<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 3951</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260226">February 26, 2026</action-date><action-desc><sponsor name-id="S404">Mr. Scott of Florida</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSBU00">Committee on the Budget</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide authority and discretion to the President over budgetary resources to achieve a balanced budget.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Balanced Budget Responsibility Act of 2026</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id0b56bbae0a5348929591c626c435cd14"><enum>2.</enum><header>Authority and discretion of the President over budgetary resources to achieve a balanced budget</header><subsection commented="no" display-inline="no-display-inline" id="idb9093c4e887c40ae9cd6af9b3adf4893"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph commented="no" display-inline="no-display-inline" id="idcc24fe68949c41248bda89b0fe3299de"><enum>(1)</enum><text>the term <term>budgetary resources</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="id4c20d615a61d466a97add71c7e4e291e"><enum>(A)</enum><text display-inline="yes-display-inline">has the meaning given that term in section 250(c) of the Balanced Budget and Emergency Deficit Control Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/2/900">2 U.S.C. 900(c)</external-xref>); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ideb7cdd1502ae4a6c902d8f075a3cd325"><enum>(B)</enum><text display-inline="yes-display-inline">includes any discretionary appropriations or direct spending, as defined in such section, available for the applicable fiscal year;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7a5b903225dc48a7b3778dd549f58c40"><enum>(2)</enum><text>the term <term>covered budgetary resources</term> means any budgetary resources, except for budgetary resources to carry out—</text><subparagraph commented="no" display-inline="no-display-inline" id="idcf91e80b4d6640208584ecfcf8543d90"><enum>(A)</enum><text display-inline="yes-display-inline">the Medicare program under title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395 et seq.</external-xref>); or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5a6945595faf47f5a4c0c0bc90323685"><enum>(B)</enum><text>the old-age, survivors, and disability insurance program established under title II of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/401">42 U.S.C. 401 et seq.</external-xref>); and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8dfe52c0951b43a2a589bd66ce12784f"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>deficit</term> has the meaning given that term under section 3 of the Congressional Budget and Impoundment Control Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/2/622">2 U.S.C. 622</external-xref>).</text></paragraph></subsection><subsection id="id4460e9b84710499fbbc90c350760863e"><enum>(b)</enum><header>Budgetary discretion</header><text>Notwithstanding the Impoundment Control Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/2/681">2 U.S.C. 681 et seq.</external-xref>), if the President determines, in consultation with the Secretary of the Treasury and the Office of Management and Budget, that there will be a deficit for a fiscal year, the President may exercise budgetary discretion and decline to obligate covered budgetary resources available for that fiscal year, as the President determines appropriate, in an amount that is not more than the amount required to eliminate the deficit.</text></subsection></section></legis-body></bill>
