastery, and Expansion for Meat Processing in Indian Country Act</short-title></quote> or the <quote><short-title>PRIME Meat Processing in Indian Country Act</short-title></quote>.</text></section><section id="idd0d8824e5c6246deb0c567882d2fb439"><enum>2.</enum><header>Tribal meat inspections</header><subsection commented="no" display-inline="no-display-inline" id="id33ec3011070f42a584d709e8d421d3a4"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Title IV of the Federal Meat Inspection Act (21 U.S.C. 671 et seq.) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="ida6ea02905ec14729affc5a440368145c"><enum>(1)</enum><text>by redesignating section 411 (21 U.S.C. 680) as section 412; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7e446d37ae574438b987a875a229397a"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after section 410 (21 U.S.C. 679a) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB35D7E87E8784013A9F2DD13499D216B"><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id9fbe6ea8b548436b8f3d32246fc0d666"><enum>411.</enum><header>Tribal meat inspections</header><subsection id="id9dce6bfc344b4485ba08a0360857bc75"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="idd6e0ed9a5d5148b7b302afc6250d2217"><enum>(1)</enum><header>Covered activities</header><text>The term <term>covered activities</term>, with respect to the inspection of meat food products under this Act, means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id04502ba57e0e4a0ea3dc3c086641251c"><enum>(A)</enum><text display-inline="yes-display-inline">the hiring and training, in accordance with relevant training standards of the Food Safety and Inspection Service of the Department of Agriculture, of Tribal personnel to conduct, at covered facilities, any inspections required under this Act that would otherwise be carried out by inspectors appointed by the Secretary; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc34a34e310b8491e8da0c039509bd2ce"><enum>(B)</enum><text>the conduct of those inspections by those Tribal personnel at covered facilities.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida22ea83d0122490abc74cd2ec7b8e406"><enum>(2)</enum><header>Covered facility</header><text>The term <term>covered facility</term> means a mobile or stationary meat processing facility not less than 51 percent of the ownership interest in which is held by an Indian Tribe, a Tribal organization, or an entity wholly owned by an Indian Tribe or Tribal organization.</text></paragraph><paragraph id="id6321c7cb0b654293a3a2e3dad15bf916"><enum>(3)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (25 U.S.C. 5304).</text></paragraph><paragraph id="id00f66151a32e46f8a499d71641ffacc5"><enum>(4)</enum><header>Meat food product</header><text>The term <term>meat food product</term> includes a carcass of, a part of, or a product derived from a portion of meat, including bison and reindeer, that is capable of use as human food.</text></paragraph><paragraph id="idb255dc0b9b714a20b8cab8ef274c10cb"><enum>(5)</enum><header>Self-determination contract</header><text>The term <term>self-determination contract</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (25 U.S.C. 5304).</text></paragraph><paragraph id="id031c0dd1501c420c8d8cbc80a0ff5334"><enum>(6)</enum><header>Tribal organization</header><text>The term <term>Tribal organization</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (25 U.S.C. 5304).</text></paragraph></subsection><subsection id="idfc3560923d37444c9e667cb44adec77b">
                <enum>(b)</enum>
                <header>Self-Determination contracts</header>
                <paragraph commented="no" display-inline="no-display-inline"
                  id="id2f1366fc5dd5452191e186b33ac0685a">
                  <enum>(1)</enum>
                  <header display-inline="yes-display-inline">Authorization</header>
                  <text>Subject to the availability of appropriations, beginning not later than 2
                    years after the date of enactment of this subsection, on receipt of a request
                    from an Indian Tribe or Tribal organization, the Secretary shall enter into a
                    self-determination contract with the Indian Tribe or Tribal organization,
                    respectively, to carry out covered activities.</text>
                </paragraph>
                <paragraph id="id9e25bead049a45c386b91aa4aed976ee">
                  <enum>(2)</enum>
                  <header>Standards</header>
                  <subparagraph commented="no" display-inline="no-display-inline"
                    id="id0d82d6cb42194acdacc6f46d5e8cc4ea">
                    <enum>(A)</enum>
                    <header display-inline="yes-display-inline">In general</header>
                    <text>The covered activities carried out pursuant to a self-determination
                      contract entered into under paragraph (1) shall meet standards and
                      requirements that are not less stringent than, as applicable, the standards
                      and requirements for inspections of amenable species under title I (including
                      regulations), or the standards and requirements for inspections of species
                      that are not amenable species under section 203(h) of the Agricultural
                      Marketing Act of 1946 (7 U.S.C. 1622(h)), with respect to—</text>

                      <enum>(i)</enum>
                      <text>antemortem and postmortem inspection;</text>
                    </clause>
                    <clause commented="no" display-inline="no-display-inline"
                      id="id23c13a3929bc4525ad0624014e7560ab">
                      <enum>(ii)</enum>
                      <text display-inline="yes-display-inline">reinspection;</text>
                    </clause>
                    <clause commented="no" display-inline="no-display-inline"
                      id="id7b0089844c7a46d3b9650afa0ab112bd">
                      <enum>(iii)</enum>
                      <text display-inline="yes-display-inline">sanitation;</text>
                    </clause>
                    <clause commented="no" display-inline="no-display-inline"
                      id="idf1a7ae1a1190439da7d42b26bd6c8af0">
                      <enum>(iv)</enum>
                      <text display-inline="yes-display-inline">humane handling;</text>
                    </clause>
                    <clause commented="no" display-inline="no-display-inline"
                      id="id41a7ae434a96423c996890c52918c64d">
                      <enum>(v)</enum>
                      <text display-inline="yes-display-inline">recordkeeping; and</text>
                    </clause>
                    <clause commented="no" display-inline="no-display-inline"
                      id="id7e234d35f99f4cc48c135f3aac1ecd15">
                      <enum>(vi)</enum>
                      <text display-inline="yes-display-inline">enforcement.</text>
                    </clause>
                  </subparagraph>
                  <subparagraph commented="no" display-inline="no-display-inline"
                    id="id0e0313271a1f4b43898655725d8e76f7">
                    <enum>(B)</enum>
                    <header>Laboratories</header>
                    <text>The applicable standards of the Department of Agriculture relating to the
                      establishment, maintenance, and operation of laboratories or other similar
                      facilities shall apply with respect to covered activities carried out pursuant
                      to a self-determination contract entered into under paragraph (1).</text>
                  </subparagraph>
                </paragraph>
                <paragraph id="idc05b47c97572441198ddb6c19201a6a6">
                  <enum>(3)</enum>
                  <header>Insurance</header>
                  <subparagraph commented="no" display-inline="no-display-inline"
                    id="id178c91c7ba424e999009afce0223521e">
                    <enum>(A)</enum>
                    <header display-inline="yes-display-inline">In general</header>
                    <text>A self-determination contract entered into under paragraph (1) shall
                      require the Indian Tribe, Tribal organization, or tribally owned entity that
                      owns a covered facility at which covered activities are carried out pursuant
                      to the self-determination contract to maintain insurance coverage (including
                      with respect to outbreaks of food-borne illnesses) that is appropriate for the
                      size of the covered facility, as determined by the Secretary.</text>
                  </subparagraph>
                  <subparagraph commented="no" display-inline="no-display-inline"
                    id="id19511a22a42f4c139b18635f504cb485">
                    <enum>(B)</enum>
                    <header>Factor for consideration</header>
                    <text display-inline="yes-display-inline">In obtaining or providing insurance
                      coverage for purposes of this paragraph, an Indian Tribe or Tribal
                      organization may take into consideration the extent to which liability under a
                      self-determination contract is covered under chapter 171 of title 28, United
                      States Code (commonly known as the <quote>Federal Tort Claims Act</quote>),
                      subject to paragraph (6).</text>
                  </subparagraph>
                  <subparagraph commented="no" display-inline="no-display-inline"
                    id="idfe0ebe9d4feb4fd585e070cf7e5bd375">
                    <enum>(C)</enum>
                    <header>Sovereign immunity</header>
                    <clause commented="no" display-inline="no-display-inline"
                      id="id25db64dafed3412e87f0de47bec20e9f">
                      <enum>(i)</enum>
                      <header display-inline="yes-display-inline">In general</header>
                      <text>A policy of insurance under subparagraph (A)—</text>
                      <subclause commented="no" display-inline="no-display-inline"
                        id="ida27709a500ef4ab8b4d0a9442bd91ae5">
                        <enum>(I)</enum>
                        <text display-inline="yes-display-inline">shall include a provision that the
                          insurance carrier shall waive any right to use as a defense the sovereign
                          immunity of an Indian Tribe from suit with respect to any claim the amount
                          and nature of which are within the coverage and limits of the policy,
                          subject to clause (ii); and</text>
                      </subclause>
                      <subclause commented="no" display-inline="no-display-inline"
                        id="id5e67ef62339c4ff0a34197aa4ed32002">
                        <enum>(II)</enum>
                        <text display-inline="yes-display-inline">shall not authorize the insurance
                          carrier to waive or otherwise limit the sovereign immunity of the
                          applicable Indian Tribe beyond the coverage and limits of the
                          policy.</text>
                      </subclause>
                    </clause>
                    <clause commented="no" display-inline="no-display-inline"
                      id="id94869545b11e4b25bee21652c608f588">
                      <enum>(ii)</enum>
                      <header>Limitations</header>
                      <text display-inline="yes-display-inline">No waiver of the sovereign immunity
                        of an Indian Tribe pursuant to this subparagraph may include—</text>
                      <subclause commented="no" display-inline="no-display-inline"
                        id="idd02560c017374db6867aa6006681bdd1">
                        <enum>(I)</enum>
                        <text display-inline="yes-display-inline">a waiver to the extent of any
                          potential liability for interest prior to judgment or punitive damages;
                          or</text>
                      </subclause>
                      <subclause commented="no" display-inline="no-display-inline"
                        id="id6d643beaedf848afb2040a1bf1f71f19">
                        <enum>(II)</enum>
                        <text display-inline="yes-display-inline">any other limitation on liability
                          imposed by the law of the State in which the alleged injury occurs.</text>
                      </subclause>
                    </clause>
                  </subparagraph>
                  <subparagraph commented="no" id="id3c883b5f0fe841cca97a29ab36e3b034">
                    <enum>(D)</enum>
                    <header>Treatment as federally inspected</header>
                    <text>For purposes of insurance and liability, a covered facility at which
                      covered activities are carried out pursuant to this section shall be
                      considered to be federally inspected.</text>
                  </subparagraph>
                </paragraph>
                <paragraph id="ide6baa3e6fc924f07b7f900d955527680">
                  <enum>(4)</enum>
                  <header>Oversight</header>
                  <text>A self-determination contract entered into under paragraph (1) shall require
                    that the Secretary shall maintain oversight authority (including recall, review,
                    and audit authorities) with respect to covered activities carried out pursuant
                    to the self-determination contract.</text>
                </paragraph>
                <paragraph commented="no" display-inline="no-display-inline"
                  id="id9d0bd5cc874d4779b5fdaeef77a48088">
                  <enum>(5)</enum>
                  <header>Enforcement authority</header>
                  <text>Tribal personnel carrying out covered activities pursuant to a
                    self-determination contract entered into under paragraph (1) shall have
                    enforcement authority in accordance with this Act, including the
                    authority—</text>
                  <subparagraph commented="no" display-inline="no-display-inline"
                    id="idd0e147943fd54f59bcc772b01e1b6eba">
                    <enum>(A)</enum>
                    <text display-inline="yes-display-inline">to provide notice of a violation of
                      this Act;</text>
                  </subparagraph>
                  <subparagraph commented="no" display-inline="no-display-inline"
                    id="idff205f25311e45849ce8d86130f3625e">
                    <enum>(B)</enum>
                    <text display-inline="yes-display-inline">to provide to a covered facility time
                      to remedy such a violation; and</text>
                  </subparagraph>
                  <subparagraph commented="no" display-inline="no-display-inline"
                    id="id68b73735b7d04b66a550123fbaa6cb21">
                    <enum>(C)</enum>
                    <text display-inline="yes-display-inline">if such a violation is not remedied,
                      to halt processing at the covered facility until the violation is
                      remedied.</text>
                  </subparagraph>
                </paragraph>
                <paragraph commented="no" display-inline="no-display-inline"
                  id="id2931302c0e634bf5adf3a286bee38418">
                  <enum>(6)</enum>
                  <header display-inline="yes-display-inline">Treatment as Federal
                    employees</header>
                  <text>Notwithstanding any other provision of law, while carrying out covered
                    activities pursuant to a self-determination contract entered into under
                    paragraph (1), Tribal personnel shall be deemed to be Federal employees for
                    purposes of chapter 171 of title 28, United States Code (commonly known as the
                      <quote>Federal Tort Claims Act</quote>).</text>
                </paragraph>
              </subsection><subsection commented="no" display-inline="no-display-inline" id="id35b0eb6f2c574e8f9ac0aaf2c38a6111"><enum>(c)</enum><header>Certification required</header><text display-inline="yes-display-inline">As a condition of entering into a self-determination contract under subsection (b), an Indian Tribe or Tribal organization shall submit to the Secretary not less frequently than annually a certification that each inspection carried out pursuant to the self-determination contract during the year covered by the certification—</text><paragraph commented="no" display-inline="no-display-inline" id="ida67b98bb994c41d1b32788f15b0a3bbb"><enum>(1)</enum><text display-inline="yes-display-inline">met the applicable inspection requirements, and established and maintained the required standards for inspection, under title I (including regulations); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide5f2d6fb5b784a53ad1316bd1c219cdf"><enum>(2)</enum><text display-inline="yes-display-inline">was conducted by an inspector employed by the Indian Tribe or Tribal organization who—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida32bb85f190a4b0bb8a865ff14256662"><enum>(A)</enum><text display-inline="yes-display-inline">was not employed by an animal food manufacturer serving the covered facility being inspected; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idac88b5fc230545938d3d7bef755c23df"><enum>(B)</enum><text display-inline="yes-display-inline">did not hold any ownership interest in such an animal food manufacturer or the covered facility.</text></subparagraph></paragraph></subsection><subsection id="id078c5d4975c149b190eb75a8472b2488"><enum>(d)</enum><header>Commercial provisions</header><paragraph commented="no" display-inline="no-display-inline" id="id842b5f6d09af4fc3b934571ad6cfb63d"><enum>(1)</enum><header display-inline="yes-display-inline">Labeling</header><text>Tribal personnel carrying out inspections pursuant to a self-determination contract under subsection (b) shall place on each meat food product that meets the applicable criteria under this Act a label of Federal inspection, in such manner and containing such information as the Secretary may require.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5217ffdbf5ea4554a063f8272bc392d2"><enum>(2)</enum><header>Shipment in interstate commerce</header><text>The Secretary shall authorize any Indian Tribes or Tribal organizations that have entered into self-determination contracts under subsection (b) to ship in interstate commerce meat food products bearing the label described in paragraph (1).</text></paragraph><paragraph id="ida0bc2225a84c41ee96cb0c48d39260af"><enum>(3)</enum><header>No sale in foreign commerce</header><text>A meat food product inspected pursuant to a self-determination contract under subsection (b) may not be sold in foreign commerce.</text></paragraph></subsection><subsection id="idff42a6ca0e114e1a893e3e56318a02b4"><enum>(e)</enum><header>Technical assistance</header><text>On request of an Indian Tribe or Tribal organization that has entered into a self-determination contract under subsection (b), the Secretary shall provide technical assistance with respect to carrying out that self-determination contract.</text></subsection><subsection id="id63bfadb4a85d4a94a3580e50396b2173"><enum>(f)</enum><header>Ritual slaughter</header><text>Nothing in this section prohibits the handling or preparation of livestock used for ritual slaughter in accordance with section 2(b) of Public Law 85–765 (7 U.S.C. 1902(b)) (commonly known as the <quote>Humane Methods of Slaughter Act of 1958</quote>).</text></subsection><subsection id="id8d61582d115e4572a66437e2158194ae"><enum>(g)</enum><header>Reports</header><text>Not later than 1 year after the date on which funds are appropriated pursuant to subsection (h), and annually thereafter, the Secretary shall submit to the Committee on Agriculture, Nutrition, and Forestry of the Senate and the Committee on Agriculture of the House of Representatives a report describing the activities carried out under self-determination contracts entered into pursuant to this section.</text></subsection><subsection id="id001f7c1f201a46c68a524d06c0650ccf"><enum>(h)</enum><header>Authorization of appropriations</header><paragraph id="id458dc346546d491aa808eca817dc0b06"><enum>(1)</enum><header>In general</header><text>There are authorized to be appropriated to the Secretary such sums as are necessary to carry out this section, to remain available until expended.</text></paragraph><paragraph id="id3cfe9ec78214414b94f07fc464a79863"><enum>(2)</enum><header>Appropriations in advance</header><text>Only funds appropriated under paragraph (1) in advance specifically to carry out this section shall be available to carry out this section.</text></paragraph></subsection><subsection id="id898a2fafa9f7477da9bf9dc148a30654"><enum>(i)</enum><header>Rule of construction</header><text>Tribal personnel may use funds made available under subsection (h) to carry out inspections of any species that is not an amenable species only pursuant to, and in accordance with, a self-determination contract under this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id4f84883c48ef4056a869ffd1e3d5d8b1"><enum>(b)</enum><header>Rural water, waste disposal, and community facility loans and grants</header><text display-inline="yes-display-inline">An Indian Tribe or Tribal organization (as those terms are defined in section 4 of the Indian Self-Determination and Education Assistance Act (25 U.S.C. 5304)) operating under a self-determination contract described in section 411(b) of the Federal Meat Inspection Act (as amended by subsection (a)) shall be eligible to receive grants and loans under section 306(a) of the Consolidated Farm and Rural Development Act (7 U.S.C. 1926(a)).</text></subsection></section></legis-body></bill>
