<bill bill-stage="Introduced-in-Senate" dms-id="A1" public-private="public" slc-id="S1-WIL26096-GVS-P3-4MK"><form><distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 3957</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260302">March 2, 2026</action-date><action-desc><sponsor name-id="S347">Mr. Moran</sponsor> (for himself and <cosponsor name-id="S275">Ms. Cantwell</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To support National Science Foundation education and professional development relating to artificial intelligence.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="idb88a8d1f-bc8a-4c43-adc2-ea700fd59e57" changed="not-changed"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>NSF AI Education Act of 2026</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id2d04576a-0833-4536-a34b-19f3bcf6d81f" changed="not-changed"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" id="id8bc8299c-2c91-4713-b8ff-b6a9bba4a8f1" changed="not-changed"><enum>(1)</enum><header>ESEA Terms</header><text>The terms <term>educational service agency</term>, <term>elementary school</term>, <term>high school</term>, <term>local educational agency</term>, <term>secondary school</term>, <term>State educational agency</term>, and <term>universal design for learning</term> have the meanings given those terms in section 8101 of the Elementary and Secondary Education Act of 1965 (20 U.S.C. 7801).</text></paragraph><paragraph commented="no" id="id4C0AF04EE4FC43B28BA15773B5674CC7" changed="not-changed"><enum>(2)</enum><header>Artificial intelligence; AI</header><text>The term <term>artificial intelligence</term> or <term>AI</term> has the meaning given such term in section 5002 of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (15 U.S.C. 9401).</text></paragraph><paragraph id="idfc8091a9-6fcb-4988-97d1-187d91a866c0" changed="not-changed"><enum>(3)</enum><header>Community college</header><text>The term <term>community college</term> means—</text><subparagraph id="id152358D5D176486F80166DE70F0F876B" changed="not-changed"><enum>(A)</enum><text>an institution that is a junior or community college, as such term is defined in section 312(f) of the Higher Education Act of 1965 (20 U.S.C. 1058(f));</text></subparagraph><subparagraph id="id14D70DF362864066A2E29FFEBB7FF533" changed="not-changed"><enum>(B)</enum><text>a degree-granting public institution of higher education at which—</text><clause id="ided08570a0caa431bb3b7e0eea22e174f" changed="not-changed"><enum>(i)</enum><text>the highest degree awarded is an associate degree; or</text></clause><clause id="idf96a540eb3b543be937db831183aa0c9" changed="not-changed"><enum>(ii)</enum><text>an associate degree is the most frequently awarded degree;</text></clause></subparagraph><subparagraph id="id09b8ded4fb794508880092701e7b39c2" changed="not-changed"><enum>(C)</enum><text>an eligible Tribal College or University; or</text></subparagraph><subparagraph id="id8fb4379735084dcb82d288133dded577" changed="not-changed"><enum>(D)</enum><text>a branch campus of a four-year public institution of higher education, if, at such branch campus—</text><clause id="ide8aad9c6392f476bb550a0610571a6aa" changed="not-changed"><enum>(i)</enum><text>the highest degree awarded is an associate degree; or</text></clause><clause id="id3fbeb4dd6c744700ba4b968920c9edc4" changed="not-changed"><enum>(ii)</enum><text>an associate degree is the most frequently awarded degree.</text></clause></subparagraph></paragraph><paragraph id="id490d77ba-4606-4b2b-bc6c-33da51ef590e" changed="not-changed"><enum>(4)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the National Science Foundation.</text></paragraph><paragraph id="id4428261e-3d80-4187-ac0a-50df7ad1c178" changed="not-changed"><enum>(5)</enum><header>Emerging research institution</header><text>The term <term>emerging research institution</term> has the meaning given the term in section 10002 of the Research and Development, Competition, and Innovation Act (42 U.S.C. 18901).</text></paragraph><paragraph commented="no" id="idcfb065e8-14d5-4198-94e5-6220bffc06b8" changed="not-changed"><enum>(6)</enum><header><enum-in-header>EPSCoR</enum-in-header> institution</header><text display-inline="yes-display-inline">The term <term>EPSCoR institution</term> means an institution of higher education, nonprofit organization, or other institution located in a jurisdiction eligible to participate in the Established Program to Stimulate Competitive Research under section 113 of the National Science Foundation Authorization Act of 1988 (42 U.S.C. 1862g).</text></paragraph><paragraph id="id74a08a6a47a74a39b0cdaea728e59f4b" changed="not-changed"><enum>(7)</enum><header>Foreign country of concern</header><text>The term <term>foreign country of concern</term> means a country that is a covered nation, as defined in section 4872(f) of title 10, United States Code.</text></paragraph><paragraph id="id712971f6c88e4974a4f16e0e6b70fc9f" changed="not-changed"><enum>(8)</enum><header>Foreign entity of concern</header><text>The term <term>foreign entity of concern</term> has the meaning given the term in section 10612 of the Research and Development, Competition, and Innovation Act (42 U.S.C. 19221).</text></paragraph><paragraph commented="no" id="ida54712a5-246e-4a58-b393-7d4f2e78d1aa" changed="not-changed">
        <enum>(9)</enum>
        <header>Historically Black college and university</header>
        <text>The term <term>historically Black college and university</term> has the meaning given
          the term <term>part B institution</term> in section 322 of the Higher Education Act of
          1965 (20 U.S.C. 1061).</text>
      </paragraph><paragraph commented="no" id="id3ede407c-f7aa-4284-a09c-20d27dafb7a8" changed="not-changed"><enum>(10)</enum><header>Institution of higher education</header><text display-inline="yes-display-inline">The term <term>institution of higher education</term> has the meaning given the term in section 101(a) of the Higher Education Act of 1965 (20 U.S.C. 1001(a)).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3a0632aa-cb24-43d2-99d3-b7befa2c7fff" changed="not-changed"><enum>(11)</enum><header>Key emerging technologies</header><text>The term <term>key emerging technologies</term> means the technologies included in the initial list of key technology focus areas set forth by section 10387(c) of the Research and Development, Competition, and Innovation Act (42 U.S.C. 19107(c)), photonics, and electronics.</text></paragraph><paragraph commented="no" id="id83dee68a-51f4-40bc-9107-f7e5c5f36fc6" changed="not-changed"><enum>(12)</enum><header>Labor organization</header><text>The term <term>labor organization</term> has the meaning given the term in section 2(5) of the National Labor Relations Act (29 U.S.C. 152(5)).</text></paragraph><paragraph id="ide5e635b3-8b38-47d6-ba45-30373bc0fd0d" changed="not-changed"><enum>(13)</enum><header>Minority-serving institution</header><text>The term <term>minority-serving institution</term> means an institution defined in any of paragraphs (1) through (7) of section 371(a) of the Higher Education Act of 1965 (20 U.S.C. 7801).</text></paragraph><paragraph id="idbf6c31bd-7ccd-4274-8173-d1e955cfd3b2" changed="not-changed"><enum>(14)</enum><header>National Laboratory</header><text>The term <term>National Laboratory</term> has the meaning given that term in section 2 of the Energy Policy Act of 2005 (42 U.S.C. 15801).</text></paragraph><paragraph commented="no" id="id9054c68d-d846-4ec1-bc1d-f5af1f7a3cfb" changed="not-changed"><enum>(15)</enum><header>Nonprofit organization</header><text>The term <term>nonprofit organization</term> means an organization which is described in section 501(c)(3) of the Internal Revenue Code of 1986 and exempt from tax under section 501(a) of such Code.</text></paragraph><paragraph id="id83c20e60-2df3-4606-9ec5-bd09dc3d698b" changed="not-changed"><enum>(16)</enum><header>Quantum hybrid computing</header><text>The term <term>quantum hybrid computing</term> means the use of quantum computing in conjunction with classical computing.</text></paragraph><paragraph id="id5fb5ae7d-5414-41fb-8fc0-b52969076ad7" changed="not-changed"><enum>(17)</enum><header>Quantum information science</header><text>The term <term>quantum information science</term> means the use of the laws of quantum physics for the storage, transmission, manipulation, computing, or measurement of information.</text></paragraph><paragraph id="ide8ff9f3b-7553-4fb1-84ba-60404ecb1664" changed="not-changed"><enum>(18)</enum><header>Rural-located institution of higher education</header><text>The term <term>rural-located institution of higher education</term> means an institution of higher education that is located in or near areas that are not classified as urban by the Census Bureau.</text></paragraph><paragraph id="ida6b896ac-b93c-4bb0-b64d-ef9a6bb99ae4" changed="not-changed"><enum>(19)</enum><header>Rural-serving institution of higher education</header><text>The term <term>rural-serving institution of higher education</term> means an institution of higher education that—</text><subparagraph id="idcac2e97d-fc36-4ce9-8214-a15f3e646315" changed="not-changed"><enum>(A)</enum><text>primarily serves areas that are not classified as urban by the Census Bureau; and</text></subparagraph><subparagraph id="id8bc399ba-8ddd-4c21-bcb2-dfbe0a5400a3" changed="not-changed"><enum>(B)</enum><text>offers degrees that are unique and helpful to rural regions that are not classified as urban by the Census Bureau.</text></subparagraph></paragraph><paragraph commented="no" id="ida002887a-0288-4233-ae6d-1e897e1c972d" changed="not-changed"><enum>(20)</enum><header>STEM</header><text>The term <term>STEM</term> means science, technology, engineering, and mathematics, including computer science.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1dbdf757-f1f3-47cf-ac3a-a7ca862e59d5" changed="not-changed"><enum>(21)</enum><header>Tribal College or University</header><text>The term <term>Tribal College or University</term> has the meaning given the term in section 316(b) of the Higher Education Act of 1965 (20 U.S.C. 1059c(b)).</text></paragraph></section><section id="id6cd50d80-92d1-476f-9e52-c7cb2c5bb080" changed="not-changed"><enum>3.</enum><header>Undergraduate scholarships for artificial intelligence education</header><subsection id="idd0111b34-cd48-4884-a287-0f31b6c270b4" changed="not-changed"><enum>(a)</enum><header>Scholarships related to AI or quantum hybrid computing</header><paragraph id="id858a3173-1163-4e57-a002-a4d01baee2f1" changed="not-changed"><enum>(1)</enum><header>In general</header><text>Subject to section 15, the Director shall award merit- or need-based scholarships to undergraduate students at institutions of higher education in order to enable such students to study—</text><subparagraph id="id28d2b500-a178-4bbd-b831-a2bfea820192" changed="not-changed"><enum>(A)</enum><text>the development, deployment, integration, or application of artificial intelligence; or</text></subparagraph><subparagraph id="id706557ae-4939-4c2d-9b01-d2a9b967fc3a" changed="not-changed"><enum>(B)</enum><text>quantum hybrid computing.</text></subparagraph></paragraph><paragraph id="id856a245f-fc02-46bf-ad11-d63f9a888cf5" changed="not-changed"><enum>(2)</enum><header>Scholarships</header><text>Scholarships awarded under paragraph (1) shall be in the form of annual grant awards for not more than a 4-year period in amounts that cover the cost of tuition, education-related fees, and a stipend. Such scholarships shall be paid directly to the institution of higher education in which the student is enrolled.</text></paragraph></subsection><subsection id="id9d7a6307-aa24-471d-98f3-69999ddf8386" changed="not-changed"><enum>(b)</enum><header>Scholarships related to AI and agriculture</header><paragraph id="id9a974734-581c-4570-8064-4af7db6c0ff0" changed="not-changed"><enum>(1)</enum><header>In general</header><text>Subject to section 15, the Director shall award merit- or need-based scholarships to undergraduate students at institutions of higher education in order to enable such students to study—</text><subparagraph id="idbc437456-a30e-48e7-8375-4367e5454f8d" changed="not-changed"><enum>(A)</enum><text>artificial intelligence and agriculture; or</text></subparagraph><subparagraph id="id39accf2b-f49e-4382-b459-ef9e1b64ef16" changed="not-changed"><enum>(B)</enum><text>the integration of artificial intelligence into agricultural operations, prediction, and decisionmaking.</text></subparagraph></paragraph><paragraph id="id0feb6b58-048d-411f-a8cb-9786b627975f" changed="not-changed"><enum>(2)</enum><header>Priority</header><text>In awarding scholarships under this subsection, the Director shall give preference to students who are attending rural-located institutions of higher education, rural-serving institutions of higher education, Tribal Colleges or Universities, or minority-serving institutions (including historically Black colleges and universities).</text></paragraph><paragraph id="id32ec867a-73d1-4360-b8f1-abe2ba521d90" changed="not-changed"><enum>(3)</enum><header>Scholarships</header><text>Scholarships awarded under paragraph (1) shall be in the form of annual grant awards for not more than a 4-year period in amounts that cover the cost of tuition, education-related fees, and a stipend. Such scholarships shall be paid directly to the institution of higher education in which the student is enrolled.</text></paragraph></subsection><subsection id="id6bd003e3-9580-4e1e-9f15-baa254cfb395" changed="not-changed"><enum>(c)</enum><header>Scholarships related to AI and education</header><paragraph id="id106c3588-24b7-4f2a-9b9d-43ee5b3f545a" changed="not-changed"><enum>(1)</enum><header>In general</header><text>Subject to section 15, the Director shall award merit- or need-based scholarships to undergraduate students at institutions of higher education in order to enable such students to study the teaching of artificial intelligence and artificial intelligence skills at elementary schools, secondary schools, career and technical education schools, institutions of higher education, or through other higher education and professional education programs.</text></paragraph><paragraph id="id61daa4ff-b605-4ec2-b993-d99317460837" changed="not-changed"><enum>(2)</enum><header>Scholarships</header><text>Scholarships awarded under paragraph (1) shall be in the form of annual grant awards for not more than a 4-year period that cover the cost of tuition, education-related fees, and a stipend. Such scholarships shall be paid directly to the institution of higher education in which the student is enrolled.</text></paragraph></subsection><subsection id="idfc7dff33-7055-4a2e-ae7f-5975490cb16b" changed="not-changed"><enum>(d)</enum><header>Scholarships related to AI and advanced manufacturing</header><paragraph id="ide345ca87-8483-4de9-bc52-0c85ca3f2ae0" changed="not-changed"><enum>(1)</enum><header>In general</header><text>Subject to section 15, the Director shall award merit- or need-based scholarships to undergraduate students at institutions of higher education in order to enable such students to study—</text><subparagraph id="idf1dfa8b9-323e-42de-ba17-76a6da5613e0" changed="not-changed"><enum>(A)</enum><text>artificial intelligence and advanced manufacturing; or</text></subparagraph><subparagraph id="ide26581d1-5473-41db-b984-eb700b995682" changed="not-changed"><enum>(B)</enum><text>the integration of artificial intelligence into advanced manufacturing operations.</text></subparagraph></paragraph><paragraph id="idcfc0f5c6-11f3-4e14-81a1-464f8512dac6" changed="not-changed"><enum>(2)</enum><header>Scholarships</header><text>Scholarships awarded under paragraph (1) shall be in the form of annual grant awards for a 4-year period that cover the cost of tuition, education-related fees, and a stipend. Such scholarships shall be paid directly to the institution of higher education in which the student is enrolled.</text></paragraph></subsection><subsection commented="no" id="id127c85be-a14a-4704-8eea-01eb378a7126" changed="not-changed"><enum>(e)</enum><header>Method</header><text>The Director may carry out this section by making awards through new or existing programs.</text></subsection></section><section id="id80ff279e-c7f0-4c3a-a417-bfdda3d4c335" changed="not-changed"><enum>4.</enum><header>Graduate scholarships for artificial intelligence education</header><subsection id="id3f2ef4f0-4bf9-483a-9418-58cb4719c031" changed="not-changed"><enum>(a)</enum><header>Graduate scholarships related to AI or quantum hybrid computing</header><text>Subject to section 15, the Director shall award merit- or need-based scholarships to graduate students at institutions of higher education in order to enable such students to study—</text><paragraph id="ida04dc544-7eb1-44ea-b693-f1f0dba99412" changed="not-changed"><enum>(1)</enum><text>the development, deployment, integration, or application of artificial intelligence; or</text></paragraph><paragraph id="id52417afe-225f-44cc-9c13-10f97bb8b958" changed="not-changed"><enum>(2)</enum><text>quantum hybrid computing.</text></paragraph></subsection><subsection id="idbc620a27-336d-400b-b825-84aec905f7b7" changed="not-changed"><enum>(b)</enum><header>Scholarships Related to AI and Agriculture</header><paragraph id="idb6ff6962-baec-419a-864a-f372f4344e1f" changed="not-changed"><enum>(1)</enum><header>In general</header><text>Subject to section 15, the Director shall award merit- or need-based scholarships to graduate students at institutions of higher education in order to enable such students to study—</text><subparagraph id="id1da5563a-5300-40f0-a15f-70ab55fa22d9" changed="not-changed"><enum>(A)</enum><text>artificial intelligence and agriculture; or</text></subparagraph><subparagraph id="id271e65bd-1d73-4912-8722-9b189640fb80" changed="not-changed"><enum>(B)</enum><text>the integration of artificial intelligence into agricultural operations, prediction, and decisionmaking.</text></subparagraph></paragraph><paragraph id="id82a27da3-5e9b-4030-baa1-c688b0d3ba47" changed="not-changed"><enum>(2)</enum><header>Priority</header><text>In awarding scholarships under this subsection, the Director shall give preference to students who are attending rural-located institutions of higher education, rural-serving institutions of higher education, Tribal Colleges or Universities, or minority-serving institutions (including historically Black colleges and universities).</text></paragraph></subsection><subsection id="id7621e202-2e4d-4152-a57d-94b9faa7fea2" changed="not-changed"><enum>(c)</enum><header>Graduate scholarships related to AI and education</header><text>Subject to section 15, the Director shall award merit- or need-based scholarships to graduate students at institutions of higher education in order to enable such students to study the teaching of artificial intelligence and artificial intelligence skills at elementary schools, secondary schools, career and technical education schools, institutions of higher education, or through other higher education and professional education programs.</text></subsection><subsection id="idb1dc44ef-7132-4fef-abf9-ef4497e44f90" changed="not-changed"><enum>(d)</enum><header>Graduate scholarships related to AI and advanced manufacturing</header><text>Subject to section 15, the Director shall award merit- or need-based scholarships to graduate students at institutions of higher education in order to enable such students to study—</text><paragraph id="id3bef1c10-7215-4d83-9e55-b8372a65db8e" changed="not-changed"><enum>(1)</enum><text>artificial intelligence and advanced manufacturing; or</text></paragraph><paragraph id="id066d8777-c3c3-4d8b-a000-fb0fb29a7bad" changed="not-changed"><enum>(2)</enum><text>the integration of artificial intelligence into advanced manufacturing operations.</text></paragraph></subsection><subsection id="ide4db10a2-8fbc-48e6-ab7c-a30c1026f966" changed="not-changed"><enum>(e)</enum><header>Scholarships</header><text>Scholarships awarded under this section shall be in the form of annual grant awards for not more than a 3-year period that cover the cost of tuition, education-related fees, and a stipend. Such scholarships shall be paid directly to the institution of higher education in which the student is enrolled.</text></subsection><subsection commented="no" id="id3da57f3b-eca7-4860-b8db-4cf99845afa2" changed="not-changed"><enum>(f)</enum><header>Method</header><text>The Director may carry out this section by making awards through new or existing programs.</text></subsection></section><section id="idd14a32eb-3494-4ff2-a581-9de1d0c758a5" changed="not-changed"><enum>5.</enum><header>NSF artificial intelligence professional development fellowships</header><subsection id="id31e18553-0a85-4341-9d3a-7287d1ec6888" changed="not-changed"><enum>(a)</enum><header>In General</header><text display-inline="yes-display-inline">Subject to section 15, the Director shall establish a program to promote the exchange of ideas and encourage collaborations between institutions of higher education and industry partners in the fields of artificial intelligence and key emerging technologies, including through fellowships for students, teachers, faculty at institutions of higher education, and industry professionals.</text></subsection><subsection id="idf87a8ecc-9147-49dc-8e5f-466c6e1d7396" changed="not-changed"><enum>(b)</enum><header>Fellowships</header><paragraph id="idb58eb583-d557-4d9f-8d34-b682dfa791c3" changed="not-changed"><enum>(1)</enum><header>In General</header><text>The Director shall award merit-based fellowships for professionals for professional development programs in STEM fields or the field of education that are administered by or affiliated with institutions of higher education, in order to enable fellowship recipients to attain skills or training in AI-related subjects, including—</text><subparagraph id="idaf48dffc-5445-4fbb-a0db-4bcb78da17d7" changed="not-changed"><enum>(A)</enum><text>the development, deployment, integration, or application of artificial intelligence;</text></subparagraph><subparagraph id="idf42c758c-7b58-47af-9623-517e9e680054" changed="not-changed"><enum>(B)</enum><text>prompt engineering; or</text></subparagraph><subparagraph id="id95cd6fba-21a5-49a8-96f9-70f2df65d5c6" changed="not-changed"><enum>(C)</enum><text>quantum hybrid computing.</text></subparagraph></paragraph><paragraph id="idda0a1723-f826-4694-9e25-3ae8dbb46ea7" changed="not-changed"><enum>(2)</enum><header>Fellowship awards</header><text>Awards under this subsection shall be in the form of one annual award that covers the cost of tuition, education-related fees, and a stipend. Such awards shall be paid directly to the institution of higher education that administers, or that is affiliated with, the program in which the fellowship recipient is participating.</text></paragraph></subsection><subsection id="id38ad34c3a92a4a9a9c5160c90d4507f6" changed="not-changed"><enum>(c)</enum><header>Application</header><text>An applicant for a fellowship under this section shall submit to the Director an application at such time, in such manner, and containing such information as the Director may require. The Director shall set minimum standards for participation in the fellowship program established under this section.</text></subsection><subsection id="idd149342e79ef49769c0866f4461e97af" changed="not-changed"><enum>(d)</enum><header>Method</header><text>The Director may carry out this section through new or existing programs.</text></subsection></section><section id="id8fb98464-2fa7-43c6-bcb2-e87364a3a004" changed="not-changed"><enum>6.</enum><header>Artificial intelligence training for land-grant colleges and universities</header><subsection id="id1d724bc4-1570-4ec7-8a99-204eb6289b27" changed="not-changed"><enum>(a)</enum><header>In general</header><text>Subject to section 15, the Secretary of Agriculture, acting through the Director of the National Institute of Food and Agriculture, in collaboration with the Director of the National Science Foundation, shall award grants to land-grant colleges and universities (as defined in section 1404 of the National Agricultural Research, Extension, and Teaching Policy Act of 1977 (7 U.S.C. 3103)) for artificial intelligence in agriculture.</text></subsection><subsection id="id4fcc0a3c-d5d5-4d6a-8285-67ffa4f29661" changed="not-changed"><enum>(b)</enum><header>Use of funds</header><text>A grant awarded under this section may be used for—</text><paragraph id="ide3fbe9f3-ef0d-41c6-a88c-08bcbeade1f5" changed="not-changed"><enum>(1)</enum><text>research and development on the use of artificial intelligence in agriculture or the integration of artificial intelligence into agricultural operations, predictions, and decision making;</text></paragraph><paragraph id="id6441b1ff-6a26-438a-9a67-a08776b72b8f" changed="not-changed"><enum>(2)</enum><text>the dissemination of educational resources for artificial intelligence in rural areas; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf344150e-f08a-4b78-bb6b-0ad8310683e7" changed="not-changed"><enum>(3)</enum><text>acquisition and deployment of artificial intelligence tools for agriculture.</text></paragraph></subsection><subsection id="idacbb4765121e4259849b701b651782d5" changed="not-changed"><enum>(c)</enum><header>Method</header><text>The Director may carry out this section through new or existing programs.</text></subsection></section><section id="id0d8a2386-c27e-44e8-a9c3-36ece212b2e9" changed="not-changed"><enum>7.</enum><header>Quantum fellowships and scholarships</header><subsection id="id9c345825-e927-4ee4-9c4e-4081fbec8c81" changed="not-changed"><enum>(a)</enum><header>In general</header><text>The Director may establish or use existing programs to support fellowships and scholarships for students at institutions of higher education for the purpose of—</text><paragraph id="idfe84f011-9ce6-4b75-ad14-6ee4b5f4c327" changed="not-changed"><enum>(1)</enum><text>increasing quantum information science, engineering, and technology exposure for undergraduate and graduate STEM students; and</text></paragraph><paragraph id="id549ac5a0-3797-4697-8bdd-4bf61ae340be" changed="not-changed"><enum>(2)</enum><text>increasing post-graduation employment opportunities for STEM students who demonstrate interest in pursuing careers in quantum information science, engineering, and technology, or fields that support the quantum industry.</text></paragraph></subsection><subsection id="id2a56ed57-d474-40b8-930a-76e2a8981200" changed="not-changed"><enum>(b)</enum><header>Requirement</header><text>Eligible participants in the fellowship and scholarship program shall be enrolled in or have graduated from a STEM degree program at an institution of higher education.</text></subsection><subsection id="id34439fc9-5e79-431d-a07c-ac28ea551766" changed="not-changed"><enum>(c)</enum><header>Considerations</header><text>Eligible fellowships and scholarships may include temporary quantum-related positions at State or Federal agencies, National Laboratories, private sector entities, institutions of higher education, or other quantum-relevant entities, as determined appropriate by the Director.</text></subsection><subsection id="id9e98104b-ad3c-4276-aaff-2e433cde9e3f" changed="not-changed"><enum>(d)</enum><header>Competitive awards</header><text>Fellowships and scholarships shall be competitively awarded through a merit-review process. The Director may prioritize fellowships that include an industry partner that provides financial assistance to the applicant for direct or indirect costs.</text></subsection><subsection id="idd58deadff49c457b9486368e59ea9d03" changed="not-changed"><enum>(e)</enum><header>Fellows in Federal agencies subject to OMB ethics requirements</header><text>An individual participating in a fellowship with an assignment at a Federal agency shall be subject to the ethics requirements prescribed by the Director of the Office of Management and Budget that apply to an employee of such agency.</text></subsection><subsection id="id66b4c83733af459c8fb2f88ba4ff11b9" changed="not-changed"><enum>(f)</enum><header>Method</header><text>The Director may carry out this section through new or existing programs.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="id14edd5a0-69b1-4fa8-8393-d6bea59a2b22" changed="not-changed"><enum>8.</enum><header>NSF outreach campaign</header><subsection id="idbf4dbb6c-ede5-4a3f-b231-0995d8bd3a2b" changed="not-changed"><enum>(a)</enum><header>In general</header><text>Subject to section 15, the Director shall carry out a nationwide outreach campaign to students, teachers, principals, and other school leaders at elementary schools, secondary schools, career and technical education schools, institutions of higher education, or through other higher education and professional education programs to increase awareness about AI or quantum education opportunities at the National Science Foundation.</text></subsection><subsection id="idc73e4225-970a-428b-96aa-704a491ed800" changed="not-changed"><enum>(b)</enum><header>Priority</header><text>In carrying out such campaign, the Director shall prioritize outreach to underserved and rural areas.</text></subsection><subsection id="id04db5af40d3e437f88b20272286d4b80" changed="not-changed"><enum>(c)</enum><header>Method</header><text>The Director may carry out this section through new or existing programs.</text></subsection></section><section id="id5c05e26e-4b8b-48e9-8345-859505c8ae32" changed="not-changed"><enum>9.</enum><header>Community college and vocational school centers of AI excellence</header><subsection id="ide4eaeca2-7776-44f8-af1e-4f0e71387896" changed="not-changed"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id19440460-9eb6-40bf-ac76-350f9cb57839" changed="not-changed"><enum>(1)</enum><header>Area career and technical education school</header><text>The term <term>area career and technical education school</term> has the meaning given the term in section 3 of the Carl D. Perkins Career and Technical Education Act of 2006 (20 U.S.C. 2302).</text></paragraph><paragraph id="idaa92dcf3-af55-486f-9ccf-a069b436e73d" changed="not-changed"><enum>(2)</enum><header>Eligible applicant</header><text>The term <term>eligible applicant</term> means a community college, vocational school, or area career and technical education school in partnership with 1 or more of the following:</text><subparagraph id="id8df8fa4d-de1d-4570-8720-0464f08960bc" changed="not-changed"><enum>(A)</enum><text>A Federal, State, local, or Tribal government entity.</text></subparagraph><subparagraph id="idee9b46fd-859d-4430-b78e-271d540c372c" changed="not-changed"><enum>(B)</enum><text>An institution of higher education.</text></subparagraph><subparagraph id="id73785732-eec5-4605-a8ed-801b7af3e3f1" changed="not-changed"><enum>(C)</enum><text>An entity in private industry.</text></subparagraph><subparagraph id="ide07fea0a-8d8b-4ddf-9088-f065ad3762cb" changed="not-changed"><enum>(D)</enum><text>An economic development organization or venture development organization.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd75ceef3bd544c84b66838e8a5ea5605" changed="not-changed"><enum>(E)</enum><text>A labor organization or a nonprofit organization if such organization partners with an entity described in any of subparagraphs (A) through (D).</text></subparagraph></paragraph><paragraph id="id0ac6f0bf-cc70-41d6-9e22-6141b93c6d33" changed="not-changed"><enum>(3)</enum><header>Venture development organization</header><text>The term <term>venture development organization</term> has the meaning given the term in section 27(a) of the Stevenson-Wydler Act of 1980 (15 U.S.C. 3722(a)).</text></paragraph><paragraph id="idfd4398f0-0189-4e08-8df8-3e580588ad54" changed="not-changed"><enum>(4)</enum><header>Vocational school</header><text>The term <term>vocational school</term> has the meaning given the term <term>postsecondary vocational institution</term> in section 102(c) of the Higher Education Act of 1965 (20 U.S.C. 1002(c)).</text></paragraph></subsection><subsection id="ide7a27c0e-71e1-4014-88f0-ed35ad5bd24e" changed="not-changed"><enum>(b)</enum><header>Establishment of centers of AI excellence</header><text>Subject to section 15, the Director, in coordination with the Regional Technology Hubs program at the Department of Commerce and the Regional Innovation Engines program at the National Science Foundation, shall choose not less than 5 regionally and geographically diverse eligible applicants to be designated as Community College and Vocational School Centers of AI Excellence (referred to in this section as <quote>Centers of AI Excellence</quote>).</text></subsection><subsection id="idcc0bd119-9b4b-41a8-a13d-6e5176136d4e" changed="not-changed"><enum>(c)</enum><header>EPSCoR State participation</header><text>Not less than 20 percent of designated Community College and Vocational School Centers of AI Excellence shall be eligible applicants that are located in a State jurisdiction eligible to participate in the National Science Foundation’s Established Program to Stimulate Competitive Research under section 113 of the National Science Foundation Authorization Act of 1988 (42 U.S.C. 1862g).</text></subsection><subsection id="id69a0da81-ccb7-4e20-a023-16faa27db822" changed="not-changed"><enum>(d)</enum><header>Application</header><text>An eligible applicant that desires to be designated as a Center of AI Excellence shall submit an application to the Director at such time, in such manner, and containing such information as the Director may reasonably require. Such application shall specify a focus area or areas for the Center of AI Excellence, which may be any of the following:</text><paragraph id="id97bb06f4-87b2-48c4-8fb0-1c47c0412e34" changed="not-changed"><enum>(1)</enum><text>AI education and training related to agriculture.</text></paragraph><paragraph id="id4f7b4668-fe71-40b9-8b6c-69da79a5ca3c" changed="not-changed"><enum>(2)</enum><text>AI education and training related to manufacturing.</text></paragraph><paragraph id="ida05083d6-f687-4253-9fe2-ce71ae72eff4" changed="not-changed"><enum>(3)</enum><text>AI education and training related to applications of AI-based technology and AI literacy.</text></paragraph><paragraph id="id91aa4cae-f179-4214-b562-badd064ba31f" changed="not-changed"><enum>(4)</enum><text>AI education and training related to another focus area as specified by the eligible applicant.</text></paragraph></subsection><subsection id="id346e1769-a4e3-49ab-afa5-8f72d2eb3e55" changed="not-changed"><enum>(e)</enum><header>Activities</header><text>A designated Center of AI Excellence shall develop and disseminate information about best practices for—</text><paragraph id="idc3a1e809-aa81-4795-9edf-708c037bdd0a" changed="not-changed"><enum>(1)</enum><text>artificial intelligence research and education at community colleges and area career and technical education schools;</text></paragraph><paragraph id="id056101ed-3653-48fc-9d7f-77cad4cc5fed" changed="not-changed"><enum>(2)</enum><text>methods to scale up successful programs that perform research or provide education on artificial intelligence at community colleges and area career and technical education schools;</text></paragraph><paragraph id="idd015db80-2519-4254-a5bf-47cd50a1b8c0" changed="not-changed"><enum>(3)</enum><text>providing hands-on research opportunities on artificial intelligence and learning opportunities for students that are enabled through artificial intelligence; and</text></paragraph><paragraph id="id502f1b21-6ebc-463a-a86d-6409147d8e49" changed="not-changed"><enum>(4)</enum><text>identifying pathways to employment for students that are enabled by artificial intelligence.</text></paragraph></subsection><subsection id="idE34D87998C6C43758E5E2A196C58E2F2" changed="not-changed"><enum>(f)</enum><header>Performance measurement, transparency, and accountability</header><paragraph id="idcabf9ea8eb8441be8b575b8f3566059c" changed="not-changed"><enum>(1)</enum><header>Metrics, standards and assessment</header><text>The Director, in coordination with the Regional Technology Hubs program at the Department of Commerce and the Regional Innovation Engines program at the National Science Foundation, shall develop metrics to assess, and shall assess, the effectiveness of each designated Center of AI Excellence in carrying out the activities described in subsection (e).</text></paragraph><paragraph commented="no" id="idb0f0e4c32253414ca243d0f0a783e8d8" changed="not-changed"><enum>(2)</enum><header>Final reports by recipients of strategy implementation grants and cooperative agreements</header><text>The Director shall require each Center of AI Excellence designated under this section to submit to the Director a report on the activities of the Center of AI Excellence that are supported by Federal funds or Federal cooperative agreements.</text></paragraph></subsection><subsection id="id0cac0cd0621241a68379b4368da40ad7" changed="not-changed"><enum>(g)</enum><header>Annual reports to congress</header><text>Not less frequently than once each year, the Director shall submit to the appropriate committees of Congress an annual report on the results of the assessments conducted by the Director under subsection (f)(1) during the period covered by the report.</text></subsection><subsection id="id6dad9c8404c14736b1e1b5bd410b69a3" changed="not-changed"><enum>(h)</enum><header>Method</header><text>The Director may carry out this section through new or existing programs.</text></subsection><subsection id="ida97df16ce31847a8a0d337e1a81a49d0" changed="not-changed"><enum>(i)</enum><header>Sunset</header><text>The section shall cease to be effective, and the activities authorized under this section shall terminate on the date that is 7 years after the date of enactment of this Act.</text></subsection></section><section id="id7063f3a1-fa90-4afc-90cb-04e469f7585e" changed="not-changed"><enum>10.</enum><header>Award program for research on AI in education</header><subsection id="id5ced89a6-0b23-45d3-a4a8-d6f381c21e69" changed="not-changed"><enum>(a)</enum><header>Eligible entity</header><text>In this section, the term <term>eligible entity</term> means—</text><paragraph id="id52c27a9f-0708-4d16-8cdb-03d451c92c8f" changed="not-changed"><enum>(1)</enum><text>an institution of higher education;</text></paragraph><paragraph id="idcc743725-aeb8-4a1b-9dc3-4b17a1c4c3b4" changed="not-changed"><enum>(2)</enum><text>a nonprofit organization; or</text></paragraph><paragraph id="id14ad9db7-b49c-4c57-ad54-ee5fd86db7f9" changed="not-changed"><enum>(3)</enum><text>a consortium of 1 or more institutions of higher education or a nonprofit organization and 1 or more private entities.</text></paragraph></subsection><subsection id="ide7a8678b-994b-4a36-b7fe-6d71154d553f" changed="not-changed"><enum>(b)</enum><header>Program authorized</header><paragraph id="id43e676ed-b9a3-461d-ba8e-b9b9edd05489" changed="not-changed"><enum>(1)</enum><header>In general</header><text>Subject to section 15, the Director shall make awards, on a competitive, merit-reviewed basis, to eligible entities, to enable the eligible entities to promote research on teaching models, tools, and materials for artificial intelligence and integration with other key emerging technologies, such as quantum information science and technologies and photonics, with a focus on teaching and learning for elementary school and secondary school students who are from low-income, rural, or Tribal populations.</text></paragraph><paragraph id="idd9d4d770-d49e-463a-a0db-704c3dd4299a" changed="not-changed"><enum>(2)</enum><header>Method</header><text>The Director may carry out this section by making awards through new or existing programs.</text></paragraph></subsection><subsection id="id580e88a9-404d-4e1b-b173-16110ac72fdd" changed="not-changed"><enum>(c)</enum><header>Application</header><paragraph id="ida51f9831-8f2b-4bfe-8108-281d9898b8f6" changed="not-changed"><enum>(1)</enum><header>In general</header><text>An eligible entity that desires to receive an award under this section shall submit an application to the Director at such time, in such manner, and containing such information as the Director may require.</text></paragraph><paragraph id="id839c4f9b-5ba8-4e0b-a06c-1d5d7375d7b0" changed="not-changed"><enum>(2)</enum><header>Contents</header><text>An application described in paragraph (1) shall include—</text><subparagraph id="id16da0e55-e1a1-4a36-bd14-641703162321" changed="not-changed"><enum>(A)</enum><text>a description of the student demographics on which the research supported under the award intends to focus;</text></subparagraph><subparagraph id="id831ed0f9-52dc-4e3f-b0c8-a8b0aff7e735" changed="not-changed"><enum>(B)</enum><text>a description of any regional partnerships the eligible entity plans to utilize to carry out the award;</text></subparagraph><subparagraph id="idE849A9BE3BCA4FA288FB86DD28DF1E1F" changed="not-changed"><enum>(C)</enum><text>a description of how such research activity or activities may inform efforts to promote the engagement and achievement of elementary school and secondary school students in artificial intelligence and other key emerging technologies, such as quantum information science and technologies and photonics;</text></subparagraph><subparagraph id="id0752ba81-c163-49bf-a51e-1522f84165ef" changed="not-changed"><enum>(D)</enum><text>with respect to an application that concerns the use or integration of artificial intelligence, a description of potential ethical concerns and implications of teacher and student interactions with artificial intelligence systems;</text></subparagraph><subparagraph id="id447e65d5-cece-4fdd-b2d5-d0238b299f9f" changed="not-changed"><enum>(E)</enum><text>a description of how the research on teaching models, tools, and materials were developed in consultation with other educators, academia, and private sector organizations; and</text></subparagraph><subparagraph id="idb700c348-95b9-4800-9e3a-00f6cb8dc269" changed="not-changed"><enum>(F)</enum><text>such other information as the Director may require.</text></subparagraph></paragraph></subsection><subsection id="id440e8035-61fd-452d-acd1-99a7c798829c" changed="not-changed"><enum>(d)</enum><header>Use of award funds</header><text>An eligible entity that receives an award under this section shall carry out a program described in subsection (b)(1) that—</text><paragraph id="id8d9fa018-5069-4041-9dca-d04db472c038" changed="not-changed"><enum>(1)</enum><text>emphasizes preparing and providing professional development to teachers, principals, and other school leaders to help them integrate artificial intelligence, key emerging technologies, and computational thinking in teaching and learning; and</text></paragraph><paragraph id="id5d3dec52-ffe6-40db-b11c-6f9f42f653b7" changed="not-changed"><enum>(2)</enum><text>supports research to develop, pilot, fully implement, or test areas, such as—</text><subparagraph id="idc51b0a65-a019-44bf-a462-32068d5e420b" changed="not-changed"><enum>(A)</enum><text>evidence-based instructional materials and high-quality learning opportunities for teaching artificial intelligence and key emerging technologies;</text></subparagraph><subparagraph id="idff4ede04-271e-46d8-9608-803223dd8d3d" changed="not-changed"><enum>(B)</enum><text>models for the preparation of new teachers who will teach artificial intelligence and key emerging technologies;</text></subparagraph><subparagraph id="id5e6e04f0-f756-461b-954c-99360d2198ec" changed="not-changed"><enum>(C)</enum><text>scalable models of professional development and ongoing support for teachers, principals, and other school leaders; and</text></subparagraph><subparagraph id="id5b5264ea-f733-46d0-9895-5263f3ae2311" changed="not-changed"><enum>(D)</enum><text>tools and models for teaching and learning aimed at supporting student access to and utilization of artificial intelligence and key emerging technologies across diverse populations, including low-income, rural, and Tribal populations.</text></subparagraph></paragraph></subsection></section><section id="id2d9a1e5e-f2e8-483a-a4cd-932742630933" changed="not-changed"><enum>11.</enum><header>National Science Foundation awards for artificial intelligence resources</header><subsection id="id03936614-de90-4584-b811-76e140859775" changed="not-changed"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id43ff2d3e-a91e-4bb7-b539-94666b68dd17" changed="not-changed"><enum>(1)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="id56c8fc8d-65d4-4569-8e4e-bebd936648c9" changed="not-changed"><enum>(A)</enum><text>a State educational agency, local educational agency, or educational service agency;</text></subparagraph><subparagraph id="idf1ec7e74-e903-4b75-94c0-9cadefaa93a9" changed="not-changed"><enum>(B)</enum><text>an institution of higher education, including—</text><clause id="id50232639-15b3-46f4-910f-a33205e4326f" changed="not-changed"><enum>(i)</enum><text>an emerging research institution;</text></clause><clause id="id8219c0a6-d6f1-4e08-ad58-f641db3eaa4e" changed="not-changed"><enum>(ii)</enum><text>an EPSCoR institution;</text></clause><clause id="id8ac7fb88-26e1-4f62-9409-58cc91f30a9d" changed="not-changed"><enum>(iii)</enum><text>a minority-serving institution;</text></clause><clause id="idc3509a02-16c0-48ce-bbd2-ffaef01e4cbc" changed="not-changed"><enum>(iv)</enum><text>a historically Black college or university;</text></clause><clause id="id7a2dbbad-db23-4084-8cb7-b8dc0389adc9" changed="not-changed"><enum>(v)</enum><text>a Tribal College or University; or</text></clause><clause id="idf937cc1d-3d32-4681-8164-8d5285b1de60" changed="not-changed"><enum>(vi)</enum><text>a community college; or</text></clause></subparagraph><subparagraph id="idda293d2b-239a-4a70-a507-f659e310a015" changed="not-changed"><enum>(C)</enum><text>a technical and vocational school.</text></subparagraph></paragraph><paragraph id="id861b3232-417e-4792-9758-e48307b3deb6" changed="not-changed"><enum>(2)</enum><header>Technical and vocational school</header><text>The term <term>technical and vocational school</term> has the meaning given the term <term>area career and technical school</term> in section 3 of the Carl D. Perkins Career and Technical Education Act of 2006 (20 U.S.C. 2302).</text></paragraph></subsection><subsection id="id466cb61e-7a9f-4fb8-85b5-81b2d191dc87" changed="not-changed"><enum>(b)</enum><header>Awards authorized</header><text>Subject to section 15, the Director shall make awards to eligible entities to enable the eligible entities to provide or increase access to artificial intelligence tools and applications to the students and researchers served by the eligible entities.</text></subsection><subsection id="id308c96ce-8aeb-44bf-9002-2d7a1c107a4e" changed="not-changed"><enum>(c)</enum><header>Preference</header><text>In making awards under subsection (b), the Director shall give preference to eligible entities that—</text><paragraph id="id8ccc52c0-a314-4328-a3cb-dc56b87e0d2c" changed="not-changed"><enum>(1)</enum><text>expand the geographic diversity of funded entities; or</text></paragraph><paragraph id="id99038ad4-1387-4f5a-b4cc-0392c8629ef2" changed="not-changed"><enum>(2)</enum><text>are emerging research institutions, EPSCoR institutions, minority-serving institutions, historically Black colleges and universities, Tribal Colleges or Universities, community colleges, or technical and vocational schools.</text></paragraph></subsection><subsection id="idfd6a30e7cfb04ee8a765e625bc3b98fe" changed="not-changed"><enum>(d)</enum><header>Method</header><text>The Director may carry out this section through new or existing programs.</text></subsection></section><section id="id6fec3a63-c118-4d58-9af0-9f070e0846ce" changed="not-changed"><enum>12.</enum><header>Guidance for the introduction and use of artificial intelligence in elementary and secondary education</header><subsection id="id569e33c5-29a1-4fd1-bc3d-aa55e4dad868" changed="not-changed"><enum>(a)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the Director, in coordination with the Secretary of Education, the Director of the Institute of Education Sciences, the Director of the National Institute of Standards and Technology, and the Director of the Office of Science and Technology Policy, shall develop and make publicly available guidance for the introduction and use of artificial intelligence in elementary and secondary education.</text></subsection><subsection id="idef734bee-5973-4a8b-a7aa-bde07358eab6" changed="not-changed"><enum>(b)</enum><header>Considerations</header><text>The guidance required under subsection (a) shall include—</text><paragraph commented="no" display-inline="no-display-inline" id="id7faf7ede-2b4d-4092-a9b6-5bd1c726d5e1" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">considerations for—</text><subparagraph id="idad3a8f4d-f083-4621-a3e6-d4cf6ee87233" changed="not-changed"><enum>(A)</enum><text>the use of artificial intelligence in elementary and secondary education in rural areas and economically distressed areas; and</text></subparagraph><subparagraph id="id3f758386-c389-43f0-9395-1751650dfcb7" changed="not-changed"><enum>(B)</enum><text>the differing applications of artificial intelligence in STEM and the liberal arts; and</text></subparagraph></paragraph><paragraph commented="no" id="idc60c3a46-9f40-4a29-b95e-07ac1d3c20c0" changed="not-changed"><enum>(2)</enum><text>a description of how the guidance was developed in consultation with educators, academia, and private sector organizations.</text></paragraph></subsection></section><section id="ideacdab8c-1563-43c8-9541-262c5e227890" changed="not-changed"><enum>13.</enum><header>NSF grand challenges relating to artificial intelligence education and training</header><subsection id="idaa4d7400-6b1b-4eab-868c-e2828b2ab90b" changed="not-changed"><enum>(a)</enum><header>Grand challenge</header><text>The term <term>grand challenge</term> means a prize competition under section 24 of the Stevenson-Wydler Technology Innovation Act of 1980 (15 U.S.C. 3719).</text></subsection><subsection id="idfb7c519c-61a9-45fc-a0e2-2ae05074d2dc" changed="not-changed"><enum>(b)</enum><header>In general</header><text>Subject to section 15, the Director, in coordination with the Secretaries of Labor and Education, shall support grand challenges to stimulate innovation regarding—</text><paragraph id="id825fb057-5b75-4f4e-abc4-96a2daf7b14a" changed="not-changed"><enum>(1)</enum><text>how to train 1,000,000 or more workers, including educators, technical and vocational workers, and professionals, in the United States by 2030 in areas related to the creation, deployment, or use of artificial intelligence, such as foundational knowledge, critical thinking, programming skills, machine learning, or deep learning;</text></paragraph><paragraph id="ida593423d-699a-4495-9dbf-b04c6d8bad8f" changed="not-changed"><enum>(2)</enum><text>how to overcome barriers in the development of the artificial intelligence education and training;</text></paragraph><paragraph id="id9c43933e-9cbd-41d7-b7ef-31741ce625af" changed="not-changed"><enum>(3)</enum><text>methods and strategies for creating artificial intelligence education and training that does not displace workers, including teachers, in the workforce;</text></paragraph><paragraph id="id348036c2-bd13-4e04-8a67-5900e8cd3a88" changed="not-changed"><enum>(4)</enum><text>ways to increase the number of women who receive artificial intelligence education and training; and</text></paragraph><paragraph id="idf2f72cd2-dcf7-4e6e-9314-13fe3bc1b4e0" changed="not-changed"><enum>(5)</enum><text>how to ensure rural areas of the United States are able to benefit from artificial intelligence education and training.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="iddb74980d029b4a06a820c73c26f7950d" changed="not-changed"><enum>(c)</enum><header>Method</header><text display-inline="yes-display-inline">The Director may carry out this section through new or existing programs.</text></subsection></section><section id="ida386a7373f9e43969369d5986f94aae1" changed="not-changed"><enum>14.</enum><header>Criteria on appropriateness of gift acceptance; principles for public-private partnerships</header><subsection commented="no" display-inline="no-display-inline" id="id45ad4947114b454cbb8ce7c1db3cceb0" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">Criteria for determining appropriateness of gift acceptance</header><paragraph commented="no" display-inline="no-display-inline" id="id638de081828047e5b603b9a6e59230fc" changed="not-changed"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Director shall establish the criteria to be used in determining whether the acceptance of contributions of money, services, use of facilities, or personal property under this Act would reflect unfavorably upon the ability of the National Science Foundation, or any employee of the National Science Foundation, to carry out its responsibilities or official duties in a fair, objective, and transparent manner, or would compromise the integrity or the appearance of the integrity of its programs or any official involved in those programs.</text></paragraph><paragraph id="id968a475a616845a692b4b5360bb71152" changed="not-changed"><enum>(2)</enum><header>Requirements</header><subparagraph commented="no" display-inline="no-display-inline" id="idd4e2640229ca41e4b6b0ba887ae482fd" changed="not-changed"><enum>(A)</enum><header>Verification</header><clause commented="no" display-inline="no-display-inline" id="idec808190c80c4588936a24e7d7dad881" changed="not-changed"><enum>(i)</enum><header>Defined term</header><text display-inline="yes-display-inline">In this subparagraph, the term <term>entity meeting the definition of foreign ownership, control, or influence</term> means, with respect to a United States entity—</text><subclause id="id97334b7eaa384b09b2b208382779e0ad" changed="not-changed"><enum>(I)</enum><text>a foreign interest has the power to direct or decide matters affecting such entity's management or operations in a manner that could—</text><item id="idd655f51d2e774e1195c6505b075ebac9" changed="not-changed"><enum>(aa)</enum><text>result in unauthorized access to classified information; or</text></item><item id="id82654f4dbf334bf89d602390a2150909" changed="not-changed"><enum>(bb)</enum><text>adversely affect the performance of a contract or agreement requiring access to classified information; and</text></item></subclause><subclause id="id404aac8f9c854a59a8f1d2e10ba0b490" changed="not-changed"><enum>(II)</enum><text>the foreign interest is—</text><item commented="no" display-inline="no-display-inline" id="id5093ecb92fa941a09e7ded4cb95ce24e" changed="not-changed"><enum>(aa)</enum><text display-inline="yes-display-inline">exercising such power directly or indirectly;</text></item><item id="idfd7ba6a32f6a4c57ac3476735c563f61" changed="not-changed"><enum>(bb)</enum><text>exercising such power through ownership of such entity's securities, by contractual arrangements, or other similar means;</text></item><item id="id2501a110520f4e60bca1724f3a95f238" changed="not-changed"><enum>(cc)</enum><text>exercising such power through its ability to control or influence the election or appointment of 1 or more members to the entity's governing board; or</text></item><item id="id36b460cfacf748489517bedac24e16ed" changed="not-changed"><enum>(dd)</enum><text>capable of exercising such power.</text></item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id646824224936489fab1a818254261576" changed="not-changed"><enum>(ii)</enum><header>In general</header><text display-inline="yes-display-inline">The Director, working with relevant Federal agencies, shall require that any criteria established pursuant to paragraph (1) include a means to verify that no contribution has any ties to a foreign entity of concern, a foreign country of concern, or an entity meeting the definition of foreign ownership, control, or influence.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf52d2963773344ea909ff2409e69a098" changed="not-changed"><enum>(B)</enum><header>Prohibition</header><text>The criteria established pursuant to paragraph (1) shall include a prohibition on the receipt of funding pursuant to the National Science Foundation’s gift authority from either a foreign country of concern or a foreign entity of concern.</text></subparagraph></paragraph><paragraph id="id9443bf0a9c044d8dbbe911517df7c93b" changed="not-changed"><enum>(3)</enum><header>Review of existing rules</header><text>To the extent the criteria described in paragraph (1) have already been established, the Director shall—</text><subparagraph id="id7a5463c170eb4fa9a2dcd961ee7e64f2" changed="not-changed"><enum>(A)</enum><text>conduct a review of the existing criteria;</text></subparagraph><subparagraph id="ide5f30f0efbae422d9bb5a9552821f865" changed="not-changed"><enum>(B)</enum><text>update the criteria as necessary to satisfy the requirements under this subsection; and</text></subparagraph><subparagraph id="idb6fb9fea180049bdb6770f586ea3e746" changed="not-changed"><enum>(C)</enum><text>include, in the report under paragraph (4), an explanation of the existing criteria and any changes made to the criteria resulting from the Director’s review.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc6c46528810a4e7aa5c77ef2698f67e8"

        <header>Principles for public-Private partnerships</header>

          <header>In General</header>
          <text display-inline="yes-display-inline">The Director shall establish principles to guide
            the National Science Foundation's formation of public-private partnerships under this
            Act to help ensure that such partnerships are aligned with the National Science
            Foundation's statutory obligations and do not reflect unfavorably upon the ability of
            the National Science Foundation or any employee of the National Science Foundation, to
            carry out its responsibilities or official duties in a fair, objective, and transparent
            manner, or compromise the integrity or the appearance of the integrity of its programs
            or any official involved in those programs.</text>
        </paragraph>
        <paragraph commented="no" id="id58dcae4e7a7c45fbbbf8cc9f9362fe0b" changed="not-changed">
          <enum>(2)</enum>
          <header>Review of existing principles</header>
          <text>To the extent the principles described in paragraph (1) have already been
            established, the Director shall—</text>

            <enum>(A)</enum>
            <text>conduct a review of the existing principles;</text>
          </subparagraph>
          <subparagraph commented="no" id="iddd15d3eb7a09418f8a798469ad48b0d8" changed="not-changed">
            <enum>(B)</enum>
            <text>update the principles as necessary to satisfy the requirements under paragraph
              (1); and</text>
          </subparagraph>
          <subparagraph commented="no" id="id7535d7b4a62740dab3ffbe451efe05a6" changed="not-changed">
            <enum>(C)</enum>
            <text>include, in the report under paragraph (3), an explanation of the existing
              principles and any changes made to the principles resulting from the Director’s
              review.</text>
          </subparagraph>
        </paragraph>
        <paragraph commented="no" display-inline="no-display-inline"

          <header>Report</header>
          <text>The Director shall submit a report on the principles established under this

            and Workforce and the Committee on Science, Space, and Technology of the House of
            Representatives.</text>
        </paragraph>
      </subsection></section><section commented="no" display-inline="no-display-inline" id="id6F55F3CBADDB416D9E3FDA334B648232" changed="not-changed"><enum>15.</enum><header>Activities subject to funding</header><text display-inline="no-display-inline">The activities under this Act that are subject to this section shall only be required if sufficient funds are either appropriated by Congress or made available to carry out those respective requirements.</text></section><section id="id13182cf3bf1c45dd8656561dde2d1f6e" changed="not-changed"><enum>16.</enum><header>Research Security</header><text display-inline="no-display-inline">The activities authorized under this Act shall be carried out in accordance with the provision of subtitle D of title VI of the Research and Development, Competition, and Innovation Act (42 U.S.C. 19231 et seq.) and section 223 of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (42 U.S.C. 6605).</text></section><section id="id7452ef71dbfa4e3eadda8ab705d49166" changed="not-changed"><enum>17.</enum><header>Workforce frameworks for critical and emerging technologies</header><subsection id="iddb4012cc2de34e7d9ce85618e2e34a6f" changed="not-changed"><enum>(a)</enum><header>Definitions</header><paragraph id="id7bd41bd5121f4b8691d6855a9ba8fbf2" changed="not-changed"><enum>(1)</enum><header>In general</header><text>In this section, the terms <term>competencies</term>, <term>workforce categories</term>, and <term>workforce framework</term> have the meanings given such terms in subsection (f) of section 2 of the National Institute of Standards and Technology Act (15 U.S.C. 272), as added by paragraph (2) of this subsection.</text></paragraph><paragraph id="id44b7638637434de18c4a4df2a15a8020" changed="not-changed"><enum>(2)</enum><header>Amendment to NIST Act</header><text>Section 2 of such Act (15 U.S.C. 272) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id45ffccf132b44bbfa52c1fbb3b98333f" changed="not-changed"><subsection id="id044e716795094a748e9ab99b4a753000" changed="not-changed"><enum>(f)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idb766d1d75afe42bab22c65374f57c4c6" changed="not-changed"><enum>(1)</enum><header>Competencies</header><text>The term <term>competencies</term> means knowledge and skills.</text></paragraph><paragraph id="id1097c6e25ecd4c89a183e5bff4387022" changed="not-changed"><enum>(2)</enum><header>Workforce categories</header><text>The term <term>workforce categories</term> means a high-level grouping of tasks across an organization as defined by work roles within the category.</text></paragraph><paragraph id="id2dac30bb6ccb4e96a166f695070d1d02" changed="not-changed"><enum>(3)</enum><header>Workforce framework</header><text>The term <term>workforce framework</term> means a common taxonomy and lexicon for any given domain that includes the building blocks of tasks, knowledge, or skills that can be structured to form work roles or competency areas.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id3628889fc0fb4b6d84e045139a29c637" changed="not-changed">

                    roles or competency areas, provided pursuant to subparagraph (A) are
                    appropriate; and</text>

                    administration and finance, law and policy, ethics, privacy, human resources,

                  <enum>(iii)</enum>
                  <text>information that promotes the discovery of careers in critical and emerging

                  <enum>(iv)</enum>
                  <text>information for how individuals can acquire relevant credentials (e.g.,
                    academic degrees, certificates, certifications, etc.) that qualify individuals

                <text>after each determination under subparagraph (B), to submit to Congress a

      </subsection><subsection id="id7ba9d03fc9dd4d528b1a21300b0d1bab" changed="not-changed"><enum>(c)</enum><header>NICE workforce framework for cybersecurity update</header><paragraph id="id0cc6ddaebf24482c9ab6412f39b78ce7" changed="not-changed"><enum>(1)</enum><header>Report on updates</header><subparagraph commented="no" display-inline="no-display-inline" id="idb90351c0e6e64517b6d2326467020cde" changed="not-changed"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>Not later than 180 days after the date of the enactment of this Act, and subsequently pursuant to paragraph (14)(F) of section 2(b) of the National Institute of Standards and Technology Act (15 U.S.C. 272(b)), as added by subsection (b) of this section, the Director of the National Institute of Standards and Technology shall submit to Congress a report that describes the process for ongoing review and updates to the National Initiative for Cybersecurity Education Workforce Framework for Cybersecurity (NIST Special Publication 800–181), or a successor framework.</text></subparagraph><subparagraph commented="no" id="id89f96ff21b554cba8a638748ae8ec65c" changed="not-changed"><enum>(B)</enum><header>Requirements</header><text>Each report submitted pursuant to subparagraph (A) shall—</text><clause id="id1d430b161cf14cdca6fa375e855d3679" changed="not-changed"><enum>(i)</enum><text>summarize proposed changes to the framework;</text></clause><clause commented="no" display-inline="no-display-inline" id="id54148f45e2914ace9f0d3e6537b07cc2" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">identify, with regard to the work roles, tasks, knowledge, and skills included in the framework, how industry, academia, labor organizations, and relevant government agencies are consulted in the update; and</text></clause><clause commented="no" id="id69578733e9b1428dab85bf0a03d64c01" changed="not-changed"><enum>(iii)</enum><text>describe—</text><subclause commented="no" id="id5c2b50ae3a9a482593819202e0dbe397" changed="not-changed"><enum>(I)</enum><text>the ongoing process and timeline for updating the framework; and</text></subclause><subclause id="id1c4f795cc50a4b8985c77eba47813857" changed="not-changed"><enum>(II)</enum><text>the incorporation of any additional work roles or competency areas in domains such as administration and finance, law and policy, ethics, privacy, human resources, information technology, operational technology, supply chain security, and acquisition and procurement.</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" id="id30f84f8d63d34ff1b319b97a75ee5b5a" changed="not-changed"><enum>(2)</enum><header>Report on application and use of NICE framework</header><text>Not later than 3 years after the date of the enactment of this Act and not less frequently than once every 3 years thereafter for 9 years, the Director shall, in consultation with industry, government, nonprofit, labor organizations, research, and academic institutions, submit to Congress a report that identifies—</text><subparagraph commented="no" id="id706b6f4fc5cb41de8548be1413d2eb6f" changed="not-changed"><enum>(A)</enum><text>applications and uses of the framework described in paragraph (1)(A) in practice;</text></subparagraph><subparagraph commented="no" id="id6d91252b13cb46a68556e65028bb5b76" changed="not-changed"><enum>(B)</enum><text>any guidance that the program office of the National Initiative for Cybersecurity Education provides to increase adoption by employers and education and training providers of the work roles and competency areas for individuals who perform cybersecurity work at all proficiency levels;</text></subparagraph><subparagraph commented="no" id="idf2cfdd86e9244d07b71496eaaede0b35" changed="not-changed"><enum>(C)</enum><text>available information regarding employer and education and training provider use of the framework;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8bcc579afae74919a3b7be62e1952f98" changed="not-changed"><enum>(D)</enum><text display-inline="yes-display-inline">an assessment of the use and effectiveness of the framework by and for individuals with nontraditional backgrounds or education, especially individuals making a career change or not pursuing a bachelor’s degree or higher; and</text></subparagraph><subparagraph commented="no" id="id92a4368cad7d41d2aecb31dc63a722d3" changed="not-changed"><enum>(E)</enum><text>any additional actions taken by the Director to increase the use of the framework.</text></subparagraph></paragraph><paragraph id="idcf4435e2003b4177aee7fd35e59ee505" changed="not-changed"><enum>(3)</enum><header>Cybersecurity career exploration resources</header><text>The Director, acting through the National Initiative for Cybersecurity Education, shall disseminate cybersecurity career resources for all age groups, including kindergarten through secondary and postsecondary education and adult workers.</text></paragraph></subsection><subsection id="id9f87275fe17544d782fd92e549b1b04a" changed="not-changed"><enum>(d)</enum><header>Additional workforce frameworks</header><paragraph id="id3c2604faf76841eca5f37336c6ae0208" changed="not-changed"><enum>(1)</enum><header>Framework assessment</header><text>Not later than 180 days after the date of the enactment of this Act, the Director shall assess the need for additional workforce frameworks for critical and emerging technologies, such as quantum information science.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id157cc7107f5743f7bc598feb570ae293" changed="not-changed"><enum>(2)</enum><header>Development of additional frameworks</header><subparagraph commented="no" display-inline="no-display-inline" id="id72a611f2baf64a72a9f539884acbc106" changed="not-changed"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Director shall develop and publish a workforce framework for each additional workforce framework that the Director determines is needed pursuant to an assessment carried out pursuant to paragraph (1).</text></subparagraph><subparagraph id="idcb5d4b68fac44f3aaa32a034a3b6966b" changed="not-changed"><enum>(B)</enum><header>Required AI framework</header><text>Notwithstanding paragraph (1) and subparagraph (A) of this paragraph, not less than 540 days after the date of the enactment of this Act, the Director shall develop and publish a workforce framework, workforce categories, work roles, and competency areas for artificial intelligence.</text></subparagraph></paragraph><paragraph id="id3819c7ed4b0f40aba2f174a99c52cc95" changed="not-changed"><enum>(3)</enum><header>Model</header><text>In developing a workforce framework under paragraph (2), the Director may use the Playbook for Workforce Frameworks developed by the National Initiative for Cybersecurity Education that is modeled after the National Initiative for Cybersecurity Education Workforce Framework for Cybersecurity (NIST Special Publication 800–181), or a successor framework.</text></paragraph><paragraph id="id5f00cd00f5a248e2aec30c733f86964e" changed="not-changed"><enum>(4)</enum><header>Framework components</header><text>Each framework developed pursuant to paragraph (2) shall include relevant support or operations work roles and competency areas such as administration and finance, law and policy, ethics, privacy, human resources, information technology, operational technology, supply chain security, and acquisition and procurement, as the Director considers appropriate, in alignment with paragraph (14)(C) of section 2(b) of the National Institute of Standards and Technology Act (15 U.S.C. 272(b)), as added by subsection (b).</text></paragraph><paragraph id="ide4a5b0ad995d4e1b8014ee3535f6ae4e" changed="not-changed"><enum>(5)</enum><header>Professional skills required</header><text>Each framework developed pursuant to paragraph (2) shall include professional skills or employability skills, as the Director considers appropriate, in alignment with paragraph (14)(C) of section 2(b) of the National Institute of Standards and Technology Act (15 U.S.C. 272(b)), as added by subsection (b).</text></paragraph><paragraph id="id72c632b0fbfc4c8d868d427efbbd8d74" changed="not-changed"><enum>(6)</enum><header>Nontraditional backgrounds</header><text>Each framework developed under paragraph (2), or materials associated with each framework, shall include information for how individuals with nontechnical or other nontraditional backgrounds and education may utilize their skills for such frameworks’ roles and tasks, in alignment with paragraph (14)(D) of section 2(b) of the such Act (15 U.S.C. 272(b)(14)(D)), as so added.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9769c380391a4f299e2708eef62de4d5" changed="not-changed"><enum>(7)</enum><header>Updates</header><text>The Director shall update each framework developed under paragraph (2) in accordance with subparagraph (B) of paragraph (14) of section 2(b) of the National Institute of Standards and Technology Act (15 U.S.C. 272(b)), as added by subsection (b) of this section, and submit to Congress reports in accordance with subparagraph (F) of such paragraph.</text></paragraph></subsection></section><section id="ida569b56b4e90427d86b63f882af03ad9" changed="not-changed"><enum>18.</enum><header>Restrictions on awards or scholarships to certain institutions or recipients</header><text display-inline="no-display-inline">The Director may not award any funds or initiate any programs authorized under or described in this Act to an elementary or secondary education institution, an institution of higher education, as defined in section 102 of the Higher Education Act of 1965 (20 U.S.C. 1002), a nonprofit entity related to or affiliated with any such institution, a nonprofit entity that engages in established curriculum-related clinical training of students registered at any such institution, a nonprofit research organization, or a governmental research organization, if such recipient has been found to be in violation of title VI of the Civil Rights Act of 1964 (42 U.S.C. 2000d et seq.) due to discrimination on the basis of shared ancestry or ethnic characteristics on or after January 1, 2020.</text></section></legis-body></bill>
