<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 3954</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260226">February 26, 2026</action-date><action-desc><sponsor name-id="S376">Ms. Ernst</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To terminate the ability of eligible telecommunications carriers in certain States to use State eligibility determination processes in place of the National Verifier to determine the eligibility of consumers for Lifeline service.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Lifeline for Dead People Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idf0ea9ffe1ebc454e830b8acf7d7b200c"><enum>2.</enum><header>Mandatory use of National Verifier to determine Lifeline eligibility</header><subsection id="iddc17aa7e418141a48fc38126735e3770"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id46b6250258b34ea98e7459d9cece74f4"><enum>(1)</enum><header display-inline="yes-display-inline">Eligible telecommunications carrier</header><text>The term <term>eligible telecommunications carrier</term> means a common carrier designated as an eligible telecommunications carrier under section 214(e) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/214">47 U.S.C. 214(e)</external-xref>).</text></paragraph><paragraph id="idc5bd2e3ad92b40d48c694ce268c0750a"><enum>(2)</enum><header>Lifeline service</header><text>The term <term>Lifeline service</term> means voice telephony service or broadband internet access service provided under the program set forth in subpart E of part 54 of title 47, Code of Federal Regulations, or any successor regulation.</text></paragraph><paragraph id="id58442d17c8f644b1a4e84105093f8840" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header>National Verifier</header><text>The term <term>National Verifier</term> has the meaning given the term in section 54.400 of title 47, Code of Federal Regulations, or any successor regulation.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ida29378763c2c4f9b8badec346eeec65c"><enum>(b)</enum><header>Mandatory use of National Verifier</header><text>An eligible telecommunications carrier may not provide Lifeline service to a consumer unless the carrier has used the National Verifier to verify the eligibility of the consumer for Lifeline service.</text></subsection></section></legis-body></bill>
