which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require a report on the competitiveness of United States exports of specialty crops.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Specialty Crops Reporting on Opportunities and Promotion Act of 2026</short-title></quote> or the <quote><short-title>Specialty CROP Act of 2026</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id0250eed8d641420da05c6359c9d86eba"><enum>2.</enum><header display-inline="yes-display-inline">Report on competitiveness of United States exports of specialty crops</header><text display-inline="no-display-inline">Section 203(e)(7) of the Agricultural Trade Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/7/5623">7 U.S.C. 5623(e)(7)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1259F970D4B44BEE83AA606BB7450951"><paragraph id="id106a625d7a7d4756a8e7ef167426514e"><enum>(7)</enum><header>Annual report</header><subparagraph id="id6194bcbe99704f5eb09b0b0101c5d704"><enum>(A)</enum><header>In general</header><text>Each year, the Secretary, in consultation with the United States Trade Representative, shall submit to the appropriate committees of Congress a report detailing the competitiveness of United States exports of specialty crops. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id784e8dc0d3a54828b9a890ff4bb106bf"><enum>(B)</enum><header>Elements</header><text display-inline="yes-display-inline">The report required by subparagraph (A) shall—</text><clause id="id8f0e359b284a4d5ead4f3cc31da964db"><enum>(i)</enum><text>identify and analyze acts, policies, or practices of foreign countries that constitute significant barriers to, or distortions of United States exports of specialty crops, including the imposition of—</text><subclause id="idf4f1d4a2bc6c4b5f8e5cf922cfc411cd"><enum>(I)</enum><text>tariffs (including retaliatory tariffs) and quotas (including tariff-rate quotas); and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idfd26a876b1724ca78cf5a623204f8c97"><enum>(II)</enum><text>nontariff barriers, including technical barriers to trade, sanitary and phytosanitary measures, import licensing procedures, and subsidies; </text></subclause></clause><clause id="id4de9777bf7df42908dc88e4f3b9d5241"><enum>(ii)</enum><text>make an estimate—</text><subclause commented="no" display-inline="no-display-inline" id="id34dc43203cdb43c08f9d3df40bbac09d"><enum>(I)</enum><text display-inline="yes-display-inline">of the impacts on the competitiveness of United States exports of specialty crops of any act, policy, or practice identified under clause (i); and</text></subclause><subclause id="ideef3496e56c14130bb82c4a423c7e111"><enum>(II)</enum><text>if feasible, of the value of additional specialty crops that would, during the year preceding submission of the report, have been exported from the United States to each foreign country an act, policy, or practice of which is identified under clause (i) if each such act, policy, or practice of that country did not exist; </text></subclause></clause><clause id="id47c97fe7553e45b18eb4a192437aa1ca"><enum>(iii)</enum><text>assess the extent to which each act, policy, or practice identified under clause (i) is subject to international agreements to which the United States is a party; </text></clause><clause commented="no" display-inline="no-display-inline" id="id93bcb29142474c19936e14e6e6ccba33"><enum>(iv)</enum><text>include information with respect to any action taken by the executive branch during the year preceding submission of the report, or expected to be taken after submission of the report, to eliminate any act, policy, or practice identified under clause (i), including—</text><subclause id="id4ebb095dc57148eea8aba794f478fad1"><enum>(I)</enum><text>any action under section 301;</text></subclause><subclause id="idafa7d3138d60434c8398e1e1c8554a5b"><enum>(II)</enum><text>negotiations or consultations with foreign governments, which may include engagement through the standing committee on sanitary and phytosanitary matters established under a free trade agreement to which the United States is a party; and </text></subclause><subclause id="id9c7ebb9777ad4aaeaf7a8d765eaf8390"><enum>(III)</enum><text>action at the World Trade Organization, including dispute settlement actions, consultations, or negotiations; and</text></subclause></clause><clause commented="no" id="id9edfa6a3894245f58ac5c629b13737d1"><enum>(v)</enum><text>a description of—</text><subclause commented="no" id="id557b47af55e94c4198e2d95b7799a8f0"><enum>(I)</enum><text>any funds provided under subsection (f)(3)(A)(iv) that were not obligated in the fiscal year preceding submission of the report; and</text></subclause><subclause commented="no" id="idbe9600980d9c48e295bb789bd403cbbe"><enum>(II)</enum><text>the reason such funds were not obligated.</text></subclause></clause></subparagraph><subparagraph id="id7d41b288482947e5916aac132781d58b"><enum>(C)</enum><header>Comment period</header><text>Before preparing the report required by subparagraph (A), the Secretary, in coordination with the United States Trade Representative, shall—</text><clause commented="no" display-inline="no-display-inline" id="id9d94c49726ef4727968f20a1995b94f5"><enum>(i)</enum><text display-inline="yes-display-inline">seek comment from the public and the Agricultural Technical Advisory Committee for Trade in Fruits and Vegetables; and</text></clause><clause commented="no" display-inline="no-display-inline" id="ida32d21ee0ca04363839105346eb00983"><enum>(ii)</enum><text display-inline="yes-display-inline">take such comments into account in preparing the report.</text></clause></subparagraph><subparagraph id="id48329e7088cf476b9eb6121c1629b5bb"><enum>(D)</enum><header>Form of report</header><clause id="id5c78d27b6742412ab5c44ebfc957ea79"><enum>(i)</enum><header>In general</header><text>The report required by subparagraph (A) shall be submitted in unclassified form, but may include a classified annex.</text></clause><clause commented="no" display-inline="no-display-inline" id="id20cd650935f34d6181f50ec6dd69d440"><enum>(ii)</enum><header display-inline="yes-display-inline">Public availability</header><text>The unclassified portion of the report required by subparagraph (A) shall be made available to the public in machine readable format.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
