<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 3908</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260225">February 25, 2026</action-date><action-desc><sponsor name-id="S344">Mr. Hoeven</sponsor> (for himself and <cosponsor name-id="S311">Ms. Klobuchar</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XVIII of the Social Security Act to allow payments under the Medicare program for certain items and services furnished by off-campus outpatient departments of a provider to be determined under the prospective payment system for hospital outpatient department services, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HDF2E31C20244438DAC5DA8AE7BEA1724"><section section-type="section-one" id="H822D6DD820B9493C99008C27B3F6B8F8"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>SOS: Sustaining Outpatient Services Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="H1A336BC5FC254FD9AF6C9552321800A8"><enum>2.</enum><header>Allowing Medicare payments for certain items and services furnished by off-campus outpatient departments of a provider to be determined under the prospective payment system for hospital outpatient department services</header><text display-inline="no-display-inline">Section 1833(t)(1)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l(t)(1)(B)</external-xref>) is amended—</text><paragraph id="HC0F0635737B949359AA084670E6E8644"><enum>(1)</enum><text>in clause (iv), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H279C9D618F0643F79527CF77F8D51020"><enum>(2)</enum><text>in clause (v)—</text><subparagraph id="HAA90CC42A0D34E079BE2939076953114"><enum>(A)</enum><text>by inserting before <quote>does not include</quote> the following: <quote>subject to clause (vi),</quote>; and</text></subparagraph><subparagraph id="HD7C793E28A654279A6EDFC8FAA430FF5"><enum>(B)</enum><text>by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph></paragraph><paragraph id="H265AE4E5FF8C44E3B928EB944CEB3640"><enum>(3)</enum><text>by adding at the end the following new clause:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HEEFCEB903A4C40E4B7CB55743C359E33"><clause id="HB0F356B8FA454BC99F215893898FB139"><enum>(vi)</enum><text display-inline="yes-display-inline">includes, with respect to a year (beginning with 2027), any item or service—</text><subclause id="H8143270476C64512868A06E46D2E6979"><enum>(I)</enum><text>that is furnished during such year by an off-campus outpatient department of a provider (as defined in subparagraph (B) of paragraph (21)); and</text></subclause><subclause id="HE483F541D438453FBDE03368A9D07C97"><enum>(II)</enum><text>with respect to which the greatest total amount paid with respect to a physician specialty under the physician fee schedule under section 1848 for all such items or services furnished by physicians in such specialty during the previous year was less than $2,000,000.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
