which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Food and Nutrition Act of 2008 to transition Puerto Rico to the supplemental nutrition assistance program, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HC9D30D336AA84083B2C79EB6BDA79296"><section section-type="section-one" id="HFB8854D7480E4ACF9933ECB649DFC241"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Puerto Rico Nutrition Assistance Fairness Act</short-title></quote>.</text></section><section id="HB1F77771D1C149DDB72AD9B9D30DC90C"><enum>2.</enum><header>Amendments to the Food and Nutrition Act of 2008</header><subsection id="HE0785CDB18404715BE602C1D3F7B5834"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 3 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2012">7 U.S.C. 2012</external-xref>) is amended—</text><paragraph id="H7D86F079180B4428B229104A8F6543BC"><enum>(1)</enum><text>in subsection (r), by inserting <quote>Puerto Rico,</quote> after <quote>Guam,</quote>; and</text></paragraph><paragraph commented="no" id="H0F8F81C4CC124F80ACB3328CA758AB72"><enum>(2)</enum><text>in subsection (u)(3), by striking subparagraph (A) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7130bbb0f66c4aeb9c649d45c5c016a9"><subparagraph commented="no" display-inline="no-display-inline" id="id2da7a50663144a9bb624b9d71286be9a"><enum>(A)</enum><text>make cost adjustments in the thrifty food plan for Hawaii, the urban and rural parts of Alaska, and Puerto Rico to reflect the cost of food in Hawaii, the urban and rural parts of Alaska, and Puerto Rico, respectively;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H3076813889E540379444AC083A7D02FF"><enum>(b)</enum><header>Eligible households</header><text>Section 5 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2014">7 U.S.C. 2014</external-xref>) is amended—</text><paragraph id="H44ECDED77C87404D8A213C2809BA0A0E"><enum>(1)</enum><text>in subsection (b), in the first sentence, by inserting <quote>Puerto Rico,</quote> after <quote>Guam,</quote>;</text></paragraph><paragraph id="HCA890082CA6E416F9533F3DC1ED81DA4"><enum>(2)</enum><text>in subsection (c)(1), by striking <quote>and Guam</quote> and inserting <quote>Guam, and Puerto Rico</quote>; and</text></paragraph><paragraph id="HB6C87A12413E4FEEBF5A1FBF7897FFAD"><enum>(3)</enum><text>in subsection (e)—</text><subparagraph id="HEAD3A041DBD34D8F9CF479BACF2D09FD"><enum>(A)</enum><text>in paragraph (1)(A), by inserting <quote>Puerto Rico,</quote> after <quote>Hawaii,</quote> each place it appears; and</text></subparagraph><subparagraph id="H787890BC21884D138AF8447CC0E61AA7"><enum>(B)</enum><text>in paragraph (6)(B), in the matter preceding clause (i), by inserting <quote>Puerto Rico,</quote> after <quote>Guam,</quote>.</text></subparagraph></paragraph></subsection></section><section id="H99EA0FD3A028442D8128EEDE884B1548"><enum>3.</enum><header>Submission of plan of operation; technical assistance; determination and certification by Secretary of Agriculture</header><subsection id="H8853F70CDE0D47B680BF2555296956BD"><enum>(a)</enum><header>Submission of plan of operation</header><text display-inline="yes-display-inline">On designating an agency of the kind described in section 3(s)(1) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2012">7 U.S.C. 2012(s)(1)</external-xref>), Puerto Rico shall have 180 days to submit to the Secretary of Agriculture (in this Act referred to as the <quote>Secretary</quote>) its plan of operation, including a plan to transition to the supplemental nutrition assistance program under section 4(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2013">7 U.S.C. 2013(a)</external-xref>) as a request to participate in the supplemental nutrition assistance program under such Act.</text></subsection><subsection id="H3BA9B7B801344032BF125E34FCF5ACEB"><enum>(b)</enum><header>Technical assistance</header><text>Within the 180-day period specified in subsection (a) and upon request from Puerto Rico, the Secretary shall provide appropriate training and technical assistance to enable Puerto Rico to formulate a plan of operation described in subsection (a).</text></subsection><subsection id="HA0EDF190AD89456C82F77C54C698C7AE"><enum>(c)</enum><header>Determination by the Secretary of Agriculture</header><text>Not later than 180 days after receiving a plan of operation described in subsection (a), the Secretary shall approve the plan of operation if such plan satisfies the requirements for a supplemental nutrition assistance program State plan in accordance with subsections (d) and (e) of section 11 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2020">7 U.S.C. 2020</external-xref>). If the Secretary does not approve such plan, the Secretary shall provide, not later than 30 days after disapproval, a statement that specifies each of the requirements that were not satisfied by such plan.</text></subsection><subsection id="H2FE18DC6C2384A49941FB4663C21481D"><enum>(d)</enum><header>Certification by the Secretary of Agriculture</header><text display-inline="yes-display-inline">If the Secretary approves the plan submitted by Puerto Rico under subsection (a), the Secretary shall submit to the Congress, not later than 90 days thereafter, a certification that Puerto Rico qualifies to participate in the supplemental nutrition assistance program as a State as defined in section 3 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2012">7 U.S.C. 2012</external-xref>).</text></subsection></section><section id="H8FFFC80BF0E544F1AC0CF41AAFC2BB10"><enum>4.</enum><header>Transition from the consolidated block grant for Puerto Rico</header><subsection id="H43311604B3004087ACA6E9F3F88733BD"><enum>(a)</enum><header>Covered period</header><text>The Secretary may continue to implement the then most recent approved consolidated block grant specified in section 19(b)(1)(A) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2028">7 U.S.C. 2028(b)(1)(A)</external-xref>) for an implementation period ending 5 years after the effective date of the amendments made by this Act, or on the date the Secretary determines that Puerto Rico no longer needs to operate the consolidated block grant to complete the transition described in section 3(a), whichever occurs first.</text></subsection><subsection id="H6609171E203D470AAB2CF362DCF76B9E"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">For each year a plan is continued under subsection (a), the Secretary shall submit to the Congress an annual report on the operation of such plan. The Secretary shall include in such report information related to increases in funding that are required to accommodate the transition of Puerto Rico from the receipt of block grant payments to the implementation of supplemental nutrition assistance program.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="H1EDE9213A1C244F78CE7AE832F0F1BBB"><enum>5.</enum><header>Consolidated block grant for Puerto Rico and American Samoa</header><text display-inline="no-display-inline">Section 19 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2028">7 U.S.C. 2028</external-xref>) is amended—</text><paragraph commented="no" id="HB06B2A8DD22345938A34E114769F0A8A"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph commented="no" id="H5A52A3F2F28147EABEAF019B307A7522"><enum>(A)</enum><text>in paragraph (1)(A), by inserting <quote>until the end of the period described in section 4(a) of the <short-title>Puerto Rico Nutrition Assistance Fairness Act</short-title>,</quote> before <quote>the Commonwealth</quote>;</text></subparagraph><subparagraph commented="no" id="HEF79FC9CD6CD440EBBDC68EA35B48B39"><enum>(B)</enum><text>in paragraph (2)—</text><clause commented="no" id="HAD1E0BE9C96D427A93AAF161D23B3955"><enum>(i)</enum><text>in subparagraph (A)—</text><subclause commented="no" id="H7E45525D580A41E5BFD63D90424D9122"><enum>(I)</enum><text>in clause (i), by striking <quote>and</quote> at the end, and</text></subclause><subclause commented="no" id="HBCD4E9780A6C4C999537FAACD407C958"><enum>(II)</enum><text>in clause (ii)—</text><item commented="no" id="HB0079932F6BE46AA8AC36E20B69353B2"><enum>(aa)</enum><text>by inserting <quote>ending at the end of the period described in section 4(a) of the <short-title>Puerto Rico Nutrition Assistance Fairness Act</short-title></quote> after <quote>thereafter</quote>;</text></item><item commented="no" id="H1221F0A228934193AAFD0005235320CA"><enum>(bb)</enum><text>by striking the period at the end and inserting <quote>; and</quote>; and</text></item><item commented="no" id="H052BA991AA254733AC05577B255BAD79"><enum>(cc)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H5D49626EE8D04625BEDA7D2C34CE548A"><clause commented="no" id="H14C8A848AB6E4605B1470003092F3963"><enum>(iii)</enum><text display-inline="yes-display-inline">subject to the availability of appropriations under section 18(a), for each fiscal year beginning after the end of the period described in section 4(a) of the <short-title>Puerto Rico Nutrition Assistance Fairness Act</short-title>, 0.4 percent of the aggregate amount specified in clause (i) and adjusted under clause (ii), as further adjusted by the percentage by which the thrifty food plan has been adjusted under section 3(u)(3) between June 30 of the penultimate fiscal year preceding such effective date and June 30 of the fiscal year for which the adjustment is made under this clause.</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></item></subclause></clause><clause commented="no" id="H8076B75E98174EE6A1113FE3DC4C565B"><enum>(ii)</enum><text>in subparagraph (B)(i), in the matter preceding subclause (I), by inserting <quote>ending at the end of the period described in section 4(a) of the <short-title>Puerto Rico Nutrition Assistance Fairness Act</short-title></quote> after <quote>thereafter</quote>; and</text></clause><clause commented="no" id="HE917CB9E40C54C948332E242812AE366"><enum>(iii)</enum><text>in subparagraph (C)—</text><subclause commented="no" id="HF47BCFCA604A45759EFEC7BFDFFDFCCD"><enum>(I)</enum><text>by striking <quote>For</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H83463DCDCF3A49A2A8E66D69AD4E4055"><clause commented="no" id="H8E72B2911D75481781C7922857695DA5"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">For</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></subclause><subclause commented="no" id="H9204E47195704B8DB8C6A441DA83DD88"><enum>(II)</enum><text>in clause (i) (as so designated), by inserting <quote>ending at the end of the period described in section 4(a) of the <short-title>Puerto Rico Nutrition Assistance Fairness Act</short-title></quote> after <quote>thereafter</quote>; and</text></subclause><subclause commented="no" id="H2A0B42993ECF4D32924724968EE8FE68"><enum>(III)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H0E191D1E3B124A439C7A2B6D8D824C62"><clause commented="no" id="H3B2F86A0639F4BB09BA5F1881F0FF5DF"><enum>(ii)</enum><header>Full use of funds</header><text display-inline="yes-display-inline">For each fiscal year beginning after the end of the period described in section 4(a) of the <short-title>Puerto Rico Nutrition Assistance Fairness Act</short-title>, the Secretary shall use 100 percent of the funds made available under subparagraph (A) for payment to American Samoa to pay 100 percent of the expenditures by American Samoa for a nutrition assistance program extended under section 601(c) of <external-xref legal-doc="public-law" parsable-cite="pl/96/597">Public Law 96–597</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/48/1469d">48 U.S.C. 1469d(c)</external-xref>).</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subclause></clause></subparagraph><subparagraph commented="no" id="H50AA861B4E2A412E9745BB0551DE3535"><enum>(C)</enum><text>in paragraph (3), by inserting <quote>until the end of the period described in section 4(a) of the <short-title>Puerto Rico Nutrition Assistance Fairness Act</short-title>,</quote> before <quote>pay to</quote>; and</text></subparagraph></paragraph><paragraph commented="no" id="H2B334C1290594B178F69116F3F70F4A3"><enum>(2)</enum><text>in subsection (b)(1)(A), in the first sentence, by striking <quote>In order to receive payments under this Act for any fiscal year</quote> and inserting <quote>Until the end of the period described in section 4(a) of the <short-title>Puerto Rico Nutrition Assistance Fairness Act</short-title>, to receive payments under this Act for a fiscal year</quote>.</text></paragraph></section><section id="HCACE86AB38714516A4465ADA5B9EC33E"><enum>6.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated to carry out this Act such sums as may be necessary until the end of the period described in section 4(a).</text></section><section display-inline="no-display-inline" id="HA436BB55879F4D91B8C6A1762498373A"><enum>7.</enum><header>Effective dates</header><subsection id="HEB490D8D306B429FB9B66A6DDDD265F0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subsection (b), this Act shall take effect on the date of the enactment of this Act.</text></subsection><subsection id="H0C1D20771CFD4169AF5C24C0E407E678"><enum>(b)</enum><header>Effective date of amendments</header><text>The amendments made by this Act shall take effect on the date that is 10 years after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
