<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 3992</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260304">March 4, 2026</action-date><action-desc><sponsor name-id="S429">Mr. Banks</sponsor> (for himself, <cosponsor name-id="S361">Ms. Hirono</cosponsor>, and <cosponsor name-id="S383">Mr. Sullivan</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 10, United States Code, to codify authority for the Joint Medical Facility Fund of the Department of Defense and the Department of Veterans Affairs, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Joint Medical Facilities Fund Act of 2026</short-title></quote>.</text></section><section id="id3b0b6a62c8524811b2c8aa07c2d87621"><enum>2.</enum><header>Codification of authority for Joint Medical Facility Fund of Department of Defense and Department of Veterans Affairs</header><subsection id="idcd9b0af92b724f4d8a375e6bc0609a1e"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/55">Chapter 55</external-xref> of title 10, United States Code, is amended by adding at the end the following new section:</text><quoted-block style="USC" display-inline="no-display-inline" id="ide8a72557c0904f3ca0cdf6c36a547f02"><section id="id1cb32032e46b4e88aa7ec45db34e4457"><enum>1110c.</enum><header>Joint Medical Facility Fund</header><subsection id="idbbf3e548118246d7a4fcdd98943c444a"> <enum>(a)</enum> <header>Establishment</header> <text>There is established on the books of the Treasury under the Department of Veterans Affairs a fund to be known as the <quote>Joint Medical Facility Fund</quote> (in this section referred to as the <quote>Fund</quote>).</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id47d4c3bf942d49fe838f755c8dbf9b5b"><enum>(b)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of the Fund shall be to facilitate the joint funding of designated combined Federal medical facilities of the Department of Defense and the Department of Veterans Affairs.</text></subsection><subsection id="id10d390e0fe0645be81d1b6b2e2002ec9"> <enum>(c)</enum> <header>Transfers to fund</header> <paragraph id="id4db1e5e902374b18b9e2f199e18e11fa"> <enum>(1)</enum> <header>In general</header> <text>Amounts may be transferred to the Fund by the Secretary of Defense from amounts authorized and appropriated for the Department of Defense and by the Secretary of Veterans Affairs from amounts authorized and appropriated for the Department of Veterans Affairs, as determined by a methodology jointly established by the Secretary of Defense and the Secretary of Veterans Affairs that reflects the mission-specific activities, workload, and costs of provision of health care at the facilities of the Department of Defense and the Department of Veterans Affairs, respectively.</text>
                            </paragraph>
                            <paragraph id="id3e62d5cc31594a9b8ae5063446a7bf16">
                                <enum>(2)</enum>
                                <header>Transfers of amounts from medical care collections</header>
 <text>Amounts may be transferred to the Fund from medical care collections under the following authorities for health care provided at designated combined Federal medical facilities of the Department of Defense and the Department of Veterans Affairs:</text>
                                <subparagraph id="id8b9ae78417004bc3bed061a578a2c27f">
                                    <enum>(A)</enum>
 <text>Section 1095 of this title.</text> </subparagraph> <subparagraph id="id4e44e5792d94442b84c0e0a5e29298cd"> <enum>(B)</enum> <text>Section 1729 of title 38.</text>
                                </subparagraph>
                                <subparagraph id="id264ca2e9dc844039b7201b8e0fb0e2e1">
                                    <enum>(C)</enum>
 <text>The Act entitled <quote>An Act to provide for the recovery from tortiously liable third persons of the cost of hospital and medical care and treatment furnished by the United States</quote> (<external-xref legal-doc="public-law" parsable-cite="pl/87/693">Public Law 87–693</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/42/2651">42 U.S.C. 2651 et seq.</external-xref>; commonly known as the <quote>Federal Medical Care Recovery Act</quote>).</text>
                                </subparagraph>
                            </paragraph>
 </subsection><subsection id="idf7915dc938a74d74aac364b6e39e12b8"><enum>(d)</enum><header>Availability of amounts in fund</header><paragraph id="id3a8c1d4492ad43e19849a304d9b4bc0e"><enum>(1)</enum><header>In general</header><text>Amounts transferred to the Fund under subsection (c) shall be available to fund the operations of designated combined Federal medical facilities of the Department of Defense and the Department of Veterans Affairs, including capital equipment, real property maintenance, and minor construction projects that are not required to be specifically authorized by law under section 2805 of this title or section 8104 of title 38.</text></paragraph><paragraph id="idd0ae86038e554de1aca2465e675cea85"><enum>(2)</enum><header>Captain James A. Lovell Federal Health Care Center</header><text>Amounts transferred to the Fund by the Secretary of Defense under subsection (c) may be used for facility operations of the Captain James A. Lovell Federal Health Care Center, consisting of the North Chicago Veterans Affairs Medical Center, the Navy Ambulatory Care Center, and supporting facilities designated as a combined Federal medical facility under an operational agreement covered by section 706 of the Duncan Hunter National Defense Authorization Act for Fiscal Year 2009 (<external-xref legal-doc="public-law" parsable-cite="pl/110/417">Public Law 110–417</external-xref>; 122 Stat. 4500).</text></paragraph><paragraph id="id64c83128d78045948812525a0aa7af2a"><enum>(3)</enum><header>Limitation</header><text>The availability of amounts transferred to the Fund under subsection (c)(2) shall be subject to the provisions of section 1729A of title 38.</text></paragraph><paragraph id="id56177ae8b0bd40159cc8e34a2a3f453c"><enum>(4)</enum><header>Period of availability</header><subparagraph id="id6d7332f016804f08ac461bc1f28f0c1b"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), amounts transferred to the Fund under subsection (c) shall remain available under this subsection until the end of the first fiscal year beginning after the date of the transfer.</text></subparagraph><subparagraph id="id67ead1f151604a868579e8d087155531"><enum>(B)</enum><header>Exception</header><text>Of the amount transferred to the Fund under subsection (c) in a fiscal year, an amount not to exceed two percent of such amount shall remain available under this subsection until the end of the second fiscal year beginning after the date of the transfer.</text></subparagraph></paragraph></subsection><subsection id="id373afbd782e14aa0a21c26dfb99ba65e"><enum>(e)</enum><header>Executive agreement</header><paragraph id="idc301db3c6dcd4d7f8901712d69b83342"><enum>(1)</enum><header>Fund administration</header><subparagraph commented="no" display-inline="no-display-inline" id="id01169faeabb041778c789150ca225bed"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Fund shall be administered in accordance with an executive agreement between the Secretary of Defense and the Secretary of Veterans Affairs.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id53639512f4504ac8b9831d7ac11cead3"><enum>(B)</enum><header>Guidelines</header><text display-inline="yes-display-inline">The executive agreement under subparagraph (A) shall be consistent with section 706 of the Duncan Hunter National Defense Authorization Act for Fiscal Year 2009 (<external-xref legal-doc="public-law" parsable-cite="pl/110/417">Public Law 110–417</external-xref>; 122 Stat. 4500) and shall provide for an independent review of the methodology established under subsection (c)(1).</text></subparagraph></paragraph><paragraph id="idb8cc0d0d91294415b70bdddf00e3a563"><enum>(2)</enum><header>Financial reconciliation</header><subparagraph commented="no" display-inline="no-display-inline" id="id77024b1b3340417eb6e6fe2f5e426b49"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The executive agreement between the Secretary of Defense and the Secretary of Veterans Affairs under paragraph (1)(A) shall provide for the development and implementation of an integrated financial reconciliation process that meets the fiscal reconciliation requirements of the Department of Defense and the Department of Veterans Affairs.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id214bbd426e5a49a4b08c2249282aad1f"><enum>(B)</enum><header>Identification of contributions</header><text display-inline="yes-display-inline">The process under subparagraph (A) shall permit the Department of Defense and the Department of Veterans Affairs to identify their fiscal contributions to the Fund, taking into consideration accounting, workload, and financial management differences.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id8b65e7d22e974a73be2f1f561a4cb0c2"><enum>(b)</enum><header>Conforming repeal</header><text>Section 1704 of the National Defense Authorization Act for Fiscal Year 2010 (<external-xref legal-doc="public-law" parsable-cite="pl/111/84">Public Law 111–84</external-xref>; 123 Stat. 2571), as most recently amended by section 1421 of the Servicemember Quality of Life Improvement and National Defense Authorization Act for Fiscal Year 2025 (<external-xref legal-doc="public-law" parsable-cite="pl/118/159">Public Law 118–159</external-xref>), is repealed.</text></subsection><subsection id="id6a3b0f1bf76149a084c79c97e0479d8f"><enum>(c)</enum><header>Report</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of Defense and the Secretary of Veterans Affairs shall jointly submit to the Committee on Veterans’ Affairs and the Committee on Appropriations of the Senate and the Committee on Veterans’ Affairs and the Committee on Appropriations of the House of Representatives a report indicating medical facilities of the Department of Defense or the Department of Veterans Affairs that either Secretary, or both, considers appropriate to be designated as combined Federal medical facilities of the Department of Defense and the Department of Veterans Affairs.</text></subsection></section></legis-body></bill>
