<section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Securing American Freight, Enforcement, and Reliability in Transport Act</short-title></quote> or the <quote><short-title>SAFER Transport Act</short-title></quote>.</text></section> <section commented="no" display-inline="no-display-inline" id="id869d4a3fe190477c8eb6a217dc8f14ca"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
<paragraph commented="no" display-inline="no-display-inline" id="id137d9320b8474db286a5bd2a96f34cb2"><enum>(1)</enum><header>Administration</header><text>The term <term>Administration</term> means the Federal Motor Carrier Safety Administration.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="idfa664ba45b6540e3a0c86cf4e68a23ed"><enum>(2)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Administration.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="idfe9510805414453fa33f2a80f9a820bf"><enum>(3)</enum><header>Appropriate committees of Congress</header><text>The term <term>appropriate committees of Congress</term> means—</text> <subparagraph commented="no" display-inline="no-display-inline" id="idd64ee46984c14660a65e5928a749610f"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Commerce, Science, and Transportation of the Senate; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="idd7bcba6b6687416cbdff3db6025320f3"><enum>(B)</enum><text>the Committee on Transportation and Infrastructure of the House of Representatives.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id26f5d609a25148749231baaf2097db43"><enum>(4)</enum><header>Broker</header><text>The term <term>broker</term> has the meaning given the term in section 13102 of title 49, United States Code.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id2c446f11f1694bf4951535939d002f2a"><enum>(5)</enum><header>Department</header><text>The term <term>Department</term> means the Department of Transportation.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id5d214a5203814d4b9bc782ad655c0ee4"><enum>(6)</enum><header>Freight forwarder</header><text>The term <term>freight forwarder</term> has the meaning given the term in section 13102 of title 49, United States Code.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id8a78f51873f347e0a25020cab54eb235"><enum>(7)</enum><header display-inline="yes-display-inline">MC number</header><text>The term <term>MC number</term> means a motor carrier docket number issued by the Administration.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="ida0f161ac38944d8aad086deb53438485"><enum>(8)</enum><header>Motor carrier</header><text>The term <term>motor carrier</term> has the meaning given the term in section 13102 of title 49, United States Code.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="idb692430a191a42cfb93e52d3fcca3554"><enum>(9)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Transportation.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id99233dcfe1a446dd818435ea0c5c0a23"><enum>(10)</enum><header>USDOT number</header><text>The term <term>USDOT number</term> has the meaning given the term in section 31132 of title 49, United States Code.</text></paragraph></section>
<section commented="no" display-inline="no-display-inline" id="id9f0cad2b69aa4c81a4582a751d8e3fd0"><enum>3.</enum><header>Freight Fraud and Theft Advisory Committee</header>
<subsection commented="no" display-inline="no-display-inline" id="ideba17385c5a4490db1ef3a0151aa0eed"><enum>(a)</enum><header>In general</header><text>Not later than 60 days after the date of enactment of this Act, the Secretary shall establish an advisory committee, to be known as the <quote>Freight Fraud and Theft Advisory Committee</quote> (referred to in this section as the <term>advisory committee</term>), to receive input from the public on ways in which the Department could contribute to the reduction of freight fraud and theft using existing authorities of the Department.</text></subsection> <subsection commented="no" display-inline="no-display-inline" id="id56565a49c0f64b64818a9f61b5f29762"><enum>(b)</enum><header>Composition</header><text>The advisory committee shall be composed of the following stakeholders:</text>
<paragraph commented="no" display-inline="no-display-inline" id="id84edd069d27446c4901131ab742ae35e"><enum>(1)</enum><text display-inline="yes-display-inline">Stakeholders representing each of the following:</text> <subparagraph id="ide7b631cd334a4ba8958c5f9605a8bba5"><enum>(A)</enum><text>Motor carriers, including independent owner-operators.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id87440b6bafda49648ece96c84db3e18e"><enum>(B)</enum><text>Railroads.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="idfbe3d496028344f7b4182bc5057155ac"><enum>(C)</enum><text>Ports.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id74c08c29b7184e8da80fb9e5a6fb9b5a"><enum>(D)</enum><text>Marine terminal operators.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id52bc494851814db386aa5d490abf5915"><enum>(E)</enum><text>Freight brokers.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="idd50a0a70df644503b1cdac1318c9877d"><enum>(F)</enum><text>Aviation operators.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="iddd1f8e1fae4d4c90af3d4ae8d9f0db0b"><enum>(G)</enum><text display-inline="yes-display-inline">State and local law enforcement officials.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id9776c54ce4004f44af19d0995bbf6ade"><enum>(H)</enum><text display-inline="yes-display-inline">Shippers.</text></subparagraph> <subparagraph id="id2e747256585147c2b9c50d19f9311eac"><enum>(I)</enum><text>Insurance companies.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="ida647f9852d5047bbb7a0f75392e41114"><enum>(2)</enum><text>Other stakeholders that the Secretary determines would provide insightful information on ways to address freight fraud and theft.</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="id5947e6cec86746f889f1fc76305b2831"><enum>(c)</enum><header>Duties</header><text display-inline="yes-display-inline">The advisory committee shall provide to the Secretary input and recommendations on ways in which the Department could contribute to the reduction of freight fraud and theft, including ways in which the Department could improve coordination within the Department and between the Department and other Federal agencies to identify and respond to freight fraud and theft.</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="id88848bf6d2524480b07e71fb67c82a91"><enum>(d)</enum><header>Report</header><text>Not later than 2 years after the date on which the advisory committee is established under subsection (a), the advisory committee shall submit to the Secretary and to the appropriate committees of Congress a report that includes the findings of the advisory committee, any recommendations provided to the Secretary under subsection (c), and any other recommendations relating to the matters described in that subsection.</text></subsection> <subsection commented="no" display-inline="no-display-inline" id="id498ee7b4fb704b359fba3942140fa15c"><enum>(e)</enum><header>Sunset</header><text>The advisory committee shall terminate on submission of the report under subsection (d).</text></subsection></section>
<section commented="no" display-inline="no-display-inline" id="idf2a5cd40d3ef446bac6f291ac108511c"><enum>4.</enum><header>Memorandum of understanding on freight fraud and theft</header>
<subsection commented="no" display-inline="no-display-inline" id="id255c8e56b1fd4926bbe8677d512b87e7"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary and the Attorney General shall enter into a memorandum of understanding on addressing freight fraud and theft.</text></subsection> <subsection commented="no" display-inline="no-display-inline" id="iddad07951ee214725a79a2b56326d2789"><enum>(b)</enum><header>Requirement</header><text>At a minimum, the memorandum of understanding entered into under subsection (a) shall—</text>
<paragraph commented="no" display-inline="no-display-inline" id="ida66f0bc191fa41bfb7608ff4c516e383"><enum>(1)</enum><text>require the Department to notify appropriate officials at the Department of Justice of any freight fraud or theft identified through the regulatory or enforcement work of the Department, and specify the method for such notification; and</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="idfeda7693b4d44b1a98ec07a09197f256"><enum>(2)</enum><text>require the Department of Justice to establish a process for receiving and handling such information from the Department.</text></paragraph></subsection></section>
<section id="id972a6e9be5c2433b99ef55660d4b8012"><enum>5.</enum><header>Securing the registration system of the Administration</header>
<subsection commented="no" display-inline="no-display-inline" id="id780fd94d550c4670b55851f88b2b099d"><enum>(a)</enum><header>In general</header><text>During the 5-year period beginning on the date of enactment of this Act, the Secretary—</text> <paragraph commented="no" display-inline="no-display-inline" id="id1eb3bebdaf19462685d9849fb1119b69"><enum>(1)</enum><text display-inline="yes-display-inline">shall not issue or renew an MC number; and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id61143780e31f4fca8533adc9848b5b5a"><enum>(2)</enum><text display-inline="yes-display-inline">shall take other appropriate steps to phase out reference to MC numbers.</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="id3ca3e675267a452cb61ac09a83261b3c"> <enum>(b)</enum> <header>Transition To use of USDOT numbers</header> <text>The Secretary shall ensure that, as of the date that is 5 years after the date of enactment of this Act—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="id4507c75ab928458aa6d17f5fa1c68600"> <enum>(1)</enum> <text display-inline="yes-display-inline">no motor carrier, broker, or freight forwarder holds an MC number; and</text> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="idf3fc4d13c6ec4aec90973854363c0aca"> <enum>(2)</enum> <text display-inline="yes-display-inline">each motor carrier, broker, and freight forwarder has been assigned a USDOT number.</text> </paragraph> </subsection>
<subsection id="id1bdeec280ea34f5f9fd13376f7c6ea4f"><enum>(c)</enum><header>Registration of freight forwarders</header><text>Section 13903(a) of title 49, United States Code, is amended—</text> <paragraph id="id9bf8797140594b978082c04129d0afb7"><enum>(1)</enum><text>in paragraph (1), by striking <quote>and</quote> at the end;</text></paragraph>
<paragraph id="id25fa89c66f27482c8675f86ded9c9698"><enum>(2)</enum><text>in paragraph (2), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph> <paragraph id="id92d439e7ecc540bbbbcff58dfad5cc05"><enum>(3)</enum><text>by adding at the end the following:</text>

<paragraph id="ida58c10672d134ec5b6d579cf5de4ba9a"><enum>(3)</enum><text>has been issued a USDOT number under section 31134.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="idaf80950b005d465a833ba6177514b38d"><enum>(d)</enum><header>Registration of brokers</header><text>Section 13904(a) of title 49, United States Code, is amended—</text>
<paragraph id="id4cbf241c19e44c79bfe7d38bf8468430"><enum>(1)</enum><text>in paragraph (1), by striking <quote>and</quote> at the end;</text></paragraph> <paragraph id="ideb00d2343f0940c39d9a3626f3d9060b"><enum>(2)</enum><text>in paragraph (2), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph>
<paragraph id="id7083bc15e35b4d7890716cd8d0d402dc"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id3e063820662348b89c6653d8d53fb4af"> <paragraph id="id1dd5e00b20f843f3b11a02fe9a6b4eac"><enum>(3)</enum><text>has been issued a USDOT number under section 31134.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="id0e3260b32d7244a4800ce9f63f58e00d"><enum>(e)</enum><header>Definitions</header><text>Section 31132 of title 49, United States Code, is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="id099bcba754de45f5aa15dbf09b0843db"><enum>(1)</enum><text>in the matter preceding paragraph (1), by striking the em dash and inserting a colon;</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="idcaf0ce1132ab4539a2a39e6cd8d64b9c"><enum>(2)</enum><text>in paragraph (8), by striking <quote>31136 and 31140–31142</quote> and inserting <quote>31136, 31141, and 31142</quote>;</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="idddc8685bcb8c4ecd9121aaa96ee060ec"><enum>(3)</enum><text>in each of paragraphs (1) through (11)—</text>

<paragraph commented="no" display-inline="no-display-inline" id="id0c32cae60d044a66a2fee2c36d2bac45"><enum>(3)</enum><header>Convicted</header><text>The term <term>convicted</term>, with respect to an employer or person, means that a conviction has been made final with respect to that employer or person.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="idc4e61e5a11d5455e8140bba4dbe54400"><enum>(4)</enum><header>Conviction</header><text display-inline="yes-display-inline">The term <term>conviction</term> means a finding of guilt (including a plea of nolo contendere) or imposition of sentence, or both, by any judicial body charged with the responsibility to determine violations of Federal or State law.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id2b1d17a4b04c41ea85a19c111748f739"><enum>(5)</enum><header>Covered felony</header><text display-inline="yes-display-inline">The term <term>covered felony</term> means a felony under Federal or State law involving—</text> <subparagraph id="id738aecd19546444592fb56757a6a1b1d"><enum>(A)</enum><text>transportation, trafficking, or smuggling of persons, property, firearms, or controlled substances;</text></subparagraph>
<subparagraph id="ide08d60449fef4c0594c1bae76f37cc40"><enum>(B)</enum><text>theft, fraud, coercion, or extortion—</text> <clause commented="no" display-inline="no-display-inline" id="idb45825245eb04b2a86516e5993b2f02d"><enum>(i)</enum><text display-inline="yes-display-inline">involving the commercial transportation of property or passengers; or</text></clause>
<clause commented="no" display-inline="no-display-inline" id="id69af84e328e2455090ed434e92bb4ecc"><enum>(ii)</enum><text display-inline="yes-display-inline">in connection with operation as a motor carrier; or</text></clause></subparagraph> <subparagraph id="idda75ab507a4a4e88b52b74791ca027c4"><enum>(C)</enum><text>transportation of property or passengers in violation of an immigration or labor law.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id62cf74028ed7481da0c7a191e7200e43"><enum>(7)</enum><text>by inserting after paragraph (11) (as so redesignated) the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="idf388fef9c3884c2cb58219b4ea61cb11"> <paragraph commented="no" display-inline="no-display-inline" id="idc2d6bcb463d5445eb6ad8ba3a0ae24ac"><enum>(12)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Transportation.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph>

<subsection commented="no" display-inline="no-display-inline" id="ida7f8b8425109412cb99f31313ef6276c"><enum>(f)</enum><header>USDOT numbers</header><text>Section 31134 of title 49, United States Code, is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="id85375430c4084c6096beeeaba0931565"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text>

<subparagraph commented="no" display-inline="no-display-inline" id="id22031836b9da41d89e12adf9537e128a"><enum>(A)</enum><text display-inline="yes-display-inline">an employer or person subject to the safety jurisdiction of this subchapter; or</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id007d08a14ad1456a9255e3a1ff1ecb4d"><enum>(B)</enum><text display-inline="yes-display-inline">a motor carrier, broker, or freight forwarder subject to chapter 139.</text></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="idf41e57a232964938ae6af4792eb7f862"><enum>(E)</enum><text>by inserting after paragraph (2) the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id34f42e2da33242de8a5a09dfa2f7f7f8"> <paragraph commented="no" display-inline="no-display-inline" id="id0a9cb60589414144a1ec0e7ed05bde62"><enum>(3)</enum><header>USDOT numbers</header><text>A USDOT number shall—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="id52a71cc942434e4fa6e36fb55e1233ab"><enum>(A)</enum><text display-inline="yes-display-inline">be required to obtain registration under this section or part B of subtitle IV;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="idb79cad209c374e3cbc38f87883768153"><enum>(B)</enum><text display-inline="yes-display-inline">uniquely identify the employer or person to which it is issued; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="ide2f51f10660848a4a88c6701c15c652e"><enum>(C)</enum><text>be the only unique identifier issued by the Secretary to the employer or person for purposes of this section or part B of subtitle IV.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id0e1f811e52964fa4a3e7ab4fc99d9740"><enum>(2)</enum><text>in subsection (b)—</text>

<subsection commented="no" display-inline="no-display-inline" id="id2522e860773942d0a015774720d2fde8"><enum>(c)</enum><header display-inline="yes-display-inline">Ownership changes and transfers</header><text>Not later than 30 days after a motor carrier, broker, or freight forwarder associated with a USDOT number of an employer or person under this section experiences a change in ownership, including through purchase, sale, merger, acquisition, or any other transfer, the new employer or person owning the motor carrier, broker, or freight forwarder shall notify the Administration of the change in ownership.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id233772d927f645c7b4c25d65fb4ca663"><enum>(5)</enum><text>in subsection (d) (as so redesignated)—</text>

<paragraph commented="no" display-inline="no-display-inline" id="id0942a53d88e445ac8b113e3bf5ad4678"><enum>(2)</enum><header>Certain convictions</header><text>The Secretary may revoke the registration of an employer or person issued under subsection (a) after notice and an opportunity for a proceeding, or suspend the registration after giving notice of the suspension to the employer or person, if the employer or person has been convicted of a covered felony relating to the motor carrier operations of, or use of a commercial motor vehicle by, the employer or person.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="id439c91f322364692b0159ffb5cec88d6"><enum>(g)</enum><header>Registration of motor carriers</header><text>Section 13902(a)(4) of title 49, United States Code, is amended—</text>

<subsection commented="no" display-inline="no-display-inline" id="id5fec159c2b104748baf27cdb8c68e8ff"><enum>(h)</enum><header>Completion of registration system</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall complete all requirements relating to the establishment of the Unified Carrier Registration System under section 13908 of title 49, United States Code.</text></subsection> <subsection commented="no" display-inline="no-display-inline" id="id8afd46a025384f9480eb0bfbac6be051"><enum>(i)</enum><header>Conforming amendments</header> <paragraph commented="no" display-inline="no-display-inline" id="idd984c17b78a94570bb71f3cbdd850db5"><enum>(1)</enum><text>Section 321(4) of the United States-Mexico-Canada Agreement Implementation Act (<external-xref legal-doc="usc" parsable-cite="usc/19/4571">19 U.S.C. 4571(4)</external-xref>) is amended by striking <quote>paragraph (1)</quote> and inserting <quote>paragraph (2)</quote>.</text></paragraph>

<subsection commented="no" display-inline="no-display-inline" id="idf51c50acf04448d3992cd5fed8689664"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>Section 31311(a)(12) of title 49, United States Code, is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="id555d643fa5264260b18391eff640dc62"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>subparagraphs (B) and (C)</quote> and inserting <quote>subparagraphs (B) through (D)</quote>;</text></paragraph>

<clause id="id1d4a21bc89c54cedb816be049da4dd80"><enum>(ii)</enum><text>provide to the Administrator of the Federal Motor Carrier Safety Administration such information as the Administrator determines necessary to confirm that the applicant is authorized to work in the United States; and</text></clause> <clause id="id2d457fa5aed0434c8f30c4003415157f"><enum>(iii)</enum><text>if the applicant’s authorization to work in the United States expires before the date on which the applicant’s commercial learner’s permit or commercial driver’s license would otherwise expire, align the expiration of the applicant’s commercial learner’s permit or commercial driver’s license to the date on which the applicant’s authorization to work in the United States expires.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="id6860ec8d2dd04ce9a770a9b093621ebd"><enum>(b)</enum><header display-inline="yes-display-inline">Monthly report</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/313">Chapter 313</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text> <quoted-block style="USC" display-inline="no-display-inline" id="id5ab55feefc614ec098748dbe4780a8e9"> <section id="id9d925ec7fc3b4837b4dae483a645ec93"><enum>31318.</enum><header>Monthly report on commercial driver’s licenses</header><text display-inline="no-display-inline">Not later than the last day of each month, each State that issues commercial driver’s licenses under this chapter shall submit to the Secretary of Transportation a report describing—</text>
<paragraph commented="no" display-inline="no-display-inline" id="id153f827474c148dba3c4b6689e6db101"><enum>(1)</enum><text>the number of commercial learner’s permits issued by the State during the preceding month;</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id21f39f42610942b4a162da7b646711af"><enum>(2)</enum><text display-inline="yes-display-inline">the number of commercial driver’s licenses issued by the State during the preceding month;</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id3c8b8cb1759f460cac271eea0e01034c"><enum>(3)</enum><text>the number of foreign non-domiciled commercial driver’s licenses issued by the State during the preceding month;</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id315fede4a08f40699578c0568bd8760a"><enum>(4)</enum><text display-inline="yes-display-inline">the number of endorsements issued by the State during the preceding month; and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id06a3fd84cf6c414383ba7673962f68f6"><enum>(5)</enum><text display-inline="yes-display-inline">the number of, and justification for, revocations, suspensions, and downgrades of commercial driver’s licenses by the State during the preceding month.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection commented="no" display-inline="no-display-inline" id="id97376cc962064fa9ba5e42987f9952d1"><enum>(c)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/313">chapter 313</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text>

<section commented="no" display-inline="no-display-inline" id="id00c6954ca70c4486af7e08ec73c3438d"><enum>7.</enum><header display-inline="yes-display-inline">Improvements to commercial driver’s license training provider registry</header><text display-inline="no-display-inline">Section 31305 of title 49, United States Code, is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="idb92e5671ed9f41888580666dd2a44a4e"><enum>(1)</enum><text>in subsection (a), in the matter preceding paragraph (1), by inserting <quote>(referred to in this section as the <term>Secretary</term>)</quote> after <quote>Secretary of Transportation</quote>; and</text></paragraph>

<subparagraph commented="no" display-inline="no-display-inline" id="iddcfe503d20ba47e3ab010b5ba379006b"><enum>(A)</enum><header>Administration</header><text>The term <term>Administration</term> means the Federal Motor Carrier Safety Administration.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="idabd83ebb01074637aee7a93bdfec2969"><enum>(B)</enum><header>Principal place of business</header><text>The term <term>principal place of business</term>, with respect to a provider, means a single physical business location of the provider where—</text>
<clause commented="no" display-inline="no-display-inline" id="ida3c4251899614624a2680bd3395f5a81"><enum>(i)</enum><text display-inline="yes-display-inline">management officials of the provider report to work; and</text></clause> <clause commented="no" display-inline="no-display-inline" id="id9baffc27f6d54735a651794db84cb936"><enum>(ii)</enum><text>the provider conducts a significant portion of its business relating to the training of persons to transport persons or property.</text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id3a7cf12cb611415095d05878e4c61ef7"><enum>(C)</enum><header>Provider</header><text>The term <term>provider</term> means a training provider (within the meaning of subpart G of part 380 of title 49, Code of Federal Regulations (or successor regulations)).</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="idaf751f51d95a4344b9267cce8226692c"><enum>(D)</enum><header display-inline="yes-display-inline">Registry</header><text>The term <term>registry</term> means the training provider registry maintained by the Administration.</text></subparagraph></paragraph>
<paragraph id="ide0621a4ae1a44af68a9cc2fda4a06d6a"><enum>(2)</enum><header>Audits</header>
<subparagraph commented="no" display-inline="no-display-inline" id="id478562d391cc4a55992614359c9b9569"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish a process to audit providers listed on the registry to ensure that each provider meets the criteria established by the Secretary to provide training.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id53cdef8eb55b45f789a30363b465ebd2"><enum>(B)</enum><header>Role of States</header><text display-inline="yes-display-inline">The Secretary may require States—</text>
<clause commented="no" display-inline="no-display-inline" id="idd4a4c1ab3cef4e88ae8c9ac57a1293f2"><enum>(i)</enum><text display-inline="yes-display-inline">to conduct an audit under subparagraph (A); or</text></clause> <clause commented="no" display-inline="no-display-inline" id="id90e14c28e605409d8b479ab370d1d2ae"><enum>(ii)</enum><text display-inline="yes-display-inline">to collect relevant information from providers in the State for the Administration to audit.</text></clause></subparagraph></paragraph>
<paragraph id="id35c2ea09be094b589cef41babb6b7c5d"><enum>(3)</enum><header>Removal for nondisclosure of certain relationships</header><text>On complaint or on the initiative of the Secretary, the Secretary may, after providing notice and an opportunity to be heard, withhold, suspend, or revoke the registration of any provider listed on the registry if the Secretary finds that the provider failed to disclose any relationship, whether arising from common ownership, management, control, or familial ties, with another provider listed on the registry or with any applicant for inclusion on the registry whom the Secretary has determined to be unwilling or unable to comply with an applicable regulation or order of the Secretary.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id39981f24b8a1491e9a3e9d3fade8ccd5"><enum>(4)</enum><header>Expedited removal from registry</header><text>Not later than 120 days after the date of enactment of this subsection, the Secretary shall establish a process for States to remove a provider from the registry if the State determines that the provider—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="ide5f846a33d434522868c773f3800cce8"><enum>(A)</enum><text display-inline="yes-display-inline">is no longer in business;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="idc4dd604e24ea4eff95df51ac3659e3ac"><enum>(B)</enum><text display-inline="yes-display-inline">has been found guilty of committing fraud; or</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id8286b201552e4a19a518dcb72f28b0f8"><enum>(C)</enum><text display-inline="yes-display-inline">has violated State regulations governing commercial motor vehicle operator training.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="idf6e763d74d33442db98f526652bc5811"><enum>(5)</enum><header>Registration of providers</header> <subparagraph commented="no" display-inline="no-display-inline" id="idada7dab943a54e6d8427f0031f23c187"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">An entity seeking to become a provider in accordance with subsection (c) shall register with the Administration.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="idb11a2ff9acc449b1aa1d5e7d8791c967"><enum>(B)</enum><header>Principal place of business</header><text display-inline="yes-display-inline">A provider may not be added to the registry unless the provider has registered a principal place of business with the Administration.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id29d2cf5014ec40af8fe8a517cf57856a"><enum>(C)</enum><header>Existing providers</header><text display-inline="yes-display-inline">A provider listed on the registry as of the date of enactment of this subsection—</text>
<clause commented="no" display-inline="no-display-inline" id="id53742b4124914160ab913bd6cf8b5ba6"><enum>(i)</enum><text display-inline="yes-display-inline">shall register a principal place of business with the Administration by the date that is 1 year after that date of enactment; and</text></clause> <clause commented="no" display-inline="no-display-inline" id="id1af77d954d904306af9fbd589fd8593f"><enum>(ii)</enum><text>shall be removed from the registry if the provider has not registered a principal place of business with the Administration by the deadline described in clause (i).</text></clause></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="idb1f0c02e8c3542d3a201663386927d72"><enum>(6)</enum><header>Deadline for review of complaints against providers</header><text display-inline="yes-display-inline">Not later than 180 days after receiving a complaint against a provider included on the registry, the Administration shall make a determination with respect to resolving that complaint.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section commented="no" display-inline="no-display-inline" id="id7425df9220fa493ebd4bcecffc13c64d"><enum>8.</enum><header>Preventing, detecting, and addressing fraud in registration</header> <subsection commented="no" display-inline="no-display-inline" id="id3e40157c1cf94175930dfb2947352f39"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this section:</text>
<paragraph commented="no" display-inline="no-display-inline" id="id68a8edeed4f3431abfbe5e452999ef93"><enum>(1)</enum><header>Existing user</header><text>The term <term>existing user</term> means a motor carrier that has access to, is registered for, or is otherwise included in the registration system.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id3095b8ba8db84354a9fb0f6a9cd56bf1"><enum>(2)</enum><header>Flagged user</header><text display-inline="yes-display-inline">The term <term>flagged user</term> means a new user or existing user—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="iddddce100bba546a4be6940b47a13a8c3"><enum>(A)</enum><text display-inline="yes-display-inline">the activity of which is flagged as suspicious by an automated system implemented under subsection (b);</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="idb0f3ff56b833467193e29b6e1941beef"><enum>(B)</enum><text display-inline="yes-display-inline">with respect to which a discrepancy or other suspicious matter is identified; or</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id2e81ef96556a432f8828a3505c70c6ce"><enum>(C)</enum><text display-inline="yes-display-inline">with respect to which the Administration receives a report or other notification of—</text> <clause commented="no" display-inline="no-display-inline" id="idb2ce5b38813a424dba70e8a9d9744b66"><enum>(i)</enum><text display-inline="yes-display-inline">failure to disclose a material fact;</text></clause>
<clause commented="no" display-inline="no-display-inline" id="ida2d207388a234e1baed4fd546d29e8ae"><enum>(ii)</enum><text display-inline="yes-display-inline">fraud;</text></clause> <clause commented="no" display-inline="no-display-inline" id="idec9c80a0e5004b79a1cb5b3f8f9b83b8"><enum>(iii)</enum><text display-inline="yes-display-inline">any activity indicative of fraud; or</text></clause>
<clause commented="no" display-inline="no-display-inline" id="ida8c5369adbad4e1db383c2b2ad4fc435"><enum>(iv)</enum><text display-inline="yes-display-inline">any other suspicious activity pertaining to the registration system.</text></clause></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="idd4d989eb89a241669800ea33a19a1fe2"><enum>(3)</enum><header>New user</header><text display-inline="yes-display-inline">The term <term>new user</term> means a motor carrier or broker that first accesses or registers, or is first included in, the registration system.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="idc963eafe08fc49ea82cc2ae6a8f13b7d"><enum>(4)</enum><header>Person</header><text>The term <term>person</term> has the meaning given the term in section 13102 of title 49, United States Code.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="ida6d141cbeab64115ba3af08424afcc5a"><enum>(5)</enum><header>Registration system</header><text>The term <term>registration system</term> means the system that the Administration uses to register motor carriers or brokers as required under section 13908 of title 49, United States Code.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="idbf3991368f5e4ab7bffec6662ebd8261"><enum>(b)</enum><header>Automated systems</header><text>Not later than 1 year after the date of enactment of this Act, the Administrator shall develop and implement 1 or more automated systems to flag suspicious activity in the registration system, or by motor carriers, brokers, or other persons dealing with the Administration, such as—</text> <paragraph commented="no" display-inline="no-display-inline" id="id663da749c6be4408981ba1932b49bf33"><enum>(1)</enum><text>rapid or unusual changes to motor carrier or broker information;</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id0963297a8aa44f17b6c8fc99f2426873"><enum>(2)</enum><text>unusual registration patterns; or</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="idf06a944adf734cb48e191afce1e4e92e"><enum>(3)</enum><text>duplicate business identifiers.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="idc8ca5d2fe44a4f99845ccca10a1c65a7"><enum>(c)</enum><header>Review of flagged users</header>
<paragraph commented="no" display-inline="no-display-inline" id="ida3ef8c0a433f4a70978065c2fbd5139f"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>The Administrator shall establish a process to review each flagged user to determine whether that user engaged in fraud with respect to the registration system.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id8c32cfabf0334d9e8127e82f3b916fb2"><enum>(2)</enum><header>Requirements</header><text>A review under paragraph (1) shall—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="id3a6b975229ac4b2bb6ed3f3b3f7c427a"><enum>(A)</enum><text display-inline="yes-display-inline">begin immediately on—</text> <clause commented="no" display-inline="no-display-inline" id="idc77a2b3787e1427596009997a027a1a3"><enum>(i)</enum><text display-inline="yes-display-inline">the flagging of suspicious activity by an automated system implemented under subsection (b);</text></clause>
<clause commented="no" display-inline="no-display-inline" id="idb04b4c8bca364492980bd90c3b558e37"><enum>(ii)</enum><text>the identification of any discrepancy or other suspicious matter; or</text></clause> <clause commented="no" display-inline="no-display-inline" id="id3458e7591b464128af3b80aec0d93c96"><enum>(iii)</enum><text>the receipt of a report or other notification described in subsection (a)(3)(C); and</text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id39c58b85a92641a4b8a8e2c600fafa9a"><enum>(B)</enum><text>include an audit of the flagged user, if appropriate or necessary to resolve the review.</text></subparagraph></paragraph> <paragraph id="id95245dd576a4489bb6ba47711da3cd1a"><enum>(3)</enum><header>Suspension</header> <subparagraph commented="no" display-inline="no-display-inline" id="id275cf87cb91d456c8d0ff4002c134a7f"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator may—</text>
<clause commented="no" display-inline="no-display-inline" id="idb6fd10fe28014834a6bc0d5d9240d6f5"><enum>(i)</enum><text display-inline="yes-display-inline">temporarily suspend the registration of any flagged user in the registration system during a review under paragraph (1); or</text></clause> <clause commented="no" display-inline="no-display-inline" id="idf6e62a681a314f51a2ef20a07c6eb558"><enum>(ii)</enum><text>note in any record of the Administration, including a public record published on the registration system, that a review of the applicable flagged user is ongoing.</text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id52f52364f6204e43b32e7a6160694644"><enum>(B)</enum><header>Requirement</header><text>If the Administrator temporarily suspends a registration of a flagged user under subparagraph (A)(i), the Administrator shall provide to the flagged user a period of not less than 30 days to respond to and address any problems identified by the Administrator for purposes of resolving the review.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id970b94f43a0e4733b5c63128a52b1ff1"><enum>(4)</enum><header>Removal and other penalties</header> <subparagraph commented="no" display-inline="no-display-inline" id="id07b2bd24f98742e79eaf8a9eeed54bc5"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">On a determination that a motor carrier, broker, or any other person has failed to disclose a material fact, submitted fraudulent information, or committed fraud with respect to the registration system, the Administrator shall, as the Administrator determines to be appropriate—</text>
<clause commented="no" display-inline="no-display-inline" id="idedf72b7a15f54ed59d6b54496feacfe4"><enum>(i)</enum><text display-inline="yes-display-inline">remove the person from the public view of the registration system;</text></clause> <clause commented="no" display-inline="no-display-inline" id="idb02fc8ba79aa433398373fad80d81e70"><enum>(ii)</enum><text>remove the ability of the person to access the registration system; or</text></clause>
<clause commented="no" display-inline="no-display-inline" id="id3369c22ca72d41d7a829f2a7c03cf4a3"><enum>(iii)</enum><text>suspend or revoke the authority of the person to operate as a motor carrier, broker, or otherwise.</text></clause></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="ide2eeed1612fb4d2e97644d917f81d3fe"><enum>(B)</enum><header>Requirement</header><text>If the Administrator takes an action described in subparagraph (A)(iii), the Administrator shall maintain the information of the applicable person in the registration system to assist the Administrator in identifying future fraudulent activities of the person.</text></subparagraph></paragraph></subsection>
<subsection id="ide258855bb3f94dd882495f69c0d3dca6"><enum>(d)</enum><header>Records updates</header><text>Any update to a record in the registration system under this section—</text> <paragraph id="id7d6c167f800e4441ac99c7d754bdc899"><enum>(1)</enum><text>shall be made instantaneously, or as near instantaneously as possible, with respect to the determination relating to the update; and</text></paragraph>
<paragraph id="id286b7143a83143f69d5c691333e08a1f"><enum>(2)</enum><text>shall not be made unless the person requesting the update verifies that the person is authorized to request the update.</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="idf843e71a404a40f9bf6d24770072d8b6"><enum>(e)</enum><header>Guidance</header> <paragraph commented="no" display-inline="no-display-inline" id="id1cf3c439a1f347e5a0f72a5a52bd8810"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, the Administrator shall issue to motor carriers and brokers guidance about how to protect against fraudulent activities.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id05b85f9188a94f9b967262c6ccafcf0d"><enum>(2)</enum><header>Updates</header><text>The Administrator shall update the guidance issued under paragraph (1) as appropriate to improve awareness of fraudulent activities.</text></paragraph></subsection></section> <section id="id95a7186a8bce42d98ee66c331ed95965"><enum>9.</enum><header>Enforcement of cabotage laws</header> <subsection commented="no" display-inline="no-display-inline" id="idd569cc37026b445c96ac1fbf0f20f92e"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator and the Commissioner of U.S. Customs and Border Protection shall enter into a memorandum of understanding with respect to how the Administrator and State law enforcement agencies communicate to the Commissioner information relating to violations of—</text>
<paragraph commented="no" display-inline="no-display-inline" id="idac72399e0de54971bfed54d0ef85df8a"><enum>(1)</enum><text display-inline="yes-display-inline">section 13902(k) of title 49, United States Code, relating to the prohibition on the provision of point-to-point transportation services within the United States by drivers or motor carriers, including motor private carriers (as defined in section 13102 of title 49, United States Code), domiciled in Mexico or Canada operating in the United States; and</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id204b0300b230434eba98f7a6f05ced76"><enum>(2)</enum><text>section 13902(l) of title 49, United States Code, relating to the prohibition on the provision of point-to-point transportation services within the United States by unauthorized alien drivers.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="id18af9f67611842588775fd90bd1fbbe3"><enum>(b)</enum><header>Registration of motor carriers</header><text>Section 13902 of title 49, United States Code, is amended by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id9b2aa5618f5e4f21a9fe7ac9030bfe2e"> <subsection id="id7fb110b1fa1a4072b38832b71ba4f314"><enum>(k)</enum><header>Prohibiting certain foreign motor carriers from point-to-Point transport of domestic cargo in the United States</header> <paragraph commented="no" display-inline="no-display-inline" id="id30e3f2618ff04c74bb828b1f33836c7a"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A motor carrier or motor private carrier described in paragraph (2) shall not transport domestic cargo from a point originating within the United States to a destination point also within the United States.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id7ecd6ffe6a934a45be2c2379b33c434d"><enum>(2)</enum><header>Motor carriers and motor private carriers described</header><text display-inline="yes-display-inline">A motor carrier or motor private carrier referred to in paragraph (1) is a motor carrier or motor private carrier that—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id4485c101e9524e87b314ace9328f7cc1"><enum>(A)</enum><text display-inline="yes-display-inline">is domiciled in Canada or Mexico; or</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id18806a0566054e0aa7b5cbfd92b287b2"><enum>(B)</enum><text display-inline="yes-display-inline">is domiciled in the United States but owned or controlled, directly or indirectly, by a person domiciled in Mexico.</text></subparagraph></paragraph></subsection> <subsection id="id1f7a8ec959724c75b496b6ec16b85da8"><enum>(l)</enum><header>Prohibiting unauthorized alien drivers from point-to-Point transport of domestic cargo in the United States</header><text>A motor carrier or motor private carrier shall not knowingly transport domestic cargo from a point originating within the United States to a destination point also within the United States in a commercial motor vehicle (as defined in section 31301) operated by an alien (as defined in section 101(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)</external-xref>)) who is not authorized by U.S. Citizenship and Immigration Services to engage in employment in the United States that includes driving a commercial motor vehicle.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection commented="no" display-inline="no-display-inline" id="id783ad244519c46ec97ab2a8d6326eeca"><enum>(c)</enum><header>Rulemaking</header><text>Not later than 1 year after the date of enactment of this Act, the Administrator shall revise section 365.101T(h) of title 49, Code of Federal Regulations, to reflect the requirements of subsection (a) and section 13902(k) of title 49, United States Code.</text></subsection></section> <section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idedf6a0f5f290453c8d8381695e3648ab"><enum>10.</enum><header>Reimbursement of certain victims of freight theft</header><text display-inline="no-display-inline">The Commissioner of U.S. Customs and Border Protection shall reimburse the victims of cargo theft under section 659 of title 18, United States Code, for fines paid by such victims to U.S. Customs and Border Protection for containers that are not sealed as required by regulations prescribed pursuant to section 204 of the Security and Accountability For Every Port Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/6/944">6 U.S.C. 944</external-xref>).</text></section>
<section commented="no" id="id83d06ba8551b4dc6986a178ab62e8cae"><enum>11.</enum><header>Criminal penalties; submission or use of fraudulent certifications</header>
<subsection commented="no" display-inline="no-display-inline" id="id19108e04bef34a71a66a9e2dd7db88fa"><enum>(a)</enum><header display-inline="yes-display-inline">Definition of fraudulent certification</header><text>In this section, the term <term>fraudulent certification</term> means any statement, representation, or omission of fact, including in any writing or document, that—</text> <paragraph commented="no" display-inline="no-display-inline" id="id24530322bfeb46e6b1c1637d237f149f"><enum>(1)</enum><text display-inline="yes-display-inline">is material;</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id8f4792175e8b40f9a9c01393351a070e"><enum>(2)</enum><text display-inline="yes-display-inline">is known by the person submitting or using it to be false, fictitious, misleading, or incomplete; and</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id87ec9e10e5ac4a1097dcc27190a5276a"><enum>(3)</enum><text display-inline="yes-display-inline">is submitted or used in connection with any registration, certification, filing, or compliance requirement administered by the Administration under chapter 5, 311, 313, or 315 of title 49, United States Code.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="id906548d27f974f10aa129ea54e81860b"><enum>(b)</enum><header>Criminal penalty</header><text>Any person who knowingly and willfully submits to the Administrator or otherwise uses a fraudulent certification and, by means of that fraudulent certification or any authority or status obtained pursuant to that fraudulent certification, engages or attempts to engage in the unlawful transportation of property or passengers in interstate commerce shall be fined under title 18, United States Code, imprisoned for not more than 5 years, or both.</text></subsection></section> <section commented="no" display-inline="no-display-inline" id="id060b7fbaed734f9dada375ef84ebd95d"><enum>12.</enum><header>Foreign dispatch services</header> <subsection commented="no" display-inline="no-display-inline" id="id64e2ef411e2f4769a990226a16cd4e5b"><enum>(a)</enum><header>Definition of foreign dispatch service</header><text>Section 13102 of title 49, United States Code, is amended—</text>
<paragraph id="idf54a68e2ebe34d6e90170d5a0260d495"><enum>(1)</enum><text>in the matter preceding paragraph (1), by striking <quote>, the following definitions shall apply</quote>;</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id95c61a83079544e29bec7682debd9067"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (6) through (27) as paragraphs (7), (8), (9), (10), (11), (12), (13), (14), (15), (16), (17), (18), (20), (21), (22), (23), (24), (25), (26), (27), (28), and (19) respectively, and moving the paragraphs so as to appear in numerical order; and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="idc8c3c6a51b8b40ceaf1ab99ce2ebc7e4"><enum>(3)</enum><text>by inserting after paragraph (5) the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="idff9625b5e7254fa0911fb793b66d7b77"> <paragraph id="idda796b1dff314adf86e9df150d5cba96"><enum>(6)</enum><header>Foreign dispatch service</header><text>The term <term>foreign dispatch service</term> means a person that—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="idbd055f63ba3c4fb79a72e9ab970992ec"><enum>(A)</enum><text>is not located in the United States, Mexico, or Canada;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id8d670ccfd3014f8ca7e203337a365735"><enum>(B)</enum><text>maintains its principal place of business or substantial operations in a foreign country;</text></subparagraph>
<subparagraph id="id17a1473a26fa442e9cd9b982c5ab5318"><enum>(C)</enum><text>acts as a direct licensed agent on behalf of 1 or more motor carriers through a formal written agreement;</text></subparagraph> <subparagraph id="id8be0cbf045e047f69583b4815a7ad48f"><enum>(D)</enum><text>receives compensation from those motor carriers based on a predetermined written legal contractual agreement;</text></subparagraph>
<subparagraph id="id5ab66339a46e4f9da892d3206b685270"><enum>(E)</enum><text>discloses that—</text> <clause commented="no" display-inline="no-display-inline" id="id3f65bb26a9494749b901a7155d4098f4"><enum>(i)</enum><text display-inline="yes-display-inline">the person is a dispatch service operating under an agreement with a specific motor carrier; and</text></clause>
<clause commented="no" display-inline="no-display-inline" id="idb670d25639cf4e20923876c614306374"><enum>(ii)</enum><text display-inline="yes-display-inline">the relevant shipment is arranged for that motor carrier only;</text></clause></subparagraph> <subparagraph id="id3e76f3010cef4d6199a5b1419e2fc7a2"><enum>(F)</enum><text>provides only administrative or support services limited to—</text>
<clause id="idd7c85d6fd1834618b9615c39750b68bf"><enum>(i)</enum><text>coordinating freight movements without assuming responsibility for the cargo or arranging transportation; and</text></clause> <clause id="idbca61ba29f26414c9af99a7821e93f2b"><enum>(ii)</enum><text>communicating through a broker to arrange for the transportation of shipments for the motor carrier; and</text></clause></subparagraph>
