<bill bill-stage="Introduced-in-Senate" dms-id="A1" public-private="public" slc-id="S1-SIL26317-FXT-0C-M46"><form><distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 3960</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260302">March 2, 2026</action-date><action-desc><sponsor name-id="S253">Mr. Durbin</sponsor> (for himself, <cosponsor name-id="S346">Mr. Lee</cosponsor>, <cosponsor name-id="S337">Mr. Coons</cosponsor>, and <cosponsor name-id="S318">Mr. Wicker</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To give Federal courts additional discretion to determine whether pretrial detention is appropriate for defendants charged with nonviolent drug offenses in Federal criminal cases.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Smarter Pretrial Detention for Drug Charges Act of 2026</short-title></quote>.</text></section><section commented="no" id="id59bb8a45b11144cd842c5f918a472b3b"><enum>2.</enum><header>Release conditions and detention in Federal criminal cases</header><text display-inline="no-display-inline">Section 3142 of title 18, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id07C14BAF561041AD8676A90988F6345B"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>(42 U.S.C. 14135a)</quote> each place it appears and inserting <quote>(34 U.S.C. 40702)</quote>; and</text></paragraph><paragraph commented="no" id="id06641f9d3db748058f78274d1dda0cc9"><enum>(2)</enum><text>in subsection (e)(3)—</text><subparagraph commented="no" id="idC401683D2AFB4C9A9852956F5154CCA4"><enum>(A)</enum><text>by striking subparagraph (A); and</text></subparagraph><subparagraph commented="no" id="idF9CC093AF51A4458B7FC1679CFDC9338"><enum>(B)</enum><text>by redesignating subparagraphs (B), (C), (D), and (E) as subparagraphs (A), (B), (C), and (D), respectively.</text></subparagraph></paragraph></section></legis-body></bill>
