which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To reauthorize the Chesapeake Bay Office of the National Oceanic and Atmospheric Administration, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H428718722A684C09B56A0A90BC1EA26B"><section section-type="section-one" id="H453FC3C3354A4CC89048EC5B125D9CD3"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Chesapeake Watershed Advancement for Training, Education, Restoration, and Science Act</short-title></quote> or the <quote><short-title>Chesapeake WATERS Act</short-title></quote>.</text></section><section id="H4FF929B6BBA744B6B94DEE1FB8D2B486"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that the Chesapeake Bay Office of the National Oceanic and Atmospheric Administration should be the primary representative of the National Oceanic and Atmospheric Administration in the Chesapeake Bay watershed.</text></section><section id="HBE7D8F33C0E146329E8EAAD3166F2511"><enum>3.</enum><header>Reauthorization of the National Oceanic and Atmospheric Administration Chesapeake Bay Office</header><text display-inline="no-display-inline">Section 307 of the National Oceanic and Atmospheric Administration Authorization Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/15/1511d">15 U.S.C. 1511d</external-xref>) is amended—</text><paragraph id="HB22C18A087424AD083B83AD7F13E2F36"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="H373B10E5AE9F414A967BD3C06BBBF862"><enum>(A)</enum><text>in paragraph (1), by striking <quote>(in this section referred to as the <quote>Office</quote>)</quote>;</text></subparagraph><subparagraph id="H98B675D26F504F788BD926C66B8C2B2F"><enum>(B)</enum><text>by amending paragraph (2) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H1B8F1B2EE46D4E62A582F54CAEC9C20C"><paragraph id="H16B131A097E047CE84FC1C3BC768320C" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The Office shall be headed by a Director, who—</text><subparagraph id="HEEA123DE85694428A74E75F27B81900D"><enum>(A)</enum><text>shall have knowledge and experience in research or resource management efforts in the Chesapeake Bay; and</text></subparagraph><subparagraph id="HA99BD49EE0AA4691AE0BBDF7FD678B6C"><enum>(B)</enum><text>shall be responsible for the administration and operation of the Office and the implementation of this section.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H8D4F08AEB02042B691D1E90E3EE7119A"><enum>(C)</enum><text>by striking paragraph (3);</text></subparagraph></paragraph><paragraph id="H8A23E2205A39424DA8758ED06A7DEA4E"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="H90F629A40881453DA61DBFB02F186339"><enum>(A)</enum><text>in paragraph (2), by striking <quote>Secretary of Commerce</quote> and inserting <quote>Administrator</quote>;</text></subparagraph><subparagraph id="H049E142736844634B73360CFD0798A6D"><enum>(B)</enum><text>in paragraph (3)—</text><clause id="H03F287312A8D4C03957293475B53DF91"><enum>(i)</enum><text display-inline="yes-display-inline">by inserting <quote>with and represent</quote> after <quote>coordinate</quote>;</text></clause><clause id="HE66787663B0F4F11B553E57450DDC929"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking <quote>, the Chesapeake Bay Regional Sea Grant Programs, and the Chesapeake Bay units of the National Estuarine Research Reserve System,</quote> and inserting <quote>for the Chesapeake Bay Program and that relate to the Chesapeake Bay watershed in furtherance of such Administration’s coastal resource stewardship mission,</quote>;</text></clause><clause id="H687C70BEB9224D0F8DE8FC724DDD8650"><enum>(iii)</enum><text>in subparagraph (A)—</text><subclause commented="no" id="H834D70A149184C3D84A4529AABDB020B"><enum>(I)</enum><text>in clauses (vi) and (vii), by striking <quote>and</quote> at the end; and</text></subclause><subclause id="HDF9849DD7103430ABA5D9A0A8BF8431F"><enum>(II)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H6B14A35441FF48AFB635DF4C4828D217"><clause commented="no" id="H043BAD56D6034E128512704B06B28D44"><enum>(viii)</enum><text display-inline="yes-display-inline">coastal hazards and climate change; and</text></clause><clause id="H5D4B872CC4F5408FAE20E4AC7FD63CF3"><enum>(ix)</enum><text display-inline="yes-display-inline">education; and</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subclause></clause><clause id="HB8A045D4D18949DF910096331E7CD53F"><enum>(iv)</enum><text>in subparagraph (B)—</text><subclause id="HBF1547BC859841FCA8887D9E3EF25CE5"><enum>(I)</enum><text>in clause (iii), by striking <quote>and</quote> at the end;</text></subclause><subclause id="HD77AE9ABCA1742B9BDE0BB86C450C188"><enum>(II)</enum><text>in clause (iv), by inserting <quote>and</quote> after the semicolon; and</text></subclause><subclause id="H2EF98123E05C4FE2A0847D9C55324AE2"><enum>(III)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF4A44B1CAB224B16928BBBB8BE35BB0C"><clause id="HC83F4545E0C041859E89316DB7547E00"><enum>(v)</enum><text display-inline="yes-display-inline">integrated ecosystem assessments;</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></subclause></clause></subparagraph><subparagraph id="H1901F8FC8FDD4B0E8AB5E34E05CD2FA0"><enum>(C)</enum><text>in paragraph (4)—</text><clause id="H2F17023277044B9793B8AA49D21AF68E"><enum>(i)</enum><text>by striking <quote>Environmental Protection Agency</quote> and inserting <quote>Chesapeake Executive Council</quote>; and</text></clause><clause id="H03B61E822A1D45A79134F7F86B2A4A59"><enum>(ii)</enum><text>by inserting <quote>as appropriate to further the purposes of this section</quote> after <quote>agencies</quote>;</text></clause></subparagraph><subparagraph id="H98C13D95E78D4204948CF36A87BD9B2C"><enum>(D)</enum><text>by striking paragraphs (5) and (7);</text></subparagraph><subparagraph id="H7B72848DDCAA41CFAC3D8E85FAE2B688"><enum>(E)</enum><text>by redesignating paragraph (6) as paragraph (5); and</text></subparagraph><subparagraph id="H1E41E067559E4698A5A477E2D6EF04A8"><enum>(F)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H76D9246F966C42D88A2B3755D5A21247"><paragraph id="H9FF496BBC25844138D65D52D8B3E094D"><enum>(6)</enum><text display-inline="yes-display-inline">perform any functions necessary to support the programs and activities referred to in paragraph (3).</text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H231E483A081E416B927F8EF590DA0D51"><enum>(3)</enum><text>by striking subsections (c), (d), and (e); and</text></paragraph><paragraph id="HAE0C066540ED4C17B4EFC16D27507028"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H6CFC4C648C8A4B3EBDCF070543769040"><subsection id="HCE327512003F43D6BF608D9E2A5C232E"><enum>(c)</enum><header>Programs and activities</header><paragraph id="H47798B248FD04953BF108E8A33D684CC"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator, through the Director, shall implement the programs and activities authorized by this section to support the activity of the Chesapeake Executive Council and to further the purposes of this section.</text></paragraph><paragraph id="H1C319B47BBB74BE1BFEC347B26B1319D"><enum>(2)</enum><header>Ensuring scientific and technical merit</header><text>The Director shall—</text><subparagraph id="H7DB0485D57974FCB8BA8CBC9D1F5578F"><enum>(A)</enum><text display-inline="yes-display-inline">establish and use an effective and transparent mechanism to ensure that projects carried out under this section have undergone appropriate peer review; and</text></subparagraph><subparagraph id="H34A57D0BC6F84B088BAB88618A196B29"><enum>(B)</enum><text display-inline="yes-display-inline">provide other appropriate means to determine that such projects have acceptable scientific and technical merit for the purpose of achieving maximum use of available funds and resources to benefit the Chesapeake Bay area.</text></subparagraph></paragraph><paragraph id="H09DC44E1C45C4CB3A337692514D8B593"><enum>(3)</enum><header>Consultation with Chesapeake Executive Council</header><text display-inline="yes-display-inline">The Director shall, in the implementation of the programs and activities authorized by this section, consult with the Chesapeake Executive Council to ensure that the activities of the Office are consistent with the purposes and priorities of the Chesapeake Bay Agreement and plans developed pursuant to that agreement.</text></paragraph><paragraph id="H4502E14801694B58984A730DFCDF8A8D"><enum>(4)</enum><header>Integrated coastal observations</header><subparagraph id="H4473E8EEAC504A2D8DBFA17E50A1D0F9"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator, through the Director, may collaborate with scientific and academic institutions, State and Federal agencies, nongovernmental organizations, and other constituents in the Chesapeake Bay watershed to support a regional coastal observing system for the Chesapeake Bay consistent with the purposes of the Integrated Coastal and Ocean Observation System Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/33/3601">33 U.S.C. 3601 et seq.</external-xref>).</text></subparagraph><subparagraph id="HCE3024666CC7438F988FC80E57CD0FB1"><enum>(B)</enum><header>Specific requirements</header><text display-inline="yes-display-inline">To support the system referred to in subparagraph (A) and provide a complete set of environmental information for the Chesapeake Bay, the Director shall—</text><clause id="H21C47ED6DDED4E35A62BA28AEAC41541"><enum>(i)</enum><text display-inline="yes-display-inline">coordinate monitoring with Federal and State agencies in the tidal portions of the Chesapeake Bay to understand impacts of water quality on living marine resources;</text></clause><clause id="HABF8399D049A46C3A215187F76783CA0"><enum>(ii)</enum><text>identify new data collection needs and deploy new technologies, as appropriate;</text></clause><clause id="HFB567CEEEA91447F83461CE261791281"><enum>(iii)</enum><text display-inline="yes-display-inline">collect and analyze the scientific information necessary for the management of living marine resources and the marine habitat associated with those resources; and</text></clause><clause id="H8B3D668D877A434BA27682F8E52052F0"><enum>(iv)</enum><text display-inline="yes-display-inline">organize the information described in clause (iii) into products that are useful to policymakers, resource managers, scientists, and the public.</text></clause></subparagraph><subparagraph id="H6A27DB6BC7AD49ADAAFE73742A2D476B"><enum>(C)</enum><header>Chesapeake Bay Interpretive Buoy System</header><text display-inline="yes-display-inline">To further the development and implementation of the Chesapeake Bay Interpretive Buoy System and associated monitoring assets to improve weather and ecological forecasts and monitor habitat conditions for living marine resources, the Director may—</text><clause id="HEC715D81DF5C4F058F4EBF051F10AF35"><enum>(i)</enum><text display-inline="yes-display-inline">support the establishment and implementation of the Captain John Smith Chesapeake National Historic Trail;</text></clause><clause id="H48F005C3B0074FF6A8720AED6D326B1F"><enum>(ii)</enum><text display-inline="yes-display-inline">delineate key waypoints along the trail and provide appropriate real-time data and information for trail users;</text></clause><clause id="H1A57928811E04B1CBAED8C1F4378E908"><enum>(iii)</enum><text display-inline="yes-display-inline">interpret data and information for use by educators and students to inspire stewardship of the Chesapeake Bay; and</text></clause><clause id="HF1B62EC277824D3396E7F89895B9F7D0"><enum>(iv)</enum><text display-inline="yes-display-inline">incorporate the observational data from the Chesapeake Bay Interpretive Buoy System into the Integrated Ocean Observing System network of regional coastal observing systems.</text></clause></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H77BBF7A0794F482FAAE7525EA0E66DC0"><enum>(5)</enum><header>Chesapeake Bay watershed education and training program</header><subparagraph id="H91D18422161E477290782073301AF652"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator, through the Director, may establish a Chesapeake Bay watershed education and training program. The program shall—</text><clause id="HA7E62095A5BE4055B6D278F27AD34AD3"><enum>(i)</enum><text display-inline="yes-display-inline">continue and expand the Chesapeake Bay watershed education programs offered by the Office immediately before the enactment of the <short-title>Chesapeake Watershed Advancement for Training, Education, Restoration, and Science Act</short-title>;</text></clause><clause id="HB2F4D6254A584365A09B2493444210FD"><enum>(ii)</enum><text display-inline="yes-display-inline">improve the understanding of elementary and secondary school students and teachers of the living resources of the Chesapeake Bay ecosystem;</text></clause><clause id="HC54715D6D851449E8FE4BA34E116E990"><enum>(iii)</enum><text display-inline="yes-display-inline">provide education and career pathway internships; and</text></clause><clause id="H1A01D0D915ED4896BFB7DE3E4CCDCAF5"><enum>(iv)</enum><text display-inline="yes-display-inline">meet the educational goals of the Chesapeake Bay Watershed Agreement.</text></clause></subparagraph><subparagraph id="H412905E06EE44AB295C85DA5E1444DF2"><enum>(B)</enum><header>Grant program</header><text display-inline="yes-display-inline">The Director may award grants for the purposes of this paragraph. Grants awarded under this subparagraph may be used to support education and training projects that enhance understanding and assessment of a specific environmental problem in the Chesapeake Bay watershed or a goal of the Chesapeake Bay Program, or protect or restore living resources of the Chesapeake Bay watershed, including projects that—</text><clause id="HBEAA12A594B34969BE93EFAB03F48F67"><enum>(i)</enum><text display-inline="yes-display-inline">provide classroom education, including the development and use of distance learning and other innovative technologies, related to the Chesapeake Bay watershed;</text></clause><clause id="H919F6BD4577749E69DA770E530D8A9EF"><enum>(ii)</enum><text display-inline="yes-display-inline">provide meaningful watershed educational experiences in the Chesapeake Bay watershed;</text></clause><clause id="H2F64334B69F74B809FFD35C1DE689703"><enum>(iii)</enum><text display-inline="yes-display-inline">provide professional development for teachers related to the Chesapeake Bay watershed and the dissemination of pertinent education materials oriented to varying grade levels;</text></clause><clause id="H42FED8CEC8B0440F993E49A603ADC2E6"><enum>(iv)</enum><text display-inline="yes-display-inline">demonstrate or disseminate environmental educational tools and materials related to the Chesapeake Bay watershed;</text></clause><clause id="H8BE805725D464949937C28C3EFFBC478"><enum>(v)</enum><text display-inline="yes-display-inline">demonstrate field methods, practices, and techniques, including assessment of environmental and ecological conditions and analysis of environmental problems; and</text></clause><clause id="HA06AB831FAB34525B874FC5D87117F33"><enum>(vi)</enum><text display-inline="yes-display-inline">build the capacity of school districts and their partners to deliver high-quality environmental education programs.</text></clause></subparagraph><subparagraph id="HD7D2DCE09ECE47C1A65BBAC0B8DF9C9B"><enum>(C)</enum><header>Coordination</header><text>The Director shall implement the education and training program in coordination with the heads of other Federal agencies, as the Director determines appropriate.</text></subparagraph></paragraph><paragraph id="HD669EB4F345944449FEC002D69A753E9"><enum>(6)</enum><header>Coastal Living Resources Management and Habitat Program</header><subparagraph id="H71C7750A4ABB4E3C8E279CDD2E6642F0"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator, through the Director, may establish a Chesapeake Bay Coastal Living Resources Management and Habitat Program to support coordinated management, protection, characterization, and restoration of priority Chesapeake Bay habitats and living resources, including oysters, blue crabs, submerged aquatic vegetation, and economically and ecologically important fish species such as striped bass and menhaden. </text></subparagraph><subparagraph id="H8609A69DE24D416DB1DA65371BFA3680"><enum>(B)</enum><header>Activities</header><text display-inline="yes-display-inline">Under the Chesapeake Bay Coastal Living Resources Management and Habitat Program, the Director may carry out or enter into grants, contracts, and cooperative agreements and provide technical assistance to support—</text><clause id="HCB0FAFEBA1254113AF52122B4327A507"><enum>(i)</enum><text>native oyster research and restoration;</text></clause><clause id="H359136045F5F4DEFBAB05E88E75A3411"><enum>(ii)</enum><text>fish and shellfish aquaculture that is carried out in accordance with a valid Federal or State permit;</text></clause><clause id="H5F64E3A4E7C04CB695AF724AC10179C7"><enum>(iii)</enum><text>the establishment of submerged aquatic vegetation restoration programs;</text></clause><clause id="HDFCA22D9C5A149DE9948A157DA3EA305"><enum>(iv)</enum><text>the development of programs that restore, protect, and build the resilience of critical coastal habitats and communities;</text></clause><clause id="H7F8F297F1FED4936AB6E779623421AF9"><enum>(v)</enum><text display-inline="yes-display-inline">habitat mapping, characterization, and assessment techniques necessary to identify, assess, and monitor Chesapeake Bay conditions and restoration actions;</text></clause><clause id="HE09BD78DAA104BE1AC00BA2A4A82CE87"><enum>(vi)</enum><text>the application and transfer of applied scientific research and ecosystem management tools to fisheries and habitat managers;</text></clause><clause id="HD76EDBEA787F498F849BA3027E6334F0"><enum>(vii)</enum><text>the collection, synthesis, and sharing of information to inform and influence coastal and living resource management issues;</text></clause><clause id="HEC435C79EBFA427FBCCB2987547D8994"><enum>(viii)</enum><text display-inline="yes-display-inline">ecologically and economically important fish and shellfish research; and</text></clause><clause id="HA4EC05F2B1774220861EA104C81E73F1"><enum>(ix)</enum><text>other activities that the Director determines are appropriate to carry out the purposes of the program.</text></clause></subparagraph></paragraph></subsection><subsection id="HAE72E366A52543B69BEDD2A121A9590C"><enum>(d)</enum><header>Delegation</header><paragraph id="HCE8D4A8761904FCB81928CFCE57DA330"><enum>(1)</enum><header>Authority</header><text>The Administrator shall delegate to the Director such authority as may be necessary to carry out this section.</text></paragraph><paragraph id="HC138B0DD6F56436F9101AB2480F60A06"><enum>(2)</enum><header>Staff</header><text>The Administrator shall delegate to the Director appropriate staff representing expertise that covers the breadth of the functions of the Office.</text></paragraph></subsection><subsection id="HE0A25F2211F14548B5F128E9921C75C1"><enum>(e)</enum><header>Reports</header><paragraph id="H48B5D705800746D6AD9A2FF352EE4CD5"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator, through the Director, shall biennially submit to Congress and the Secretary of Commerce a report on the activities of the Office and progress made in protecting and restoring the living resources and habitat of the Chesapeake Bay.</text></paragraph><paragraph id="H9D173B3C4EE148D28D5DD258405C40E2"><enum>(2)</enum><header>Action plan</header><text display-inline="yes-display-inline">Each report required by paragraph (1) shall include an action plan for the 2-year period following submission of the report, consisting of—</text><subparagraph id="H1264CFFB030A4043AEE00A70EF53755D"><enum>(A)</enum><text display-inline="yes-display-inline">a list of recommended research, monitoring, and data collection activities necessary to continue implementation of the strategy under subsection (b)(2); and</text></subparagraph><subparagraph id="HCB3D70B8FD99425AB7A0FB5ABEB7279D"><enum>(B)</enum><text display-inline="yes-display-inline">recommendations to integrate activities of the National Oceanic and Atmospheric Administration with the activities of the partners in the Chesapeake Bay Program to meet the commitments of the Chesapeake Bay Agreement and subsequent agreements.</text></subparagraph></paragraph></subsection><subsection id="HB1A91E34EFD646F8B95F740EF397E86E"><enum>(f)</enum><header>Agreements</header><paragraph commented="no" id="H0B3BEFFC1EBF43078D3C17846EE3939A"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator, through the Director, may enter into and perform such contracts, leases, grants, or cooperative agreements as may be necessary to carry out the purposes of this Act.</text></paragraph><paragraph id="H01C78D0F008E4FDAB6B7A0C9CC1E650A"><enum>(2)</enum><header>Use of other resources</header><text display-inline="yes-display-inline">For purposes related to the understanding, protection, and restoration of the Chesapeake Bay, the Director may use, with consent and with or without reimbursement, the land, services, equipment, personnel, and facilities of—</text><subparagraph commented="no" display-inline="no-display-inline" id="idda149b6701614173be5c07638464fc41"><enum>(A)</enum><text display-inline="yes-display-inline">any Department, agency, or instrumentality of the United States; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf657e7168fe74a849822c99cceae0158"><enum>(B)</enum><text display-inline="yes-display-inline">any State, local government, or Indian Tribe, or any political subdivision thereof.</text></subparagraph></paragraph></subsection><subsection id="HBAA972A2C634451B98A309DBABC02405"><enum>(g)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HAAEBB46C54E749789B07B1E4F1E3732A"><enum>(1)</enum><header>Administrator</header><text display-inline="yes-display-inline">The term <term>Administrator</term> means the Administrator of the National Oceanic and Atmospheric Administration.</text></paragraph><paragraph id="HC1E731D47066474D81C0FD8B77426516"><enum>(2)</enum><header>Chesapeake Bay Agreement;
