which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit the issuance of commercial driver’s licenses to individuals who are not citizens or lawful permanent residents of the United States or holders of certain work visas, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as <quote><short-title>The Dalilah Law</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id3e546cfd55c34bbe88de18a760e28570"><enum>2.</enum><header>Prohibition on issuance of CDLs to individuals who are not citizens or lawful permanent residents of the United States or holders of certain work visas</header><subsection commented="no" display-inline="no-display-inline" id="idf71fdca4c3b74acfb40ce976b85b4e6d"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id903f1d2ca5944013b1c0f080602ef2ec"><enum>(1)</enum><header>Commercial driver’s license</header><text>The term <term>commercial driver’s license</term> has the meaning given the term in section 31301 of title 49, United States Code.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf8ead5c9a7ba41258d737417c40ce377"><enum>(2)</enum><header>Commercial motor vehicle</header><text>The term <term>commercial motor vehicle</term> has the meaning given the term in section 31301 of title 49, United States Code.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7c7e0e9358484dda9e0708f4a8349202"><enum>(3)</enum><header>Covered examination</header><text>The term <term>covered examination</term> means any test or examination relating to the issuance or renewal of a covered license or authorization, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf0bda3781b204e86a47c42524e24bd3c"><enum>(A)</enum><text display-inline="yes-display-inline">a commercial driver’s license knowledge test;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2623a5a7274548c28b0e5f80cf6efca8"><enum>(B)</enum><text>a commercial driver’s license skills test; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id570d843564084a46be7a796a715e8c00"><enum>(C)</enum><text>any other test or examination required to acquire, maintain, or upgrade a covered license or authorization.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id01da5f4f50674fde86e2dd00cceea121"><enum>(4)</enum><header>Covered funding</header><text>The term <term>covered funding</term>, with respect to a State, means any funding that is authorized to be provided by the Secretary to that State, or for a project or activity carried out in that State, under any provision of Federal law (including regulations).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4d92894859dd4f3f84c9c09486237d28"><enum>(5)</enum><header>Covered license or authorization</header><text>The term <term>covered license or authorization</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="ide5321fbd16634bf28484e38b7dd280e0"><enum>(A)</enum><text display-inline="yes-display-inline">a commercial driver’s license, including a non-domiciled commercial driver’s license; and</text></subparagraph><subparagraph id="id705b7a5b88ff4e0cbe439ed5c064d4b3" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>any other license or authorization issued by a State authorizing an individual to operate a commercial motor vehicle.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6638b7f8915b4055b44973085a66a7e0"><enum>(6)</enum><header>Non-domiciled commercial driver’s license</header><text>The term <term>non-domiciled commercial driver’s license</term> means a commercial driver’s license issued by a State or other jurisdiction to an individual who is not domiciled in that State or jurisdiction, in accordance with part 383 of title 49, Code of Federal Regulations (or successor regulations).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idd6c2dbef7f9640acb472f0f99481ebd9"><enum>(b)</enum><header>Prohibition</header><text>Section 31311(a)(12) of title 49, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id491d4dbb60f04f439a3ad0c2c3475aa8"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idda00625675b242bd955f23781faa2caf"><enum>(A)</enum><text>by striking <quote>who operates</quote> and inserting the following: “who—</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7d7d4b8e8897471882940b8d8ac53631"><clause id="id4382feac04bc4ba8bdd8e872ff382e6a" indent="up1"><enum>(i)</enum><text>operates</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id61a3df67d9154962ac609b1a2df23493"><enum>(B)</enum><text>in clause (i) (as so designated), by striking <quote>vehicle and is</quote> and inserting the following: “vehicle;</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6a606420715b4d7c8bd9b9df33965cc0"><clause id="id8dc81e10f4d146fd9609bd20f39a519f" indent="up1"><enum>(ii)</enum><text>is</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddd84207460ff4f04a78ecb571fe6a004"><enum>(C)</enum><text>in clause (ii) (as so designated), by striking <quote>State.</quote> and inserting the following: “State; and</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2aa1dfd85de048d8baa8e0c011b32d71"><clause commented="no" display-inline="no-display-inline" id="id359bd93a92814c07b21370a89e99fc4d" indent="up1"><enum>(iii)</enum><text>is a citizen or lawful permanent resident of the United States.</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcdc2947cf6da48cb833cab75977730bd"><enum>(2)</enum><text>in subparagraph (B)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9aecb0e88a45498f946fc8d14825ef52"><enum>(A)</enum><text>in clause (i), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf62a4fb791cd431baf24750416020965"><enum>(B)</enum><text>in clause (ii), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6c72c9a2c09b4832b565af35fdcf3c27"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idd504007924174a1db43fd169be15a414"><clause commented="no" display-inline="no-display-inline" id="id2d4742f739634e719ce7589a8673f8ac" indent="up1"><enum>(iii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id686ed636f8c34fe2a862788f67f67593"><enum>(I)</enum><text>is a citizen or lawful permanent resident of the United States; or</text></subclause><subclause commented="no" display-inline="no-display-inline" indent="up1" id="id7b543ba37f6148cdbdda51857dec6386"><enum>(II)</enum><text display-inline="yes-display-inline">is a nonimmigrant described in subparagraph (E)(ii), (H)(ii)(a), or (H)(ii)(b) of section 101(a)(15) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)</external-xref>) and is in possession of a valid, unexpired nonimmigrant visa issued to the individual pursuant to any such subparagraph.</text></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd1b0e094ce2c47568f0a73fab7d8960e"><enum>(3)</enum><text>in subparagraph (C)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6e5a31c5807b4d15a1e2e36ba51214cd"><enum>(A)</enum><text display-inline="yes-display-inline">in clause (ii)(II), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idda38691f4d234b9987005836931159e4"><enum>(B)</enum><text>in clause (iii), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida97c00266e9a47efb93ceeb3d57a1502"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4805b79f43cd42a09689e5dfe80c9f3d"><clause commented="no" display-inline="no-display-inline" id="id9dd080dd0c564de7ab29b0add04a0a30" indent="up1"><enum>(iv)</enum><subclause commented="no" display-inline="yes-display-inline" id="idc50a46dc805e49e08944817e4a6850b1"><enum>(I)</enum><text>is a citizen or lawful permanent resident of the United States; or</text></subclause><subclause commented="no" display-inline="no-display-inline" indent="up1" id="id26e8cacce8a2415996e179b67de378b0"><enum>(II)</enum><text display-inline="yes-display-inline">is a nonimmigrant described in subparagraph (E)(ii), (H)(ii)(a), or (H)(ii)(b) of section 101(a)(15) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)</external-xref>) and is in possession of a valid, unexpired nonimmigrant visa issued to the individual pursuant to any such subparagraph.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ida7a0b7f81fc94e3b81f78d5b6e1ab1b2"><enum>(c)</enum><header>Disqualifications</header><text>Section 31310 of title 49, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id645210bf1e2d424998d97239ae28bc47"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (d)(2)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id20881ac73e2f4921a487b3b174bfc7ae"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>paragraph (9) of</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd772b258e410461295b88500e5612157"><enum>(B)</enum><text>by striking <quote>7102(9)</quote> and inserting <quote>7102</quote>; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9e09ad78a0c847119c0f0d96dac62777"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id90b45fd984d34a9c87341a1fd866bb42"><subsection commented="no" display-inline="no-display-inline" id="idf0c13342eaae4c4cb5fafe8265e7d855"><enum>(l)</enum><header>Disqualification based on lack of citizenship, lawful permanent residence, or work visa status</header><text>The Secretary shall disqualify from operating a commercial motor vehicle for life an individual who operates a commercial motor vehicle in the United States while that individual is not a citizen or lawful permanent resident of the United States or a nonimmigrant described in subparagraph (E)(ii), (H)(ii)(a), or (H)(ii)(b) of section 101(a)(15) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)</external-xref>) in possession of a valid, unexpired nonimmigrant visa issued to the individual pursuant to any such subparagraph, unless such individual—</text><paragraph commented="no" display-inline="no-display-inline" id="id760375c53d2445f0ad994dc51afe20dd"><enum>(1)</enum><text display-inline="yes-display-inline">is operating a commercial motor vehicle as a nonimmigrant described in subparagraph (B) of that section and is in possession of a valid, unexpired nonimmigrant visa issued to the individual pursuant to that subparagraph; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1a6de2cb9b604fa9980cd23f34770089"><enum>(2)</enum><text display-inline="yes-display-inline">holds a valid travel authorization pursuant to section 217.5 of title 8, Code of Federal Regulations (or any successor regulation), and possesses a valid, unexpired admission record pursuant to section 1302 of title 8, United States Code.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id62596abc6bab492b844580a49255ff64"><enum>(d)</enum><header>Recertification</header><text>To avoid the withholding of covered funding under paragraphs (1) and (2) of subsection (e), a State shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id50b3df62d71d44cc93acd27f75e626a0"><enum>(1)</enum><text display-inline="yes-display-inline">require all individuals who, as of the date of enactment of this Act, hold a covered license or authorization issued by the State to be recertified for that covered license or authorization not later than 180 days after the date of enactment of this Act, which recertification shall include verification that the individual—</text><subparagraph commented="no" display-inline="no-display-inline" id="idcbde795438e146839f0a2bcc99d615d3"><enum>(A)</enum><text display-inline="yes-display-inline">is—</text><clause commented="no" display-inline="no-display-inline" id="id43bc7f80e7c74323851f569003dd422a"><enum>(i)</enum><text display-inline="yes-display-inline">a citizen or lawful permanent resident of the United States; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id1c4924887cf54973a529e88b1309b0b5"><enum>(ii)</enum><text display-inline="yes-display-inline">a nonimmigrant described in subparagraph (E)(ii), (H)(ii)(a), or (H)(ii)(b) of section 101(a)(15) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)</external-xref>) in possession of a valid, unexpired nonimmigrant visa issued to the individual pursuant to any such subparagraph;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddd79a7c10d784b5ca217c45fd2d74259"><enum>(B)</enum><text>is proficient in the English language, as described in section 391.11(b)(2) of title 49, Code of Federal Regulations (as in effect on the date of enactment of this Act); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id91c0dec3fdf54599b18a6748388c72e8"><enum>(C)</enum><text>has passed all covered examinations relating to the covered license or authorization in English; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id64b038ac7ee24c998d28a74b6a4fd03d"><enum>(2)</enum><text>revoke the covered license or authorization of any individual who—</text><subparagraph commented="no" display-inline="no-display-inline" id="ide509866866ef40f190e85e70a5856523"><enum>(A)</enum><text>fails to recertify by the deadline described in paragraph (1); or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida448dc8d213f4f4b9adbd4b89cb4d250"><enum>(B)</enum><text display-inline="yes-display-inline">on recertification under that paragraph, is found—</text><clause commented="no" display-inline="no-display-inline" id="idde3bd87b94bd401284211049aa7e4f3c"><enum>(i)</enum><text display-inline="yes-display-inline">to be neither—</text><subclause commented="no" display-inline="no-display-inline" id="id2a310178f2aa44feb6f32dac630e0f90"><enum>(I)</enum><text display-inline="yes-display-inline">a citizen or lawful permanent resident of the United States; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id56ab409d34e0443b92cd30f38caad770"><enum>(II)</enum><text display-inline="yes-display-inline">a nonimmigrant described in subparagraph (E)(ii), (H)(ii)(a), or (H)(ii)(b) of section 101(a)(15) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)</external-xref>) in possession of a valid, unexpired nonimmigrant visa issued to the individual pursuant to any such subparagraph;</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id1c71247495b54d82958e2850f4215480"><enum>(ii)</enum><text>not to be proficient in the English language, as described in section 391.11(b)(2) of title 49, Code of Federal Regulations (as in effect on the date of enactment of this Act); or</text></clause><clause id="idc272a239f3594aaeb5314f4ab28f5586"><enum>(iii)</enum><text>not to have passed all covered examinations relating to the covered license or authorization in English.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9d315966338348dab3c3aab0ed2a7f15"><enum>(e)</enum><header display-inline="yes-display-inline">Withholding of covered funding</header><paragraph commented="no" display-inline="no-display-inline" id="id31e98b9c33034d1c9d4e03c8a329d2ee"><enum>(1)</enum><header>Withholding for recertification failure</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, beginning with the first fiscal year beginning after the deadline for recertifications under subsection (d)(1), the Secretary shall withhold all covered funding from a State that fails to complete those recertifications by that deadline.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id172cd5dedb7e45ab82171ee5c16b02a8"><enum>(2)</enum><header>Withholding for revocation failure</header><text>Notwithstanding any other provision of law, beginning with the first fiscal year beginning after the deadline for recertifications under subsection (d)(1), the Secretary shall withhold all covered funding from a State that fails to complete the revocations described in subsection (d)(2) by that deadline.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfe961fc0a1a9467dbc3406e859f988bd"><enum>(3)</enum><header>Witholding for status verification failure</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, beginning with the first fiscal year beginning after the date of enactment of this Act, the Secretary shall withhold all covered funding from a State that, after that date of enactment, issues covered licenses or authorizations to individuals who are neither—</text><subparagraph commented="no" display-inline="no-display-inline" id="ided30f470ca3d408898920fbd23b0f041"><enum>(A)</enum><text display-inline="yes-display-inline">citizens or lawful permanent residents of the United States; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddebf8fc5f2164b5e8331c85e6a29016d"><enum>(B)</enum><text display-inline="yes-display-inline">nonimmigrants described in subparagraph (E)(ii), (H)(ii)(a), or (H)(ii)(b) of section 101(a)(15) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)</external-xref>) in possession of a valid, unexpired nonimmigrant visa issued to such individuals pursuant to any such subparagraph.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id546c8d5f06094a01af0391b2dca25254"><enum>(4)</enum><header>Witholding for English proficiency verification failure</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, beginning with the first fiscal year beginning after the date of enactment of this Act, the Secretary shall withhold all covered funding from a State that, after that date of enactment—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd3f88a1f63e642ddaa2249450283208c"><enum>(A)</enum><text display-inline="yes-display-inline">issues covered licenses or authorizations to individuals who are not proficient in the English language, as described in section 391.11(b)(2) of title 49, Code of Federal Regulations (or a successor regulation); or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf24b7bf8f44a4591aedbce3c3f831f61"><enum>(B)</enum><text>administers any covered examination in any language other than English.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
